Whereas, section 17(3) of Delhi School Education Act, 1973 provides that Manager ofevery recognized school, shall, before the commencement of each academic session, file with theDirector a full statement 01' lees to be levied by such school during the ensuing academic session,and except with the prior approval of Director, no such school shall charge, during that academicseSSIOIl,any fee in excess of the fee specified by the manager in the said statement.

And Whereas, the Hon'b!e Supreme COUI"1by a common majority judgment dated 27-04-2004 in Civil Appealno.2699 01'200 I (Modern School Vis Union or India) & II connected CivilAppeal no's 2700 to 2710 of2001, directed that "Every school is required to file a statement oflee every yew' before ensuring academic session under section 17 (3) of the Act with the Director"of Education Such statement will indicate estimated income of the school derived from fees,estimated current operational expenses towards salaries and allowances payable to employees interms ofrule 177(1) of the rules. Such estimate will also indicate provision lor donation, gratuity,reserve fund and other items under rule 177(2) and savings thereafter, if any, in terms of theproviso to Rule 177(1)".

Now, therefore, in exercise or the powers conferred under section 17(3), 18(5) & 24(3\read with sub-rule (xviii) 01' rule SO 01' the Delhi School Education Rules, 1973, and also inpursuance of the direction given by the Hon'ble Supreme Court or India III the judgment dated27-04-2004 in Modem School case as referred above, I, Snumya Gupta, Director (Education)hereby specify the format to file the full statement 01" the lees under section 17(3) of DelhiSchool Education Act, 1973 by the Private Unaided Recognized Schools of Delhi for the currentacademic session i.e. 2017-18 onwards with the district authority concerned (format enclosed).Those schools which have already submitted statement of fees Jar current academic year neednot to submit the same again.

Note> The school shall determine and utilize the fee in letter & spirit of the provisions of DSEA & R 1973 along with all Orders,Notifications and Court Judgements.

Rule 177 of Delhi School Education Rules, 1973 shows that salaries and allowances shall come out from the fees whereas Capitalexpenditure will be a charge on the savings. Capital expenditure can not constitute a component of the financial fee structure. Salariesand allowances are revenue expenses incurred during the current year and, therefore have to come out ofthe fees of the CUITentyearwhile Capital Expenditure/Investments have to come from savings.
