Issuing a Light Vehicle Trip Permit, Form 735-306 & 306A
Oregon dealers acting as agents of DMV may choose to issue light vehicle trip permits. These permits may only be issued for passenger vehicles with a registration weight of 10,000 pounds or less, light trailers weighing 8,000 pounds or less, motorcycles, mopeds, low-speed vehicles and medium-speed electric vehicles.
There are now two options for ordering Light Vehicle Trip Permits:
Form 735-306: Book of 25 permits - $750.00 ($30.00 for each permit) Form 735-306A: Book of 5 permits - $150.00 ($30.00 for each permit) Forms 735-306 and 306A are identical except for the form number, and in the top right corner Form 735-306 has a “D” while Form 735-306A has a “DS.” (See the example end of this section.) When ordering these permits you
may either complete a Trip Permit Order Request, Form 735-6937, and mail it with the fees to Business License Unit, DMV, 1905 Lana Avenue NE, Salem OR 97314, or come to the office at 1965 Lana Ave NE, Salem OR 97314. Dealers may only issue the light vehicle trip permits (non-commercial) for the following reasons:
When a new owner of a vehicle is not subject to Oregon registration requirements, but needs to operate the vehicle over highways to leave the state;
To allow a customer to drive an unregistered vehicle to a DEQ inspection station to get a certificate of compliance prior to
applying for registration; To allow a customer to drive an unregistered vehicle to DMV or to a law enforcement agency for a VIN inspection; and To allow a customer to drive an unregistered vehicle to a DMV office to apply for registration if the dealer will not be submitting the application for title and registration on behalf of the new owner. No more than one (21-day) trip permit may be issued under the conditions specified in items numbered 1, 3, or 4, above. Up to two (21-day) trip permits may be issued -under the conditions specified in item number 2 above - within any 12-month period, until there has been a complete change in ownership. Dealers may issue this type of permit for a 21-day period per permit only, including the date of issue. Dealers may not charge more than what they pay for trip permits. Complete the permit as follows:
FRONT (Press firmly so the information transfers through to all copies)
• Complete the name and address of the customer.
• Write the effective date and expiration date.
• Write the vehicle description, making sure the VIN is correct and legible.
• Write the customer’s driver license, permit or I.D. number and the state of issue.
• Write the customer number for a business.
• Sign the permit and fill in your dealer number in the space provided.
• Have the customer: Write in their insurance
company name (not the agent’s name) and policy number on the permit (for motor vehicles only); and Sign and date the permit form indicating they have not been issued more than two (21-day) trip permits for this vehicle in a 12-month period.
DO NOT ISSUE A PERMIT if the customer does not have insurance and cannot provide their insurance company name and policy number or the vehicle has had two (21-day) light vehicle trip permits issued within the last 12 months.
The items listed above are required to make the permit valid. The operator of the vehicle could be at risk with law enforcement if the permit was not completed properly.

Complete the back of the “Window Copy” with the effective date, dealer number and the expiration date Keep the blue copy; this becomes part of your records which are inspected by DMV investigative staff. The effective date must match the date on the front of the permit. Write the expiration date, including the actual day, using a wide black felt marking pen so that the date is easily read. These permits are only issued for 21 days. Attach this copy to the vehicle. Instructions for placement are on the permit.

