MINUTES DECEMBER 9, 2019

Meeting was called to order by Supervisor Haga at 7 p.m.. Members present: Supervisor Haga, Clerk Smith, Treasurer Moran, and Trustee Proos. Trustee Hurwitz arrived at 7:02 p.m. Members absent: Trustees Jacobs and McAleenan. Also Present: Planning Director Ferro, Parks Director Fitzpatrick, Assessor Boerman, and approximately 17 community members.

BOARD COMMENT

Trustee Proos asked about an update from Progressive AE regarding the cultural arts center of the library building. He expressed kudos to all involved in the activities of the past weekend and expressed excitement about the post cards being handed out for Envision Ada. He also stated it’s been an exciting year.

Supervisor Haga brought attention to the Leonard Field Master Plan input open house and the status report of the library/community center.

RELEASE OF EASEMENTS AFFECTING MARKET PLACE SQUARE CONDOMINIUM AND RIVER STREET COMMONS CONDOMINIUM Karen Custer, Miller Johnson, and Steve Groenenboom, Moore and Bruggink explained the need for terminating the easements. Moved by Proos, supported by Hurwitz, to approve termination of easements 2, 3, 5, and partial termination of 44, affecting Marketplace Square Condominium and River Street Commons Condominium. Roll Call: Yes - Proos, Hurwitz, Smith, Moran, Haga; No - 0; Absent - Jacobs, McAleenan. Motion carried. AMI - ADVANCE METERING INFRASTRUCTURE - LICENSE AGREEMENT WITH CITY OF GRAND RAPIDS Nicole Pasch, City of Grand Rapids, explained the requested agreement. Moved by Proos, supported by Hurwitz, to approve the Advanced Metering license agreement. Roll Call: Yes - Hurwitz, Proos, Smith, Moran, Haga; No - 0; Absent - Jacobs, McAleenan. Motion carried. Moved by Proos, supported by Moran, to approve the Consumers Energy Easement for Electric Facilities for the library/community center. ADA TOWNSHIP GOVERNANCE TASK FORCE RECOMMENDATION Susan Burton and Joe Schmeider, of the Governance Task Force, explained the request for recommendation of hiring a Township Manager. Moved by Proos, supported by Moran, to approve the Governance Task Force’s recommendation to hire a township manager and refer to the personnel committee to develop a hiring process. Roll Call: Yes - Hurwitz, Proos, Moran, Haga, Smith; No - 0; Absent - Jacobs, McAleenan. Motion carried.

OPPORTUNITY FOR ADDITIONAL PUBLIC COMMENT Kindell Rerucha, on behalf of the Ada Business Association, thanked the township for its help and support for the Tinsel Treats and Trolleys activities. She also expressed full support for a township manager position.

ADA TOWNSHIP DOWNTOWN DEVELOPMENT AUTHORITY (DDA) BOARD OF DIRECTORS

MINUTES OF THE NOVEMBER 4, 2019 MEETING ADA, MICHIGAN

I. CALL TO ORDER AND ROLL CALL

The meeting was called to order at 8:00 a.m. by Chairperson, Bowersox.

BOARD MEMBERS PRESENT: Terry Bowersox, George Haga, Bryan Harrison, Devin Norman, Ted Wright, Margaret Idema, BOARD MEMBERS ABSENT: Dawn Marie Coe, Justin Knapp, Walt VanderWulp STAFF PRESENT: Jim Ferro, Planning Director, Brian Hilbrands, DDA Coordinator, Adina Winczewski, Administrative Assistant, Kevin Moran, Township Treasurer PUBLIC PRESENT: 2 members

II. APPROVAL OF AGENDA

It was moved by Harrison, seconded by Norman, to approve the agenda as presented. Motion passed unanimously.

III. APPROVAL OF MINUTES OF OCTOBER 14, 2019 REGULAR MEETING ANDOCTOBER 14, 2019 SEMI-ANNUAL INFORMATIONAL MEETING

Idema stated that her comments on a lack of senior and/or low-income housing were not mentioned in the regular meeting minutes. It was moved by Idema, seconded by Norman, to approve the minutes of the October 14, 2019 meetings as amended. Motion passed unanimously.

