MOM Technical Notes for Learning Service Providers: PART I

1 Interpretation

In this set of Technical Notes, unless the context otherwise requires:

“Approved Facilitator” means a facilitator approved by a Certification Body to conduct a specific course for a Learning Service Provider in accordance with the ISO 29990:2010 LSP certification process. “Authorities” refers to the Government of Singapore c/o the Ministry of Manpower (MOM), Singapore Accreditation Council (SAC) and/or Certification Bodies accredited by SAC.

“Auditor” means any authorised persons, agents or representatives of the Certification Bodies or MOM carrying out an audit function. “ATP” means an Accredited Training Provider accredited by MOM to conduct a particular course in a particular language. “Commercial School” means a premise used for the purpose of teaching, training or imparting of knowledge or skill, which includes a tuition centre, language school, speech and drama school, child development centre or play school, but does not include a primary school, secondary school, junior college, vocational and technical institution, polytechnic or university. “Certification Body” (CB) means a company accredited by SAC to certify Learning Service Providers (LSPs). “Facilitator” refers to a person who works with a Learner to assist him with learning. “Government of Singapore” refers to the Government of the Republic of Singapore as a whole including all its ministries, government departments and organs of state. “Industrial Training” means training or teaching on the use of or involving the use of industrial machinery, industrial systems, industrial equipment or industrial components. “Learner” means any individual who attends any course conducted by the LSP, which has been approved by a Certification Body. “LSP” means a learning service provider certified by a Certification Body, and accredited by the SAC to conduct WSH course(s). “MOM” means the Ministry of Manpower, a ministry under the Government of the Republic of Singapore

“Requirements” refer to the terms and conditions as well as course specific requirements stated in the MOM Technical Notes. “SSIC-GT” means Shipyard Safety Instruction Course for Workers (General Trade) “SSSC” means Shipyard Supervisors Safety Course. “Training Venue” means any training venue which has been certified by a Certification Body

2. Requirements 2.1 A LSP shall comply with the Requirements set out in the MOM

Technical Notes. 2.2 MOM reserves the rights to revise the MOM Technical Notes and the

Requirements as and when it deems it necessary to do so.

3. Conduct of Courses i.e. Theory and Practical Training / Assessment

3.1 The LSP shall only conduct WSH courses for which certification had been obtained from a SAC accredited CB and only when it has a valid certification certificate. The conduct of such courses shall be in compliance with the Technical Notes. The LSP shall ensure the integrity of the system of administering and conducting courses.

3.2 The LSP shall ensure that for any practical training and or

assessment, which involves the use of a scaffold, the following must be observed:

(a) There shall be no more than one Learner and one Approved

Facilitator /assessor on the scaffold;

(b) The training area used for the training or assessment must:

Have sufficient space for all Learners to clearly observe and learn (visual and audio) from the Approved Facilitator, even when they are waiting for their turn to take part in the practical training and or assessment

Be more than 2 times the width of the scaffold

(c) A Learner must be accompanied by an Approved Facilitator (during training) or an assessor (during assessment) when training or assessment is conducted either on the lower or upper deck of the scaffold.

4. Certification

4.1 The LSP shall renew its certification prior to the expiry of its existing certificate in order for the LSP to continue to conduct any course which extends beyond such expiry date.

4.2 The LSP applying for a renewal of its certification shall submit its application at least (3) months before the expiry of the certificate. The LSP shall not conduct any course upon expiry of the certificate until official notification of its renewal approval by the CB has been given.

5. Training Venue

5.1 Unless prior approval has been granted by the CB, which had certified

its WSH courses, each LSP shall maintain and conduct its WSH course at its primary Training Venue. In addition, the LSP shall ensure that the following are not shared with any other LSP:

(a) their approved Training Venue/s; and

(b) Any other equipment or loads, which are used for the conduct of

the WSH course. 5.2 In the event, where the LSP wishes to conduct its WSH theory

course(s) at a venue, other than the approved Training Venue, the LSP must inform the CB, which had certified its WSH course(s) at the approved Training Venue/s, of its intent to effect such a change, and it must also demonstrate to the CB that:

(a) It has an approved Training Venue at the registered address;

(b) That the proposed venue is conducive for learning; and

(c) That there are no safety and health concerns in relation to the

proposed venue/s.

