Section 451 of the Local Government Act 1993 requires that if a councillor or member of a council or committee has a pecuniary interest in any matter before the council or committee, he/she must disclose the nature of the interest to the meeting as soon as practicable and must not be present at, or in sight of, the meeting, when the matter is being discussed, considered or voted on. A pecuniary interest is an interest that a person has in a matter because of a reasonable likelihood or expectation of financial gain or loss (see sections 442 and 443 of the Local Government Act 1993). A non-pecuniary interest can arise as a result of a private or personal interest which does not involve a financial gain or loss to the councillor or staff member (eg friendship, membership of an association, or involvement or interest in an activity). A councillor or staff member may elect to leave the Council Chambers during consideration of the matter.

Parts of the Meeting that can be Closed to the Public Section 10A of the Local Government Act 1993 states that a Council, or a Committee of the Council of which all the members are Councillors, may close to the public so much of its meeting as comprises: a) The discussion of any of the matters listed below, or b) The receipt or discussion of any information so listed Matters & Information

(a) Personnel Matters concerning particular individuals (other than Councillors). (b) Personal hardship of any resident or ratepayer. (c) Information that would, if disclosed, confer a commercial advantage on a person with

whom the Council is conducting (or proposes to conduct) business. (d) Commercial information of a confidential nature that would, if disclosed:

(i) Prejudice the commercial position of the person who supplied it, or (ii) Confer a commercial advantage on a competitor of the Council, or (iii) Reveal a trade secret.

(e) Information that would, if disclosed, prejudice the maintenance of law. (f) Matters affecting the security of the Council, Councillors, Council Staff or Council

property. (g) Advice concerning litigation, or advice that would otherwise be privileged from

production in legal proceedings on the ground of legal professional privilege. (h) Information concerning the nature and location of a place or an item of aboriginal

significance on community land. (i) Alleged contraventions of any code of conduct requirements applicable under section

440. A Council or Committee of the Council may allow members of the public to make representations to or at a meeting, before any part of the meeting is closed to the public, as to whether that part of the meeting should be closed. A meeting is not to remain closed during the discussion of anything referred to in the above list except for so much of the discussion as is necessary to preserve the relevant confidentiality, privilege or security, and if the matter concerned is a matter other than a personnel matter concerning particular individuals, the personal hardship of a resident or ratepayer or a trade secret - unless the Council or Committee concerned is satisfied that discussion of the matter in an open meeting would, on balance, be contrary to the public interest. The grounds on which part of the meeting is closed must be stated in the decision to close that part of the meeting and must be recorded in the minutes of the meeting. The grounds must specify the relevant provision of Section 10A(2), the matter that is to be discussed during the closed part of the meeting, and the reasons why part of the meeting is being closed. 8. Background 1045/20.08.19 – Hillston Common Responsible Officer: GM DECISION ACTION TAKEN 1045/20.08.19 – Council renegotiate with the Department of Industry regarding the water licence of 972ML currently held by the Hillston Common Trust, being transferred to Council should it resolve to become the land manager of the land under the Crown Lands Act 2016.

Information provided saying the licence is held in the name of the Hillston Common Trust. Letter written requesting transfer of Water Licence with crown land.

1092/17.09.19 – Hillston Caravan Park Responsible Officer: GM DECISION ACTION TAKEN Council develop a strategic management plan for the Hillston Caravan Park.

Report expected mid 2020 currently being developed.

1105/17.09.19 – Fixing County Bridges Funding Responsible Officer: DIS DECISION ACTION TAKEN Council negotiate with the RMS regarding the design and funding for the construction of the bridge over the Lachlan at Hillston.

Walt Secord, Shadow Minister for the Arts, calling for bi-partisan support for Consumer Price Index (CPI) indexation of state funding for NSW public libraries, as well as legislation of all elements of the 2019-20 to 2022-23 NSW state funding model.

10.2.1 Correspondence for Information

Office of Local Government (OLG) Advice has been received from the OLG that Council elections have been postponed for 12 months and may be extended further until 31 December 2021. Where elections were held for Mayor’s in 2018 the two year term expires and elections will need to be held in our case in September for both Mayor & Deputy Mayor.

Recommendation: That Council note the postponement of the Local Government elections. 10.2.2 West Wyalong Mission - Rankins Springs Parish

On behalf of St Kevin’s Church, Boomerang Street, Rankins Springs requesting an exemption from the $452 annual access charge for potable water supply to be introduced by Council from 1 July 2020. While a religious organisation is exempt from rates under s555 of the Local Government Act 1993, a religious organisation is not exempt from charges under s501 of the Act.

Recommendation: For Council determination.

