PROTECT MEDICAL & DENTAL EDUCATION FROMDISTRUCTIONS & LOCKOUT

PAMI is the representative association of private medical and dental colleges and is the biggest stakeholder in medical education. The Pakistan Association of private medical and dental colleges ( PAMI) is the biggest stakeholder in medical and dental educa-tion as more than 60% of the medical and Dental Colleges in Pakistan are private. Out of the total of 173 colleges in Pakistan , the private medical colleges are 114 while the public colleges are 59. The students in private medical and dental colleges are 10399.The teachers in the private medical colleges are more than 5000 and mostly are professors of highest standing and have served in public colleges before joining the private colleges.

Private medical and dental colleges have made huge financial investments / spending to establish the colleges and hospital facilities in Pakistan and this needs to be acknowl-edged, appreciated and not castigated. The Supreme Court as well as the High Courts, the PMDC and PMC have acknowledged the experience and expertise of PAMI in the medical education in the past and at numerous times the PAMI has been consulted by the PMC and the Government before making crucial policy decisions.

In these times of Covid 19 , Pakistan urgently needs its first line hospitals and doctors and paramedics, and we need to boost up their morale, give them incentives and try our best to avoid anything which saps their spirit.

Matter No 1: Members of the PMC

1. Pakistan Medical Commission replaced the Pakistan Medical, Dental Council. While the Pakistan Medical and Dental Council had elected members majority of which were actively involved in teaching medical education while the Pakistan Medical Commission has only nominated members who have never been teachers or administrators in the medical and dental colleges.

2. It is a fact that PMC is a selected group and not an elected body and the internation-al bodies have shown deep reservations that PMC has no professional persons and elected members. PMC is likely to be shunned by all international regulatory bodies concerned with medical education.

3. The Honourable Supreme Court in para 6 and para 7 of its judgment 2018 SCMR 1956 has narrated the relevant legislative history of the Pakistan Medical and Den-tal Council till 2016. The salient landmarks are that the Honourable Supreme Court has catalogued that the initially a Medical Council was established under the Indian Medical Council Act, 1933 (Act of 1933) as a regulator of the medical education in order to have uniform standard of medical education in the whole of British India. After partition of the sub-continent, on the recommendation of the Health Conference in 1947, the Act of 1933 was adopted and a Medical Council constitut-ed thereunder. The Medical Council was re-organized under the Pakistan Medical Council Act, 1951, which provided for a Medical Council for each Province. In 1957, the West Pakistan Medical Council was created by merging the Sindh and Punjab Medical Councils. Thereafter, the Ordinance of 1962 was promulgated and the Medical and Dental Council was established as a regulator of the medical edu-cation in order to have uniform standard of medical education in the whole of Pa-kistan. The additional task of maintaining a national Register of medical and dental practitioners was also added in the functions of the Council. Under its Section 3(1) of the PM&DC Ordinance 1962, the Federal Government was to constitute a Coun-cil comprising of the members provided therein, which (members) were to elect its President [Section 3(2)].

4. The Honourable Supreme Court in para 6 of its judgment 2018 SCMR 1956 had reproduced the Section 3 of the Ordinance of 1962 substituted by the Medical and Dental Council (Amendment) Act, 2012 (Act of 2012), which holds field now

“3. Constitution and composition of the Council.— (1) The Federal Government shall, by notification in the official Gazette, cause to be constituted a Council consisting of the following members, namely:- (a) One member each from the Senate and the National Assembly to be nominated

by the Chairman or, as the case may be, the Speaker from amongst the mem-

bers of the respective House; (b) Secretary, Health Department of each Province; (c) One member each to be elected by the member of the Syndicate of each public

sector Pakistan university from amongst the members of its medical faculty and dental faculty of all its constituent as well as affiliated colleges from each Province, Gilgit Baltistan, Federally Administered Tribal Areas (FATA) and Islamabad Capital Territory;

(d) One member each to be elected by the members of the Syndicate of each pri-vate sector Pakistan university from amongst the members of its medical facul-ty and the dental faculty of all its constituent as well as affiliated colleges from each Province, Gilgit-Baltistan, FATA and Islamabad Capital Territory;

(e) One member from each Province, Gilgit-Baltistan, FATA and Islamabad Cap-ital Territory to be elected amongst themselves by the registered medical prac-titioners;

(f) Four members to be nominated by the Federal Government of whom one shall be Surgeon General of the Armed Forces Medical Services;

(g) One member to be elected from amongst themselves by the registered dentists from amongst themselves from each Province, Gilgit-Baltistan, FATA and Is-lamabad Capital Territory.

(h) one member to be elected from amongst the Professors of the teaching staff of the public sector medical colleges from each Province, Gilgit-Baltistan, FATA and Islamabad Capital Territory;

(i) One member to be elected from amongst the Professors of the teaching staff of private sector medical colleges from each Province, Gilgit-Baltistan, FATA and Islamabad Capital Territory;

(j) One member to be elected from amongst the Professors of teaching staff of public sector dental colleges from each Province, Gilgit-Baltistan, FATA and Islamabad Capital Territory;

(k) One member to be elected from amongst the Professors of the teaching staff of private sector dental colleges from each Province, Gilgit-Baltistan, FATA and Islamabad Capital Territory;

(l) One member to be elected by the Council of the College of Physicians and Surgeons;

(m) One member, belonging to the legal profession, to be nominated by the Chief Justice of Pakistan;

(n) Senior most officer looking after health matters at the Federal level or an au-thority looking after the affairs of Council at Federal level designated or noti-fied by the Federal Government, as the case may be; and

(o) Immediate ex-President of the Council who shall be a member of the Council for one non-renewable term of three years provided that he or she will not hold office.