The LSP may conduct its WSH theory course(s) at a venue other than the approved Training Venue/s only after obtaining the CB’s approval.

5.3 To avoid doubt, the requirement stated in paragraph 5.2 shall apply to

a LSP whether or not the use of a venue is intended for a single use or a period of continuous usage.

5.4 Where the CB has been granted approval to conduct the WSH theory

course(s) at an alternate venue, the LSP must ensure that:

a) All training and assessment records are kept by the LSP, for courses conducted, at the alternate venue. Such records shall include the following documents:

i. Photographs of the alternate venue; ii. Photographs of the WSH theory course(s) being conducted

at the alternate venue; iii. Layout plan of the alternate venue; and iv. Leasing documents;

b) The records mentioned in sub-paragraph 5.4(a) above, are

continually updated;

c) The alternate venue is only used for the conduct of WSH theory course(s). No practical training/assessment shall be allowed at the alternate venue, unless approval has been granted by the Authorities; and

d) The alternate venue is not used by another LSP or WSH approved training provider

5.5 The LSP must ensure that all Training Venues (including alternate

venues) have been approved by the Urban Redevelopment Authority (URA) or the Housing & Development Board (“HDB”), either as a Commercial School (theory based only) or for Industrial Training (theory and practical), before it applies to be certified by the CB.

Note: Tenancy agreement (e.g. from JTC Corporation or other

Developers) does not constitute a URA approval. Only correspondence with letterheads bearing the office of the relevant government authorities granting the approval shall be recognised.

5.6 Paragraph 5.5 will not apply where the LSP only intends to use the

venue once for theory lesson. 5.7 The LSP is to note that a CB’s approval of any practical training

venue is in relation to the safe condition and adequacy of the training facilities and equipment. The LSP shall comply with all relevant legislations including but not limited to legislations involving land use, building, fire and safety.

6. Training Facilities and Equipment

6.1 The LSP shall provide all the necessary training facilities and

equipment to carry out the training. Such training facilities and equipment shall include, but are not limited to, the items listed in Annex A. The sharing of training equipment or venue by two or more LSPs is strictly prohibited.

6.2 The LSP shall ensure proper management of the classrooms used for

training and assessment. This includes proper seating and writing facilities for example, writing desks must be reasonably and comfortably spaced for the purpose of conducting an assessment. The design and maintenance of the facilities shall account for the safety, sound insulation, ventilation, ergonomics and cleanliness, so as to create an environment that is conducive* for teaching and learning. The LSP shall also ensure adequate and clean sanitary facilities are provided for use by the Learners at all times.

Note*: For practical training, a training area is considered to be conducive for

teaching and learning when there is sufficient space for all Learners to clearly observe and learn (visual and audio) from the Approved Facilitator and fellow Learners when waiting for their turn to participate in the practical training or assessment. See Para 3.2.

7. Approved LSP Facilitator

7.1 Only Approved Facilitator(s), registered by the LSP and approved by

a CB for the WSH course(s) certified, shall be allowed to conduct the course(s). The Approved Facilitator shall only conduct the WSH course in the language(s) he/she has been approved to instruct on.

7.2 The LSP shall maintain an updated register of the Approved Facilitators for all the LSP certified WSH courses.

7.3 Approved Facilitator(s) shall conduct the WSH course in a

professional and ethical manner and be competent in the course delivery. Failure to demonstrate competency shall render the Approved Facilitator liable for removal from the LSP(s) by the Authorities.

7.4 With effect from 11 January 2011, all Approved Facilitators listed in

the LSP applications are required to attain the Advanced Certificate in Training and Assessment (ACTA) and the respective Workplace Safety & Health (WSH) Professional qualifications (refer to Para 7.5)

7.5 Any Facilitator applying to teach any worker level course in LSP must

be certified by Skills Future Singapore’s (SSG) Advanced Certificate in WSH (Level B).

