BJP Accused of delegitimising 200 million Muslims of Indian citizenshipIndia’s parliament led by the right-wing Hindu nationalist Bharatiya Janata Party (BJP), has passed a bill which has been criticised as a violation of India’s constitution and the latest effort by Narendra Modi’s government to ‘delegitimise the country’s 200 million Muslims of their citizenship.

’The Citizenship Amendment Bill (CAB bill) provides right to remain for non-Muslim illegal immigrants from six religious minority communities: Hindu, Sikh, Buddhist, Jain, Parsi and Christian – should they prove that they are from Pakistan, Afghanistan or Bangladesh.

The bill amends the 64-year-old Indian Citizenship law, which currently prohibits illegal migrants from becoming Indian citizens, amending a provision which states a person must have lived in India or worked for the federal government for at least 11 years before they can apply for citizenship.

Under the new law, they will only have to live or work in India for six years to be eligible for citizenship by naturalisation.

In addition, people holding Overseas Citizen of India (OCI) cards – a status permitting a foreign individual of Indian origin to live and work in India indefinitely - can lose their status if they violate local laws for major and minor offences and violations.

Opponents of the bill say it is exclusionary and violates the secular principles enshrined in the constitution, insisting ‘faith cannot be made a condition of citizenship’.

Delhi-based lawyer Gautam Bhatia says that by dividing alleged migrants into Muslims and non-Muslims, the bill “explicitly and blatantly seeks to enshrine religious discrimination into law, contrary to our long-standing, secular constitutional ethos.”

The BJP government has defended the legislation as no more than a means to assist persecuted minority Hindus from neighbouring Muslim-majority countries.

Critics say that if it is genuinely aimed at protecting minorities, the bill should have included Muslim religious minorities who have faced persecution in their own countries -such as the Rohingyas in Myanmar, for example.

However, the government has gone to the Supreme Court and is seeking to deport Rohingya refugees from India.

Rahul Gandhi, the former head of the opposition Congress party, tweeted that the law was a “weapon of mass polarisation unleashed by fascists.”

Modi tried to reassure the public, saying on Twitter that the new law “does not affect any citizen of India of any religion.” And that “no Indian has anything to worry” about.

However, when a citizenship registry took place in Assam earlier this year it left 1.9 million people off a list of Indian citizens, prompting historian Mukul Kesavan to say the purpose of the bill is “the delegitimisation of Muslim citizenship”.

Nationwide protests against the new law began in the north-eastern state of Assam. Thousands of people took to the streets in the state’s biggest city, Guwahati as protests also escalated in West Bengal as Chief Minister, Mamata Banerjee vowed that the citizenship amendment act would be implemented “over my dead body”.

Police in many areas of the country have banned large gatherings in an attempt to stop protests. It follows weeks of demonstrations that have left many dead and prompted warnings from the UN over the excessive force deployed by the security forces.

Protesters also took to the streets in Kerala, another state that has said it will not allow the law to be introduced.

Anger also continued to grow within university campuses across the country, fuelled by a brutal police crackdown.

Police entered the Jamia Millia Islamia University (JMI) campus in New Delhi and detained more than 100 students, beating activists in the street and firing

teargas as nearby schools and offices.

Anti-riot police also subjected students marching at Aligarh Muslim University in Uttar Pradesh to alleged brutality, reportedly firing teargas into crowds and arresting dozens, whilst an internet block was also implemented in an attempt to quell the mounting unrest.

Iman Usmani, an 18-year-old undergraduate student at JMI, said police “pounced” on demonstrators.

“They fired teargas shells at us, before they resorted to caning us ruthlessly. They did not even spare the girls,” Usmani said.

Sociology student Mohammad Faisal was also on the JMI campus on Sunday. “The policemen entered the library and mosque inside our campus and beat up the students mercilessly who were studying or offering prayer,” said Faisal.

Protests have spread to university campuses in the cities of Mumbai, Hyderabad, Chennai, Bengaluru, Chandigarh and Lucknow.

Among those arrested included prominent Hindu’s including Ramachandra Guha, one of India’s most well-known historians who wrote a book on Gandhi.

Guha, 61, was forcibly detained as he was partaking in an interview during protests in Bangalore.

“I have been detained for holding a poster of Gandhi and speaking about the constitution to the press. I am protesting non-violently, but look they are stopping us,” said Guha, as he was shown being violently dragged by three police officers in footage broadcast across Indian news channels.

The UN secretary general’s spokesman, Stéphane Dujarric expressed concern over “the violence and alleged use of excessive force by security forces that we’ve seen that has been taking place.”

Scholars and students from the Indian Institute of Management, Bangalore, and over 625 academics and writers released a statement expressing

caution against the divisive and discriminatory changes..

The statement read: “The CAB goes against the fundamental founding principle of our republic — equality before law without regard to religious beliefs. For the first time, there is an attempt to exclude Muslims from the possibility of amnesty and citizenship, for no other reason than their religion.”