(2) The President of the Council shall be elected by the members of the Council from amongst themselves.

(3) No act done by the Council shall be invalid on the ground merely of existence of any vacancy in or any defect in the constitution of the Council.

(4) The President shall be the head of the office of the Council and shall be the compe-tent authority for all employees of the Council.”

5. The Honourable Supreme Court after deep study of the composition of the Council as in PMDC Amendment Act 2012 observed that the PMDC Council composition contains the best and the most experienced technical and proficient professors and academicians who are elected by their peers to represent medical education in the country in its apex regulatory authority of the medical education. The only reserva-tion of the Honorable Supreme Court was that the private sector members should not be more than public sector University members and other than that there were no observations.

6. The Honourable Supreme Court declared in its para 24 of 2018 SCMR 1956 that promulgation of Ordinance after Ordinance like the PMDC ordinance 2013, PMDC ordinance 2014 and PMDC ordinance 2015 on the same topic was a subversion of the democratic process by the President of Pakistan and a fraud on the constitution by him.

7. On coming into effect of the judgement of the Honourable Supreme Court 2018 SCMR 1956, an adhoc Council was setup by the Court till the new elected Council takes control.

8. Rather than conducting elections of the Council and by ignoring the orders Hon-ourable Supreme Court declared in its para 24 of 2018 SCMR 1956 , the President of Pakistan again resorted to promulgation of Ordinance namely PMDC Ordinance 2019 which repealed the entire substantive law PM&DC Ordinance 1962 . PMDC Ordinance 2019 did away with the elected academicians and professional experts of the medical profession and education, and introduced a totally new composition and the following were appointed by the Prime Minister without any criteria or advertisement or due process of search committee etc . The persons notified as members and their expertise / profession/ organization is shown against each

9. The PMDC Ordinance 2019 was challenged in the Islamabad High Court and the Honorable Court declared the PMDC Ordinance 2019 as ultraviris of the Consti-tution and that the judgment of the Honourable Supreme Court 2018 SCMR 1956 has already held that President of Pakistan cannot promulgate somewhat identical Ordinances on the same topic as would be a subversion of the democratic process by the President of Pakistan and a fraud on the constitution by him. In para 41 to 46 of the order in WP 3800 of 2019 , the Islamabad High Court observed that none of the members are deserving to be made members of this apex body and conflict of interest was evident and all norms of transparency and merit have been violated.

10. Despite all orders of the Honourable Supreme Court , the Honourable President

of Pakistan promulgated another Ordinance on 21st October 2019 namely the Pa-kistan Medical Commission Ordinance 2019 while it had been made clear by the Honourable Supreme Court 2018 SCMR 1956 that President of Pakistan cannot promulgate somewhat identical Ordinances on the same topic as would be a sub-version of the democratic process by the President of Pakistan and a fraud on the constitution by him. The following persons were notified as members of the PMC Commission by notification dated 23rd October 2019 under the PMC ordinance 2019 are and their expertise / profession/ organization is shown against each

11. The PMC Ordinance 2019 was not passed by the Parliament and consequently got repealed on expiry of time as per constitution. After repeal of the PMC Ordinance 2019, the PMDC Ordinance 1962 came back to hold field and the adhoc committee set out by Supreme Court in 2018 SCMR 1956 came to control PMDC.

12. That the PMC Act 2020 was passed by the Parliament on 24th September 2020 and the Prime Minister notified the following members as members of the Pakistan Medical Commission and they started working as is evident from the first page of minutes of the Meeting of the PMC of 16th October 2020. The persons notified as members of PMC under the PMC Act 2020 are the following and their expertise / profession/ organization is shown against each

13. That the Pakistan Medical Commission has only nominated members who have never been teachers or administrators in the medical and dental colleges and it is repeated that PMC members is a selected group and not an elected body and the international bodies have shown deep reservations that PMC has no professional persons and elected members. PMC is likely to be shunned by all international reg-ulatory bodies concerned with medical education.

14. Ever since the set of members detailed above have come to control PMC/ PMDC they have brought in one bad policy after another and has been nothing less than a disaster and the policies are surely and steadily leading the medical profession and medical education towards disaster and extinction.

15. The main reason is that Pakistan Medical Commission is controlled by this inexpe-rienced group is now fast becoming very dangerous for the medical profession and the medical education and Pakistan is losing ground rapidly in the world arena. An unforgiveable disaster is that PMC has failed to obtain and maintain the equiva-lence of Pakistani accreditation standards and processes to be equivalent to those which are used by the US to accredit medical schools in the US https://pami.org.pk/wp-content/uploads/2020/11/US-comparability-of-Standards-with-Pakistan.pdf

16. PMC controlled by Mr Ali Raza and company have not understood the value of accreditation of the US of the standards of Pakistan where Pakistan standards and processes used by the PMDC in Pakistan to accredit medical schools in Pakistan. The standard of medical education were studied by the US in 2008 and after through

scrutiny and oral testimonies , the US congressional Committee declared the Paki-stani standards and processes of PMDC to be made equivalent to those which are used by the US to accredit medical schools in the US. What else can Pakistan want? However, PMC has not been able to maintain the declaration of the US government while it should have cherished, nurtured and protected the equivalence declaration as this was the first step on which Pakistan had built its international image and presence and a whole infrastructure of respect as a medical regulatory body. It is very simple to comprehend that once a regulatory body of any country has stand-ards equivalent to the US then how can the world not accept Pakistani doctors for jobs and postgraduate studies abroad. PMC has publicly refused inspection by the WFME (World Federation of Medical Education), rebuked it and resultantly the WFME cancelled its inspection. PMC controlled by Mr Ali Raza does not at all understand that if Pakistan is not accredited by the WFME then no Pakistani can work on the US soil and gradually nowhere in the world. https://pami.org.pk/ecf-mg-that-wfme-recognition-of-national-accreditation-standards/

17. The Federal Government has realized its folly of appointing the inexperienced and unrelated persons as members of the PMC Commission and have announced a search Committee vide regulations dated 18th May 2021 “the appointment of members ( Council and Board) Rules 2021”. Hopefully this search Committee will advertise the positions and select the members on merit without any conflict of in-terest as was pointed out by the Honourable Islamabad High Court in WP 3800 of 2019 by citing examples.

