Instructions:

• Remind participants that on Day 1 of the workshop they learned that “protection is a legal responsibility”. Ask participants to explain what this means. (“Protection is a legal responsibility, principally of the State and its agents. In situations of armed conflict, that responsibility extends to all parties to the conflict under international humanitarian law, including armed opposition groups. Humanitarian and human rights actors play an important role especially when States and other authorities are unable or unwilling to fulfil their protection obligations.”)

• Remind participants that on Day One they also looked at national law in the form of the Myanmar Constitution and how it could apply to IDP Protection.

• Ask participants what international law or human rights conventions might apply to IDPs in Myanmar. Give participants time to think about the conventions and list them. (UDHR, CEDAW, CRPD, CRC, ICESCR)

• Remind participants that Myanmar is a party to each of these human rights conventions which means Myanmar is obligated to comply with these conventions.

Activity 1: Introduction to the Guiding Principles (30 mins) လႈပရားမႈ ၁ - လမးညႊနအေျခခမမားက မတဆကျခငး (၃၀မနစ)

Purpose of Activity: To introduce participants to the Guiding Principles on Internal Displacement. လႈပရားမႈ ၏ ရညရြယခက - သငတနးသ၊သားမားက ျပညတြငး ေနရပစြန႕ခြာ ေရႊ႕ေျပာငးေနထငရျခငး နင ပတသကေသာ လမးညႊနအေျခခမမားက မတဆကေပးရန ျဖစသည။

INSTRUCTIONS

• Tell participants that this session will focus on the Guiding Principles on Internal Displacement.

• Tell participants that these principles are not binding like a convention such as CEDAW or the CRC, but that they are based on these conventions as well as international humanitarian law that protects civilians during armed conflict. The principles were developed to provide guidance to States when faced with internal displacement.

• Tell participants that in law we often think in terms of “duties” and “rights”. • Ask participants: “what is duty?” List the responses on the whiteboard. • Ask participants: “what is a right?” List the responses on the whiteboard. (5 minutes) • Now tell participants that they are going to look at Principle 3 of the Guiding

Principles on Internal Displacement which talks about the “duty” of the national authorities and the “rights” of the IDPs. Give each participant Handout 25.4.1.

• Now tell participants that they are going to debate which one is more important in Principle 3, duty or right, using the PRES method.



• Divide participants into 4 groups. Groups 1 and 2 will argue that the duty of the national authorities is more important. Group 3 and 4 will argue that the right of the IDPs is more important.

• Explain PRES to participants. (5 minutes) လမးညြနခကမား

• Tell participants that the Guiding Principles consist of 30 Principles divided into 5 sections. In the previous activity, they looked at Principle 3 which is one of the general or foundational principles.

• In this activity, participants will look at principles from the other 4 sections. • Divide participants into 4 groups. Give each group the assigned Handout.



• Tell participants to imagine that they are working for a civil society organization that raises awareness on IDP protection. Ask them to draw a poster showing the right described in their Handout. (15 minutes)

Ask each group to choose ONE rule of law poster that best matches their drawing and tape it next to their drawing.