A statement by the United Ulama of South Africa (UUCSA) also lambasted the enactment of the bill.

Secretary General, Moulana Yusuf Patel said in a statement: “On face value, the law merely paves the way for persecuted religious minorities from Pakistan, Afghanistan and Bangladesh to fast-track claims to Indian citizenship. But by pointedly excluding Islam from faiths whose followers will receive special consideration —the government signals that Muslim migrants aren’t welcome in India.

“Muslim history in India dates back to the 6th century when Arab merchants interacted with Indians and the first known Arab Muslims settled on the Indian coast in the last part of the 7th century. Muhammad bin Qasim was the first Muslim general to enter the Indo- Pak subcontinent in 705.

“Maulana Abul Kalam Azad had the distinction of serving as the President of the Congress at the most critical junctures of the nation’s history.

“In the forefront of resistance against the British was Maulana Husain Ahmad Madani who displayed extraordinary patriotic zeal in the defence of India.”

Analysts believe it will be unlikely that the BJP will scrap the law. “Modi still remains, head and shoulders, the most popular politician in India,” Milan Vaishnav, director and senior fellow of the South Asia Program in the Carnegie Endowment for International Peace, told CNN.

The foreign community “is waiting and watching to see how the (law) will be implemented,” Vaishnav added.

“Are you going to see large numbers of Muslims detained or lose their citizenship? It is a game of wait and see.”

Understanding the Islamic perspective on organ donationA special one-off event exploring issues around organ donation within Islam and changes in the law was held at the Al-Hikmah Centre on Tuesday the 10th of December.

IMWS, organised the event as an opportunity for Muslims in the local community to learn more about and understand the Islamic perspective on organ donation.

IMWS Chair, DR. Imtiyaz Patel told Paigaam: “We wanted to hold the event to help raise awareness and advise the local Muslim community about the Islamic viewpoint in relation to organ donation and recent changes in the law.”

The latest NHSBT statistics show that around 35 percent of the total number of patients on the waiting list for a kidney transplant were from BAME communities, with waiting times around 2 and a half years.

Speakers invited included: Islamic Scholar and Doctor Moulana Rafaqat Rashid, who presented the theological arguments for and against organ donation within Islam and Angela Ditchfield, an award winning specialist organ donation nurse, who works as the diversity lead nurse for organ donation and transplantation, engaging with black, Asian and minority ethnic communities.

Also in attendance to speak to the audience was Shahid Farid, an award winning consultant Liver Transplant Surgeon, (one of only two in the U.K), who was recently awarded the prestigious Calne and Williams Gold Medal for highlighting the need for expertise in organ retrieval and its role in improving transplant outcomes.

Dr/Moulana Rafaqat Ali pointed to a number of hadiths and primary Islamic sources, along with a recently published fatwa (religious edict) around organ donation by Mufti Zubair Butt in order to bring about some clarity in relation to a plethora of opinions and issues centred around the Islamic position on whether

Muslims can donate their organs after death.

He also cited his very own dissertation, ‘Organ transplantation an Islamic perspective To Human Bodily Dignity And Property In The Body, which was revised in 2018.

He told Paigaam: Events like this are important where experts or a group of people who are well grounded in the knowledge of organ transplantation – its fiqh, its processes and its pros and cons, address a Muslim audience.

“They are happy to answer their queries and concerns in an amicable way, so that people make informed choices and not choices based on myths, poor knowledge or misunderstandings.

“This is not about promoting but about informing and stating things are they are.”

Paigaam also spoke to an individual who had to wait an excruciating 23 years for a kidney transplant and also whilst waiting, won changes to Islamic guidance in relation to allow organ donation

Amjid Ali, from Bristol, started a campaign for changes to be implemented in 2013 and is the NHS lead on the Transplantation in Islam project.

In September 2013, Mr Ali led a conference with 56 scholars, organisations, imams and chaplains about the issue, two years after his own life-saving operation.

Mufti Mohammed Zubair Butt issued the fatwa, and Mr. Ali said he hoped the move would help to “serve as a catalyst” for change.

He told Paigaam: “Many Muslims feel (organ donation) is not in line with their faith.”

“They needed an authoritative religious figure to be able to give them the satisfaction that they’ve researched the subject in such a way

that covers all of the key points around the permissibility of organ donation and Mufti Butt then did his research and issued the fatwa.”

“I for one, don’t want anyone of any background to go through the journey I’ve been through with kidney failure.

“It’s that aspiration that’s guided me and driven me over the last six years. Quite simply, without organ donors there can be no organ transplantation. So, for me, it is my sincere hope that the updated religious edict on ‘Transplantation and Organ Donation in Islam’ and the educational seminars being run by IMWS and other community organisations will help British Muslims make an informed decision about becoming an organ donor, and to also consider other forms of donation such as blood and stem cell donation.”

When asked about the idiosyncrasies in relation to organ donation Dr Shahid Farid told Paigaam: “As it stands people from the Black and Asian community are highly and disproportionately represented in the waiting list and the need for organ transplantation compared to the number of donors from the same community. As a result our community waits longer for life saving transplants.

