MEMBERS OF THE GALLERY Your attention is drawn to Section 114 of Council’s Local Law No. 1 – Meeting Procedures. Section 114 Chairman’s Duties and Discretions (1) In addition to other duties and discretions provided in this Local Law, the Chairman

(a) must not accept any motion, question or statement which appears to the Chair to be incorrect, derogatory, defamatory or embarrassing to any Councillor, member of Council staff, ratepayer or member of the public;

(b) may demand the withdrawal of any inappropriate statements or unsubstantiated allegations;

(c) may call on a Councillor to withdraw, and apologise for, any expression used by that Councillor during the meeting which was offensive or disorderly;

(d) must call to order any person who is disruptive or unruly during any meeting; (e) must ensure silence is preserved in the Visitors’ Gallery during any meeting;

and (f) must call to order any member of the public gallery who approaches the

Council/Committee table during the meeting.

(2) A person who does not withdraw an inappropriate statement or unsubstantiated allegation when demanded by the Chairman to do so is guilty of an offence. (Penalty: 1 Penalty Unit)

(3) A Councillor who does not withdraw an expression used during the meeting which

was offensive or disorderly, and who fails or refuses to apologise when twice called on by the Chairman to do so, is guilty of an offence. (Penalty: 1 Penalty Unit)

(4) A person who disrupts a meeting or during a meeting behaves in an unruly manner,

and who fails to come to order when called to order, is guilty of an offence. (Penalty: 1 Penalty Unit).

(5) An Authorised Officer must, if directed to do so by the Chairman, remove from a

meeting any Councillor or other person who has committed an offence under clause 114(2) or (3).

4. Disclosures of Conflict of Interest

Conflict of Interest – requirements of Councillors, special committee members and Council staff

Pursuant to the Local Government Act 1989 a Councillor, member of a special committee or member of Council staff who has a direct or indirect conflict of interest in respect of a matter which is to be or is likely to be considered or discussed must:

– Make a full disclosure of that interest by advising of the class (ie direct or indirect) and nature of the interest immediately before the matter is considered at the meeting or in writing to the Chief Executive Officer prior to the meeting. Where the disclosure is made to the Chief Executive Officer in writing, the Councillor or member must only disclose the class of the interest to the meeting, immediately before the matter is considered.

– If the Councillor or member will not be present at the meeting, make a full disclosure to the Chief Executive Officer or Chairman of the meeting, in writing, of the class and nature of the interest. If a Chairman is given a written disclosure, he or she must give the written disclosure to the Chief Executive Officer.

The CEO must keep written disclosures for three years after the date the Councillor or member who made the disclosure ceases to be a Councillor or member, and destroy the written disclosure when the three year period expires.

While the matter is being considered or any vote taken, the Councillor or member with the conflict of interest must leave the room and notify the Mayor or Chairman he or she is doing so. The Mayor or Chairman must notify the Councillor or member he or she may return to the room after consideration of the matter and all votes have been cast.

The minutes of the meeting must record any disclosures of conflict of interest, the class of the interest and if the Councillor or member has disclosed the nature of the interest to the meeting, the nature of the interest.

A failure by a Councillor or member to comply with Section 79 of the Act may result in a penalty of up to 120 penalty units and disqualification under section 29(2) of the Act.

Councillor Richards / Councillor Vale: That the Planning and Development Committee acting under its delegated authority of the Council approve the drafting of hangar leases at the Benalla Airport on the following basis:

(a) a lease for each airside private structure at the airport

(b) a lease for each designated area of the Council’s structure airside at the airport

(c) annual rent for each lease calculated at $5/m2 plus GST and the Fire Services Levy

(d) the term of leases be up to 25 years providing that the initial period and any options are in five-year increments.

3. Victorian Government - New Energy Jobs Fund

The report presents information regarding the Victorian Government New Energy Jobs Fund. Councillor Crocker / Councillor Vale:

1. That the Council take on the role of lead Council in the Goulburn Broken Greenhouse Alliance application to the Victorian Government New Energy Jobs Fund for the Goulburn Broken Local Government New Energy Opportunities project, utilising Watts Working Better project underspend as a cash contribution to the project.

