ORDINANCE NO. 042, s, 2000
AN ORDINANCE REGULATING THE USE OF STREET, ROADS DURING THE CONDUCT OF PARADE, MOTORCADE, FUNERAL MARCH, RELIGIOUS PROCESSION, AND OTHER SIMILAR ACTIVITIES.
BE it ordained by the SANGGUNIANG BAYAN of Ragay, Province of Camarines Sur, that -
SECTION I - COVERAGE AND DEFINITION OF TERMS USED IN THIS ORDINANCE.
a). Street mentioned in this ordinance shall mean municipal streets at the Poblacion, while Roads shall cover the municipal, or provincial roads including Quirino Highway;
b). Applicant shall apply to any of the following:
- In case of learning institutions such as schools, day care centers, and others, the Principal or Director, or Teacher-In-Charge shall mean the applicant;
- In case of religious organization, the President or Head of that organization shall mean the applicant;
- For Non-learning institution and non-religious organization, specifically during funeral march, any member of the family of the deceased, or any authorized representative shall mean the applicant;
- For other groups, or organization, the President, Chairman, or Head, or any authorized representative shall refer as the applicant.
SECTION II - REGULATORY ACTS. No parades, either rehearsal or actual, motorcades, funeral march, religious procession, and other similar activities shall be allowed to use any part or portion of the street and/or roads without first securing a permit from the Office of the Mayor.
SECTION III - PERMIT TO BE SECURED. Permit shall be secured through the following process;
a). A letter of application for a permit written either in English or Filipino language by the applicant shall first be addressed and submitted to the Office of the Mayor two (2) days prior to the holding of said activity;
b). A sketch, in duplicate copy, showing the route to be used by said activity should be attached to the application letter;
c). The Office of the Mayor shall inform and coordinate with the Traffic Management Section (TMS) of the Ragay Philippine National Police (PNP) Station and shall provide them a copy of the sketch of the road/street route that will be used;
d). After verification by the TMS, the Office of the Mayor shall then issue a permit for that purpose free of any charge whatsoever.
SECTION IV - DUTIES AND RESPONSIBILITIES OF TRAFFIC MANAGEMENT SECTION. It shall be the duties and responsibilities of the TMS to:
a). to provide reasonable number of personnel to be assigned in the route applied;
b). to direct and control traffic in the said route;
c). to maintain peace and order during and after the activity.
SECTION V - PENALTY. Violation of this Ordinance shall be dealt with accordingly with punishment/fines:
FIRST OFFENSE:FOR SUCCEEDING OFFENSE:
For Learning Institution:
The School Principal, Director,
or Teacher-In-Charge shall be
held liable with - - - - - - - -- REPRIMAND
Fine of P 500.00
For Non-Learning Institution/
Religious Organization, and
Others: The President, Chairman,
or Head, or any member of the
family of Deceased, or any
representative shall be held liable
with - - - - - - - - - - - - - - - - REPRIMAND
Fine of P 300.00
SECTION VI - REPEALING CLAUSE. All Ordinances, rules and regulations, or parts thereof, whose provisions are in conflict are hereby repealed, amended and modified accordingly.
SECTION VII - EFFECTIVITY. This Ordinance shall take effect immediately after publication in a local newspaper.
