INTRODUCTIONFrom i t s inception i n 1909, t h e National Association f o r t h e A d v a n c e m e n t o f Colored People (NAACP) h a d a s i t s principal objective t h e e n f o r c e m e n t o f t h e Fourteenth a n d Fifteenth Amendments i n order t o secure

constitutional rights f o r black Americans. F o r more than t w o decades, h o w e v e r , t h e attention o f t h e organization w a s devoted primarily t o t h e struggle

against m o b rule a n d lynching, disfranchisement, a n d residential s e g r e g a t i o n ordinances. Occasionally t h e association and/or i t s local branches

became involved in battles against school segregation, principally innorthern towns and cities that attempted to establish segregated schoolsystems in place of previously integrated systems as a result of the growingblack migration from the South.

As the NAACP charted its legal strategy for the 1930s it decided to shift

i t s major emphasis t o t h e problem o f educational segregation a n d d i s c r i m i n a t i o n i n t h e South. T h e inauguration o f this campaign w a s facilitated b y a

grant from the American Fund for Public Service (generally known as theGarland fund). This grant enabled the NAACP to establish a full-time paidlegal counsel for the first time in 1936. The man selected for the post, andwho set the basic tactics for the litigation, was the prominent black attorneyand dean of Howard University Law School, Charles H. Houston. Two yearslater his former student, Thurgood Marshall, took over the helm of theNAACP's legal department and the struggle against Jim Crow education.

The NAACP's strategy in the educational equality cases was two-fold.One campaign was aimed at southern state universities, demanding theadmission of blacks into those graduate and professional programs (such aslaw, medicine, and journalism) for which no provision had been made at theblack state colleges. The other campaign was aimed at demandingequalization of public school education at the elementary and secondarylevels-equalization of school facilities, school-term length, and especially of

teachers' salaries. A frontal attack o n school segregation p e r s e w a s p o s t p o n e d , partly because i t w a s felt that such a direct approach would fail i n t h e

courts and partly because the NAACP operated on the theory that a trulyequal dual-school system would be so expensive that it would collapseunder its own weight. (This approach, of course, did not take into accounteither the urban school segregation that would remain because of

ghettoization and housing segregation, or the amount of money whitesoutherners proved to be prepared to spend to maintain the dual-schoolsystem.)

Closely related to the legal strategy of the education cases were otherimportant NAACP objectives. These included the building of local NAACP

branch membership b y appealing t o black school teachers-then u n d o u b t e d l y t h e largest group o f black professionals i n America and, a s such,

better able to contribute dues and articulate voices to the association.Another important objective involved the efforts of Houston and thenational staff to develop a network of impeccably professional blackattorneys to wage the educational and other civil rights legal campaigns incoordination with local branches and the national office.

As the documents in this collection demonstrate, what in retrospectappears to have been a program of litigation that was shrewdly planned fromthe very start was in actuality a struggle characterized by a spirit ofexperimentation and flexibility. The most successful thrust of the strategy atfirst was the salary equalization cases. Then, in 1949, following theNAACP's success in Shelley v. Kramer (the 1948 Supreme Court decision

declaring restrictive covenants t o maintain housing segregation u n c o n s t i t u t i o n a l ) a n d t h e declaration against segregation made b y President

Truman's Committee on Civil Rights, the NAACP and its attorneys decidedto shift their focus from the inequities in southern school systems to anassault on the very principle of school segregation itself. By 1950 theassociation had succeeded in persuading the Supreme Court to declaresegregation in advanced professional training, such as law, inherentlyunequal. This landmark was established in two cases, McLaurin v. Board ofRegents a n d Sweatt v . Painter, which a r e fully documented i n this c o l l e c t i o n .

I t i s a t this point that t h e record i n t h e legal files o f t h e National A s s o c i a t i o n f o r t h e Advancement o f Colored People a t t h e Library o f Congress

becomes thin. By 1950 its tax-exempt legal arm, the NAACP Legal and

Educational Fund, Inc., h a d (because o f Internal Revenue Service r e g u l a t i o n s ) become a completely independent organization, a n d t h e files o f

subsequent litigation are to be found in its archives. But the NAACPcampaign for educational equality had set the stage for the series of casesthat culminated in the famous 1954 Brown decision in which the SupremeCourt struck down the "separate but equal" rationale for racial segregation inAmerican society.