7.6 All Facilitators conducting any supervisor level and above course

must be certified in Specialist Diploma in WSH (Level C) by Skills Future Singapore, or equivalent i.e. Safety Officer Training Course (SOTC) with a pass in Risk Management Test.

7.7 For each WSH course approved by the CB, the LSP must have at

least:

a. 1 full time Principal/Director; b. 1 full time WSH Approved Facilitator for each WSH course1; and c. 2 approved full time/associate Facilitators for each of the

language, which the LSP has been approved to teach for the course.

7.8 The full time WSH Approved Facilitator referred to in paragraph 7.7 b,

cannot be a full time/associate Approved Facilitator with any other LSP(s).

7.9 The LSP shall notify the CB, in writing, to remove any Approved

Facilitator from the LSP’s records once any Approved Facilitator is no longer engaged by the LSP, be it full time or associate Approved Facilitator. The Director/Principal shall be fully responsible to ensure this.

8. Approved Facilitator to Learner Ratio for Certified Courses 8.1 LSPs shall comply with the Approved Facilitator-to-Learner ratio as

listed in the table below, unless otherwise stated in the MOM Technical Notes Part II

9. Course Materials

9.1 With effect from 1 January 2016, all LSPs shall submit all relevant

course materials to the CB for certification and audit. 9.2 The LSP shall be responsible to include the date of the last revision in

the course materials, for reference purpose. The LSP shall ensure that the course materials meet the requirements documented in the respective MOM’s Technical Notes Part II. The LSP shall retain a copy of all the versions of the course materials used by the LSP during the certification period. Such documents shall be readily available during the annual audit conducted by the CB or as required by the Authorities.

9.3 Approved course materials are to be revised / updated at least once

every two (2) years. The LSP shall maintain proper documentation whenever the course materials are revised / updated.

9.4 The LSP shall be fully responsible to ensure the LSP does not infringe

any patent, design, and copyright or intellectual property rights in the use of the course materials.

10. Course Information

10.1 The LSP shall make all general course information available to all

course Learners and the general public from the onset. General course information shall include but are not limited to the course title and outline, entry requirements, course pass mark and criteria, course fees, appeal fees (if applicable) and government subsidies, if applicable, certificate issuance policy, LSP contact details, training venue, Approved Facilitator(s) details and the option to attend the “Assessment Only Pathway” (AOP) if applicable. All policies relating to fees refund as well as course cancellation or postponement, shall also be clearly documented and be made available to all the course Learners and the general public.

10.2 Where any adjustment is made to course information and in particular

to, but not limited to, fees, CBs shall be notified by the LSP at least one (1) month in advance.

10.3 From time to time, the Authorities may request from LSPs information

on the course and assessment fees. LSPs are to ensure that the information given to the Authorities are accurate and updated.

11. Course Entry Requirements

11.1 The LSP shall ensure that each Learner meets the stipulated

requirements in the respective course MOM’s Technical Notes, including language proficiency, during enrolment.

12. Assessment Requirements

12.1 The LSP shall be responsible for the proper conduct of any assessment and for ensuring a robust system is in place to prevent any irregularity or misconduct that may occur prior, during and after the conduct of the assessment. The LSP shall be accountable for the assessments and related activities, which include but are not limited to the following:

(a) The LSP is to ensure each Learner meets the minimum course

requirements before attempting the assessment. This includes but is not limited to, the minimum course attendance requirement. Unless otherwise stated in the MOM’s Technical Notes Part II of the specific course, the general attendance requirement for a course that is more than one (1) day is 75% for the theory section and 100% attendance for all practical training and assessment sessions. Attendance requirement for all one (1) day course shall be maintained at 100%.

(b) The LSP shall ensure that each Learner attempts the

assessment in the language which he/she was registered for. (c) Format and duration of the assessment shall adhere strictly to

the MOM’s Technical Notes Part II.

(d) Conduct the assessment using at least two (2) different sets of the latest assessment questions for all WSH courses.

(e) All assessment sets shall be clean and free of any markings or

answers. (f) Learners re-sitting the assessments at the same LSP shall be

given a different set of assessment questions from the last assessment taken by the Learner.

(g) The assessment questions shall be revised at least once every

two (2) years. The LSP shall include the date in which the assessment sets were last revised.

