What is a patent? a government authority or license

conferring a right or title for a set period, especially the sole right to exclude others from making, using, or selling an invention. – Google search definition

What does the government get for granting a patent?

Who can apply for a patent?

USPTO – applications must be by or in the name of the actual inventor. The person or entity that owns the rights to the patent is the Assignee.

Rest of the world – the person or entity that owns the rights to the patent

What can be patented? (USPTO)Utility patents are provided for a new, nonobvious and useful:

Process Machine Article of manufacture Composition of matter Improvement of any of the above

In addition to utility patents patent protection is available for (1) ornamental design of an article of manufacture or (2) asexually reproduced plant varieties by design and plant patents.

What can’t be patented? (USPTO) Laws of nature Physical phenomena Abstract ideas Literary, dramatic, musical, and artistic

works (these can be Copyright protected). Inventions which are:

Not useful (such as perpetual motion machines); orOffensive to public morality

How long do patent protections last? USPTO – Utility patents are good from

the date of filing through 20 years no matter how long it took to be granted Design patents are good from the date of filing through 14 years