2. That the Council support the Benalla Sustainable Future Group to further scope an application to the Victorian Government New Energy Jobs Fund for the development a feasibility study and a future energy plan for Benalla which includes community-owned renewable energy options.

3. That the Council support the Benalla Sustainable Future Group to run a process to gauge the level of interest in a community renewable energy project.

4. That a report be presented to the Planning and Development Committee on 7 September 2016 providing information on the progress of Part 2 and Part 3 of the recommendation.

5. Municipal Emergency Management Plan 2016

The report presents the Municipal Emergency Management Plan 2016 for consideration. Councillor Crocker / Councillor Vale: That the Planning and Development Committee acting under its delegated authority of the Council adopt the Municipal Emergency Management Plan 2016.

8.2 Finance and Operations Committee Report and recommendations of the Finance and Operations Committee meeting held on Wednesday 22 June 2016.

1. Youth Action Committee The Youth and Community Development Coordinator introduced members of the Youth Action Committee (YAC) who presented an overview of their recent activities including a proposal to establish a Benalla Youth Resource Hub at the Benalla Drill Hall Community Activity Centre. Councillor King / Councillor Crocker: 1. That the presentation be received. 2. That a report be presented to a future meeting of the Finance and

Operations Committee regarding use of the Benalla Drill Hall Community Activity Centre by the Youth Action Committee.

3. That the Council forward a letter of support for the Youth Action

Committee to use when it makes applications for grant funding. Carried

9.1 2016/17 Budget

PURPOSE OF REPORT The report presents for adoption the 2016/17 Budget for the financial year ending 30 June 2017. BACKGROUND At its meeting on 3 May 2016, the Council resolved:

1. That public notice be given that the Council has prepared its Proposed 2016/17 Budget.

2. That the Proposed 2016/17 Budget be placed on public exhibition for a period of 28 days.

3. That submissions relating to the Proposed 2016/17 Budget be heard at a Special Meeting of the Finance and Operations Committee on Wednesday 8 June 2016.

4. That the Council consider submissions on the Proposed 2016/17 Budget at a Special Meeting of the Council on Wednesday 22 June 2016.

5. That the Council consider adoption of the 2016/17 Budget at a Special Meeting of the Council on Wednesday 29 June 2016.

Public notice was given in the Benalla Ensign on Wednesday 4 May 2016 and the submission period closed at 5pm on Wednesday 1 June 2016. The community was provided with the opportunity to make appointments with Council officers to discuss the budget prior to making submissions. No appointments were requested. That the Strategic Resource Plan - Rating Strategy for the financial years 2013/14 to 2016/17 be prepared on the basis of movement in the Consumer Price Index and the Local Government Cost Index plus an additional 2% allowance to be applied to capital projects, however, not exceeding 5% per annum.

2. That the Strategic Resource Plan - Debt Management Strategy for the financial years 2013/14 to 2016/17 be prepared on the basis of reducing Council debt by the end of the current Council term to a Indebtedness ratio of <35%.

5. That the Strategic Resource Plan – Human Resource Strategy for the financial years 2013/14 to 2016/17 be prepared on the basis of a maximum growth in salaries and wages of 5% per annum to cover all costs related to salary movements incorporated in the Enterprise Agreement 2012.

As part of the Council Plan 2013-17 (2014 Review), the redevelopment of the Benalla Art Gallery was made a priority project to be advanced to a ‘shovel ready’ status.

The Draft Council Plan 2013-2017 (2016 Review) proposes that the Benalla Landfill and Resource Recovery Centre also be made a priority project in light of the establishment of the Benalla Landfill Development Strategy Project Steering Committee and State Government funding of $75,000 to undertake an investigation into the site’s potential as a regional landfill servicing the North East.

Budget amendments Subsequent to the release of the Proposed 2016/17 Budget, the following amendments have been made:

as a result of the 22 June Council resolution, operational expenditure has increased by $35,000

to amend a pricing anomaly the Weekly Recycle Collection charge has been increased from $57 to $90

the rate and amount of rates payable in relation to land in each differential rate category has been amended to reflect data from the final stage of the 2016 general valuation

carried forward capital works projects of $1.47 million have been recognised.