(h) The LSP shall retain copies of the following for CB’s verification

and audit purposes:

For examinable/tested courses – copies of the assessment sets, Learners’ answer scripts and records of results; and

For non-examinable/non-tested courses – copies of the deliverables for the course, as specified under the MOM’s Technical Notes Part II

(i) The LSP shall ensure and enforce strict confidentiality and

security of all assessment related materials. The LSP shall not reproduce and/or disseminate any assessment questions obtained from the Authorities to any third party.

(j) The LSP shall document, maintain and account for all assessment papers at all times.

(k) The LSP shall dispose the excess and/or expired assessment

papers as soon as possible or no later than one month from the date of assessment. There shall be a proper disposal system for all the excess or unwanted assessment question sets and these question sets must be properly accounted for by the LSP at all times. An example of a proper disposal of the assessment question papers is by shredding.

(l) With effect from 1 Jan 2017, all WSH course assessment

results shall be uploaded to MOM/WSHC’s Training Records System (TRS). All Training Providers are required to upload the WSH course assessment results to MOM/WSHC no later than 5 calendar days from the end of each WSH course assessment.

12.2 The LSP shall ensure each Learner attends no more than 8 training

hours per day. Training hours exclude break durations. 12.3 The LSP shall comply with the passing mark stipulated in the

Technical Notes Part II. 12.4 The LSP shall comply with the passing mark stipulated in the table

below, unless otherwise stipulated in the Technical Notes Part II (course specific).

12.5 MOM reserves the rights to adjust the passing mark, when deemed

necessary.

13. Conduct of Assessment 13.1 The LSP shall verify the identity of each Learner before the Learner is

allowed to take the assessment. 13.2 Unless otherwise permitted by the Authorities or specified in the

specific WSH course’s Technical Notes Part II, Learners who fail any WSH course assessment shall be required to recourse before being allowed to retake the assessment.

13.3 The assessment shall be invigilated by an authorised employee of the

LSP who is not the Approved Facilitator for the course under assessment. At least one invigilator shall be present to invigilate the theory assessment session at all times. For practical assessment, the assessment shall be taken by assessor(s) knowledgeable in the course contents and the Requirements, but who was not the Approved Facilitator for the particular course under assessment.

13.4 For all work at height courses involving practical training and

assessment, the Learner shall be physically accompanied by an Approved Facilitator (during training) or an assessor (during assessment) at all times, i.e. at both the lower and upper levels of the scaffold structure[2]. During the assessment, the Approved Facilitator is not allowed to assist the Learner. The Approved Facilitator may, however, coach the learner who has failed in 3 or less number of stations, to prepare him for a re-attempt of the stations he had failed in on the same day of the assessment.

13.5 The time and duration for each assessment shall be communicated

clearly to Learners before the commencement of the assessment. The invigilator/assessor shall also communicate to the Learners that anyone caught acting inappropriately, engaging in any dishonest acts which include cheating and/or plagiarism shall be severely dealt with.

13.6 The LSP shall develop guidelines for invigilators and assessors to

ensure that the invigilators and assessors are familiar with the training centre’s operations, course assessment and pass criteria. The guidelines shall also include a code of conduct for the appointed invigilators and assessors i.e. expectations and requirements of an invigilator/assessor. Examples of such expectations include the honesty and integrity of the invigilator/assessor during the conduct of the assessment and to report instances of irregularities or misconduct to the LSP.

14. Dishonesty in Assessment

14.1 An act of dishonesty is deemed to have taken place during the assessment under the following circumstances:

(a) Communication by word of mouth or by other means during the

conduct of the assessment that is not authorised by the invigilator/assessor; or

(b) Possession of any materials during the assessment that is not

authorised by the invigilator/assessor; or

(c) Any act by the LSP Management including the Approved Facilitator, invigilator and or assessor that compromises the integrity of the assessment system.

14.2 The LSP shall ensure that no acts of misconduct, dishonesty,

cheating or plagiarism occur during the assessment. Any Learner who engages in such acts shall be deemed to have failed the assessment.

footage, without physically accompanying the learner on the scaffold structure.

