Operator reserves the right toremove any Guest from a Tour should Operator determine that theGuest cannot meet the physical requirements of theTour, as statedin theTour itinerary, or is disruptive to theTour time schedule, or isadversely affecting the overall group dynamics. In the event that aGuest is removed from a Tour, Operator will not refund any moniesto the Guest.Transportation costs to return home, airline penalties,andanyotherexpenseswillbetheresponsibilityoftheGuest.Intheevent that a Guest voluntarily chooses to leave aTour, Operator willrequire a written, signed statement of the Guest’s intent to departfrom the Tour. In the event that a Guest voluntarily departs from aTour,OperatorwillnotrefundanymoniestotheGuest.Transportationcoststoreturnhome,airlinepenalties,andanyotherexpenseswillbe

CHILD POLICY

Infants aged 0 to 4 years old are not accepted on any of our sharedsemi-privatetours.Ourprivatetourscanbeadaptedtoallfamilieswithinfant friendly activities on request. Adultes travelling with childrenover 4 years old have the obligation to inform operator of age andweightofchildsothatwemayprovidetheadequatechildorboosterseat. Without this information, operator will not accept the child onthe tour and no refund will be possible for child and accompanyingadult(s). Children aged from 4 to 12 years old will benefit of a 50%reductiononadultprice.

HEALTH

In Operator’s Promotional Materials: Photographs and video taken byOperator’s Tour leaders and other Operator representatives duringaTour are the property of Operator, and may be used in promotionalmaterials.Feedback,bothverbaland/orwritten,providedbyGuesttoOperatoraboutaTourisalsothepropertyofOperator,andmaybeusedinpromotionalmaterials,includingOperator’swebsiteandsocialmedias.

Acceptance of the initial services to be provided on the Tour shallconstituteanacceptancebytheGuestoftheseTermsandConditionsrecited above. RESERVATIONS

They are accepted by Operator upon receipt of a completed andsigned reservation form (word document or through our website) orupon receipt of a completed and signed, printed reservation formaccompanied by a 30% deposit. For multi day tours and packages,the remaining balance of theTour is due no later than 30 days priortotheTourdeparturedate.Reservationsmadewithin30daysofTourdeparture date are subject to full payment within seven days fromthedateofreceiptofTourreservation. IfOperatordoesnotreceivebalance payment of Tour from Guest by the designated due date,OperatorreservestherighttocancelGuestreservation.

PAYMENT CONDITIONS AND CANCELLATION FEES FOR GROUPS (LARGER THAN 8 PEOPLE)

Ophorus requires a deposit of 30% on booking confirmation withbalancetobemadeat least30dayspriortoarrival(incaseof lastminute registration payment is expected immediately). We acceptpayment by credit cards (Visa, Master card, American Express) orbanktransfer(WiretransferfeesatthechargeoftheGuest).ThereisnochargeorservicefeeforprocessingcreditcardpaymentsexceptwithAmericanExpress+3%.

Agroupiscomposedofmorethan8peopleandtherateiscalculatedaccordingtoaprecisenumberofparticipants.Thebelowcancellationpoliciesapplytoallthegroup.

Incaseoneorseveralpersonsinthegrouphavetocanceltheirtour,the price of the tour will be recalculated with the definite numberof participants. The below cancellation policies also apply for theperson(s)cancellingits/theirparticipation.

>60+days:€20feeperperson >59to30dayspriortoarrival: 30%oftheoverallprice(deposit) >29to15dayspriortoarrival:75%oftheoverallprice

>14daysorlesspriortoarrival:norefund

Noinsuranceforcancellationorassistanceisincludedinthepricesmentioned for all packages. Each customer has to check that he orshehastheappropriatedocumentsfortheirjourney:apassport(withvisaifnecessary)oravalidIDcard.Norefundwillbegrantedincase

oflackorlossofIDdocuments.Eating,drinkingandsmokingonboardtheminivansarestrictlyforbidden(lawofSeptember17th,1977).Allpassengers are insured during the excursions while in the vans. TheresponsibilityofOphorusislimitedtoourinsurancecontractclauses.

WINE TOURS

Ophorusreservestheright(anddelegatestoitsdriverstheright)torefusetocarryanypersonwhoisthoughttobeundertheinfluenceofalcoholordrugsand/orwhosebehaviorisconsideredtoposeathreatto the chauffeur, the vehicle or the other passenger(s). Customerswhosoiltheinteriorofavanareliabletoanonthespotfineof50€.This fine is payable immediately to Ophorus driver. If the customerrefusestopay,orhasnomoneywithwhichtopay,thena50.00€valetcleaningfeewillbetakenontheircreditcard.Parents,orminders(orfriendsover18yearsold)ofchildrenandadolescentsundertheageof18yearsold,areresponsiblefortheconductoftheseminorswhileinthevehicles,andwillbeheldresponsibleforanydamagecausedbythe aforementioned minors. Legal drinking age in France is 18 yearsold and therefore parents or minders will be responsible for minorsduringthewinetoursastoalcoholconsumption.AnydamagecausedtoanOphorusvehiclebyacustomermustbepaidforimmediately.Ifpayment cannot, or will not be made then Ophorus will be forced totake legal action against the customer(s) in question. Passengersarenotallowedtotakeontoourvehiclesanyalcoholicdrinksforthepurpose of consuming them, or to drink such drinks on our vehicles.SmokingisnotpermittedinOphorusvehicles.

OPERATOR CANCELLATION OR SUBSTITUTION

OphorusmaycancelanyTouratanytimebeforedepartureforanyreason,including without limitation, if Operator deems the number of GuestssignedupforagivenTourtobeinsufficienttooperatesuchTour.Operatormayinits’solediscretionsubstituteaserviceorgoodofsimilarqualityforanyserviceorgoodstatedinaTouritinerarywithoutnotice.OperatorshallattempttonotifyGuestofthecancellationofaTourforwhichGuesthaspaidadepositorTourFeeassoonaspossibleafterOperator’sfinaldecisiontocancelsuchTour.IfaTouriscancelled,Operator’sliabilityislimitedtoafullrefundofaffectedGuest’sTourdepositsandTourFees,andOperatorwillnotbeliableforanyothercosts,damages,orrefundsofanykindforanyloss,delay,inconvenience,disappointment,orexpensewhatsoever in such circumstances. Operator is not responsible for anylossincurredonaccountofnon-refundableornon-transferableairtickets.OperatorItinerariesaresubjecttochange.Duetocircumstancesbeyondits control, Operator may make partial changes to the stated itinerary.Everyeffortismadetokeepchangestoaminimum,anditshighqualityisalwaysmaintained.IfGuestencountersanyproblemduringthedeliveryofaTour,Guestisrequestedandresponsibletobringtheproblemtothelead guide’s attention immediately in order to give the guide and Tourteamthechancetocorrecttheproblem.Uncompletedorunusedportionsofanytouritineraryarenotcauseforcomplaintorrefund.Ifforreasonsbeyond Operator’s control, a Tour in progress must be interrupted orcancelled,Operatorwill ingoodfaithrefundaportionoftheTourFeesdependingonOperator’sactualcostsincurredcomparedtotheTourasoriginallycontemplated.