18. The Federal Government has tried to protect its current members by saying in rule 8 that present members will continue till new members are selected. This defeats the entire purpose and a caretaker person or Secretary of commission can look after the day to day work till the Search Committee identifies and the Prime Minister notifies the new members, which they have persisted with since 2019 and are listed below for convenience. By rule 8, the Federal Government is trying to protect its current inexperienced and unrelated persons as members of the PMC Commission which

19. In the above circumstances and once the Federal Government has introduced a rule to protect the blue eyed persons which it has been appointing again and again since 2019 without any merit or advertisement so it is humbly prayed

1. Appointment of persons appointed before the rules as void2. Strike down rule no 8 of the regulations dated 18th May 2021 “the appointment of

members ( Council and Board) Rules 2021”.3. Order the Search Committee to advertise and recommend names for notification to

the Prime Minister for the members of Commission and Board.4. Authorize any appropriate person from the Ministry or the Secretary of the com-

mission to perform day to day functions till the Prime Minister appoints the mem-bers of the commission after recommendations of the search Committee.

Matter No 2: The flawed 2021 admission regulations made by PMC

1. The damage done to medical and dental colleges and especially the dental colleges in the admissions in 2020

a. PAMI notes with regret that PMC which did not have even a single member having any experience of running a medical or dental college or working in it made disastrous policies for the 2020-2021 admissions.

The Islamabad High Court in its para 41-46 of its order in WP 3800 had passed

observations on each and every member of the commission individually and was of the view that not even one of the members deserved to be a member of the Commission, and concluded that the selection of members was murky and was a clear conflict of interest. Later the Supreme Court observed in CP Np 1301-K / 2021 that the Federal Government must appoint a Search Com-mittee and select members after advertisement and selection process. Federal Government did make the criteria for members and a search Committee but to accommodate their blue eyed Mr Ali Raza said that these rules will be applied for the next term of the members. Perfect example of hoodwinking.

b. It is common knowledge through years that the students do the following:1. The students prefer to go to public medical colleges due to extremely low

cost of tuition and only once the public colleges admissions get closed the students go to private medical colleges.

2. The private medical colleges need atleast one month to complete their ad-missions after public medical college admissions have been closed.

3. Once the students cannot get admission in private medical colleges , they will then try for admission in private dental colleges and the private dental colleges need atleast one month to complete their admissions after closure of admission in the private medical colleges.

4. Traditionally the merit in dental colleges is atleast 10% lower than the low-est merit in the medical colleges.

c. In the 2020 admissions, the PMC opened admission of public colleges and pri-vate colleges simultaneously.

d. A number of students lost their chance to get admission in dental colleges once they kept hoping to get admission in medical colleges but admissions in dental colleges closed on the same date and the colleges did not have the permission to adjust medical student candidates in dental colleges.

e. The PMC MDCAT was controversial and hit the Province of Sindh worse.f. The dental colleges in Sindh could not fill their seats in time and resultantly al-

most 800 seats of BDS went vacant and this loss cannot be forgiven easily. Had PMC risen to the occasion and had given more time to private dental colleges

then had given a reasonable concession in qualifying percentage of even 10 % the private dental colleges would have completed their BDS admissions.

2. Fallacies and important points in the 2021 admission regulations an-nounced by the PMC

Rather than learning from its mistakes of 2020. The PMC has announced a very controversial and a non workable admission process. The analysis is as under:a. PMC has no authority to make criteria for admission in Private Colleges (

section 18 of PMC Act). It can make rules for MDCAT only.b. PMC has increased the eligibility to appear in the MDCAT from 60%

marks in FSc to 65 % marks.c. Stopped the private medical colleges to gauge paying capacity which is es-

sential as private medical education has a cost.d. Private colleges not to charge fee from failures.e. Private colleges cannot fill the seats vacated by the students who leave. The

colleges should have the right to fill seats within the allotted seats if the seat falls vacant.

f. PMC has tried to levy penalties on private colleges to arm twist them.g. PMC has gone back on its promises and commitments not to categorize/

grade a college and has started floating this idea again.

4. The 2021 MDCAT1. The PMC announced MDCAT for 2021 admissions. The basic idea behind en-

try test to medical colleges admissions has been to gauge aptitude and there has been no requirement to pass that exam and just its numbers are used to make an overall merit. PMC has set a pass percentage of 65 %. It is unnecessary.

2. There has been no consultation process with stakeholders or any scientific ra-tionale. It just seems a mean to shrink the base and damage private medical and dental college admissions and benefit foreign medical colleges which are favorites of PMC owners.

3. It is plainly written in law that PMC is supposed to conduct MDCAT itself but

is again planning to lease it out to its favorite partners for financial considera-tions. The PMC has to remain within four corners of its PMC Act. As per PMC minutes of 16 Oct 2020 and certain provisions of the PMC Act aswell as by let-ters written by PMC and letters written by Ministry of Education , the regulator for medical and dental colleges and for medical and dental education is now HEC and not PMC.