14.3 Any LSP who contravenes the terms and conditions in the Technical Notes will be subjected to punitive actions.

15. Absence from Assessment

15.1 A Learner is considered to be absent from an assessment with valid reasons if he/she has:

(a) Obtained a medical certificate from a medical practitioner

registered under the Medical Registration Act (Cap. 174), and has presented such medical certificate to the LSP within 48 hours of his absence; or

(b) Obtained other acceptable documentary evidence supporting

his absence and has presented such documentary evidence to the LSP within 48 hours of his absence.

15.2 A LSP may choose to allow a Learner, who absents himself from an

assessment with valid reasons, to re-sit the assessment. 15.3 A Learner who absents himself from an assessment without valid

reasons shall be deemed to have failed the course.

16. Certificate/Safety Pass of Successful Completion (where applicable)

16.1 A certificate and/or safety pass of successful completion of a course shall only be issued to the Learner who has successfully completed the course and passed the assessment.

16.2 The certificate/safety pass shall be issued to the Learner or his

employer no later than one (1) month from the date of completion of the final assessment.

16.3 The certificate/safety pass issued for the successful completion of the

course shall indicate the validity period of the certificate/safety pass, where relevant*.

Note: Where the course has no validity period, a ‘NIL’ is to be reflected. 16.4 Safety Pass Information: The LSP’s contact and other relevant

information shall be printed on the safety pass. A photograph of the Learner shall be placed at the front of the safety pass.

16.5 All LSPs shall adhere to the standard template provided by MOM with

regard to the design of the safety pass/card and the Certificate of Successful Completion of the course. The standard template can be found on the WSHC website at www.wshc.sg or at Annex C of this document.

16.6 The LSP shall maintain documentary records and be accountable for

the following:

(a) All issued certificates / safety passes (b) All certificates prepared but not issued

16.7 The LSP shall also ensure that a proper disposal system is in place for all certificates/safety passes prepared but not issued. All such documentary records shall be made available by the LSP during inspection or audit.

16.8 Any re-issuance or replacement of any certificate/safety pass shall be

clearly indicated on the certificate/safety pass. The LSP shall maintain documentary records of all the re-issued or replaced certificates/safety passes.

17. Course Evaluation and Feedback

17.1 The LSP shall conduct an end-of-course evaluation for every WSH

course conducted after the completion of the theory and or practical assessment. Each Learner shall be given an evaluation form for evaluation purposes. All Learners shall evaluate the course contents, course duration, course assessment, the Approved Facilitator(s) and assessors for each course conducted. The LSP shall ensure all the returns by the Learner (inclusive of nil entry) shall be properly accounted for and made available for audit purpose. The forms shall be kept for at least 2 years from the date of evaluation.

17.2 The course content, presentation and Approved Facilitators are to be

rated on a scale of 1 to 5 as follows: “Excellent” (very much above expectation, rating 5), “Very Good” (above expectation, rating 4), “Satisfactory” (up to expectation, rating 3), “Fair” (below expectation, rating 2) or “Poor” (significantly below expectation, rating 1). Learners shall also be allowed to give written comments and / or free-text feedback. The LSP shall not coach Learners on the ratings and/or feedback to give when completing the evaluation form in order to influence the evaluation outcomes.

17.3 The LSP shall keep and maintain proper records of all evaluations

and feedback received from the Learners. The LSP shall monitor the evaluation and feedback closely. The LSP shall ensure that action is taken to address the Learner’s evaluation below the rating of 3. The LSP shall maintain documentary records of such actions taken.

18. Statistical Updates and Performance Indicators

18.1 The Authorities may request the LSP to submit statistical updates

including, but not limited to registration, timeliness, course runs and number of course Learners.

18.2 The LSP shall maintain all training records, performance indicators on

the Approved Facilitator-to-Learner ratio, candidacy pass rates and course evaluation satisfaction ratings at the site where the training is conducted. The LSP shall furnish all documents, information, materials and articles relating to statistics update and performance indicators to the Authorities when requested.

19. Inspections, Investigations and Audits 19.1 The LSP shall give its full support and cooperation to the Authorities

conducting inspections, investigations and/or audits on the LSP from time to time.