IV. BUSINESS UPDATEa. Clark Crookshanks, Union Bank

Mr. Crookshanks introduced himself. Union Bank, located at Headley and Ada Drive, has seen an increase of about 30% for walk-in traffic in the past year. People are coming into the bank to inquire about rates. Everything is moving in a positive direction.

Norman asked about the history of Union Bank. Mr. Crookshanks stated the bank originates from Lake Odessa. It started with a merger from two different banks back in the 1930s. There are now seven branches throughout western Michigan. Mr. Crookshankes stated he manages the Ada branch and the marketing for all the west Michigan branches.

Norman asked why Union Bank chose to open a branch in Ada. Mr. Crookshanks stated the company saw how Ada was growing. Ada is a small but very vibrant community. The company wanted to be adjacent to Grand Rapids before deciding to open a branch in downtown Grand Rapids.

Norman asked if not having a drive-through is affecting the bank’s business. Mr. Crookshanks stated the lack of a drive-through has affected the older generation of customers. However, with the accessibility of online banking, he believes there will be fewer customers coming into the branches.

Norman asked how he feels about parking. Mr. Crookshanks stated Union Bank is fine with the parking situation. The only time there are issues is when there’s a lot of snow.

Hilbrands stated Mr. Crookshanks/Union Bank has been the Cup Sponsor for both Beers at the Bridge and Brats & Bonfires.

V. APPROVAL OF PAYABLES a. Seyferth PR September Invoice, Event Planning Services

Hilbrands reviewed the September invoice as presented in the board packets. It was moved by Norman, seconded by Idema, to approve the September invoice to Seyferth PR in the amount of $3,109.56. Motion passed unanimously. VI. DEVELOPMENT OF DDA YEAR-END REPORT

Hilbrands stated he has been working with Seyferth PR for ideas on the year-end report. Right now, they are considering a 4-page report. They are aiming for the report to be inserted into the spring edition of the Ada View. They would like to begin with a short introductory letter from the entire DDA Board or from Chairperson, Bowersox. They would also like to add a number of statistics showing the growth within the DDA District, info on DDA projects and events, and an update on future plans for the DDA. Hilbrands stated the goal is to have a draft report at the December meeting and a final report to be approved at the January meeting. Idema recommended that the report: 1) have an area encouraging residents to attend DDA meetings and, 2) have contact information for all the DDA members in case residents would like to reach one of them. Wright agreed and suggested holding an occasional evening meeting for residents who are unable to attend the regular morning meetings. Idema asked if there are any social events between all the different entities in the Township, stating that she feels she doesn’t know anybody on any of the other committees. Hilbrands stated there is not. Harrison suggested adding more than a 1-year retrospect of DDA’s accomplishments in the year-end report and to also add the DDA’s mission and an explanation of what the DDA does. It would also be nice to have a schedule of 2020 events listed in the report. Hilbrands stated he can start adding a brief DDA update in each of the Ada Views from now on.

VII. REPORTS AND COMMUNICATIONS

a. Status of Legacy Park Construction

Ferro stated the amphitheater is running behind schedule. The railing should be completed soon. The concrete foundation for the memorial is complete and the sculpture will be delivered next week, weather permitting. There was a discussion around standing water around the amphitheater during heavy rain seasons. Ferro stated the deck will indeed get flooded on occasion. Norman asked if there’s a plan for a fountain to move water in the nearby pond so it is not stagnant. Ferro stated there used to be an aeration fountain included in the scope of work but it may not be included now. The Parks Director would like to take a holistic look at how to manage water quality in that pond. Only about 25% of the pond is on Township property. If the other property owner provides a deed for their portion of the pond, it would make more sense to look into adding an aeration fountain at that time.