4. PMC is trying to exceed its jurisdiction by trying to enhance its scope by the admission regulations 2021 and this is beyond its Act PMC Act 2020. As per order of Lahore High Court Lahore in WP 1775 of 2017 it was declared that

“It is settled that the power is controlled and regulated by the parent statute and rule-making authority cannot enhance it. It has to remain within the scope of delegated legislative power given by the parent statute. In the instant case, im-pugned Regulations are not at the same pedestal as its parent statute. The efficacy of provisions of a statute cannot be left to the kind mercy of rule-making power of the Council. The command of legislature cannot be overridden by the fiat of the Council. Complete, absolute, unclear, unguided and uncontrolled rule-making power has not been given by the parent statute.”

5. The exorbitant fee of MDCAT of Rs 6500/- Six Thousand Five hundred from each candidate where the number of candidates are more than one lac Thirty Thousand and then leasing out this Exam by PMC to mint money will end up in a scandal which will damage the image of medical education in Pakistan.

Matter No 3: Matter of The NLE Examination

1. While PAMI is the representative association of private medical and dental colleges and is the biggest stakeholder in medical education it has 10399 students in private medical and dental colleges.

2. Students in Private medical and dental colleges have made huge financial investments / spending to get their education and most are examined by public universities.

cil. While the Pakistan Medical and Dental Council had elected members majority of which were actively involved in teaching medical education while the Pakistan Medical Commission has only nominated members who have never been teachers or administrators in the medical and dental colleges.

It is a fact that PMC is a selected group and not an elected body and the interna-tional bodies have shown deep reservations that PMC has no professional persons and elected members and as these persons do not belong to medical education, it is not their fault as they do not know anything about medical education and medical and dental colleges and the intricacies of running especially the private medical and dental colleges, the importance of international linkages, recognitions like the US Government NCFMEA comparability, approval of the WFME and the image of PMC in the eyes of these organization.

It must be clearly understood that on coming into effect of the PMC Act 2020 a huge intentional blunder has been committed and the new PMC is now a regulatory body just for practice by the registered practitioners and it is the HEC which is now the regulatory body for medical education and medical and dental colleges and PMC has transferred all regulatory to it by writing letters explaining the PMC Act 2020 to HEC and the Ministry of Education has taken over the role of controlling Ministry for regulating medical education and medical and dental colleges through HEC.

As per PM&DC Ordinance 1962 as amended by PMDC amendment Act 2020, the PMDC was a regulatory body for Pakistan for medical education and medical and dental colleges as well as the regulatory body for practice by the registered practi-tioners. PMDC was recognized and acclaimed to be one of the best medical regu-latory bodies in the world especially by the US and the WFME. All this has gone to the wind.

8. How can the PMC impose the NLE National licensing Examination on the student who took admission before the PMC act before NLE concept took force. These stu-dents will find it hard to accept NLE and may invite protests by the student body as the law cannot be applied retrospectively. It will lead to endless litigation.

9. The NLE National Licensing Examination shall invite mushroom growth of coach-ing academy mafia which will charge exorbitant fees. It is ironic that first the student has to go to academies for entry test to get into MBBS and BDS courses and then once they graduate then they will have to re-graduate the NLE National Licensing Examination and will obviously go to private academy mafia to prepare for PMC NLE National Licensing Examination to maximize their chances to get the license to practice.

10. Even India, which Mr. Ali Raza and company love to follow in every thing did not allow a separate NLE Examination rather they declared the Final Year Examination as national exit Examination for standardization( NLE). But does PMC care. No.

Matter No 4: Matter of indifference of PMC to loss of international recognition of Pakistan medical education system . Transfer of regu-latory power by PMC to HEC regarding recognition and inspection of regulations

1. PAMI is the representative association of private medical and dental colleges and is the biggest stakeholder in medical education and feels responsible to secure the future of its students and graduates so that they get good jobs ready nationally and internationally.

2. PAMI is deeply disturbed over the irresponsible behaviour of the PMC controlled by Mr Ali Raza and demands that the PMC subjects itself immediately to WFME inspection so that the Pakistani doctors do not lose their jobs and careers as thou-sands of Pakistani doctors are secured.

3. It must be clearly understood that on coming into effect of the PMC Act 2020 a huge intentional blunder has been committed and the new PMC is now a regula-tory body just for practice by the registered practitioners and it is the HEC which

The PMC controlled by Mr Ali Raza is making sure that Pakistani doctors are dis-credited and they loose their jobs in the US, UK, Euroupe, Canada and other for-eign countries and this will benefit India and Bangla desh mostly who will immedi-ately fill the void. Pakistan under policies of Mr. Ali Raza is all set to lose billions of dollars earned by Pakistani doctors working abroad.

6. It is also submitted with concern that an attempt is being made to transfer all pow-ers of accreditation nor inspection of medical colleges to HEC while neither the HEC has any such expertise and they will try their own brands and experiments of accreditation of medical colleges which will further damage the credibility of Paki-stan Medical Education and institutions and this will erode the confidence and trust of the world on our doctors. This will be a black day in the history of Pakistan.

7. HEC at the Federal level is a failing institution in any case and Provinces have al-ready established its own HECs so it is clear where the regulatory role of medical and dental institutions and education will end up with.