“Without organ donation in our community more people may die unnecessarily. The new opt out proposal that comes into place next year is not a barrier to transplantation in Islam but instead an opportunity to get more information and make an informed decision on your choices.”

When asked the same question, Angela Ditchfield said the aim of the programme was to enter into positive dialogue with the community: “The organ donation awareness event organised by IMWS was a fantastic event which gave the local community opportunity to find out the right information about organ donation, dispelling myths opening positive discussions. It was an honour to be invited to this great community event.”

IMWS donate gifts to elderly hospital patients

Kind-hearted staff from the Indian Muslim Welfare Society took time out to visit elderly patients at Dewsbury Hospital, bearing a number of gifts.

IMWS Vice Chair, Mohammed Laher was accompanied by General Manager, Nadeem Raja and Charity Lead, Munir Daji.

The visiting members of IMWS were accompanied by Hafeeza Nurgat from Dewsbury Hospital, who along with her father, Ilyas Norat, who is a serving as an elected member of the IMWS Executive Committee, helped organise the visit.

The visitors were afforded an opportunity to converse with the elderly patients on Ward 8 and 9 and pass on a number of gifts.

The IMWS delegation were also introduced to staff, who kindly accepted chocolates on behalf of the community for their dedication and hard work.

Commenting on the visit, IMWS Vice Chair, Mohammed Laher told Paigaam: “We are grateful to Dewsbury Hospital for allowing us to visit and pass on gifts to elderly patients.

“As we all now, the winter can be rather difficult for our elders, therefore it is imperative, something we see as our duty, that we share our best wishes, warm feelings and kind gestures with senior patients, safe in the knowledge that so that our community would like to share our good fortune with those who may be going through a period of ill health and suffering.

“We at IMWS are ready and happy to help our elderly community regardless of their faith and background.”

Munir Daji, who helped organise the event said: “These sort of visits where warmth, closeness, togetherness and joy is shared between people on special occasions, are vital

not only to bring a smile on patient’s faces, but also to help strengthen community and race relations and build a unified community based on core values of care and compassion.

“My I also take this opportunity to thank Ilyas Norat and his daughter Hafeeza, who purchased the presents, organised the logistics of the visit and then went on to pack the gift sets and packed them rather nicely, with the help of the entire Norat family.”

Hope and Fear: General Election Fall out

For the first time in almost a decade Britain has a government that has a majority that is big enough to implement its election manifesto and survive five years in power.

However, what will a Boris Johnson led government actually mean for our nation?

Get Brexit Done

The most pressing priority for the prime minister is to deliver his central election pledge to “get Brexit done”. With a majority of around 80 seats there is now no question that Britain will leave the EU on January 31.

As expected, MPs have backed Prime Minister Boris Johnson’s plan for the UK to leave the EU on 31 January.

They voted 358 to 234 - a majority of 124 - in favour of the EU (Withdrawal Agreement) Bill, which now goes on to further scrutiny in Parliament.

The bill would also ban an extension of the transition period - during which the UK is out of the EU but follows many of its rules - past 2020.

The PM said the country was now “one step closer to getting Brexit done”.

Brexit was originally due to take place on 29 March 2019. Two years after then Prime Minister Theresa May triggered Article 50 - the formal process to leave.

Jeremy Corbyn‘s sons take to Twitter to slam ‘poisonous attacks’ against the Labour leader after Labour’s General Election defeat.

Jeremy Corbyn‘s three sons expressed their pride in their father despite the 70-year-old leading the Labour Party to its worst election loss since the 1930’s.

Mr Corbyn’s son, Seb released a statement on Twitter, on behalf of himself and his brothers, Tommy and Benjamin, explaining why they believe their dad paid the price for being ‘honest, humble and good-natured in the poisonous world of politics’.

They also lavished praise on their father for his his lifetime record of championing the ‘less fortunate’ and for producing the ‘most wonderful manifesto the country has ever seen’, whilst insisting Mr Corbyn suffered the ‘most despicable attacks, filled with hatred’ during his 36 years as an MP.

The statement, posted by Tommy, continued: ‘He took on an entire establishment. This meant the attacks from all sides intensified and became even more poisonous while he was leader. ‘We’ve never known a politician to be smeared and vilified so much.

After winning his Islington North seat, Mr Corbyn said he would not be leading the Labour party into the next General Election.

Muslim Council of Britain and Baroness Sayeeda Warsi call on Boris Johnson to reassure British Muslims

Whilst the Conservative Party celebrated their victory, Harun Khan, Secretary General of the MCB, insisted, there was a ‘palpable sense of fear’ among Muslim communities around the UK.

He said: “We entered the election campaign period with long standing concerns about bigotry in our politics and our governing party. Now we worry that Islamophobia is ‘oven-ready’ for government. ‘Mr Johnson has been entrusted with huge power, and we pray it is exercised responsibly for all Britons.”

The warning from MCB came as

ramp up efforts to bring communities together.