b. Amy Van Andel Library and Community Center Update

Ferro stated the footings are in and the foundations are being completed. Steel erection and masonry for the elevator tower will be next. Ferro explained the 3 bid alternates related to windows, flooring, and snowmelt. The Township Board will be looking at snowmelt at the next Township board meeting. Ferro summarized the operating/energy costs for the snowmelt system. Norman asked if more will be added to the retaining wall on the east side of the library area. Ferro answered no, the retaining wall is complete as-is and it’s being used to protect the sewer pump station.

c. 2019 Brats & Bonfires Recap

Hilbrands stated the October 17th event had a record of 1,401 attendees. The weather cooperated nicely. They had record revenue from ticket sales and sponsorships.

d. Unfinished Business

Hilbrands updated the DDA on the uneven pavers VanderWulp mentioned during the last meeting, stating he is expecting a quote from Twin Lakes Landscaping. Per the Township Purchase Policy, if the work is under $3,000, he can go ahead and approve work to begin. If the quote is over $3,000, he will need to get a total of 3 quotes and get approval from the DDA.

e. DDA Financial Report, 10/31/19

Hilbrands summarized the financial report as presented in the board packets. All events had great revenues. The Farmers’ Market did not finish as high as estimated. Hilbrands will get feedback from the Market Manager.

VIII. BOARD MEMBER COMMENT Norman inquired about the lot width change mentioned during the last DDA meeting. Ferro stated the Planning Commission recommended approval of the change and it will be on the Township Board agenda for review and action next week. Norman asked for an update on the potential rental units near the Ada Market. Ferro stated the developer is working on modifying the building design and will likely present a formal application in January. He will share the next round of drawings with the DDA when he receives them. Idema stated she is concerned with the lack of activity with the Bronson Residences. It seems work has come to a halt. Norman stated he spoke to the new owner of the Schnitz / Ada Bike Shop building and was told they will be putting on a new roof and improving the appearance around the building. IX. PUBLIC COMMENT There were no public comments.

A meeting of the Ada Township Planning Commission was held on Thursday, November 21, 2019, 7:00 p.m. at the Ada Township Offices, 7330 Thornapple River Dr., Ada, MI.

Ken Dixon of Dixon Architecture summarized the proposed project. Mr. Dixon stated the current Crown Jewel Spa & Salon near the corner of Spaulding Ave. and Cascade Rd. will be demolished and replaced with this proposed 18,950 sq. ft. building. Each floor will be around 9,800 sq. ft. The first floor will have a spa & salon comprising around 6,500 sq. ft. The remainder of the first floor will be a fitness center. The second floor will comprise one business office. They will have 91 parking spaces which meets the minimum amount of parking spaces required. They will also be meeting the required landscape buffers and greenbelt along Spaulding Ave.

Mr. Dixon stated that in addition to the current access driveway from Spaulding Avenue, they will be

Mr. Dixon stated that they meet all the setback requirements as well as the minimum lot area and width. Mr. Dixon noted that they will be going before the Zoning Board of Appeals for a variance on maximum building height. The maximum height is 30 ft. but a portion of this building will be 35 ft. Mr. Dixon stated they will have an underground stormwater storage system. The storage tanks will hold around 8,500 cubic feet of stormwater. Mr. Dixon also explained the proposed lighting and building materials. Easter asked if the curb-cut is already existing on Cascade Road. Mr. Dixon confirmed that it is existing. There will be a new, small retaining wall along the property line. Easter asked if some of the roof will be a green roof. Mr. Dixon stated that the overhangs will be green. Heglund asked if underground water retention has been done previously in Ada. Mr. Dixon stated yes and provided several examples. Carter noted the potential risk of drivers cutting through the parking lot from Spaulding Ave. to make a right-hand turn onto Cascade Rd. Easter asked about the hours of operation. Mr. Dixon stated the hours will be 8am – 8pm Monday through Saturday, closed Sunday. Easter asked about signage. Mr. Dixon stated signage has not been finalized and will be obtained by a separate sign permit through the Township. Easter inquired about the siding. Mr. Dixon explained that it is a metal material made to look like wood. It is durable and long-lasting. Heglund asked if the 33 ft. easement is across the neighboring properties and if those neighbors are aware of the easement. Mr. Dixon stated the neighbors are aware of the easement and there have been discussions between all parties over the easement. Ferro asked where the mechanical equipment would be located. Mr. Dixon stated it would be on the rear area of the roof, behind a screen. Chairperson opened the Public Hearing at 7:22 pm. Paul Drueke, partial owner of adjacent property located at 5181 Cascade Rd. SE, expressed concerns over the wetlands on the east side of the easement and the retaining wall that is proposed in the easement area. Mr. Drueke stated the easement has not been used since 1984 and he believes he does not have to allow the applicant to use it. Mr. Drueke believes it could also be a safety risk for his clients and employees to potentially have 91 additional cars using their Cascade Road driveway. After no further comments, the Public Hearing was closed at 7:31 pm. Planning Director, Ferro, summarized the proposed project as stated in the staff reports dated 11/14/19. Ferro stated that day spa, hair salon, and fitness uses are all personal care uses that require a Special Use Permit. There are 4 general standards which must be satisfied which are:

1) The special use shall be designed, constructed, operated and maintained in a manner harmonious

with the character of adjacent property and the surrounding area. 2) The special use shall not change the essential character of the surrounding area. 3) The special use shall not be hazardous to adjacent property, or involve uses, activities, materials

or equipment which will be detrimental to the health, safety or welfare of persons or property through the excessive production of traffic, noise, smoke, fumes or glare.

4) The special use shall not place demands on public services and facilities in excess of capacity. There are no characteristics of the proposed use that would conflict with these standards. Ferro stated there is a 10 ft. drainage easement on the west side of the property which does not seem to be in use currently. The underground storm water management system will conform with the standards of the Township Stormwater Ordinance. Ferro stated the parking, lighting and landscaping all appear adequate. Don DeGroot, Exxel Engineering, confirmed that the proposed retaining wall will extend south of the applicant’s property and 40 ft. into Mr. Drueke’s property. The wall is for retaining the grades and also for protecting the wetlands. Leisman stated the Planning Commission can only approve what is in the site plan on the applicant’s property. Anything on the neighboring property will need to be handled between property owners. In response to Mr. Drueke’s concerns on whether or not the easement rights are still valid, Leisman suggested adding a condition of approval to state that the cross access is optional. Ferro agreed. Ferro stated that the standards of approval for a Special Use Permit have been met, and recommended approval of the Special Use Permit and Site Plan subject to the 4 conditions as listed in the staff memo dated 11/14/19. Carter asked if the applicant would need to return to the Planning Commission if they chose not to connect to the driveway easement but instead wanted to change their parking. Ferro stated that would be a minor modification. Board discussed and determined that change could be handled by the Planning Department. Moved by Easter, supported by Jacobs, to approve the Special Use Permit based on the findings that it meets the 4 general Special Use Permit approval standards as previously stated and to approve the Site Plan subject to the following 6 conditions:

1. The Site Plan shall consist of a 18,950 sq. ft., 2-story building and site improvements as shown on the plans titled “1035 Spaulding Ave. SE (civil drawings) dated October 23, 2019, “1035 Spaulding Mixed-Use Building” (architectural and photometric drawings) dated October 24, 2019, and “1035 Spaulding Mixed-Use Building (landscape drawing) dated November 13, 2019, except as modified in accordance with these conditions of approval.

2. Approval of the stormwater detention system by the Township’s consulting engineer, including the submittal of a stormwater permit application and a permit issued by the Township, in compliance with the stormwater ordinance, prior to issuance of a building permit and/or construction of any site improvements.

3. A building height variance granted by the Zoning Board Appeals or the plans being modified to eliminate the clerestory roof monitor to satisfy the maximum building height regulation of 30 feet for the PO Professional Office zoning district.

4. Any pole and/or exterior building mounted light fixtures shall qualify as “full-cutoff” control of light emission, subject to approval of the Planning Department. Fixture specifications shall be submitted for approval, prior to building permit issuance.

