CUSTOMS ACTS AMENDMENT BILL
EXPLANATORY NOTE
PART I of this Bill relates to Customs duties.
Part II amends the Distillation Act 1908.
Part III confirms certain Customs Tariff Amendment Orders.
Clause 1 relates to the Short Title.
PART I
CUSTOMS DUTIES
This Part is to be read with the Customs Act 1913.Clause 2.
Clause 3.· Section 11 of the Customs Amendment Act 1921 provides that adumping duty may be imposed on goods imported into New Zealand in certaincases. The effect of this clause is that in addition to the existing grounds setout in section 11 the dumping duty may be imposed where the Minister is ofopinion that the importation of gpods into New Zealand has or is likely tohave an adverse effect on any industry, or on the establishment of anyindustry, in New Zealand or in some other part of the Commonwealth.
Clause 4 extends for a further year the existing concession under formerTariff item 448, subject to the power of the Minister to revoke the concession.
Clause 5 repeals, as from 1 January 1966, the Tariff items set out in theFirst Schedule to the Bill, and substitutes the items set out in the Second
Schedule. The alterations set out in the Third and Fourth Schedules are
consequential.
Clause 6 repeals, as from the date of commencement of Part II ofthe Decimal Currency Act 1964, the Tariff items set out in the FifthSchedule to the Bill, and substitutes the items set out in the Sixth Schedule.The amendments set out in the Seventh Schedule are consequential.
The efTect of the clause is to substitute rates in decimal currency in thosecases where the current rates are not readily convertible into decimal currency.The alterations will operate in respect of goods entered for home consumptionon or after the date on which the changeover to decimal currency takes place.
PART II
DISTILLATION
Clause 7: This Part is to be read with the Distillation Act 1908.
Clause 8: The effect of section 71 of the principal Act is that a distiller ischargeable with duty for any decrease exceeding 5 per cent in the quantity ofworts or wash on which duty is assessable under the section. The effect of thisclause is to relieve him from liability in respect of ·any part of the discrepancythat can be accounted for to the satisfaction of the Chief Inspector.

Clause 9. The effect of the new section 58A is to allow the delivery to thedistiller, vigneron, rectifier, or compounder of samples of spirits in suchquantities and subject to such conditions as the Chief Inspector determines.At present there is only a limited provision for a distiller to take, with theleave of the Chief Inspector, such samples as may be allowed by the Minister.
PART III
CONFIRMATION OF ORDERS IN COUNCIL
Clause 10 confirms the Orders in Council set out in the Eighth Scheduleto the Bill.

A BILL INTITULED
An Act to amend the Customs Acts, and to validate andconfirm certain Orders in Council made under the authorityof the Customs Amendment Act 1921 and the Customs
5 Acts Amendment Act 1961
BE IT ENACTED by the General Assembly of New Zealandin Parliament assembled, and by the authority of the same,as follows:
1. Short Title-This Act may be cited as the Customs Acts10 Amendment Act 1965.

PART I
CUSTOMS DUTIES
2. This Part to be read with Customs Act 1913-This Part
of this Act shall be read together with and deemed part of theCustoms Act 1913* (in this Part referred to as the principal 5Act).
3. Dumping duty-( 1) Section 11 of the Customs Amend-ment Act 1921 is hereby amended by repealing subsection(2), and substituting the following subsections:
" (2) If in the opinion of the Minister the importation into 10New Zealand from any country (whether or not it is part ofthe Commonwealth) of any goods of a class or kind producedor manufactured or intended to be produced or manufacturedin New Zealand, or in some other part of the Common-wealth, has or is likely to have any effect prejudicial to any 15industry carried on in New Zealand or in some other part ofthe Commonwealth (not being the country from which thegoods are imported) or to the establishment of any industryin New Zealand or in such other part of the Commonwealthas aforesaid, a dumping duty may be levied in respect of any 20such goods imported into New Zealand in any of the followingcases, namely:
" (a) If the actual selling price of the goods to any importeris less than the current domestic value of the goodsdetermined in accordance with the provisions of 25the principal Act:
"(b) If the actual selling price of the goods to any importeris in the opinion of the Minister less than the costof production, with a reasonable profit addedthereto, of similar goods in the country of origin 30or the country of exportation to New Zealand atthe time of such exportation:
"(c) If the Minister is satisfied that, in respect of the goods,any special concession (whether by way of railwayor shipping or air freight, subsidy, bounty, rebate, 35or otherwise) has been or is to be allowed, taken,or granted.
"(2A) For the purposes of this section, the determinationby the Minister of the amount of any concession to whichparagraph (c) of subsection (2) of this section relates shall 40be final."