He said: “We understand that the Prime Minister insists that he is a One Nation Tory. We earnestly hope that is the case and urge him to lead from the centre and engage with all communities. ‘We must all redouble our efforts to heal the country and bring communities together.”

Paula Sherriff loses Dewsbury seat as Tracy Brabin wins once again in Batley and Spen

In a closely fought campaign, Paula Sherriff lost her Dewsbury seat to Mark Eastwood of the Conservative Party.

Mr Eastwood’s took the seat by overturning Ms Sherriff’s 3,321 majority, winning by 1,561 votes as he secured 26,179 in total with Ms Sherriff polling 24,618.

Mr Eastwood said he would like to see a great deal more positivity in the vicinity of his home town. He said: “There has been quite a lot of unpleasantness in politics and maybe Brexit has contributed to that. I would like to see politics a bit nicer in the future.”

Commenting on her defeat, Miss Sherriff shared a statement on Twitter, stating she felt privileged to have served as an MP for Dewsbury, as she acknowledged: “Alas 2019 was not meant to be”.

In Batley and Spen, Tracy Brabin secured her seat for Labour, albeit with a reduced majority of 3,525 as she secured 22,594 votes whilst Tory Candidate, Mark Brooks secured 19,069.

Ms Brabin said she had run an honest and fair campaign. However, she called for unity in the vicinity.

“When we allow ourselves to spin off into our tribes we risk polarising our community further,” said Brabin.

“I never thought growing up in Howden Clough that I’d be stood here as my home town’s MP having won a third election in four years. Words cannot describe how pleased I am to represent the community that made me the woman I am today.”

Commander in Chief of 1857 Revolt: Bahadur Shah ZafarBy Mohammed Mulla

Recently I had a good fortune of visiting some of my relatives who live in Yangon (formerly known as Rangoon, Burma), Myanmar.

From the history lesson at school and my natural interest in Mughal reign in India I could not resist the opportunity to visit the tomb of one of the last Mughal emperors Bahadur Shah Zafar.

It was indeed a chance encounter and bliss to offer my respect to the late emperor.

Late Bahadur Shah Zafar was a Moghul Emperor during the 1857 rebellion (sometime also known as “the Sepoy mutiny or first battle of Indian Independence”) against the rule of the British East India Company which functioned as a sovereign power on behalf of the British Crown.

He was unanimously chosen as the overall leader and commander in chief by the Indian kings, princes, and sepoys, during the rebellion.

The mutineers fought audaciously but the British won the battle. Bahdur Shah Zafar was tried and charged on four counts of aiding and abetting, starting a war against the British, and assuming sovereignty.

He was spared death sentence but was exiled to Yangon where he was accompanied by his two surviving sons, wife and other family members. He later died there at the age of 87 years on 17th November 1862.

The exact location of his grave was unknown until 1991 when the construction of a memorial hall started. It was found during this phase and restored by the custodians of the site.

The tomb itself is well preserved and has a mausoleum built round it.

The walls in the room where the mausoleum is housed has been decorated with various photographs, with a well known poem in Urdu inscribed on ceramic walls, a nice touch as the late emperor himself was a renowned poet of his time.

A brief resume of the emperor in both English and Burmese languages is also on display for all to see.

His late wife and daughters are also buried on the same site.

There is also a functioning mosque where five times prayers are offered.

During my visit I could not help thinking of the sacrifice and important contribution made by the Muslims in the Indian independence struggle and felt enormously proud.

But at the same time I could not help a feeling of melancholy at the thought of what the current right wing Indian government is doing to divide the community in India and abroad and proactively wiping out the outstanding contribution made by the Indian Muslims in the development of India.

The new Citizenship Amendment Bill, escalating attacks on Muslims in India, love Jihad, targeted religious lynching etc. are examples of the hatred they are trying to spread not just in India but amongst the Indian diasporas in the UK as well the US.

However hard they try to wipe out the Muslim history they can not destroy it in its entirety, as the legacy of the likes of late emperor will be present in many places and Yangon is such an example.

IMWS Members Dinner: A night of reflectionThe IMWS Members Dinner was deemed a fundraising success after hundreds of guests attended the event, hosted at the Al Hikmah Centre on Saturday the 14th of September.

Those who attended were treated to a lavish meal as they met up with friends, old and new, whilst guest speakers who entertained the members consisted of Moulana Abubaker Divan, Iqbal Bhana, Leader of Kirklees Council, Cllr Shabbir Pandor and Yunus Lunat.

However, the most poigant address of the evening was that of IMWS Chair - Dr. Imtiyaz Patel who evoked memories of yesteryear, with a trip down memory lane, explaining how historically, it was very interesting to see how the society came into existence.

He said: “Often we don’t make shukur of what we have.

“We have a very rich history over the past six decades of the activities we undertake: burial, youth, women’s, paigaam, Islamic and of course the charity we undertake (Locally nationally and international).”

Dr. Imtiyaz also praised the efforts of ‘our forefathers’ who strived to establish the most basic of facilities.