8. The PAMI is deeply disturbed and submits that while the private medical colleges are providing 65% of the total medical and dental professionals every year. Out of

the total of 173 colleges in Pakistan , the private medical colleges are 114 while the public colleges are 59. The students in private medical and dental colleges are 10399. If the Government does not intervene and does not remove Mr. Ali Raza and his gang from PMC and put a stop their unreasonable and destructive policies, then the private sector colleges will be forced to close down and the billions invested by the private sectors in these colleges and private hospitals will go down the drain and thousands of persons working in these institutions will lose their jobs. The ultimate beneficiary of closure of colleges in Pakistan will directly or indirectly be India and Indian led Central Asian medical colleges which will absorb the Pakistani students.

Matter No 5: Inspection Criteria, inspection Performa and matter of categorization and grading of medical and dental colleges

1. If the preamble of the PMC Act 2020 is examined , it is quite telltale and is repro-duced for convenience

“WHEREAS it is expedient to provide for the regulation and control of the med-ical profession and to establish a uniform minimum standard of basic and higher medical education, and training and recognition of qualifications in medicine and dentistry;”

The preamble talks only to establish a uniform minimum standard and that is it and all medical and dental colleges have to maintain a uniform minimum standard and if they don’t they will be derecognized under the law and there is nothing in the law which talks of categorization and grading of medical and dental colleges.

No consultation has been carried out in the preparation of these important documents and the HEC being blind will put the criteria sent by Mr Ali Raza and his PMC and that would be a total disaster. If someone thinks a few friends of Ali Raza will escape he is mistaken.

Matter No 6: College of Physicians and Surgeons Pakistan matters College of Physicians and Surgeons Pakistan is the premier Postgraduate Institution in Pakistan and its graduates are the best professionals who enjoy worldwide respect. PMC is trying to derecognize their training programs which will be strongly resisted by PAMI at every level.

Charter of demands1. An independent, reputed (third party) audit agency should be hired for an authen-

tic HR and financial audit so that all the incompetent and inexperienced officials shall be removed and capable, experienced and duly elected officials shall be includ-ed in PAMI.

2. Admission regulations 2021 are in excess of PMC Act 2021 and should be with-drawn and no action should be carried out pursuant to it.

3. MDCAT’s passing percentage is unacceptable. Only the obtained marks may be announced.

4. NLE examinations should be postponed immediately . Consultation process on it should be started.

5. There is no provision in law of categorization/ grading of colleges and will not be accepted.

6. No interference by PMC in CPSP will be accepted.7. PAMI is the biggest stake holder and HEC and PMC have to give it the status of

Partner as it’s a norm in international and national organisations.8. New members be advertised and selected as per june 2021 Federal Government

Regulations and Secretary PMC can look after day to day work till decision of Search Committee and notification by Hon’ble Prime Minister .

If the above demands are not met to save the medical and dental education , then PAMI vows to use all measures at its disposal including protests and legal recourse.

The points from justice Mohsin Kiani’s decision in write petition 3905/2019, that are still applicable.

42. The above mentioned members of the Council referred in the Ordinance were ap-pointed by the Prime Minister of Pakistan on the strength of Section 4(1)(a)(b) and (c), whereby an absolute discretion has been extended to the Prime Minister. The respond-ent Federal Government as well as the respective ministries have failed to substantiate as to how and under what circumstances the Prime Minister came to know that Roshaneh Zafar of Kashf Foundation Lahore (respondent No.5), Muhammad Ali Raza, Advocate (Respondent No.6) and Tariq Ahmad Khan, Partner, Baker Tilly, Member (Respondent No.7) fall within the concept of “recognized philanthropist or person of known repute, a legal professional and a chartered accountant” as there are thousands of Chartered Ac-countants, Philanthropists, Advocates and Professionals who have been excluded from consideration. It is necessary for an authority like Prime Minister to call upon those individuals through a structured formula by way of open advertisement, which is miss-ing in this case or a fair chance to be given to every professional for his selection in this regard.

43. Similarly, the other three members nominated in terms of Section 4(1)(b) of the PMC Ordinance, 2019 being licensed medical practitioners, with at least 20 years expe-rience with outstanding merit were notified by the Prime Minister as Dr. Rumina Has-san, Agha Khan University, Sindh (Respondent No.8), Dr. Asif Loya, Shaukat Khanum Memorial Cancer Hospital, Lahore (Respondent No.9), and Dr. Arshad Taqi, Hameed Latif Hospital, Lahore (Respondent No.10), but in this nomination the required formula has not been adopted, especially when Shaukat Khanum Memorial Hospital, Lahore was established by the Prime Minister himself. He claims that he has established a state of the art hospital, as such, the nomination of Dr. Asif Loya clearly spells out the conflict of interest on the part of Prime Minister of Pakistan. Similarly, the other two members nominated by the Prime Minister under this provision could not be selected or nomi-nated without any structured criteria, which is lacking in this case.