Rates and charges Total rates and charges revenue is budgeted to increase by 4.4 per cent to $16.091 million compared to the prior year budget. To fund the increase in total rates and charges revenue it is projected that general rate revenue will increase by 3.1 per cent, Municipal Charge revenue will increase by 2.3 per cent and Waste Management Charges revenue will increase by 14.5 per cent.

1. Although the general rate in the dollar increases by 2.5 per cent in line with the State Government rate capping policy, total rate revenue rises by 3.1 per cent due to an increase in the number of rateable properties (7,425 in 2015/16 and 7,453 in 2016/17).

2. The Municipal Charge rises by 2.4 per cent to $231.70, however, Municipal Charge revenue increases by 2.3 per cent as there has been no provision for supplementary valuations in 2016/17.

3. The Waste Management Charge has increased by 9 per cent, however, the number of waste services has increased from 6,804 in 2015/16 to 7,052 in 2016/17 following the introduction of the organics collection service. The 9 per cent increase reflects increasing landfill operating and rehabilitation costs.

9.2 Council Plan 2013-2017 (2016 Review)

PURPOSE OF REPORT The report presents for adoption the Council Plan 2013-2017 (2016 Review). BACKGROUND The Local Government Act 1989 requires that at least once in each financial year, the Council must consider whether the current Council Plan requires any adjustment in respect of the remaining period of the Council Plan. The Local Government Act 1989 also requires that the Council must review the Strategic Resource Plan during the review of the Council Plan and adopt the Strategic Resource Plan no later than 30 June each year. Following the review of the Council Plan the Council is required to invite public submissions in accordance with Section 223 of the Local Government Act 1989. If the Council makes any adjustment to the Council Plan, it must within 30 days advise the Minister for Local Government of the details of the adjustment. DISCUSSION The Council Plan 2013-2017 identified strategic objectives across six key areas that provide the framework for our commitment to meeting the needs and aspirations of our community. Our Community We are committed to building a healthy, active, safe and socially connected community that offers opportunities for people of all ages, backgrounds and abilities to participate in community life. Places and Spaces We will provide community places and spaces to meet the needs of our community and focus on thoughtfully planned growth to maintain and enhance the high amenity and character of our Rural City. Our Economy We will support, promote and encourage the long-term growth, diversification and strengthening of our economy as a key contributor to a healthier and more sustainable community.

The Mayor Councillor Justin King has submitted Notice of Motion 2016/3 requesting that the Council assist in funding the hire of a bus to transport 32 community members known as ‘Max’s Heroes’ to and from Melbourne on 24 July 2016 to participate in Run Melbourne. Funds raised by the run will be donated to Beyond Blue ‘Suicide Prevention’ in honour of Benalla boy Max Moyne. Refer Appendix 1. 13. Public Question Time

In accordance with Clauses 45 to 51 of the Local Law 1 – Meeting Procedures up to 15 minutes shall be allowed for the answering of questions. 14. Authorisation of Signing and Sealing of Documents 14.1 Code of Conduct for Councillors The Council at its meeting on 25 May 2016 adopted a Code of Conduct for Councillors pursuant to s. 76C of the Local Government Act 1989 which requires councils to amend their Code of Conduct within four months after the commencement of s.15 of the Local Government Amendment (Improved Governance) Act 2015. The code:

sets out the standards of conduct expected of elected representatives

endeavours to foster good working relations between Councillors to enable Councillors to work constructively together in the best interests of the local community

mandates Councillor conduct designed to build public confidence in the integrity of local government.

Section 76C (6A) of the Act requires that within one month of amendments to a Councillor Code of Conduct being approved in accordance with this section, a Councillor must make a declaration stating that they will abide by the Councillor Code of Conduct. The Code is presented for signing by the Councillors who were not in attendance at the Council Meeting on 1 June 2016. Recommendation: That the Code of Conduct for Councillors be signed by Councillors and witnessed by the Chief Executive Officer.