“We are talking of 1957 when our population consisted of a handful of Muslims from India. I would imagine about 50 men, hardly any under women folk and I would imagine a handful of under 16’s. There was no

masjid then, namaaz was prayed in homes, Jumma and Eid namaz in local civic halls.

“Indeed our first masjid was built in 1961, possibly the first in the North East and sixth in UK.”

The Chair urged all present to pray for those who are no longer with us.

“When making duas always remember our forefathers and the sacrificed they made,- 6-8 men living in two up two down terracehouse working 12 hours shifts with basic amenities, yet still carrying out their Islamic duties.

“I remember coming across minutes from a meeting in the early 60’s where they listed 10 aims, one of which is to hold future meetings on chairs around a table but interestingly having a library ( which we still needs to establish).”

“The aims and objectives of the society have changed over the past 62 years as has the name; the biggest change was n 1984 when autonomy was given to the six affiliated areas for self governing autonomy.

“As I mentioned earlier we have not only this facilities but we have 8 of which five purposes built masajids, maktaab which in total gives taalim to approx 1500 children.

However, Mr Patel lamented the lack of Muslim/Gujarati voices in the corridors of power across in Westminster and beyond.

“We need to ensure our voices are heard in the corridors of power and for that we need to have representation in places such as house of lords and Westminster. (17 muslims MP – none gujurati mslim, 17 hindus).

“We need rep also in council, the police service the CPS, and I would even say in the armed forces.”

IMWS Vice Chair, Mohammed Laher, who helped organise the event agreed that it was great to derive considerable pleasure in participating in such a unique event.

“I am delighted with the way the evening unfolded,” Mr Laher told Paigaam.

“On behalf of the IMWS Management Committee, I would like to extend our heart-felt thanks to all our guests for your support in making this event such a great success.

“The IMWS dinner is now firmly established as one of the leading networking events in the regional calendar, and it was great to see so many of you in the luxurious setting of the Al Hikmah Centre.

“Again, my sincere thanks for choosing to be a part of the IMWS Dinner, and we are hoping that we will see you again next year.”

Time for action not apathy

The law, which has already been passed will come into force from September 2020. Statutory Guidance for RSHE published by the Department of Education (DfE) in July 2019, outlines what schools need to cover from September 2020.

Concerned Parents around the country have raised serious concerns about RSHE and the way it may be taught. Parents have raised concerns that some schools in Kirklees are not taking in account age appropriateness and faith sensitivities of the parents and community.

Under the new regulations schools must;

1) Consult parents and the community.

2) Ensure that the curriculum is age appropriate.

3) Ensure teaching is sensitive to faith and belief.

4) Ensure equality and inclusivity.

Know your facts

● Parents will not be able to withdraw their child from any aspect of Relationships Education or Health Education.

● Parents will be able to withdraw their child from any or all aspects of Sex Education, other than those which are part of the science curriculum, up to and until three terms before the age 15.

● Schools are required by law to consult parents and the community as they develop their policies for RSE subjects.

● All schools must work closely with parents when planning and delivering these subjects.

Attend consultation meetings and respond to written consultation

Parents must engage with schools and attend consultation to ensure that their voices are heard.

● Schools should ensure that parents know what will be taught and when.

● What resources, if any, the schools will be utilising? Note that primary schools do not have to use any books or external resources, for Relationship Education.

● How will the school ensure teaching is age-appropriate and sensitive to pupils’ faith and belief?

Parents should;

● Be prepared to review RSHE curriculum and policy.

● Raise concerns in respectful manner and should not be afraid to ask questions.

● Understand the difference between education, promotion and indoctrination.

What the community is doing - available help and advice

Kirklees Parents and Community

Alliance (KPCA) and some Christian clergy are your local organisation consisting of Ulama, Alimas, professional brothers and sisters.

We are actively working with parents and Kirklees Council. We are aiming to ensure that Kirklees schools hold a meaningful and thorough consultation with parents taking into account their faith sensitivities and age appropriateness. KPCA is also working with key schools to develop its own curriculum which will be ready shortly.

Celebrating 25 years of Zain BikhaWorld famous nasheed artist, Zain Bikha was back in UK last month whilst taking part in a 14 city tour across England, Scotland, Wales and Ireland.

The principal nasheed artist, who is an also ambassador for Islamic Relief has been singing nasheeds for the last 25 years.

As part of a collaboration between IMWS and Islamic Relief, Zain performed to a capacity crowd at the Kabana Banqueting suite in Dewsbury, with the event entitled ‘Winter Road Trip.’

The assembled crowd were treated to nasheeds such as Zamilooni, Mountains Of Makkah and many more

well known tracks Zain is renowned for.

Funds were raised on the night for the orphans 121 program, with children around the world benefitting.

Islamic Relief is the largest Muslim charity in the UK and the only Muslim charity who is part of DEC ( Disasters Emergency Committee )

Dr Imtiyaz Patel, Chair of IMWS spoke about the history of IMWS whilst the organisation’s treasurer, Rafiq Dabhad, spoke about the charity work IMWS been doing in partnership with Islamic Relief.