Governor Signs 2 of 3 California BHPH Bills

California buy-here, pay-here dealers will have more compliance procedures to maintain when Jan. 1 arrives, since two of the three bills aimed at changing how the industry operates were signed by Gov. Jerry Brown.
But the measure Brown vetoed — a policy that would have created a hard interest-rate cap — is leaving the head of the Independent Automobile Dealers Association of California breathing a little easier. Brown did not sign Senate Bill 956, a measure that would have put a ceiling on today’s interest rates at 17.25 percent.
“It’s more than a small victory; it’s huge,” IADAC executive director Larry Laskowski told sister publication SubPrime Auto Finance News just a couple of hours after Brown made his decisions on Saturday.
“That was absolutely the worst one by far,” Laskowski emphasized. “That would have absolutely put a lot of dealers out of business. We’re pleased we’ve been able to help preserve some of the jobs and businesses in California, along with what it would have done to the industry.”
To recap, SB 956 written by Sen. Ted Lieu had three main goals:
— Impose first-ever regulations on dealers
offering buy-here, pay-here installment loans by requiring them to obtain a California Finance Lender’s license, which lawmakers
believed would have provided consumers with
an array of protections.— Limit used-vehicle installment
loans to no more than 17-percent interest, plus the variable Federal funds interest rate, which today is 0.25 percent. That level would have given California the strongest cap in the nation.
— Change the way BHPH dealers are able to repossess vehicles to include grace periods and make it easier for buyers to reinstate a repossessed unit.
In vetoing the bill, Brown said, “This bill requires, among other things, that buy-here, pay-here dealers be regulated by the Department of Corporations under the California Finance Lender’s Law.
“I am not yet convinced the evidence merits the regulatory oversight of this bill,” Brown continued. “I signed two buy-here, pay-here consumer protection bills this session. If consumers need added protection once those bills are implemented, my administration
will work with the legislature to find appropriate, measured solutions.”
As the governor pointed out in his veto letter of SB 956, he did put his signature on two bills that originated from the Assembly.
The main points of AB 1447 written by Assemblyman Mike Feuer include:
— Require BHPH dealers to provide a written warranty that covers most major components and lasts for at least 30 days or 1,000 miles, whichever happens first.
— Prohibits BHPH dealers from requiring a buyer to make regular payments in person.
— Requires BHPH dealers to receive written consent from the buyer prior to selling a vehicle equipped with electronic tracking technology.
— Requires BHPH dealers to provide notice to the buyer of the presence of “starter interrupt” technology in the vehicle, ensuring that advance warnings are provided to the driver — prior to the vehicle being disabled — in order to help avoid stranding a driver in dangerous circumstances.
Meanwhile, AB 1534 written by Assemblyman Bob Wieckowski requires a BHPH dealer to display a label on any used vehicle offered for retail sale that states the “reasonable

market value” of the unit from outlets such as Kelley Blue Book or NADA Used Car Guide. The bill would require the label to contain specified information used to determine the vehicle’s reasonable market value and the date the value was determined.
Moreover, AB 1534 would require a BHPH dealer to provide to a prospective buyer of the used vehicle a copy of any information obtained from a nationally recognized pricing guide the dealer utilized to determine the reasonable market value of the vehicle.
“Quite frankly, the bill by Wieckowski is relatively harmless in comparison to the other bills,” Laskowski surmised. “That one I don’t think is going to upset the industry’s apple cart too much.
Laskowski continued by stating, “1447 still has a ways to go in order, at least from my perspective, to figure out how a dealer complies with it without breaking any existing laws. We did mention that to the governor’s office when we spoke last week.”
FinCo Management, a provider of financing solutions for buy-here, pay-here dealers, reviewed each element of AB 1447 again this past weekend. In a message to SubPrime Auto Finance News, FinCo president Toby Reiley shared what part of the new law might be most difficult for BHPH to navigate.
In regard to the warranty, Reiley stressed that many states already have this provision.
“And some are much more restrictive than these two regulations as approved, but I don’t know of any that go into such an exhaustive list of covered components,” he continued. “The law expressly states that the burden of proof for compliance is on the dealer.
“While it will curtail bad practices by the bottom 25 percent of the dealers (as measure by selling a quality vehicle) it will cost all dealers something out of their pockets as they will have to fix cars or add warranties. But people whose cars don’t run, don’t pay,” Reiley went on to say.
“We know that long term warranties are good for the dealer bottom line. The unscrupulous will be prevented from preying on the customer with a down payment but no means to fix a car in the first month. So I think this is for the good of the dealer as well as the consumer,” he added.
The bill’s provision about payments is what caught Reiley’s attention.
“The law is vague about how these ‘in-advance’ or ‘not-in-person’ payments are made,” Reiley contends. “This may be the biggest challenge of all. It is a huge operation to collect and store the information and authorizations required to process electronic payments such as credit cards, debit cards, direct deposit and ACH transactions. Many of these people don’t have checking accounts, and the cost of money orders is high.”
Laskowski emphasized that IADAC’s staff will continue to be working with regulators in Sacramento so instructions are clear about how dealers can be compliant with these new laws that go into effect when 2013 begins.
While Laskowski might have preferred that all three bills would have been vetoed, he applauded the work completed by IADAC, as well as other organizations such as the National Alliance of Buy-Here Pay-Here Dealers and the National Independent Automobile Dealers Association, which also vehemently opposed the measures.
“It was clearly a team effort to try to educate everybody involved as to what the industry is really all about and how far over the top these bills really take it,” Laskowski said. “I think the fact that we were able to get a veto on SB 956 was a huge victory. We’re just pleased the governor saw that way also.
“The one thing that’s become very clear out of all of this is there really isn’t a landscape within the industry that allows you to just go day-to-day and not pay attention to what’s going on,” Laskowski went on to say. “I think the lesson out of all of this is if you’re a business person in California, you really need to be aware of what’s going on and have someone with you to help voice your opposition to harmful legislation such as this.”

