ORDINANCE NO. 7 336 -------
AN UNCODIFIED ORDINANCE OF THE CITY OF PASADENA GRANTING NON-EXCLUSIVE POLICE TOWING FRANCHISES
WHEREAS, on December 10, 2018, the City Council of the City of Pasadena adopted a resolution setting a public hearing for January 14, 2019, in order that all ...,
persons wishing to be heard in favor or in opposition to the granting of non-exclusive police towing franchises will have the opportunity to do so; ·
WHEREAS, a duly-noticed public hearing was held on January 14, 2019; and
WHEREAS, after reviewing the applications, and after a public hearing, it was determined that the applications comply with Chapter 10.46 of the Pasadena Municipal Code, and that the successful applicants have agreed to comply with all provisions of this Chapter.
NOW, THEREFORE, the People of the City of Pasadena ordain as follows:
SECTION 1. Pursuant to Chapter 10.46 of the Pasadena Municipal Code, a nonexclusive police towing franchise is granted to all applicants listed by name and business address in Section 2, below, according to the terms and conditions set forth in the text of this Ordinance and to the terms and conditions of a separate franchise agreement to be executed by eac~ franchisee.
The grant of franchise is based on the certifications of that franchisee that it shall comply with all the provisions of Chapter 1 0.46. The franchise shall be for a period of one year, if a written franchise has been fully executed by the franchisee and all other requirements of Chapter 10.46 have been met by the franchisee. The franchise may be extended for up to four additional renewal terms, at the option of the City Manager and according to the provisions of Chapter 1 0.46, with each renewal term being a term of one year.
SECTION 2. Pursuant to Chapter 10.46 of the Pasadena Municipal Code, a nonexclusive police towing franchise is granted to the following applicants:

TITLE OF PROPOSED ORDINANCE
AN UNCODIFIED ORDINANCE OF THE CITY OF PASADENA GRANTING NONEXCLUSIVE POLICE TOWING FRANCHISES
PURPOSE OF ORDINANCE
At a January 14, 2019 public hearing, the City Council will be requested to direct the City Attorney to prepare an uncodified ordinance granting non-exclusive police towing franchises. This ordinance would achieve the granting of franchises, as requested by staff, and if approved by the City Council.
REASON WHY LEGISLATION IS NEEDED
The Charter of the City of Pasadena, Article XI , Section 1104, specifies that the method and procedure for granting a franchise shall be by ordinance.
PROGRAMS, DEPARTMENTS OR GROUPS AFFECTED
The Police Department will implement this ordinance.
FISCAL IMPACT
The City is scheduled to receive $22,500 annually per police towing franchisee, pursuant to Resolution number 9675, adopted on August 27, 2018. Currently, there are

. four franchisees, although that fig~re could change, depending on the number of nonexclusive franchises ultimately awarded by the City Council.
ENVIRONMENTAL DETERMINATION
Through the January 14, 2019 public hearing where the City Council will consider an award of non-exclusive police towing franchises, the City Council is requested to find that the proposed action is not a project under the California Environmental Quality Act (CEQA) in accordance with Section ·21065 of CEQA and State CEQA Guidelines Sections 15060(c)(2), 15060 (c)(3), and 15378.