19.2 The LSP shall make available all relevant documents, information,

materials and articles to the Auditor(s) during the said inspections, investigations and or audits.

19.3 In the event of a breach or non-compliance of any of the

Requirements, the LSP shall implement the necessary corrective actions within the stipulated timeline. Notwithstanding, the Authorities reserves the right to cancel or suspend the LSPs’ certification in the event of a breach of the Requirements

19.4 The LSP agrees that the Authorities shall be allowed to retain any

information, document or materials that are deemed relevant to the audit, inspection and/or investigation.

20. Certification under ISO 29990:2010

20.1 As part of the conditions / pre-requisites for an LSP to be approved,

the LSP must have obtained the ISO 29990 certification from a SAC accredited CB.

20.2 Upon successful certification by a CB, LSP shall, in writing, update

MOM’s Licensing Branch to terminate its ATP status for the said course that had been certified under ISO 29990:2010 immediately, if applicable.

21. Retention Period for Documents and Records

21.1 Unless otherwise specified, all documents and records shall be retained for a minimum of 2 (two) years from the date of creation.

21.2 The LSP shall ensure all relevant & updated documents are properly

maintained at the Training Venue. Relevant and updated documents include, but are not limited to, the MOM Technical Notes Parts I & II, LSP’s training Standard Operating Procedures (“SOP”), Approved Facilitators’ Guide and any other relevant and appropriate documents for the conduct of the audit/inspection/investigation.

22. System Requirements

22.1 The LSP shall comply with the computer hardware and software

requirements stipulated by the Authorities from time to time, including the purchase of new computer hardware and software, if necessary.

23. Paid Up Capital

23.1 LSPs conducting WSH courses other than Safety Orientation Course

(SOC) shall maintain a paid up capital of at least S$5,000 (Five thousand dollars), or otherwise stated by the Authorities. Other LSPs such as Associations or Unions, who are not registered under Accounting and Corporate Regulatory Authority (ACRA) shall show proof of their financial status via other equivalent means subject to approval by the relevant authorities.

23.2 LSPs who are conducting the SOC such as SSIC-GT course, shall

maintain a paid up capital of at least S$50,000 (Fifty thousand dollars) or otherwise stated by the Authorities.

24. Indemnity/Disclaimer against Claims

24.1 The LSP shall fully indemnify SAC, CBs, and the Government of the

Republic of Singapore against all actions, claims, demands, costs and charges arising from or relating to any infringement of any patent, design, and copyright or intellectual property rights owing to the use of any material or equipment by the LSP, and against all actions, claims, demands, costs and charges arising from or relating to any accident/incident occurrences at or other than LSP accredited training venues.

25. General Damages, Cancellation or Suspension of LSPs’ Certification

25.1 In the event of any breach by the LSP against any clause in the MOM Technical Notes, the Authorities may carry out any or all of the following:

(a) File a suit against the LSP for general damages (b) Immediately suspend the LSP’s certification (c) Withdraw the certification of the LSP

25.2 Clause 25.1 may also apply, including but not limited to the following events:

(a) Giving of false, inaccurate, or misleading information by or on behalf of the LSP and/or Approved Facilitator(s);

(b) Lodgement of complaint or police report against the LSP,

facilitator, employee, owner/director/principal/manager of the LSP or anyone who has an influence over the LSP’s operations;

(c) Ongoing investigations or legal proceedings relating to the

LSP, Approved Facilitator, employee, owner/director/principal/manager of the LSP or anyone who has an influence over the LSP’s operations;

(d) Failure to comply with any additional conditions imposed on the

LSP and/or Approved Facilitator.

(e) Failure to comply with any additional condition imposed on the LSP and/or Approved Facilitator, pursuant to paragraph 2.2, after the LSP has been certified;

(f) Involvement in any case of cheating and/or fraud, including

cases with the intent to do so even though the intended outcome may not have been achieved; or

(g) Any other circumstance in which the organisation is no longer

fit and proper to act as a LSP, or where it is not in the public interest for the organisation to be a LSP.

(i) When the LSP is unable to fulfil the annual surveillance audit

requirement.