Rental CarsA month after Rep. Lois Capps
(D-Calif.) introduced H.R. 6094, which prohibits the rental of motor vehicles under a safety recall until the defect or noncompliance is remedied, Sen. Barbara Boxer (D-Calif.) introduced S. 3502, the Raechel and Jacqueline Houck Safe Rental Car Act of 2012, with Sen. Feinstein (D-Calif.) as cosponsor.
The bill, a modification of a similar bill introduced by Sen. Boxer 2011, requires notification by car rental companies to renters about any defect or noncompliance regarding the rented vehicle at issue, as well as imposing limitations on sales, leases or rentals by rental companies, holding rental companies to the same standard of responsibility as dealers with respect to various vehicle inspection, investigation and records requirements, and authorizing the Department of Transportation to study “the effectiveness o the amendments made by [the bill] and other related activities of rental companies.”
Consumer Financial Protection Bureau
The CFPB says it can assert jurisdiction over any financial entity that otherwise is not covered under the definition of a “larger market participant” if the CFPB has reasonable cause to believe such an entity is posing a risk to the market.
That proposed procedural rule has the potential to impact our members that are not otherwise defined as larger market participants.
The procedural rules outline the process under which the CFPB would find an entity to be a risk and the process by which that entity is entitled to challenge the proposed determination before being subject to the CFPB’s supervision. If the CFPB staff has “reasonable cause” to believe the entity is a risk, the deputy
direction will send a written notice to the entity explaining why the bureau believes that risk exists.
It will then provide an opportunity for the entity to respond in writing and to pa4rticipate in an informal telephone hearing between CFPB staff and the assistant director. The response from the entity would include any written information the CFPB could and should consider.
After the informational hearing, the assistant director would submit a written proposed order to the director of the CFPB to bring the entity under the supervisory oversight of the CFPB. If the determination is made to supervise the entity, the CFPB will do so for a minimum of two years and can make a petition to be relieved of that obligation after that time, but only once annually.
We reviewed these proposed rules and found several concerns we asked the CFPB to consider through comments submitted to it. Our first significant concern was the lack of clarity from the bureau as to the type of conduct the bureau believes is “reasonable cause” to find an entity to be a risk. The proposed rule does not define “reasonable cause” or provide any framework of conduct the bureau believes would create the risk.
We asked the CFPB to revise the rule to provide this definition. We also asked the CFPB to limit the risk to inappropriate or undisclosed financial risk to the consumer so the scope of misconduct the bureau would attempt to regulate is not overly broad.
Second, we raised concerns about the information used to make that determination. Presumably, much of the information will be made on consumer complaints, but the rules do not specify the information bureau will use in making its risk determination. We asked the bureau to address that.
We also pointed out what we considered an unfair process, notwithstanding the CFPB’s attempt to keep it informal. The procedures proposed in the draft rule would not allow the entity potentially subject to the conduct to exercise discovery and examine the same material the CFPB reviewed in making its determination. The rule would not allow an entity to depose witnesses, review documents, ask interrogatories of either consumer complains for CFPB staff as to what forms the basis of the “reasonable cause.”
We believe it is patently unfair to be placed at such a disadvantage when compared to the CFPB staff, which has access to consumers or other information in making its determination. An entity should be provided the same level of access in order to properly defend itself.
We also asked the CFPB to consider allowing an entity the opportunity to rebut the assistant director’s recommendation to the director before the director makes his final recommendation.
Regulation Z: The CFPB has proposed a number of changes to Reg Z in the mortgage arena. While it does not directly affect the automotive industry, it could be an indicator for proposed regulations in the near future.
The proposed mortgage regulation would require prompt crediting of payments on mortgage loans and prompt response time for payoff amount inquiry.
The CFPB is proposing changes to the definition of the “finance charge” in a mortgage transaction by eliminating certain exclusions that were not otherwise considered when calculating an APR. The SFPB has invited comments on the proposed changes to be submitted by Nov. 6. We will analyze the proposed change for any potential impact if something similar was adopted in the auto finance sector.