Munir Daji, IMWS Charity Project Coordinator, thanked Islamic Relief for

arranging the event along with brother Ateeq and Shiraz for all their hard work in making the event a success.

Gambia’s leading lawyer has told the International Court of Justice (ICJ) that Aung San Suu Kyi, whose official title is the state counsellor of Myanmar, cannot be trusted to hold Myanmar soldiers accountable for alleged atrocities against the Rohingya minority, and recommended measures to stop the violence immediately.

The claim that Myanmar’s military carried out mass murder, rape and destruction of Rohingya Muslim communities was brought by the west African state, Gambia.

The country’s leading lawyer Paul Reichler along with attorney general and justice minister, Abubacarr Marie Tambadou, insisted the ICJ also known as the ‘world court’ should impose protective “provisional measures” to prevent further killings and genocide of the Rohingya people in Myanmar.

Nobel Peace Prize winner, Suu Kyi, responded to the accusation by rejecting it as an “incomplete and misleading factual picture of the situation,” insisting the violence had been triggered by terrorist attacks from the Arakan Rohingya Salvation Army.

Leading her country’s defence, she said told the court that the military-led “clearance operation” in western Rakhine State was a response to coordinated Rohingya attacks against dozens of police stations in August 2017.

She insisted Myanmar “actively investigates, prosecutes and punishes soldiers and officers that are accused of wrongdoing” and argued the tribunal, also known as the World Court, should not have jurisdiction.

She said that even if there had been violations of humanitarian law during what she described as an internal conflict, they did not rise to the level of genocide and were not covered by the 1948 convention.

However, Reichler said Myanmar had not even tried during the hearings to deny most of the accusations of extreme violence made against its military, known officially as the Tatmadaw, nor of the mass deportation of Rohingya following a 2017 crackdown.

Statements from Myanmar that it was taking action to prosecute soldiers accused of wrongdoing were incredible, he said.

“How can anyone possibly expect the Tatmadaw to hold itself accountable for genocidal acts against the Rohingya, when six of its top generals including the commander-in-chief, Senior General Min Aung Hlaing, have all been accused of genocide by the UN fact-finding mission and recommended for criminal prosecution,” he told the panel of 17 judges.

He was referring to the findings of United Nations investigators who in an August 2018 report said the Myanmar

military had carried out killings and mass rape with “genocidal intent” in the 2017 operation.

Antonia Mulvey, Director of the human rights organisation Legal Action Worldwide, served on the UN’s fact-finding mission on Myanmar.

Interviews she carried out with Rohingya refugees who had been raped were read out as evidence during the ICJ hearing. “Aung San Suu Kyi and her lawyers were silent about the use of sexual violence,” Mulvey said. “They will never be able to justify widespread rapes as part of a military campaign (against terrorists).”

Gambia, a member of the Organisation of Islamic Cooperation, instructed their legal team to outline graphic testimony from the UN report at the first day of hearings.

The court were shown images of murdered Rohingya men in a grave in the village of Inn Din along with images of tanks on the street

The massacre was exposed by Reuters reporters Kyaw Soe Oo and Wa Lone. And although the journalistic world rewarded them with a Pulitzer Prize; Myanmar handed them more than 500 days in prison.

The court has not set a date for a decision on provisional measures; however, one could be made in January.

IMWS trustees meet ICWA committee membersAs part of the IMWS strategy, a number of IMWS trustees met with key committee members of ICWA on 28th November 2019.

The main objective of these meeting with all seven affiliated areas is to improve communication, working collaboratively and tackling the issues faced by the shared members.

The meeting was very cordial and mutually beneficial. Many issues were discussed at the meeting which included the followings:

There has been good communication and cooperation between the Society

and ICWA on many issues, which was acknowledged mutually. There have been good attendances from the representatives at the IMWS Executive committee meetings, which was also acknowledged.

Many issues were discussed including salaat time tables and how these can be delivered on time to the area mosques, need for common madressa syllabus and how it will have positive effect on Islamic teaching in madressa, the need for prayer facility in Batley cemetery, exploring group purchasing of utilities, insurance, stationery etc.,

The Islamic Nikah service has been

registered by the area mosques through IMWS.

However, recently some area mosques and other independent mosques have been offering this service too. It was suggested that IMWS call a meeting of all affiliated masjids to draw up a common policy on this subject.

As new areas and mosques are coming into existence a concern was expressed by some who were present as these new entities have different form of membership regulations and constitution.

Women benefit from IMWS car maintenance workshop for beginnersAs the cold weather closes in, it is vital to know that your car is safe and problem free, thus ensuring it is up to the challenges that winter brings.

Therefore, the Al Hikmah centre opened up its doors to a number of women who braved the cold weather in order to attend a very well attended winter car maintenance workshop.

A plethora of women were taught about a number of maintenance tips that are essential for this time of year.