Project Updates McGee Street Rehabilitation – Stage 1 (Hillston Motel to Hillston Hardware) is progressing ahead of schedule with the following works complete:

• All pavement layers at finished height, shaped and compacted • Concrete works (kerb and gutter and no-fines concrete layer) • Subsoil and stormwater drainage

Works crews will proceed onto stage 2 (Hillston Hardware to High St intersection) on Monday 7 April 2020. Contractors are on site to lower Telstra, NBN and Council communications. Hillston Aerodrome – Pavement testing of the Hillston Aerodrome has been undertaken by Aitken & Rowe Geotechnical Engineers. The purpose of the testing is to get a pavement load rating so that council are then aware of what aircraft can/can’t land on that airstrip. The outcome of the testing is pending. Carrathool Rd Pave and Seal – Full 4km of road has been brought to final surface level and awaiting final trim. Sealing complete on 1km section of road whilst other sections are drying out from significant rainfall over the job site. Lachlan Valley Way Pave and Seal – Side-track and subgrade formation is complete on next 3.7km section of Lachlan Valley Way heading south from end of existing seal to approx. 200m south of Cowl Cowl Station entrance. Gravel haulage continues in between wet weather events. Lachlan River Rd Pave and Seal – Side-track and subgrade formation is complete on next 1.6km of sealed pavement heading north from existing seal. Gravel haulage continues in between wet weather events. Hillston Bore-5 investigation – Council has completed the process of flushing of Bore-5 on Lachlan River Road to address water quality issues. This project was requested by the Department of Primary Industry & Environment (DPIE) to find a way to go forward to address the water quality and utilize the bore for drinking water. Council has submitted a report with all water testing results to the Public Health Unit on 26/03/2020 for review and further recommendations to resolve water quality issues. A detailed report will be submitted to the council with Public Health Unit (PH unit) recommendations in due course.

10.4 Heavy Vehicle Safety and Productivity Program - Round 7 Funding GS:PRO:HVSPP

Author: Director Infrastructure Services Purpose: To outline to Council the projects nominated under round seven of the Heavy Vehicle

Safety and Productivity Program

Background

The Heavy Vehicle Safety and Productivity Program (HVSPP) is now open for Local Councils. Under Round Seven (7) of the Heavy Vehicle Safety and Productivity Program (HVSPP), the Australian Government will provide up to 50 percent of the total cost of eligible proposals that meet the program objectives. Proposals will be comparatively assessed with a total of $150 million in funding made available. The Department will use the information provided in the proposed projects to check eligibility and assess proposals for funding recommendation. Where appropriate, priority may be given to councils classified as Category C under Disaster Relief Funding Arrangements (DRFA) relating to natural disasters during the round. Proposals which have been lodged with the National Bushfire Recovery Agency (NBRA) or Emergency Management Australia (EMA) are not eligible for supplementary or additional funding under Round Five of the Bridges Renewal Program (BRP).Projects that are eligible for funding under the stream must meet one or more of the following conditions:

• Proposals on the National Land Transport Network; • Rest Areas; • Parking/decoupling bays; • Technology trials; • Road enhancements; • Bridges, where they are a necessary component of the works and do not exceed 40 percent

of the total project funding; • Demonstration projects; • Livestock transport industry proposals, provided such a facility is in a drought declared area

and associated with a public road, and initiated and delivered by a local, state or territory government; and

• Livestock vehicle effluent collection and treatment facilities (provided such a facility is associated with a road and access is similar to that of a traditional rest area).

Applicants may submit as many projects as they see fit. Applicants should demonstrate they have considered the level of monetary and in-kind co-contribution to the project. Projects with co-contribution from multiple sources are viewed favourably by the Project Assessment Panel as they provide compelling evidence of stakeholder alignment. Co-contribution for Council projects is not compulsory but is an advantage in the decision-making process. This year’s project nominations and associated funding request, along with Council contributions is outlined in the table below.

10.5 Pulletop Road Closure RDS:RC:PRC

Author: Manager Infrastructure Services Purpose: Request permission to close public access to northern section of Pulletop Road to

support the Reviving Malleefowl project

Background:

Riverina Local Land Services (LLS) is working with landholders within Carrathool Shire to help protect and restore Malleefowl habitat to increase Malleefowl numbers through the Reviving Riverina’s Malleefowl project. Land adjoining both sides of Pulletop Road (located adjacent to Rankins Springs Road north of Griffith) has been selected as one of these habitats. LLS has requested that Council assist in the project by allowing LLS to install gates and fencing across the road reserve to restrict public access through the habitat. The section of Pulletop Road requested is shown below with the habitat area outlined in green. This section is unformed and is not maintained by Council, where access to Pulletop Nature Reserve will be maintained. The same landholder owns both sides of this section of Pulletop Road and is one of the main proponents of the project.