44. Likewise, Dr. Anees-ur-Rehman of Islamabad (Respondent No.11) has been nomi-nated by the Prime Minister in terms of Section 4(1)(c) being a licensed dentist with at least 20 years experience with outstanding merit, but in this case the Prime Minister or relevant Ministry has not referred anything on record that the said Member has been selected amongst hundreds of dentists available in Islamabad or Pakistan or what factors distinguish him from others to be nominated and appointed as Member of the Council. This composition of the Council in terms of Section 4(1)(a)(b) and (c) as drafted in the Ordinance is based on a person specific selection concept, whereas the Prime Minister is bound to follow the spirit of fair competition, equal opportunity and merit in all respects being the Executive Head while holding such a prestigious position. The PMC Ordi-nance, 2019 with reference to composition of Council negates the wisdom laid down in Article 25 of the Constitution as well as the latest judgement of the Hon’ble apex Court reported as 2019 SCMR 1952 (in the matter of: SELLING OF NATIONAL ASSETS IN-CLUDING PIA AT THROWAWAY PRICE) wherein, it has been settled that authority being responsible for planning, succession and appointment of a public sector company, had to evaluate a potential candidate for appointment on a fit and proper criteria, and must act independently, transparently, totally impartially and in an unbiased manner, so as to select the best and the most suitable candidate strictly on merit . Hence, the very selection of Members of Council under Section 4 is against the wisdom laid down in the Constitution of the Islamic Republic of Pakistan, 1973, therefore, their further selection of the President is also not justified, which could not be allowed to perpetuate for any decision as it amounts to enhance the illegalities with multiplying factors, which has di-rect bearing on entire process on medical profession including registration, examination and licensing of medical experts.

45. While considering the above background, this Court has come to an irresistible con-clusion that the very nomination of members of the Council to represent PMC for the objective of said Ordinance i.e. to rationalize the medical profession and its allocation, is in violation of the principles laid down by the superior Courts in cases reported as PLD 2015 Lahore 522 (Imrana Tiwana v. Province of Punjab), 2015 SCMR 1739 (Lahore Development Authority v. Ms. Imrana Tiwana), 2013 SCMR 1159 (Muhammad Ashraf

While considering the principles laid down in the above mentioned case laws, this Court has come to an irresistible conclusion that the appointment of Respondents Nos.5 to 11 is in violation of the basic principles of law as unstructured discretion was applied by the Prime Minister of Pakistan without any subjective criteria, even no rational ap-proach was laid down in Section 4 of the PMC Ordinance, 2019, whereas the other law in terms of Public Sector Companies (Corporate Governance) Rules, 2013 is inapplication to other positions by the same Government and even the Prime Minister is exercising its authority under the said law through structured formula, but in this case all the relevant processes and procedures were not referred in Section 4 in order to accommodate the blue eyed persons by the Prime Minister, which is in violation of the constitutional man-date as discretion was specifically provided to the Prime Minister, which could not be applied in a wide manner in violation of the governing principles laid down in the cases of Tariq Aziz-ud-Din and others referred supra.

Subject: ADMISSIONS IN DENTAL COLLEGES.

Respected Sir,We are all stakeholders in promoting the Medical and Dental Education in Pakistan. While we must not compromise on the standards and quality of education and must ensure that the national interest is upheld and all regions of Pakistan are equipped with qualified doctors and dentists.

Sir, as you are aware, this year the results of MDCAT were not the same for all regions. The results were worst for the rural Sindh with only 25% passing the test whereas many regions had passing rate over 70%. Passing scores were not the part of the act but were later inserted in the regulations at 60% or above. The results for Sindh urban were only slightly better than that of Sindh rural. Unfortunately, rural Sindh was the area which was severely deprived of doctors and even more deprived of the dentists. The result meant that where other regions had 5 students competing for one seat of MBBS or BDS, less than 2 students were competing for one seat in Sindh.

As a result, just over 8000 students qualified for about 5500 seats in Sindh. When it came to private sector, just over 1500 candidates of Sindh domicile applied for 2590 seats. All of these candidates preferred admissions in Medical (1850 available seats) rather than dental colleges (740 available seats). All were interviewed and less than half of the medical seats got filled with these candidates. Hardly anybody applied for the 740 dental seats.

There’s no doubt that students try to get admissions in MBBS before they look for the BDS. One practice that has kept the dental admissions going in the last years, is to keep the Dental eligibility lower than the eligibility for admissions in the Medical Colleges.

For example, if this year, the eligibility for dental colleges is kept at 40% of MDCAT, all those with MDCAT scores between 40-59% would have made up their mind for dental colleges from the day one. Whereas in current situation, they are all waiting and hoping for the admissions in MBBS.

It is pertinent to note that while 65% of marks limit in FSc has some merit, fixing another parameter of 60% in MDCAT has• No scientific basis as there is no research done and no evidence that it may be

useful.• It is not a part of PMC act to fix the passing mark at 60%.• It is against the practice in countries like UK and USA. In UK, similar UCAT has no

lower limit and each admitting university only uses it to determine the merit of the applicants. Hence it varies from university to university and from year to year. Same is true about the MCAT examination of USA.

• If a limit has to be fixed, past criteria should be taken into consideration. Only few months ago it was 33% which was suddenly increased to 60%.

• Another most important consideration is the ground facts. This year, the results are worse than last year. The whole world is giving concession to the students and the institutions due to Covid -19 situation. Only previous year, the last candidate admit-ted in private dental colleges of Sindh had the MDCAT score of 53/200 or 26.5%. How can one perceive that admissions in BDS will be possible with the eligibility increasing to 60%?

As a result, this situation, is more adversely affecting the 12 private dental colleges of Sindh where hardly any candidate is showing an interest for admissions in the 740 seats of the dental colleges. This, in one hand is unnecessarily giving the impression of ignor-ing and in fact, violating the rights of Sindh. On the other hand, it is depriving hundreds of graduates from attaining higher education in the field of their dream. Moreover, it isdriving a large number of students into the foreign universities, which will result in fam-ilies facing the hardship and the nation being deprived of billions of dollars of foreign exchange.

This problem can be addressed even now by lowering the eligibility for BDS admis-sions to 40% or extending the date of admission in BDS for three weeks. This should be stressed that life threatening conditions, such as multiple traumas, Myocardial Infarc-tion, Shock etc. are dealt by the medical, rather than the dental graduates.

