In exercise of the powers conferred by clause by clause (d) of Sub. Section (1) of Section 10 of the Industrial Disputes Act, 1947, the Government of Goa. by its order No. 28/46/91-LAB dated 20th December, 1991 has referred the following issue for adjudication by this Tribunal:

"Whether the action of the management of Mis Alfa Tiles, Corlim Industrial Estate, Ilhas-Goa, in terminating the services of their workman Shri Dincar Kalangutkar with. effec;:t from 28th January, 1990 'is legal and justified. ., ...

If not, to what relief the workman is entitled?"

2. On receipt of this reference, a casc at No. lT/3/92 was registered and notices were issued to both the parties. In response to the said

notice Party I ~ Shri Dinkar Kaiangurkar appeared in this court and filed his statement of claim (Exb. 3) wherein he has averred !hus:

Party I (hereinafter called as the 'workman") was appointed as a clerk by Party II-MIs Alfa Tiles, Corlim, Goa (hereinafter called as the 'Employer') since 15th April, 1980. After onc year he was appointed as supervisor. On 18th of September, 1988 all the workmen of party II decided to form an Union and accordingly they joined Goa Trade & Commercial Workers"Union. Party I was elected.as the Vice President of the Local Committee. The fact that the workmen had joined the Union was duly communicated to the employer. Thereafter the Union submitted a Charter of Demands pursuant to which the Employer started issuing several show cause notices making allegation of mis-conduct on the part of the workman. Ultimately, on 2nd Jarr., 1990 the Employer issued a notice to the present worker alleging acts­of various mis-conducts. The· present worker was not allowed to resume to his duties and thus, the employer terminated his services without there being any justifiable grounds. Hence, the workman raised a dispute before the Labour Commissioner but as there was no settlement a failure report was sent to the Government in pursuance of which. the Government made the above referred reference. The workman therefore prays that the action taken by the Employer is

• illegal and unjustitIed and hence he should be reinstated with full back wages.

3. Party II-Mis Alfa Tiles. was duly represented by Adv. M. S. Bandodkar. However, he did not me· any written statement and in­stead it was submitted by the learned representatives of both the parties that there was every possibility of an amicable. settlement and hence the case was adjourned from time to time. Ultimately, on 22nd July, 1992. the parties tiled a deed of settlement (Exb. 5) which has been duly verified. I have gone through the terms of settlement and I have found that the same is certainly in the interest of the workman and hence I accede to the request made by the parties that a consent award be passed in terms of this settlement (Exb. 5). I, therefore, pass the following order.

ORDER

In view of the settlement at Exb. 5, the following consent award is hereby passed:

J. The management of MIs Alfa Tiles agrees to pay Shri D. Kalangut~ar a sum of Rs. 12,500/- (Rupees Twelve Thousand Five Hundred Only) towards fuJI an.d tInal settlement of his legal dues which includes gratuity, retrenchment compensation, Leave salary, Bonus and Notice pay and unpaid wages.

2. The management agrees to issue a bonafide service certificate to Shri Dinkar Kalangutkar within 15 days from the signing of this settlement. •

3. The management agrees to effect the said payment as per Clause (l) pf the settlement in two instalments i.e. 50% of the amount on 10-7~992 and 50% of the amount on 20-7-1992.

4. In view of the aforesaid clauses of agreement the workman agrees that his dispute with the Employer pertaining to the termi­nation of services raised before the Industrial Tribunal, bearing No. IT/3/92 is conclusively settled; and further that he has no claim of whatsoever nature including monetory claim ancYor any claim of reinstatement or re-employment against MIs Alfa Tiles, Corlim, I1has-Goa.

No order as to. costs. Inform the Government accordingly.

Whereas. Shri Shaikh Rafik, Physical Education Teacher working at Dr. T. B. Cunha Govt. Hr. Sec. School, Panaji and under the control of the Directorate of Sports & Youth Affairs, Panaji has absented himself from duties unauthorisedly from 1-9-94 till date. Two tele­grams dated 6-4-98 and 27-S-98 was sent to his residence directing hi~ to report to duties immediately failing which action deemed fit wopld be taken against him. Subsequently a Momorandum dated 6-~-98 was again sent to his residence by Registered NO dit:ecting him to !report for duties by 12-8-98, but the said memorandum was returned with remarks by the Postal authorities. "Partly left."

Whereas inquiries were made through Police Authorities who have reported that after conducting due inquiries regarding the whereabouts of Shri Shaikh Rafik and as per the say of his household family members Shri Rafik has gone to Bombay about some four months back in <?rder to proceed abroad and has since not returned. That further as per information furnished by his neighbour Shri Shaikh Rafik is abroad for the last 3 to 4 years. The address where he is working abroad is not made available by his family members.

Whereas as' per Government instructions a Govt. servant desiring to leave the Country is required to have permission to do so from Competent Authority and also to get leave sanctioned before leaving the Country. The said Shri Shaikh Rafik has failed to observe the above Government instructions.

Whereas as per provision of Rule 19(ii) of C.C.S. (C.C.A.) Rules, 1965, where the Disciplinary Authority is satisfied for reasons to recorded in writing that it is not reasonably practicably to· hold an inquiry in the manner provided under the Rule 14 to Rule 18 of the c.C.S. (C.C.A.) R~les. the Disciplinary Authority after considering the circumstances..of the case may impose penalty without conducting any inquiry.

And whereas, I am satisfied on the basis of the report received

fro~ the Police Authorities, that the whereabouts of Shri Shaikh Rafik

is not known and that it is not reasonably practicable to hold an

inqutry in the manner provided under Rule 14 to Rule 18 of the C.C.S:

(C.C.A.) Rules, 1965.

Now therefore, in exercise of the powers conferred by Rule 19(ii)

of the C.C.S. (C.C.A.) Rules, 1965 the undersigned hereby removes

the said Shri Shaikh Rafik. Physical Education Teacher from Govt.

Service with immediate effect.