LLS request permission from Council to install fencing and gates at the locations marked on the map above. The project is fully funded by LLS. The restricted access would not create any significant implication in this area and would enable greater biodiversity as well as provide safe habitat for a species otherwise thought extinct. Under Division 2 of the Roads Act 1993 Council can permit a landholder to erect a gate across a road where it intersects a boundary fence. It is recommended that Council grant permission for the landholder to erect a fence and gate at the locations shown.

10.9 Development Application Modification - 2019/003 – Two Manufactured Dwellings DA2019/003

Background

On 4 March 2020, Council received an application to modify Development Application (DA 2019/003) which was originally approved by Council at the August meeting in 2019. The original DA was for the installation of two (2) manufactured homes located at 33 Molesworth Street Hillston. The applicant has decided to change the outlay of one of the cabins along with the external cladding. Under the Environmental Planning and Assessment Act 1979, this requires a S4.55 1(A) Modification-a modification that will have minimal environmental impact. The modification was notified to neighbours, as the original one was, and no objections were received during the notification period. As the original DA was determined by Council, the Application for Modification has returned to Council for determination. The subject site is Zoned RU5-Village. Description of Proposed Development The proposed new manufactured home is 10m long by 6.8m wide for a total floor area of 68m2. This is compared to the original approved manufactured dwellings of 10.1m long by 7.22m wide with a total floor area of 73m2. The location of the windows has varied slightly, with the vinyl cladding to be a different profile. All of the above are considered minor changes, hence the minor modification classification. Subject Site and Locality Deception The subject site is Lot 13, Section 8, DP 257, 33 Molesworth Street Hillston New South Wales 2675, with the total area of the site being 1012m2. The proposed manufactured dwelling is to be located at the front of two (2) existing manufactured homes on the lot.

DRAFT CONDITIONS DA2019/003 Modify

1. COMPLIANCE WITH THE BUILDING CODE OF AUSTRALIA (Prescribed Condition) All building work must be carried out in accordance with the requirements of the Building Code of Australia (as in force on the date the application for the relevant Construction Certificate or Complying Development Certificate was made).

2. RESIDENTIAL BUILDING WORK (Prescribed Condition) Building work (within the meaning of the Home Building Act 1989) must not be carried out unless the Principal Certifying Authority for the development: a) in the case of work done by a licensee under the Act:

i) has been informed in writing of the licensee’s name and contractor license number, and ii) is satisfied that the licensee has complied with the requirements of Part 6 of that Act, OR

b) in the case of work to be done by any other person:

i) has been informed in writing of the person’s name and owner-builder permit number, or ii) has been given a declaration, signed by the owner of the land, that states that the

reasonable market cost of the labour and materials involved in the work is less than the amount prescribed for the purposes of the definition of owner-builder work in Section 29 of the Act,

and, is given appropriate information and declarations under paragraphs a) and b) whenever arrangements for the doing of the work are changed in such a manner as to render out of date any information or declaration previously given under either a) or b). NOTE: A certificate issued by an approved insurer under Part 6 of the Home Building Act 1989 that states that the person is the holder of an insurance policy is sufficient evidence to satisfy this condition.

3. SIGNS TO BE ERECTED ON BUILDING AND DEMOLITION SITES (Prescribed Condition) A sign must be erected in a prominent position on any work site on which work involved in the erection or demolition of a building is being carried out: a) stating that unauthorised entry to the site is prohibited, and b) showing the name of the person in charge of the work site and a telephone number at which

that person may be contacted outside work hours c) the development consent or complying development consent number, the name and contact

details of the Principal Certifying Authority. Any sign must be removed when the work has been completed. NOTE: This condition does not apply to: a) building work carried out inside an existing building, or b) building work carried out on premises that must be occupied continuously (both during and

outside work hours) while the work is being carried out.

4. NOTICE OF COMMENCEMENT (Prescribed Condition) The applicant is to submit to Council, at least two (2) days prior to the commencement of any works, a ‘Notice of Commencement of Building or Subdivision Works’.

5. BUILDING INSPECTIONS The applicant must obtain a Compliance Certificate pursuant to Section 6.16 of the Environmental Planning and Assessment Act 1979, as amended, from Council or an accredited certifying authority, certifying compliance with the Building Code of Australia for the stages of construction listed in Column 1. For the purposes of obtaining the Compliance Certificate the works must be inspected by the accredited certifying authority at the times specified in Column 2.