5. The west elevation plan shall be modified to show the trellis.

6. Driveway access connection to Cascade Road shall be optional. Motion passed unanimously.

2. Request to rezone parcel from (R-3) Medium Density Single-Family Residential, to (V-R) Village Residential, Parcel No. 41-15-34-402-008, 7699 Fase St. SE, Chuck Hoyt on behalf of TPR 7699 Fase Street, LLC

Chuck Hoyt of Thornapple Pines Development presented. Mr. Hoyt stated they would like to create a residential neighborhood and make it Village Residential like the rest of the street. They would like to create walkable neighborhoods as described in the Master Plan. Easter asked if the soil has been tested for contamination. Mr. Hoyt stated it has, and the environmental tests came back negative for any contamination. Ferro gave a brief summary of the subject property and stated a more thorough evaluation of the proposed rezoning will be available at the Public Hearing. Leisman asked if there is a potential for this property to be connected to Ada Moorings. Ferro stated no, Mr. Hoyt agreed. Heglund moved, Easter supported, to set a Public Hearing on December 19th. Motion passed unanimously. VII. COMMISSION MEMBER/STAFF REPORTS Ferro advised the Commissioners of a discrepancy he found related to the Fulton Woods Corporate Park project heard last month. In reviewing the proposed Master Deed amendment, he noticed that a proposed restriction on use of 6 parking spaces adjacent to Unit 1 does not conform with the overall intent of the original PUD plan which is for all parking to be shared by all unit owners. Ferro stated the applicant has made a revision addressing the issue and is circulating it to the other unit owners for review. VIII. PUBLIC COMMENT In anticipation of public comments, Leisman invited Ferro to speak on the recent community discussions involving a gas station which has not come before the Township. No application has come before the Township. Ferro stated he was approached in September by property owners and a representative of J&H Oil about the possibility of building a gas station at the SE corner of Knapp and Pettis. Ferro stated that he explained to them the steps that would need to be taken to achieve that type of development. It would require an amendment to the Township Master Plan; it would require rezoning; and it would require approval of some type of a development plan. In addition, he pointed out to the property owner and developer that the Township has an adopted Wellhead Protection Plan for the area in question and that would also be an area of concern for the Township. Ferro stated he encouraged the property owner to solicit some neighborhood feedback before they make any decisions to submit a formal application. That resulted in them holding a meeting at Roselle Park on November 18th. That meeting was not a Township

Ferro stated that if they do submit a formal application to the Planning Commission, there will be plenty of notice to neighbors and many opportunities to provide public input. It is premature for the Planning Commission to come to any conclusions on this subject without being presented a formal application. Ferro encouraged everyone to return to speak if/when a formal application is presented. Leisman stated, as a Planning Commission, they are adamant about following the Master Plan and the Zoning Ordinance. If an applicant asks for changes, the Commission is required to listen. Property owners have a right to ask for changes. However, just because they ask, doesn’t mean their request will be approved. Kelly VanDyke, 5585 Pettis Lane NE, expressed her opposition to the potential gas station should an application be submitted. It doesn’t fit with the Master Plan or the current zoning. Ms. VanDyke stated she and many other neighbors are concerned with the environmental impact, the safety of their children, and the safety of their drinking water. Ms. VanDyke asked for clarification over what can be built on the larger parcel in question (2355 Pettis Ave). Ms. VanDyke recalls the homeowner saying that they were told they can not build a home on their property. Dave Smits, 2323 Grand Valley Dr. NE, expressed gratitude for the beauty of Ada. Noelle DiVozzo, 7115 Bronson St., encouraged the audience members to get on the email list for Ada Township to stay apprised of all upcoming meetings. Pat Toll, 8125 2 Mile NE, thanked the Planning Commission for their work. Becky Carpenter, a resident outside of Ada, stated her family is impacted by Ada’s decisions. Her children attend Forest Hills Eastern Schools. Ms. Carpenter stated everything the Township does reaches the surrounding areas and she thanked the Commissioners for what they do. Ferro stated that the Township maintains an email mailing list which will notify you of upcoming meetings. He encouraged the audience members to get on that email list if they haven’t already done so. In response to Ms. VanDyke’s question regarding what the homeowner can build on their larger parcel, Ferro stated he does not recall the property owners ever inquiring about what can/can not be built on that property. From what he understood, the developer did not want to give up any land to allow a house. The developer mentioned the idea of creating a large landscaped berm on the opposite side of the creek. Ferro stated the larger parcel in question is a part of the Grand Valley Estates Subdivision plat. There is a floodplain boundary shown on the plat map and a drain easement to the Kent County Drain Commissioner. Ferro stated he can not confirm if the parcel has sufficient buildable land outside those restricted areas or not. Ferro stated there is nothing in the zoning rules from the standpoint of minimum lot size and setbacks that would prohibit building a house there. IX. ADJOURNMENT – Meeting adjourned at 8:12 p.m.