Issuing a Dealer/Tower Trip Permit, Form 735-307
A Dealer/Tower Trip Permit, Form 735-307, may only be issued when a dealer or tower is required to remove the registration year stickers from both Oregon registration plates that are on passenger vehicles they sell (see section in this chapter entitled “When an Oregon Dealer Sells a Vehicle” for more information).
There are now two options for ordering Dealer Trip Permit books:
Form 735-307: Book of 25 permits - $375.00 ($15.00 for each permit) Form 735-307A: Book of 5 permits - $75.00 ($15.00 for each permit)
Forms 735-307 and 307A are identical except for the form number, and in the top right corner Form 735-307 has an “NS” while Form 735-307A has an “SN.” (See the example end of this section.) Dealers and towers may issue

A light vehicle trip permit may not be issued to the following types of vehicles:

A Temporary Registration Permit, Form 735-315, may be issued to a vehicle purchaser by an Oregon dealer if the dealer collects title, and registration or plate transfer fees, and if the dealer submits the combined title and registration application to DMV on the purchaser’s behalf. below titled “Issuing a Temporary Motorcycle Permit, Form 735-309.”
Form 735-315 allows the use of the vehicle while the customer is waiting for plates and stickers. Temporary registration permits are valid for 90 calendar days. When a temporary registration permit has been issued, DMV’s copy of the permit and all title and registration documents and fees must be taken or mailed to DMV within 30 days from the date the dealer sells the vehicle. Dealers cannot extend the temporary registration permit beyond 90 days, nor can they issue a second permit. If a customer needs another permit, they must go to a DMV office.
The Form 735-315 is proof of temporary registration until a transaction is processed at DMV headquarters. The effective date of the registration is the date the temporary registration permit is issued.
A Form 735-315 cannot be issued if the vehicle has not met DEQ requirements where applicable. If DEQ is required for a vehicle, a Trip Permit, Form 735-306, may be issued to allow the vehicle to be taken to a DEQ inspection station.

BACK
Complete the “Window” copy (back) by writing in the effective date, dealer number and the expiration date. Write the expiration date using a wide black felt marking pen. The effective and expiration dates, including the day of expiration, must match those on the front of the permit. Place this copy in the vehicle.
Attach the “DMV” copy (white copy) to the title documents to be sent to DMV. Leave the yellow copy in the book.
If a permit is voided, leave all three copies of the voided permits in the book. A signed explanation as to why the permit is voided must accompany each voided permit.
When all permits have been issued, return the book and yellow copies to:

The permit books will be audited and a replacement book will be sent to you. If the yellow copies were removed for any reason, they must be put back into the book in number order for auditing. Yellow copies not
in order will cause a delay in replacing temporary registration permit books. DO NOT submit an empty book to a DMV local office. Educational Instructor Bobbi Cockeram Born and raised in Eastern Oregon in the little town of Vale,
Bobbi worked for the local GMC dealership in Ontario, Oregon at the age of 18 selling to the local “Good ol’ boys” farmers and ranchers. This is where her love for the Auto Industry started. She relocated to the Portland area in 1996 where she entered her career as a “Title and Registration Specialist.” It was a very challenging time back then as there were no classes or training of any sort, so after years of hard work, dedication, and making it her business to become as knowledgeable as she could from whatever resources she could find, she successfully graduated from the school of “Hard Knocks,” and took off in the world as an independent Auto Dealer Consultant/Title and Registration Specialist for Oregon auto dealers. Bobbi has not only had the opportunity to work with Oregon auto dealers, but with Dealer Auctions, and several other states dealers as well. Additionally, she is well versed in other state laws and DMV statues. Bobbi started instructing Title and Registration classes as well as Pre-licensing Courses and other forms of Continuing Education for us at the OIADA 3 years ago and the classes just keeping better and bigger. She brings to us a great deal of knowledge and experience to our members and staff. We are very excited about partnering with Bobbi.
