1.

Other Terms & Conditions:

1. Quotation should be submitted in sealed envelops superscripted with tender enquiry ref. no. &date. The quotations will be received up to 3:00 P.M on or before 26.09.2017 in the office ofChairman, Institute Works Department, IIT(BHU).

Tender Fee:

2. The quotation forms complete in all aspects should be submitted in sealed envelope along with

tender fee of Rs. 500/- in the form of demand draft drawn in favour of the Registrar, IIT (BHU),

payable at Varanasi.

3. EMD: < 10,000.00 in the form of Demand Draft drawn in favour of the Registrar IIT(BHU)payable at Varanasi.

4. Institute reserves the right to reject any quotation or all quotation without prejudice, assigning any

reason or giving any explanation.

5. If quotation is submitted without clearly writing the rates then quotation in the given format may

be rejected as non responsive.

Quotation not signed by the bidder or his legally authorized agent will be considered invalid.

The Empanelment and Rate Contract will be valid for a period of ONE year from the date ofawaro.

8. The Rate contract will be terminated, if the firm fails to abide by the terms and conditions of the

contract or fail to supply the goods in time or supply substandard goods or make any false

declaration or fails to provide satisfactory after sale service to the Institute. In such situation, thepenalty will be imposed on the firms by an expert committee and penalty amount will be deducted

from the Security Deposits,/bills submitted by the firm.

9. IIT (BHU), Varanasi reserves the right to keep a number of firms in Rate contract for the supply ofabove items.

10. IIT(BHU), Varanasi also reserves the right to procure above items from other vendors also whoare not empanelled in the rate contract.

11. If the quality of product and service provided is not found satisfactory, IIT (BHU), Varanasireserves the right to cancel or amend the contract.

12. The Empanelled supplier will abide by all the Terms & Conditions of the Tender.

13. IIT (BHU), Varanasi reserves the right to cancel any category from the rate contract and continuewith other categories.

14. Document to be submitted with the bid:(i) OEM should submit an undertaking that they are Original Equipment Manufacture of the

item quoted by them on their letter head.

(ii) Authorized Dealers/sub dealers should submit a certificate from the OEM on the letter headof the OEM that they are the authorized dealers for the items quoted by them and also

mention the dealership validity period.

Institute Works Department15. Bid Prices: MUST BE SUBMITTED IN PRICE, BID FORM given in tender only and duly signed

and stamped by the bidder.

16. If the price is not quoted in Price Bid Form provided in tender document then, IIT (BHU),

Varanaii will reject bid along with forfeiting Earnest Money Deposit. If the supplier wishes to give

separate pricing details they may be attached in separate sheet along with the duly filled price bid

format only.

17. Any new taxes and duties liable on the subject contract due to change in legislation during the

contract period shali be reimbursed subject to the applicability of the said act to the satisfaction ofthe purchaser and the production of documentary evidence after availing of statutory concession,

benefits etc.

1g. The supplier shall pay and bear all other liabilities, taxes and duties not specifrcally agreed by the

Purchaser in the contract.

19. BIDDER should clear mention PAN Number & GSTIN on the letter pad.

20. Fall clause:

(D The price quoted by the supplier should not be higher than the maximum retails price if any,

for the storis and the same shall not be higher than the price usually charged by the supplier

for stores of the same nature, class or description to any other purchaser.

(iD The price charged for the stores supplied under the contract by the supplier shall in no event

exceed the lowest price at which the supplier sells the stores of identical description to any

other person during the period till performance of all supply orders placed during the

cuffency of the contract is completed. If at any time during the period the supplier reduces

the sale price of such stores or sells such stores to any other person including his dealers at a

price lower than the price chargeable under the contract, he shall forthwith notify such

reduction or sale to the purchaser and the price payable under the contract for these items ofstores supplied after the date of coming into force of such reduction or sale shall stand

correspondingly reduced.

(iiD If it is disproved that the supplier has contravened the above conditions, then without

prejudice to any other action which might be taken against him, it shall be lawful for the

p*.[ur. to (a) revise the price at any stage so as to bring it in conformity with sub-clause(i)

ubou., or (b) to terminate the contract and purchase the items of stores at the risk and cost ofthe supplier and in the even the provisions of Clause 28 of General Conditions of Contract

shall, as far as possible, be applicable or recover the loss.

21. Bid evaluation Criteria:

(i) The bids will be opened and comparative statements of quoted items will be prepared in

respect of resPonsive bids onlY.

(iD Lowest rate for each item will be decided based on L-l in respect of each item. (Item wise

L-1 rate will be decided).

(iii) The item wise L-1 rates will be considered as empanelled rates for each item and all agreeing

will be empanelled for suPPlY.

(iv) All the participating bidders who agree to supply on the L-l rates shall submit an undertaking

that they agree to supply the items on the lowest evaluated rates approved by the Institute.

22.Payment within 30 days from the date of delivery and & Acceptance Certificate of concemed

l)epartment / Section / Materials Management Division. Advance payment will be made only

against Bank Guarantee.

23. Payment shall be made by Cheque or such other mode / electronic fund transfer offered by the

Baxk.

Delivery schedule:

24. Free delivery at IiT (BHU), Varanasi. Delivery Period rs 2-4 weeks, and for bulk purchases,

delivery period is 6-8 weeks from the date of issue of Purchase order. Non-availability of the stock

should be informed in writing immediately. No part-supply will be allowed. Defective items or

items not as per given brands or samples, if any supplied must be taken back and be replaced

immediately with no additional cost to the Institute.

Security Deposit:

25.For successful tenderer/ bidder, Eamest money deposit will be converted to Security Deposit and

. will be retained with IIT (BHU), Varanasi till the expiry / termination of rate contract without

interest.

26.The successful tenderer is entirely responsible for due performance of the contract in all respects

according to the speed, intent and meaning of the terms and conditions and specification and all

other documents referred to in the acceptance of tender.

Penalty:

27. Timely delivery is essence of the contract and hence if any consignment be delayed, liquidated

damages at the rate lo/o of the price of the deiayed consignment, for each week or part whereof

shall be levied and recovered subject to maximum of l0% of total purchase order value.

Force Maieure:

28. Force Majeure will be accepted on adequate proof thereof.

Legal matter:

29.In the event of any dispute over this contract, IIT (BHU), Varanasi decision shall be final and

binding.

30. The bids submitted after the last date & time will not be considered for opening. The bids received

within the last date & time will be opened on26.09.2011 at 4:00 P.M. in the Committee room

(Ground Floor) of the Administrative Building, IIT (BHU),.Varanasi.