( 2) The said section 11 is hereby further amended byomitting from paragraphs (a), (b), and (c) of subsection (3)the words "the last preceding subsection", and substitutingin each case the words "subsection (2) of this section".
5 (3) Section 8 of the Customs Acts Amendment Act 1961is hereby consequentially repealed.
4. Entry of certain goods under former Tariff-( 1) Section4 of the Customs Acts Amendment Act 1961 (as amended bysection 8 of the Customs Acts Amendment Act 1964) is hereby
10 amended by omitting from subsection (2) the words "fouryears", and substituting the words "five years".
(2) Paragraph (b) of subsection (1) of section 8 of theCustoms Acts Amendment Act 1964 is hereby repealed.
(3) This section shall come into force on the first day of15 July, nineteen hundred and sixty-six.
5. Alteration of Tariff-(1) The Customs Tariff is herebyamended by repealing so much thereof as is specified in theFirst Schedule to this Act, and substituting the duties andexemptions from duty specified in the Second Schedule to
20 this Act.
( 2) The Tariff is hereby further amended in the mannerindicated in the Third Schedule to this Act.
( 3) The Second-5chedule to the Customs Acts AmendmentAct 1963 is hereby amended by repealing so much thereof as
25 relates to Group 719.(4) The Orders in Council specified in the Fourth Schedule
to this Act are hereby amended in the manner indicated inthat Schedule.
( 5) This section shall come into force on the first day of30 January, nineteen hundred and sixty-six.
6. Tariff rates expressed in decimal currency-( 1) TheCustoms Tariff is hereby amended by repealing so muchthereof as is specified in the Fifth Schedule to this Act, andsubstituting the duties and exemptions from duty specified in
35 the Sixth Schedule to this Act.
(2) The Orders in Council specified in the Seventh Scheduleto this Act are hereby amended in the manner indicated inthat Schedule,

(3) Notwithstanding the provisions of section 143 of theprincipal Act, there shall be levied, collected, and paid on allgoods of a kind mentioned in the Sixth Schedule to this Actand entered for home consumption after the commencementof this section the duties at the rates ( if any) provided for 5in that Schedule.
(4) This section shall come into force on the date of thecommencement of Part II of the Decimal Currency Act 1964.
PART II
DISTILLATION
7. This part to be read with Distillation Act 1908-ThisPart of this Act shall be read together with and deemed partof the Distillation Act 1908* ( in this Part referred to as theprincipal Act).
8. Charging of duty-Section 71 of the principal Act is 15hereby amended by omitting the words "takes place in thequantity of wort or wash in the distillery", and substitutingthe words "of the quantity of wort or wash in the distillerycannot be accounted for to the satisfaction of the ChiefInspector". 20
9. Delivery of samples to distiller, etc.-(1) The principalAct is hereby amended by inserting, after section 58, thefollowing section:
"58A. Samples of spirits distilled, rectified, compounded,blended, flavoured, or reduced in strength in accordance with 25any provision of this Act may be delivered to the distiller,vigneron, rectifier, or compounder, as the case may be, in suchquantities and subject to such conditions as to disposal thereof,and with or without payment of duty thereon, as the ChiefInspector may determine." 30
(2) Section 91 of the principal Act is hereby amended byomitting the words "and also to take such samples thereof asmay be allowed by the Minister, with or without entry, andwith or without payment of duty, except in so far as the samemay eventually become payable as on a deficiency of the 35original quantity".

CONFIRMATION OF ORDERS IN COUNCIL
10. Orders in Council confirmed-Whereas by section 31of the Customs Amendment Act 1921 (as amended by section
5 18 of the Customs Acts Amendment Act 1961) it is providedthat every Order in Council made under section 12 of theCustoms Amendment Act 1921 and laid before the House of
Representatives in any session pursuant to that section shallexpire on the close of the last day of that session except so far
10 as it is expressly validated or confirmed by an Act of Parlia-ment passed during that session: And whereas by subsection( 8) of section 5 of the Customs Acts Amendment Act 1961(as amended by subsection (2) of section 3 of the CustomsActs Amendment Act 1962 and section 8 of the Customs Acts
15 Amendment Act 1963) it is provided that the provisions ofthe said section 31 shall apply to every Order in Council madeunder subsection (6A) or subsection (7) of the said section 5:And whereas the Orders in Council specified in the EighthSchedule to this Act have been made under the authority of
20 section 12 of the Customs Amendment Act 1921 and section 5of the Customs Acts Amendment Act 1961 and have been laid
before the House of Representatives during the present session,and it is desirable to validate and confirm those Orders:Be it therefore enacted as follows:
25 The Orders in Council specified in the Eighth Schedule tothis Act are hereby declared to be valid and are herebyconfirmed as required by section 31 of the Customs Amend-ment Act 1921.