ADA TOWNSHIP ZONING BOARD OF APPEALS MINUTES OF THE TUESDAY, DECEMBER 3, 2019, REGULAR MEETING

A regular meeting of the Ada Township Zoning Board of Appeals was held on Tuesday, December 3, 2019, 4:30 p.m., at the Ada Township Office, 7330 Thornapple River Drive, Ada, Michigan.

NEW BUSINESS

1. Request for a Variance from Private Road Standards to allow a new parcel to have access to a private road(Baer Dr.) which does not meet roadway width, easement width, or grade standards and does not have arecorded maintenance agreement, Parcel No. 41-15-27-200-054, Emily & Reed Dietrich, 201 Honey CreekAve. NE

Emily and Reed Dietrich, homeowners at 201 Honey Creek Ave. NE, presented their request. Mr. Dietrich stated they would like to parcel off 2.5 acres of their land and have access to that land come from Baer Dr. which is a private road.

Planning Director, Ferro, summarized the applicant’s request stating the applicants own slightly over 12 acres in which they would like to split off 2.5 acres, creating a new parcel. Ferro explained that the applicants currently use a driveway located on the north end of their property to access their home from an easement on adjoining property. The proposed parcel will have a driveway located south of the property on Baer Drive with about 83 feet of direct

frontage. Ferro stated the 2.5-acre parcel is moderately sloped and provides a suitable building site that would comply with setback requirements. The new parcel would be subject to the Riparian Protection Rules due to a secondary stream corridor that runs through the property. Ferro stated he believes there is sufficient area to build outside of those protection zones. He is not aware of any wetlands on the subject parcel; a qualified wetlands consultant would have to make that determination. Ferro stated that Baer Drive is an informal name not approved by the Kent County Road Commission, however, it can be found on some maps as ‘Baer Drive’. All the properties along Baer Drive are addressed as Honey Creek Ave. Baer Drive does not conform with several of the Township’s current private road standards. The private road access rules state that any new lot that is created must have access that complies with current private road standards. In order for a new lot to be created, the private road would need to be modified to comply with the private road standards or a variance would need to be granted. Ferro summarized those private road standards with which it currently does not comply including: easement width, improved surface width, grade, and lack of a recorded private road maintenance agreement. Ferro also stated that Baer Drive connects to a location on Honey Creek Ave. that has very inadequate sight distance in both directions. Chair Dixon opened the floor for public comments at 4:41 pm. Ralph Crosby, 75 Honey Creek, stated that this same request was brought before the ZBA in 2006 by homeowners located at 117 Honey Creek, which is located at the end of Baer Drive. Mr. Crosby stated that at that time the Kent County Road Commission had issues with the project due to poor visibility on Honey Creek. He believes the same issues apply in this case. He also noted that there is already increased traffic on Baer Drive due to an in-home daycare at 117 Honey Creek which adds 12 additional cars on the private road. Marti O’Brien, 61 Honey Creek, stated that she believes there are wetlands on the proposed 2.5-acre lot. She is concerned that construction will compromise the health of the creek and its tributaries. Ms. O’Brien stated the private road already has more cars than it can handle. Public comments closed at 4:45 pm. Ferro reviewed the criteria which must be satisfied in order for the Zoning Board of Appeals to grant a variance: 1. Whether unique physical circumstances exist which cause a “practical difficulty” in complying with the Zoning Ordinance standards. Ferro stated the existing private road, has been in place since approximately 1950. Nearly all of the existing homes accessed by the road were constructed prior to the Township’s adoption of private road standards in 1990. Putting in place a recorded maintenance agreement between the property owners using the road would require unanimous approval by all of the owners which is beyond the applicant’s control. There would need to be modifications to the private road in respects to grade, easement width and pavement width. Ferro stated that one thing the applicant can control is where on their 12-acre property they choose to put an additional home site. There is a lot of additional land that is accessible from the same route that their existing driveway follows on their 33 ft. easement, which already complies with the Township’s private road standards, that would easily accommodate another home site. Ferro stated there are no “exceptional” physical conditions associated with the property that necessitate the granting of a variance in order to create an additional home site from the parent parcel. Ferro stated that on that basis he recommends denial of the variance.

