ORDINANCE NO. 044 s. 2000

PROHIBITING THE OPERATION OF VIDEO-KARERA MACHINE IN THIS MUNICIPALITY AND PROVIDING STIFFER PENALTIES FOR THE VIOLATION THEREOF.

BE it ordained by the SANGGUNIANG BAYAN of Ragay, Province of Camarines Sur, that -

SECTION 1. Definition. For purpose of this Ordinance, the following terms shall mean and be understood to be hereunder indicated:

a).Video Karera Machine - shall refer to a video gambling machine wherein an images of racing horses appears and whereby a bet is inserted to a coin box.

b).Owner - refer to a person who is in charge of the operation of video karera machine.

c).Player - shall refer to the bettor.

d).Bet - shall mean coins deposited in the coin box.

SECTION 2. Prohibition. It shall be prohibited for any person, either owner or player to operate video karera machine in this municipality.

SECTION 3. Penalties. Any person found violating the provision of this ordinance shall be dealt accordingly:

For Owner of the Video-Karera Machine - a fine of Two Thousand Five Hundred (P2,500.00) or imprisonment from one (1) month to six (6) months or both upon the discretion of the court and confiscation of the video karera machine including the bet.

For Player - a fine of Five Hundred (P500.00) to ONE THOUSAND (P1,000.00) Pesos.

SECTION 4. Forfeiture of Prima-Facie Evidence. All prima-facie evidence such as but not limited to, video-karera machine including the bets and other accessories shall be confiscated and forfeited in favor of the Municipal Government.

Forfeited video karera machine shall be burned in the Municipal Plaza in Public View.

Forfeited bet shall be rewarded to any Law Enforcement Unit including Barangay Local Government Unit responsible in the Law Enforcement Operation and apprehension of video-karera owner and player while in the act of operating the machine.

SECTION 5. Enforcement of this Ordinance. The Ragay Municipal Police Station thru the Chief of Police and all Punong Barangays of this Municipality are hereby ordered to strictly enforce and implement the provisions of this Ordinance.

SECTION 6. Disciplinary Actions for Barangay Official and Police Officer. Any Barangay official who, with knowledge of the existence or operation of a video-karera machine in his jurisdiction fails to abate the same or take action in connection therewith shall be recommended for disciplinary action as provided under Chapter 4, R.A. 7160 or the Local Government Code of 1991. The same shall also apply to any police officer who, with knowledge of the existence or operation of a Video-karera machine in the place or barangay where he resides fails to abate the same or take action in connection therewith shall be recommended for disciplinary action as provided under Republic Act 8551 or the New Police Act of 1998.

SECTION 7 -SEPARABILITY CLAUSE - If for any reason, any section or provision of this ordinance shall be held to be unconstitutional or invalid by competent authority, such judgement or action shall not affect or impair the other sections or provisions thereof.

SECTION 8 - REPEALING CLAUSE - All ordinance, rules and regulations, or parts thereof, inconsistent with or in conflict with the provisions of this ordinance, shall be deemed repealed or amended accordingly.

SECTION 9 - EFFECTIVITY CLAUSE - This ordinance shall take effect immediately after its approval and publication in a local newspaper.