25.3 The Authorities reserve the right to immediately suspend the training

and or assessment session if the following occur:

(a) LSP is found to be in breach of any of the conditions listed in the Requirements; or

(b) Safety and / or Health of those involved in the training may be compromised if training/assessment was allowed to continue.

Withdrawal of Certification

25.4 Where the LSP’s certification to conduct any WSH course has been withdrawn, the SAC/CB’s terms and conditions of withdrawal shall apply.

25.5 Upon withdrawal of the LSP’s certification, the LSP shall:

(a) Stop the registration of new Learners; (b) Complete any ongoing courses, if there is no immediate safety

and or health concerns, but the LSP will not be allowed to commence any new courses;

(c) Immediately cease all representations and training activities

related to the LSP status; (d) Resolve all outstanding issues such as full course refund,

assisting affected Learners with new course placements and or other relevant administrative matters; and

(e) Immediately destroy and dispose of any course-related training material issued by MOM. For example relevant Work at Height courses and Formwork Safety course for Workers.

25.6 At any time during the validity of the LSP certification, the LSP may

provide no less than one (1) month notice in writing to inform the Authorities of its intention to withdraw from the LSP scheme.

25.7 The Authorities reserve the rights to withdraw the certification of the

LSP if the LSP is inactive, i.e. non-conduct of any LSP training course for a continuous period of twelve (12) months.

25.8 The Authorities are not obliged to refund any fees paid, whether in full

or in part, when the LSP ceases to be certified (whether voluntarily or obligated).

25.9 LSP whose certification is suspended or withdrawn any time may be

barred from future certification for such period as the Authorities deem fit.

26. Change in LSP Management

26.1 In the event where an LSP wishes to change its Director/Principal, the LSP shall do the following:

(a) Inform the CB two months before its intent to effect such a change

in its management; and

(b) Submit relevant supporting documents (e.g. ACRA Company Business Profile (if applicable), appointment letters etc.) associated with such a change to the CB for its assessment and approval.

26.2 The LSP’s request to replace its director/principal is subjected to the

Authorities’ approval. The Authorities reserve the rights to reject such a change to the director/principal.

Clauses 27 to 33 are applicable to only LSPs conducting the following courses:

Shipyard Safety Instruction Course for Workers– General Trade (SSIC-GT);

Shipyard Supervisors Safety Course (SSSC); 27. Registration of Courses and Assessment

27.1 The LSP shall process all course and assessment registrations within

one (1) working day of receipt. This includes, but is not limited to the registrations received by post, facsimile, email, online applications or made in person.

27.2 All registrations shall be accompanied by supporting documents such

as a copy of the passport, and where appropriate, the In-Principal Approval (IPA) of the Learners.

28. Administration and Conduct of Courses and Examinations/Tests

28.1 The LSP shall conduct the course according to the published

scheduled date of the course. 28.2 For LSPs who have been certified to conduct SSSC course, the LSP

is to take reference from the relevant MOM Technical Notes Part II during the development of the course materials.

28.3 The LSP shall ensure that each Learner attempting the SSIC-GT

course assessment is given a different set of assessment question paper.2

28.4 The LSP shall ensure that each Learner attempting the SSSC course

assessment is given a different set of assessment question paper. LSPs are to ensure there are at least two different sets of assessment question papers at any one time.

28.5 The LSP shall ensure that before a Learner is allowed to attempt any course assessment, the Learner must first satisfy all the requirements set out in Paragraph 12 of the Technical Notes.

28.6 During the assessment of either the SSIC-GT or SSSC, the LSP shall

remind each Learner to document the serial number of the assessment question paper attempting.

28.7 Person/s renewing the SSIC-GT certification, due to expiry, is/are

permitted to only re-sit the assessment without the need to attend the complete course. However, there is no objection if a person chooses to attend the complete course and assessment.

29. Uploading of Assessment Results

29.1 The LSP offering SSIC-GT and or SSSC course(s) must install the

latest version of the Automated Marking System (“AMS”) to enable marking and uploading of the assessment results. No other means of uploading of the assessment results shall be permitted.