The cold weather can be tough on batteries as it reduces the amount of power it produces, therefore participants were advised to invest in a good quality battery and told not keep headlights and radio on before leaving the car, thus ensuring the battery will not run down.

In addition, attendees were told to take the car out for a drive once a week to keep the battery charged and the engine running smoothly.

Women were also taught how to

jump start a vehicle, how to check and maintain engine oil and fluid levels, about why it is so important to maintain a tyre’s pressure as road safety is a must, especially when it is snowing, or it is icy, even tips such as keep your number plate clean or you might be fined and so much more.

She said: “It was great to see that the session was very well attended and that so many women learned a great deal about car maintenance.

“Everyone who attended learned a great deal from the session, with many questions asked time and time again.

“Road safety is absolutely essential and I for one am glad that by partaking, many women can take the information on board, for their benefit and also to pass on to their friends and family.

“There was so many basic things that they although the participants did not know, now I am sure that they will be confident enough to carry out most of the basic yet important checks. I would like to also thank everyone who attended and took the time to learn some vital skills.”

Duty Land Tax Dodge Backfires

When a couple wished to avoid paying Stamp Duty Land Tax (SDLT) on the purchase of a property, they hit on what looked to them like a great idea. Instead of buying the property outright, they paid for it in two stages…a deposit, plus the purchase of an annuity to be assigned to the seller.

The annuity paid annually was very small, but the seller had the right to redeem it for a lump sum (£726,750), which corresponded to the expected balance due based on the market value of the property at the time of the sale.

Tax law relating to the assignment of annuities places a charge on the value of the first 12 (only) years’ payments under the annuity.

The net effect of the arrangement, or so the couple thought, was that the house purchase did not carry a charge to SDLT, which would otherwise have been more than £30,000.

HM Revenue and Customs (HMRC) challenged the tax treatment of the sale and persuaded the First-tier Tribunal that the payment on completion from the annuity was made at the direction of the purchasers and, in any event, anti-avoidance legislation would prevent the scheme from being effective. The whole of the consideration therefore fell into charge, not just the 12 annual annuity payments.

HMRC’s SDLT assessments and all but one of the related penalty notices were confirmed.

Refused Planning Permission? You Are Entitled to Know the Reason Why

A fundamental principle of good government is that anyone on the receiving end of an adverse decision is entitled to know why it was made. In a case on point, the High Court came to the aid of a housing developer who could only speculate as to the reason why it had been refused a grant of planning permission.

The developer wished to build 203 new homes in the countryside, close to a market town. The local authority refused planning permission despite advice from one of its planning officers that it should be granted. The developer appealed to a government planning inspector who, following a public inquiry, recommended to the Secretary of State for Housing, Communities and Local Government that the proposal should be approved.

In refusing to grant permission, however, the Secretary of State disagreed with his inspector’s view that the council’s assertion that it had in hand a five-year supply of deliverable housing land was over-optimistic. He estimated that the council could deliver 10,000-10,500 new homes, sufficient to last up to 6.2 years

and comfortably exceeding the target set by the National Planning Policy Framework.

Upholding the developer’s challenge to that decision, the Court noted that by the time it was reached – more than two years after the original planning application – not even the council was asserting that it could demonstrate a five-year supply of housing land. The developer’s plea that the supply fell well short of that target was backed up by an expert report from planning consultants.

The Secretary of State had given no explanation for the figures he had adopted and the means by which he had arrived at them was a matter of pure speculation.

His reasoning was entirely undisclosed and the developer had suffered prejudice, in that it had been left with no understanding of why its figures had been rejected. The Secretary of State’s decision was quashed and he was directed to reconsider the planning application in the light of the Court’s ruling.

Knowledge - Employer Defeats Claim Thanks to Reasonableness Test

Under Section 15 of the Equality Act 2010, an employer’s duty to make reasonable adjustments for an employee who is disabled is only triggered if the employer has actual knowledge or could reasonably be expected to know (has ‘constructive knowledge’) of the disability. To defeat a claim that it had constructive knowled

ge of an employee’s disability, the employer must show that it was unreasonable for it to be expected to know that the employee suffered an impediment to their physical or mental health or that the impairment had a substantial and long-term effect.

In cases where the employee has a poor attendance record, the explanations given for their absences can be important when determining the question of reasonableness. In deciding whether or not an employer had constructive knowledge of an employee’s disability, an Employment Tribunal (ET) must reach a decision based on the individual facts of the case.

In A Limited v Z, the claimant was dismissed from her job as a part-time finance coordinator, working for an organisation that brings together contractors and trade associations in the construction industry, because of her poor attendance and timekeeping.

It was accepted at the ET that she was disabled for the purpose of the Act because she suffered from mental and psychiatric impairments – namely stress, depression, low mood and schizophrenia.

She had made no mention of her conditions when her employer had inquired about her sickness absence in her previous job, however, and had replied ‘no’ to questions asking if she had any form of disability on a questionnaire she was asked to fill in shortly after taking up her post.

