ORDINANCE NO. 003, s. 2001

AN ORDINANCE RATIFYING THE FEES TO BE COLLECTED BY THE LOCAL CIVIL REGISTRAR FROM A PETITIONER FOR THE CORRECTION OF CLERICAL OR TYPOGRAPHICAL ERROR AND/OR TO CHANGE FIRST NAME OR NICKNAME IN THE CIVIL REGISTER PURSUANT TO REPUBLIC ACT NO. 9048 AND ITS IMPLEMENTING RULES AND REGULATIONS.

BE it ordained by the SANGGUNIANG BAYAN of Ragay, Province of Camarines Sur, that -

Section 1.Definition of Terms. - As used in this Ordinance, the following terms shall mean:

a.Petitioner - refers to a natural person filing the petition and who has direct and personal interest in the correction of a clerical or typographical error in the entry or change of first name or nickname in the civil register.

b.Indigent Petitioner - refers to destitute, needy and poor individual who is certified as such by the social welfare and development office of the municipal government.

c.Clerical or Typographical Error - refers to a mistake committed in the performance of clerical work in writing, copying, transcribing or typing an entry in the civil register that is harmless and innocuous, such misspelled name or misspelled place of birth or the like, which is visible to the eyes obvious to the understanding, and can be corrected or changed only by reference to the other existing record or records; Provided, however, that no correction must involve the change of nationality, age, status or sex of the petitioner.

d.First Name - refers to the name or nickname given to a person which may consist of one or more names in addition to the middle and last names.

e.Civil Register - refers to the various registry books and related certificates and documents kept in the archives of the Local Civil Registrar Office.

f. Migrant Petitioner - refers to a petitioner whose present residence or domicile is different from the place where the civil registry record to be corrected was registered.

Section 2. Collection of Fees. The following fees are hereby ratified to be collected by the Local Civil Registrar from a petitioner to correct clerical or typographical error and/or to change first name or nickname in the civil register pursuant to Republic Act No. 9048 and its implementing rules and regulations, to wit:

1.Filing fee for petition for change of first name

or nickname - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - P 3,000.00

2.Filing fee for petition for correction of clerical

or typographical error - - - - - - - - - - - - - - - - - - - - - - -P 1,000.00

3.Service fee from migrant petitioner for correction

of clerical and typographical error - - - - - - - - - - - - - - P 500.00

4. Service fee from migrant petitioner for change

of first name or nickname - - - - - - - - - - - - - - - - - - - - P 1,000.00

Section 3. Exemption. An indigent petitioner as defined under paragraph b, Section 1 of this Ordinance shall be exempt from payment of said fee.

Section 4.Accrual of Fees. All fees collected shall accrue to the general funds of this municipality.

Section 5.Separability Clause. If any portion or provision of this Ordinance is declared void or unconstitutional, the remaining portions or provisions thereof shall not be affected by such declaration.

Section 6.Effectivity. This Ordinance shall take effect upon its approval and after publication in a newspaper of local circulation.

UNANIMOUSLY ADOPTED, By order of the Sangguniang Bayan of Ragay, Camarines Sur this 10th day of September 2001 at Ragay, Camarines Sur, Philippines.