If the Compliance Certificates are not issued Council may refuse to issue a Building Certificate under Section 6.26 of the Environmental Planning and Assessment Act 1979, as amended. NOTE 3: Submission of the bracing plan and the Truss and Frame Certificate is required seven (7) working days before the frame inspection.

6. CONFORM WITH APPROVED PLANS The development shall take place in accordance with the approved development plans as submitted with DA2019/003 and DA2019/003 Modify. Any alterations or additions marked by Council on the approved plans and/or the specifications must be carried into effect.

7. HOURS OF OPERATION The applicant must take all reasonable steps to minimise dust and noise generation during the demolition and/or construction process. No offensive noise must be emitted during either process. Such activities must only be undertaken Monday to Friday 7.00am to 6.00pm and Saturday 8.00am to 1.00pm, excepting public holidays. 8. RUBBISH AND DEBRIS All building rubbish and debris, including that which can be wind-blown, must be contained on site in a suitable enclosure, approved by Council, at all times prior to disposal at Council's Waste Management Centre. The container must be erected on the building site prior to work commencing. Materials and sheds or machinery to be used in association with the construction of the building must not be stored or stacked on Council’s footpath, nature strip, reserve or roadway. NOTE 1: No building rubbish or debris must be placed, or be permitted to be placed on any adjoining public reserve, footway, road or private land. NOTE 2: The applicant must retain weighbridge certificates, receipts or dockets that clearly identify where waste has been deposited. Documentation must include quantities and nature of the waste.

This documentation must be provided to Council prior to application for an Occupation Certificate for the development. NOTE 3: The suitable container for the storage of rubbish must be retained on site until an Occupation Certificate is issued for the development. The reason for the imposition of the above consent conditions is as follows: 1. To achieve the objectives of Section 1.3 of the Environmental Planning and Assessment Act

1979, having regard to the relevant matters for consideration contained in Section 4.15 of the Act and the Environmental Planning Instruments applying to the land;

2. To ensure compliance with the Building Code of Australia, to enable the achievement and maintenance of acceptable standards of structural sufficiency, safety, health and amenity, for the benefit of the community now and in the future;

3. To confirm the details of the application and plans submitted by the applicant; 4. To ensure compliance with relevant planning controls; 5. To ensure that appropriate environmental protection measures are in place; 6. To ensure the development complies with the requirements of Council policies; 7. To ensure that works do not interfere with reasonable amenity expectations of residents and

the community. ADVICE TO APPLICANT 1. The above consent is not an approval to commence work or to carry out any structural work.

A Construction Certificate under Part 4 of the Environmental Planning & Assessment Act 1979 (preceding the 1 March 2018 amendments) shall be sought and obtained before any work is carried out to implement the above consent. Also, the applicant is not relieved of any obligation to obtain an approval required under any other Act.

2. This Notice of Determination does not remove the applicant’s obligation to obtain approvals required by any other legislation.

3. Part 8, Sections 8.3 and 8.7 of the Environmental Planning and Assessment Act 1979 confers on the applicant who is not satisfied with determination of the consent authority a right of appeal to the Land and Environment Court exercisable within 6 months of receipt of this notice.

4. Any person who contravenes this Notice of Determination of the above consent shall be guilty of a breach of the Environmental Planning and Assessment Act, 1979, and shall be liable to a monetary penalty and/or a restraining order which may be imposed by the Land and Environment Court.

5. The applicant should be aware of the provisions of the Disability Discrimination Act 1992. This Act imposes responsibilities additional to planning legislation.

Background

The Council as part of the budget process reviews the Community Strategic Plan Objectives from year four in Council’s Delivery Program and any objectives that are incomplete from the previous year. These are then complied into the new Operational Plan for 2020/21 financial year. The resources to complete these objectives are contained within the new budget for the 2020/21 year. Council are requested to review these objectives and approve them for inclusion in the Operational Plan for 2020/21.

10.13 Economic Development Officer Report – March 2020 ED:TOU:TE

Author: Economic Development Officer Purpose: To inform Council of recent activities undertaken by the Economic Development Unit

Background

Youth Week 2020 The 2020 Youth Week event will be a virtual scavenger hunt and brain game challenge to be held the week beginning 6 April. Advice from the Department is that the funding will be held over to later in the year, with this in mind a BBQ and craft morning will be organised for later in the year. SCCF Rounds 1 & 2 Projects are progressing with the round one projects close to being finalised. Kidman Way Sydney Caravan Show has been cancelled. There will be a focus on advertising in “The Wanderer Magazine” as well as other publications. The committee is currently in the process of updating the Kidman Way website. Carrathool’s focus on the Kidman Way Facebook page concluded at the end of February. The next month for Carrathool Shire will be July.