When asked about her frequent absences from work, she had not disclosed her conditions to her employer, but gave alternative reasons for her health-related absences, deliberately omitting any reference to her psychiatric conditions.

Whilst her employer had conceded that the claimant was a disabled person for the purposes of the Act, the issue was whether or not it had actual knowledge at the time of her employment that she had any form of mental illness or mental impairment.

The ET found that although her employer was aware that she experienced stress and distress on occasions, on account of difficult personal and family circumstances, the weight of the evidence ‘pointed to these symptoms being unremarkable and unsurprising reactions to problems in her life’.

However, the ET concluded that, by the time of her dismissal, her employer should have enquired further into her wellbeing and this failure prevented it from successfully defending a claim that it ought to have known that she had a disability.

On appeal, the Employment Appeal Tribunal found that the ET had failed to apply the correct test. It had sought to answer the question of what the employer might reasonably have been expected to do in terms of enquiring after the claimant’s wellbeing, given that people with mental health conditions are often discouragedfrom disclosing them because such problems often carry a stigma.

However, that did not answer the question of what the employer might reasonably be expected to know having made those enquiries. The ET’s later findings provided the answer.

It had expressed the view that the claimant would have continued to suppress information regarding her mental health problems and would not have agreed to an occupational health referral or other medical examination that might have revealed her psychiatric history.

The inevitable conclusion, therefore, was that taking such steps would not have made any difference and the employer could not reasonably have known of the claimant’s disability.

Mount Cricket Club Presentation Evening a great success alongside a very special guest: ICC Cricket World Cup TrophyMount Cricket Club recently held its 43rd annual community presentation evening at the Al-Hikmah Centre, Batley.

The club was established by two enthusiastic cricketers, our very own Mr Hanif Mayet and the late Farid Karolia together with help and support from their family and friends.

Since then the club has progressed through various Yorkshire leagues and now plays its senior cricket in the Halifax Cricket League (HCL) winning many trophies, friends and supporters along the way in England and increasingly abroad.

In attendance were members of the community including men, women, boys and girls together with a whole host of community groups, voluntary & statutory organisation, public / private businesses & enterprises and local schools.

The audience were treated to having the opportunity to see and take selfies with the official ICC Cricket World Cup Trophy which the England team dramatically won against New Zealand in the summer.

Bringing the Trophy was not an easy task and special thanks go to the following: Mohammed Arif, George Camm & Daniel Kemp England & Wales Cricket Board (ECB), Gulfraz Riaz National Asian Cricket Council (NACC), Andrew Watson Yorkshire Cricket Board, Nasa Hussain Yorkshire Cricket Foundation who physically brought the Trophy on the night and to Abdul A Ravat from the Club for working with all parties and making it happen.

The key note speakers reflected on the club’s growing community footprint and approach to forging effective partnerships and using the power of cricket to bring individuals, groups, communities and faiths together. They included:

Another key highlight of the evening was giving the ‘Community Champion Awards’ to two exceptional individuals for their service and bravery. They are:

Stan Gostellow – for his devotion to local grassroots cricket. Stan. Has been associated with the Dewsbury & District League for 56 years as a player and serving on its Board where he was the Treasurer for over 40 years. Mount CC is indebted to Stan for his support when we joined in 1975/76 and the subsequent 25 years playing in the league.

Ismail Patel – a truly inspirational individual when in his late teen’s tragedy struck which left him in a coma for 3 weeks fighting for his life and the medics practically given all hope up of any hope. But his fighting spirit has shone through and despite the fact that he has paralysis on the left side of his body and can only walk aided with a walking stick this remarkable young man has taken up running and completed over 10, 10k runs in places like Bradford, Sheffield, Blackburn, York, Bolton and Dewsbury. Ismail has bigger targets and hopes to complete the London Marathon and raise money for local causes.

The audience heard of the work the club is engaged with in promoting inclusivity and to open cricket opportunities to all sections of the community including girls, women, children with disabilities and for the over 50s.

Hanif Mayet, Chairman of Mount CC began the proceedings and said: “Another amazing presentation evening to celebrate our fantastic achievements, sincere thanks to everyone who continues to support us. The club continues to be as determined as ever to provide and encourage participation opportunities into sport especially for women, girls and children from the age of 5 onwards and for those with disability. But the struggles continue in our quest to secure much needed improvement to our facilities and pavilion and meet the ever growing needs of our community and we are committed in continuing to serve with limited resources and basic facilities that we currently have”.

“It was an excellent event attended by hundreds of local people. I was amazed that Mount CC managed to get the actual World Cup Trophy into Batley, this shows the dedication and commitment everyone has in this club, it was a historic moment. I was also amazed that the 2nd XI won the Premier Division at the first time of asking. The club has got bags of talent and this talent can be further nurtured by having modern premises and facilities. I was very pleased that everyone who spoke gave their firm commitment to look at how funding options could be aligned in making this dream a reality and I too will work to achieve this in my capacity at Kirklees Council”.
