5. Qualifications and method of appointment.--(1) All appointments to the Service shall be made inthe manner specified in Appendix •B' :

AppUcations, of the Punjab Civil Services(General and Common Conditions of Service) Rules,1994•..,.,(lL,ln. respect.,of., the matters, which are -notspecifically provided in these rules, 'the members' ofthe_Service_ shall be" ,governed, by, the Punjab CivUServices' (General and Common Conditions .of ServiceRules, ,,1994; as amended from time to time.

(2)' The, Punjab CivU Services. (General andCommon, Conditions of Service) Rules,. 1.994 as inforce at present are annexed as Appendix 'C'.

. '8. Repeal and saving.--The Punjab TransportDepartment (State Service Class III) Rules, 1963. arehereby repealed;

4. Disqualifications .--No person -- (a) who hasentered into or contracted a marriage with a personhaving a spouse living, or '

(bl who, having a Spouse' living, has enteredinto or contracted a marriage with any pe'rson,

shall be eligible for ajJpointment to the Service :

S. Age .-- (1) No person, shall be recruited tothis Service by direct ap pointment if he is less thaneighteen years or is more than thirty years of agein the case of non-technical posts and thirty threeyears in the case of technical posts on the 1st dayof January of the year immediately jJreceding thelast date fixed for submission of applications by theCommission or the Board, as the case may be, orunless he is within such range of minimum andmaximum age-limits as may be specifically fixed bythe Government from time to time:

Provie.ce. that where different lower and upperage limits have been specifically prescribed forposts in the Service Rules. these limits shall bemade applicable for appointment to such posts :

Provided further that the upper age-limit maybe relaxed up to forty-five years in the case ofpersons already in the employment of the PunjabGoveroment, other State Gover'nment, or theGovernment of India

14. Oath of alleg!ance.--Every member of aService, unless he has already done so, shall berequired to take oath of allegiance to India and tothe Constitution of India as by law established .

Debarring for consideration for promotionof a Government employee who refuses to acceptpromotion. --In the event of refusal to acceptpromotion by a member of a Service he shall bedebarred by the appointing authority fromconsideration from promotion for all the consecutivechances which may occur in future within a periodof two years from the date of such refusal to acce;Jtpromotion :

Provided that in a case where the appointingauthority is satisfied that a member of a servicehas refused to accept promotion under thecircumstances .beyond his contro'!. it may exampt sucha member for reasons to be recorded therefor inwriting from the operation of this rule.

Rules relating to the. subjects and standardcompetitive .examination of candidates forof Assistant District Transport Officer-":

1. A candidate shall answer the papers inPunjabi or English.

2. No candidate sha'll be eligible to appear inthe viva-voce test unless he obtains 50percent marks in the aggregate of allsubjects :

Provided that if any examination a. sufficientnumber of candidates do not obtain 50 percent marks in the aggregate. theCommission/Board may at their discretionlower this percentage to not below 45 percent.

3. No candidate shall be considered to havequalified in the examination unless heobtains at least 50 per cent marks in theaggregate in all subjects including viva-voce except in the case of any examinationfor which this percentage has been loweredto not less than 45 per cent by theCommission/Board under the proviso to rule2 in which case the qualifying percentageshall be determined by the. Commission/Board.
