CHARLOTTE CITY COUNCIL

Resolution Authorizing Sale of Personal Property by Public Auction

Whereas, G.S. 160-270 allows the City Council to sell personal property at public auction upon adoption of a resolution or order authorizing the appropriate official to dispose of the property at public auction;

Whereas, G.S. 160A-274 allows the City Council to donate personal property to another governmental agency; and

Whereas, the City Manager has recommended that the property listed on the attached Exhibit A should be sold at public auction as surplus property; now therefore,

Be it resolved, by the Charlotte City Council that the City Manager or her designee is authorized to sell at public auction on the 24 th day of June 2000, at 10:00 a.m. and on the 1 st day of July 2000, at 10:00 a.m. both at the City-County Surplus Property Facility, 3301 North 1-85 Service Road, Charlotte, North Carolina,the surplus property described on Exl'tibit A, as per the terms and conditions as specified in the Auctioneer Services contract approved by this Council and in accordance with G.S. 160A-270. The terms of the sale shall be net cash. The City Manager is directed to publish at least once and not less than ten (10) days before the date of the auction, a copy of this resolution or

a notice summarizing its content as required by North Carolina General Statute 160A-270.

Be it also resolved by the Charlotte City Council that the City Manager or her designee is authorized to donate seven (7) surplus staffcars (Exhibit B) to Work First program.

RESOLUTION CLOSING A PORTION OF AMBLE DRIVE IN THE CITY OF CHARLOTTE, MECKLENBURG COUNTY, NORTH CAROLINA.

WHEREAS, pursuant to the provisions of Chapter 160A-299 of the General Statutes of North Carolina, the City Council has caused to be published a Resolution of Intent to close a

portion of Amble Drive which calls for a public hearing on the question and:

WHEREAS, the petitioner has caused a copy of the Resolution of Intent to close a

portion of Amble Drive to be sent by registered or certified mail to all owners of property adjoining the said street and prominently posted a notice of the closing and public hearing in at

least 2 places along said street or alley, all as required by G.S. 160A-299; and

WHEREAS, the public heating was held on the 12th day of June, 2000, and City Council determined that the closing of the portion of Amble Drive is not contrary to the public interest, and that no individual, fLrm or corporgfioa owning property in the vicinity thereof will be deprived of reasonable means of ingress and egress to his or its property.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Charlotte, North Carolina at its regularly assembled meeting of June 12, 2000, that the Council hereby orders the closing of the portion of Amble Drive in the City of Charlotte Mecklenburg County, North Carolina as shown in a map marked "Exhibit A" and is more particularly described by metes and bounds in a doeumant marked "Exhibit B", both of which are aV.aehed hereto and made a part hereof.

BE IT FURTHER RESOLVED that a certified copy of this Resolution be filed in the Office of the Register of Deeds for Mecklenburg County, North Carolina.

COMMENCING at an existing iron md located in the southerly right-of-way margin of Amble Drive (Variable Public Right-of-Way) and the northeasterly property line of Mecklenburg County, now or formerly, as more particularly described in Deed recorded in the Mecklenburg Public Registry in Book 8142, at Page 384, and the southwesterly property line of Budd Investment Properties, LLC, as more particularly described in Deed recorded in the Mecklenburg Public R.cgistry in Book 10591, at Page 440; thence from said existing iron red and along the southerly right-of-way margin of Amble Drive, with the arc of a circular curve to the left, having a radius of 119.26 feet, an are distance of 25.56 feet and being subtended by a chord bearing and distance of N 73-51-42 E 14.15 feet to a new iron rod and being the POINT OF BEGINNING; thence from said Point of Begirming and through the right-of-way of Amble Drive, with the arc of a circular curve to the left, having a radius of 50.00 feet, an arc distance of 93.90 feet, and being subtended by a chord bearing and distance of N 22-30-33 E 80.70 feet to a new iron rod located in the property line of Budd Investment Properties, LLC and the northerly right-of-way margin of Amble Drive; thence along the common property line of Budd Investment Properties, LLC and the right-of-way margin of Amble Drive, the following four (4) courses and distances: 1) N 67-42-04 E 38.54 feet to a new iron rod; 2) S 22-17-56 E 60.00 feet to an existing iron rod; 3) S 67-42-04 W 69.96 feet to an existing iron rod; and 4) with the are of a circular curve to the right, having a radius of 119.26 feet, an are distance of 25.65 feet, and being subtended by a chord bearing and distance ors 73-51-42 W 25.60 feet to the Point and Plaec of Beginning, containing 2,917 sq. ft. or 0.0670 acre, more or less.