We are all aware of your vision and command on national issues related to Medical & Dental Education. I am sure that you will take a bold decision and save the futures of hundreds of students. Your action of lowering the required percentage for admission in BDS will bring a great national harmony and save the country a huge amount of foreign exchange.

Dear Sir,I wish to write five points that are necessary to bring in the notice of the Pakistan Medi-cal Commission, Ministry of NHS and Health and the Government of Pakistan.I want to begin with the assertion that we all are partners in promoting the medical & dental education and healthcare facilities in Pakistan and we should cooperate and coor-dinate within the legal and constitutional framework. I will urge you to arrange meetings with the above organizations so we can remove the deficiencies and problems.

I want to stress on the the following five points.

1. The very constitution of PMC is against the constitution and human rights since it does not have representation from the major stakeholder (PAMI)

The PMC and its National Medical & Dental Academic Board have no representation of the Pakistan Association of Private Medical & Dental Institutions (PAMI) which repre-sents nearly 2/3rd of the Medical & Dental Colleges and about 55% of students studying Medicine & Dentistry in Pakistan. This is classical example of non-inclusiveness which is illegal according to the Equality Act 2010 and The Human Rights Act 1998. In Ghalib’s words:

Kindly look at the number of the Public Sector Medical & Dental Colleges (62/176), Pri-vate Sector Medical & Dental Colleges (114/176) and the number of students studying in Public Sector (8830/19220) and the number of students studying in Private Sector (10390/19220) colleges. Can anyone consider it fair not to include PAMI in decision making bodies?

2. Setting MDCAT at 60% last year and 65% this year, is putting illegal & irrational, unjustified, unreasonable, impractical, harsh and damaging, interna-tionally rejected, non scientific conditions, promoting the quacks and setting the contradicting standards in MDCAT marks scoring.

a. Why illegal and irrational? In a very similar case, the Supreme Court of India in February 2021, set aside its

order not to lower the minimum marks for admission to the Bachelor of Dental Surgery (BDS) course for 2020-2021 saying it suffers from the vices of illegality and irrationality.

A bench of Justices L N Rao and Krishna Murari held that the candidates belonging to the general category who have secured 40 percentile shall be eligible to be considered for admission in the first year BDS course for 2020-2021. It noted that large number of seats available for admission to the first-year BDS course during the current academic year for which the examinations were held on September 13, 2020.

b. Why Unjustified?Because there should be only one standard for admission in a medical and dental college as is the case in UK and USA. So in Pakistan, it is fine to keep 65% in FSc to set a mini-mum standard to apply for MDCAT. MDCAT itself should only be used for setting the merit. If a passing mark has to set, it should not be more than 33% so that practically only those students with more than 65% in FSc and a competitive score in MDCAT should be admitted. Moreover, since dental admissions start where the medical admis-sions stop, the minimum standard for applying to a dental college should be lower than it is for a medical college. This will ensure that a group of students will know that they are only eligible for admission in the dental college and will seek admissions in dental colleges.

c. Why Unreasonable?Because in the year before last, last student getting admission in a dental college has had MDCAT score of 26.5% (53/200) and in previous years even lower. Last year, when the PMC set the passing score of MDCAT to 60%, 70% of seats in the 12 private dental colleges of Sindh have remained vacant. This year, they have increased the passing marks of MDCAT to 65%. This will totally destroy most of the dental institutions of Sindh and also in other provinces.

d. Why Harsh and Damaging?Because only last year 452 students from Sindh remained waiting despite scoring larger numbers than those admitted in previous years, and despite the seats remaining vacant, the PMC is expressing its intention to increase the MDCAT passing score to 65%. This

will be so harsh and unkind to the students as well as institutions and those in threat of losing jobs should these institutions are closed and ultimately to the future patients.

e. Why Internationally Rejected?Both UKCAT (UCAT now) and MCAT in UK and USA have done away with asking the same questions that have been asked in their previous exams and instead for example UCAT assesses the applicants on1. Verbal Reasoning.2. Decision Making.3. Quantitative Reasoning.4. Abstract Reasoning.5. Situational Judgement.

The USA uses different tests for admissions in Medical (MCAT) and Dental (DAT) col-leges. The DAT is a dental education admission test for those interested in attending a dental education program. This dentistry test is designed to provide dental education programs with means to assess program applicants’ potential for success. The DAT consists of a battery of four tests on the following: Survey of the Natural Scienc-es, Perceptual Ability, Reading Comprehension, and Quantitative Reasoning. While MDCAT insists on reassessing the students on the same subjects that they have taken in FSc.

Moreover, as mentioned above, UCAT and MCAT are used to help in determination of merit without any pass/fail criterion, MDCAT is set to have a pass mark and that too very high and impractical. Basically, it is designed to destroy the Pakistani private insti-tutions and force the student to seek studies outside Pakistan.

f. Why Non-Scientific?There is a method of reviewing and changing the entrance tests in Dental & Medical schools. One cannot comprehend that how can someone simply presume that setting a higher level in MDCAT (which itself is flawed and changed long time ago by psycho-

metric testing in developed countries) will produce better graduates. If someone indeed wants to make such claims and change the practice, there is a scientific way of doing it. In September 2018, University of Newcastle produced a literature review of Best Practice in the Assessment of Competence for admission in Medical & Dental Schools. No such analysis has ever been done by the Pakistan Medical Commission before sud-denly deciding to set the MDCAT level of 60% for admissions in Dental Colleges.We have compared the results of university examination of various Dental Colleges and compared them with the results of these students in MDCAT. We have found that many students with lower MDCAT results produced better than their compatriot with higher MDCAT and those with higher marks in MDCAT actually struggled in the University examinations.