2. Whether granting the variances would alter the essential character of the area. Granting of a variance would not alter the essential character of the area. A new home could be placed on the proposed 2.5-acre lot without major alteration of the existing natural features that are important to the character of the area. 3. Whether the circumstances leading to the variances are self-created. The applicant has not taken any actions that have contributed to the non-conformity of the private road with the Township’s standards. 4. Whether amending the Zoning Ordinance standards is a more appropriate remedy to the situation. The type of variance requested is not so common or recurrent as to warrant amending the zoning regulations. Mr. Dietrich asked Ferro if he had walked the property. Ferro stated he had not but he did view it on aerial and topographical maps. Mr. Dietrich stated splitting the property in a different location would mean bringing in large equipment and removing large trees, which he does not want to do. He also stated that while visiting the proposed 2.5-acre lot on 6 different occasions last month, only once did he see a vehicle using Baer Drive. He does not feel the road is overwhelmed with traffic. Mrs. Dietrich stated it seems they have 2 separate issues. The first is parceling off the 2.5-acre lot in a way that won’t affect the neighboring lots. That is why they are asking for the variance. They would prefer not damaging neighboring lots by widening the road. If there are any wetlands, that would be addressed in the building permit process. The second issue, which she feels is the most important, is the safety issue in regards to visibility. Mrs. Dietrich stated there are a significant number of private roads that have access to Honey Creek with inadequate visibility. The safety issue affects many more private drives than just Baer Drive. Board reviewed aerial photos and discussed location of Baer Drive and proposed driveway access. Dixon asked how many homes have access on the private drive. Ferro stated 10 existing homes and there are two additional vacant lots. Dixon stated there are a lot of issues with this request: width of private road easement, width of improved road surface, steepness of the terrain, and a lack of a recorded private road maintenance agreement. In addition, many neighbors have submitted letters of opposition for the variance. It’s difficult to go against the zoning code when the community is also opposing what is being requested. Burton inquired about the condition of Baer Road. Mrs. Dietrich stated the road is in need of maintenance. Burton stated she is also concerned with safety on Honey Creek Ave. Mr. Crosby asked to address the Board about the two vacant lots previously mentioned. Dixon recognized Mr. Crosby. Mr. Crosby stated that years ago, five homeowners along Baer Drive purchased those two lots with the expectation of keeping them vacant. They do not have any plans of ever building on or selling those two lots. Ferro reviewed two alternative building locations on an aerial photo where additional home sites could be situated on the applicants’ property without accessing from Baer Dr. Smith asked for clarification on the conditions. Dixon stated that a condition of approval could be that they must create a private road agreement. Ferro agreed but stated that the burden would be on the applicant to get agreement from all property owners along the private road. It was moved by Smith, supported by McNamara, to deny the variance request. Motion passed unanimously.