A portion of the newly discovered material belonging to Group II, SeriesB, Legal File has not been included on this microfilm edition, however.These materials are approximately 1 1/2 feet of legal documents for the case

o f Brown v . Board o f Education o f Topeka, Kansas. They have been a r c h i v e d i n Boxes ll-B-139-141, a n d these boxes a r e accordingly absent from

the Reel Index of this user's guide under the subseries, "Schools" of theLegal File.

These materials were omitted because they were the only case forwhich the legal files in the area of educational equality extend beyond 1950,and because they are incomplete of themselves. The material pertains onlyto the Topeka, Kansas case and to none of the collateral cases that weregrouped in the Brown litigation. Moreover, none of the background

SCOPE AND CONTENT NOTELegal File

The Campaign for Educational Equality, 1940-1950, consists of threegeneral areas of legal activity: schools, teachers' salaries, and universities.School cases generally sought the equalization of facilities amongsegregated schools or the desegregation of school systems. Teachers'salary cases challenged the existence of separate and inferior pay scales forblack educators. University admission cases concentrated on the admissionof qualified black scholars to the state-funded graduate schools of their

home states. Files typically document t h e development, litigation, r e s o l u t i o n , a n d aftermath o f attempts b y black Americans t o obtain educational

equality. Documents include correspondence, memoranda, reports, t r a n s c r i p t s , a n d legal briefs.

Spearheading the legal effort was Thurgood Marshall as SpecialCounsel to the NAACP Legal Defense and Educational Fund. Providingadvice and assistance were William H. Hastie, Charles H. Houston, BenjaminKaplan, Leon A. Ransom, and Spottswood W. Robinson III. AssistantSpecial Counsels and Legal Research Assistants in the NAACP officesincluded Charles Anderson, Robert L. Carter, Edward R. Dudley, Milton R.Konwitz, Cassandra Maxwell, Constance Baker Motley, Marian Wynn Perry,Frank D. Reeves, Prentice Thomas, and Franklin H. Williams. RegionalSpecial Counsel for the Southwest Division beginning in 1948 was U.Simpson Tate. In addition, the efforts of many local attorneys representing

both t h e branch a n d national offices o f t h e Association a r e fully d o c u m e n t e d . O f particular importance among these were Oliver W . Hill o f

Richmond, Sidney Redmond of St. Louis, A. Maceo Smith of Dallas, andA.P. Tureaud of New Orleans.

In the early litigation for educational equality, the NAACP's object was

n o t t o question t h e premise o f segregated education. Rather, t h e A s s o c i a t i o n sought t o force equalization o f educational facilities. However, i n

1946, local attorneys representing the NAACP in the educational campaignmet with Thurgood Marshall in Atlanta, Georgia, to review all cases pendingin the South. This Special Lawyers Conference and other developments inthe immediate post-war era document a shift in policy by the NAACP. No

longer content t o fight f o r separate b u t equal a s a step toward d e s e g r e g a t i o n , t h e association increasingly fought t h e very concept o f s e g r e g a t i o n in a n y form.

Among the frequent correspondents were newspaper editors (seeparticularly the Schools File-Appeal for Funds on Reel 1, frame 0066).Prominent editors of the Negro press in these years included RoscoeDunjee of the Black Dispatch, Louis Martin of the Chicago Defender, CarlMurphy of the Afro-American, C.B. Powell of the New York AmsterdamNews, John Sengstacke of the Chicago Defender, and P.B. Young of theNorfolk Journal and Guide. These leaders of the black press were vital to thepublic relations effort associated with the educational campaign. Oliver W.Harrington and Henry Lee Moon as directors of Public Relations receivedmemoranda and briefings on the details of the campaign.

Walter White and Roy Wilkins, as Executive Secretary and AssistantSecretary of the NAACP, respectively, provided logistical support andserved as liaisons, between various elements of the public, officials, staff,and the Board of Directors of the association. Local and state branches
