Appeal Revived In ‘Boys Don’t Cry’ Neb. CaseOMAHA, Neb. (AP) — Nebraska death-row inmate John Lotter
has filed documents to support the federal appeal of his convictionin the triple murder that inspired the 1999 film “Boys Don’t Cry.”
An appeal Lotter filed in U.S. District Court in May 2004 had beenon hold while he pursued an appeal in state courts. The NebraskaSupreme Court upheld Lotter’s conviction in September.
U.S. Magistrate Judge Cheryl Zwart recently reopened the feder-al appeal, and Lotter filed documents Monday that moves the caseforward.
Lotter has maintained since his arrest that he is innocent.He claims that, among other things, the state used a threat of
torture to coerce his friend Thomas Nissen into lying about themurder of Teena Brandon and two others in southeast Nebraska.
Lotter and Nissen were convicted of the 1993 murder ofBrandon, a 21-year-old who lived briefly as a man and dated theirfemale friend. They also were convicted of killing Lisa Lambert, 24,and Philip DeVine, 22, who witnessed Brandon’s death in the farm-house near Humboldt.
Brandon had reported being raped by the two men. A formerRichardson County sheriff was later criticized for his handling of therape charges and for failing to offer protective custody.
In a deal with prosecutors to avoid the death penalty, Nissen tes-tified against Lotter, saying he stabbed Brandon but that Lotter firedthe shots that killed the three.
Nissen was sentenced to life in prison.In July 2007, Nissen changed his story and said he, not Lotter, shot
all three.
Rape Suspect Escapes Custody In S.D.MARTIN (AP) — Authorities in south-central South Dakota are
looking for a rape suspect who escaped custody while en routefrom Winner to Martin.
A release from South Dakota’s Division of CriminalInvestigations says 24-year-old Dennis Bettelyoun escaped earlyTuesday while being transported from Winner’s city jail to theBennett County sheriff’s office in Martin.
Authorities have not said where along the 100-mile trip thatBettelyoun escaped.
The Division of Criminal Investigations refers calls to the sher-iff’s office. No one was available at the office to comment Tuesdayevening.
The Winner police department declined to release information.
1 Killed In Explosion, Fire In HastingsHASTINGS, Neb. (AP) — One person has died following an
explosion at a farmstead south of Hastings.Authorities have not released the name of the person killed in
the explosion and ensuing fire, which was reported about 2:30p.m. Tuesday.
The explosion happened in a garage, which was destroyed. Thefire also damaged two vehicles and a nearby building.
Brad Friesen of Henderson was working at Freeland Creekdevelopment, which is near the scene. He says he saw fireworksgoing off for several minutes.
The state fire marshal’s office is investigating.
Fire Sparks Aberdeen Bank EvacuationABERDEEN (AP) — Authorities say a downtown Aberdeen bank
was evacuated for about three hours on Monday after a fire brokeout on the fourth floor of the building.
Kevin VanMeter, battalion chief at Aberdeen Fire and Rescue,says workers were burning paint off the exterior of the buildingand didn’t notice when a fire started burning inside the DacotahBank.
Officials say most of the damage was on the fourth floor, whichwas unoccupied and used for storage.

LINCOLN, Neb. — In state governmentoffice buildings across Nebraska, thousandsof workers have received a motherly sugges-tion in the name of saving money: Clean upafter yourself.
Since the beginning of June, the state hasbeen taking out the trash just two days aweek instead of each workday in offices occu-pied by about 6,000 workers in Scottsbluff,North Platte, Lincoln and Omaha. If workerswant their trash emptied the rest of the week,they must do it themselves using large trashbins provided by the state.
There's less vacuuming of carpets, too,and windows won't be cleaned as often.
"I didn't realize it until I came in Mondayand the trash was not emptied," said JohnMcMahan, who works in the Nebraska StateOffice Building in Lincoln. "It probably makessense," he said of the decision by the stateDepartment of Administrative Services. Itmanages 10 or so office buildings in the statethat each houses workers from multiple stateagencies.
Carlos Castillo, director of the stateDepartment of Administrative Services, saysthe changes are expected to save about$500,000 a year.
State government is pinching pennies as ittries to weather its worse budget crisis inrecent memory. Lower-than-expected tax rev-enues forced Gov. Dave Heineman to call aspecial session in November. During the ses-sion, he and lawmakers closed a $334 millionbudget gap, primarily using across-the-boardcuts to state agencies.
During the regular legislative session thatended in April, lawmakers and Heinemanreduced the current two-year budget byanother $48 million, cutting agencies more.More cutting is expected when lawmakersmeet in January: Current estimates peg thebudget deficit for the two-year budget thatwill begin in July 2011 at roughly $670 million.
State government's most prominent officebuilding, the Nebraska Capitol, will also get abit mussed up to help save money.
Beginning in July, trash will be taken outthree times a week instead of five, and car-pets vacuumed twice weekly instead of five.Windows will also get cleaned less, accordingto Capitol Administrator Bob Ripley.
He said the changes should save about$90,000 next year. Some capitol renovationprojects will also be delayed.
Heaping trashing cans and dirty carpetsmay not be the only symptoms of budgetcuts in buildings run by Castillo's depart-ment.
Sensors that turn off lights when officesare empty may be installed and hot-airmachines will replace paper towels in bath-rooms.
But money isn't so tight that people willhave to pay by visiting offensive bathrooms.Castillo said they will continue to be cleaneddaily.