g. How is it promoting the quacks?There are around 40,000 non-qualified dental practitioners or quacks in Pakistan who are playing havoc with the lives of people as they have no or little concept of infection control and sterilization. As compared to dental quacks, there are only 19,539 qualified dental practitioners and 1,867 specialists in Pakistan. The dentist to population ratio in Pakistan is 1:1,305,811, whereas WHO recommends a dentist to population ratio of 1:75,000 for developing countries. It is quite obvious that such harsh rules of MDCAT will leave the seats vacant and the gap will be filled by even more quacks.

h. How does it set the contradicting standards?Due to pandemic, the education department has allowed many relaxations to the stu-dents appearing in pre medical FSc examination. While the PMC is tightening the nob around the neck of the aspiring students. One wonders why are these two standards in one country? When the education ministry thinks that these students are worthy of re-laxation, why the PMC thinks they deserve the stricter, harsher conditions?

3. NLE for fresh graduates is unconstitutional, illegal, unjustified and harsh condi-tion. The fresh graduates got registration from PMDC under Ordinance, 1962 and continued studies under their rules. Under the rules of PMDC, they were required to do their grad-uation from the university recognized by the said PMDC and then complete house job for one year. After that, they were entitled for license as registered Medical Practitioner without any further tests or examination.

The right to get license as registered Medical Practitioner without any test had accrued on their registration. The Medical and Dental Council Ordinance, 1962 has been re-pealed through Pakistan Medical Commission Act, 2020 (hereinafter called as act of 2020). This act has introduced “NLE”.

The repealing provision i.e. section 50 has made the repeal subject to section 6 of the general clauses act, 1897 which protects all the new doctors’ rights having accrued after registration with PMDC under the ordinance of 1962. Thus, their right to get registered as Medical practitioner without any licensing examination after graduation and house job. Even otherwise article 264 of the constitution of Islamic Republic of Pakistan, 1973 also protects their right. It even does not allow the legislature to take away that right by giving such defect to the new law because article 264 protects the right unless it is taken away by any other provision in the constitution. The text of the article is reproduced here under:

“Art. 264: Effect of repeal of laws. Where a law is repealed or is deemed to have been repealed, by under. Or by virtue of the constitution, the repeal shall not except as other-wise provided in the constitution…….a. Revive anything not in force or existing at the time at which the repeal takes effect; b. Affect the previous operation of the law or anything duly done or suffered under the

law;c. Affect any right, privilege, obligation or liability acquired, accrued or incurred under

the law; d. Affect any penalty, forfeiture or punishment incurred in respect of any offence com-

mitted against the law; or e. Affect any investigation legal proceeding or remedy in respect of any such right, priv-

ilege obligation, liability, penalty, forfeiture or punishment; and any such investigation, legal proceeding or remedy may be instituted, continued

or enforced, and any such penalty forfeiture or punishment may be imposed, as if the law had not been repealed.

Let us see the international practices in the health sector: At present, PLAB is taken by the International Medical Graduates wanting to prac-

tice in the UK. It is solely for IMGs. UK medical graduates do not need to take a national licensing examination. In 2019, the General Medical Council decided to change it with UK Medical Licensing Assessment (UKMLA). It will be introduced for UK and international graduates alike. However, they decided that it can only be applied for the graduates who took admission in UK Medical Schools knowing that they will need to take the UKMLA after graduation and not to the existing students who had no information of it while taking the admissions. Hence UKMLA will be necessary for those graduating in the academic year 2024-2025

4. The changes in the inspection criteria of colleges and hospitals are without any research/logical basis causing uncertainty and financial problems in the larger segment private colleges and hospitals.

For the recognition and inspection colleges and/or hospitals, no increase in require-ment should be allowed in building, faculty, instruments & equipment without: 1. proper research, 2. full discussion and agreement of the stakeholders and 3. explanation of why this change is necessary to improve the standards.

The recent regulations are simply asking the private medical & dental colleges to spend more than they earn. Would it be wrong to expect:• Only a body should bring the change that includes the proportional representa-

tion of the members form Private Medical & Dental Institutions (PAMI).• Every change should be backed by a thorough and detailed research and it should

be properly explained in documentary form. The representative bodies should discuss it and then present it’s suggestions in a written form.

• Overnight changes which have not gone through the process of research and dis-cussion, should be declared illegal.

5. A suggestion which will single handedly bring immense improvement in the standard of medical & dental education.

The government should start a scheme through the state bank and provide loans to the students who qualify for the admission in Private Medical & Dental Colleges of Paki-stan. We know that only 20-35% of students qualifying for admissions can afford the fees of Private Medical & Dental Colleges. Please note that these colleges spend substantially less amount (less than 50% of public sector colleges) on the education of each student.This loan will be the similar as given by the state bank scheme through the private banks for solar system and many other projects at an interest of 5%. Note that similar educa-tional schemes for University education are in operation in UK and many other devel-oped countries.

On one hand this scheme will mean education for all without any loss to the taxpayer. On the other hand, it will mean the end to corruption in a very few cases where claims have been made that the private colleges have been collecting donations. It will also mean large financial activity which will be good for banks and businesses in Pakistan. It should be in line with the repayment mortgage for 25 years.Many people worry that these loans may not be repaid. This is a fair observation but there is a simple solution. All such students who take loan should only be issued PMC registration for one year which will be renewed after the evidence that their monthly re-payment (perhaps direct debit from the salary) has continued for a year. Their travelling outside Pakistan may also be subject to full repayment of the loan.