29.2 The LSP shall be solely responsible for any issue that may arise in

connection with the installation, usage, and maintenance of the AMS. Such issues shall include, but is not limited, to any cost that may arise due to the installation, usage and maintenance of the AMS.

29.3 Following the conduct of any SSIC-GT/SSSC assessments, the LSP

shall ensure the assessment results are verified by the LSP and uploaded to MOM’s Training Record System within the time specified below:

i. For SSIC-GT course: the assessment results are to be

uploaded within 12 hours from the time of the assessment.

ii. For SSSC course: the assessment results are to be uploaded no later than 5 calendar days, from the date of assessment.

29.4 All system errors, in relation to the uploading of results, shall be

rectified by the LSP within 12 hours from the time the LSP was notified of the error by the AMS.

29.5 The LSP is not allowed to erroneously upload 2 or more learners’

records per month.

29.6 The LSP shall generate and maintain all documented reports related to the uploading process regularly. The Authorities may request, from the LSP, statistics update and records as and when required/necessary.

30. Award and Disposal of Safety Pass

30.1 The LSP shall issue the safety passes and/or certificates to learners who have passed the assessment at the end of the course. As the safety pass is a controlled item managed by the LSP, the LSP shall ensure that security measures are implemented to ensure the safety passes issued are not compromised in any manner i.e. sold, forged or unlawfully altered in any form. Any void or pre-prepared safety pass and or certificate no longer required, shall be disposed of and documented for audit purpose.

30.2 The LSP shall only replace lost, damaged and or defaced safety

passes when the claim is supported by official documentary proof, such as records of police statement. The LSP shall keep and maintain the documented records of such application for audit purpose.

31. Retention of Answer Sheets 31.1 All Learners’ assessment answer sheets for SSIC-GT course shall be

retained for a minimum of three (3) months from the date of assessment. 32. Fees

32.1 The LSP shall pay the stipulated administrative charge to MOM for every learner’s assessment administered by the LSP for the SSIC-GT course. MOM reserves the rights to charge interest on fees which are not paid by the LSP within the stipulated time. In addition, MOM reserves the rights to amend the administrative charges when it deems necessary and appropriate to do so.

32.2 All payment for the administrative charges referred to in Clause 32.1

shall only be made via GIRO. 33. Passing Rate

33.1 The average monthly passing rate for the SSIC-GT assessment results, is stipulated at 85% and above. The LSP conducting the course shall monitor and ensure the passing rate does not fall below 85%. If the average monthly passing rate does fall below 85%, the LSP is required to review the training materials and method of instruction by the Approved Facilitator to ensure the relevance and literacy of the Learners are not compromised.

33.2 All actions taken by the LSP to address its inability to meet the

average monthly passing rate, as stipulated in Clause 33.1, must be documented for audit purposes and communicated to the Authorities together with explanation for its failure to meet the average monthly passing rate. The Authorities reserve the rights to review any of the said action(s) and require the LSP to carry out any follow-up action deemed necessary.

Reviews and Revisions 34. For the purpose of keeping an up-to-date record of the Technical Notes, it shall be updated from time to time. 35. The review and revision format shall be as follow:

37. Prior to the certification of a LSP, the LSP’s Principal/Director shall declare to the CB, in writing, that the LSP has not, at any time, been withdrawn, suspended by any other CB/s and or was black listed by the Authorities previously. 38. A LSP shall remain with the same CB for at least one year if any of its LSP courses had been withdrawn, be it temporary or permanent previously. 39 If an LSP had applied for an initial certification and audited by a certification body, but later decides to switch to another certification body for certification before obtaining its certification from the 1st certification body, the LSP shall inform the new certification body in writing of the reasons why it did not complete the certification process with the 1st certification body. 40. If a LSP has its certification withdrawn by a certification body previously and subsequently wishes to be re-certified, it could either apply to the same certification body or another certification body. If it applies to another certification body, after one year, the LSP shall inform the certification body, applying to, in writing of the reasons for the withdrawal by the 1st certification body. 41. A LSP shall be certified by only one CB for all the WSH courses under ISO 29990:2010 at any one time i.e. no mix certification by different CBs for different WSH courses is permitted.
