Whereas, MATT KERNER is a proud Buckhannon resident who many years ago came to Buckhannon to attend West Virginia Wesleyan College but who during the past 11+ years has served as the Executive Director of Opportunity House, a residential facility offering comprehensive services in assistance to those in recovery from substance abuse; and, Whereas, MATT KERNER has been a primary partner with the City of Buckhannon embracing project HOPE, a program aimed at providing those in recovery with Health, Opportunity, Place, & Employment; and, Whereas, MR. KERNER has initiated community-wide dialogue in effort to lessen the stigma associated with addiction through sponsorship of showing documentaries & general engagement of our community with those in recovery; and, Whereas, MR. KERNER recently spearheaded the highly successful, inaugural HOPE AND HELP ASSEMBLY (HAHA), bringing people together from all over West Virginia here in Buckhannon to share information & hopeful stories of recovery; and, Whereas, MATT KERNER’S selfless & outstanding service & contributions to our community are indicative of our citizen and business ownership in & respect for community activities, & represent the very finest example of our high quality of life enjoyed by our residents here; and,

Whereas, our City is very proud of one of its most accomplished citizens who steadfastly epitomizes positive thinking, dedication, & accomplishment while serving as an exceptional role model for everyone throughout our B-U community, & now desires to recognize MATT KERNER for his outstanding contributions by bestowing upon him our City’s Ambassador’s award. • Upshur County CEOs – Breast Cancer Awareness Proclamation made earlier in the

week: Proclamation

West Virginia Breast Cancer Awareness Day & Breast Cancer Awareness Month

In 2017, an estimated 1,400 West Virginia women will be diagnosed with breast cancer and approximately 280 women

will die from the disease. Breast cancer continues to be a leading cause of cancer related deaths among WV women. A woman

has about a 1 in 8 (12%) chance of developing breast cancer in her lifetime and about a 1 in 37 (2.7%) chance of dying from the

disease.

Currently, the best method to reduce deaths due to breast cancer is through early detection of the disease. Based on

your age and medical history, your healthcare provider will be able to make the best breast health recommendation for you. This

may include a clinical breast exam, mammogram, and monthly self-breast exams. Clinical breast exams, breast self- exams, and

mammograms can save lives. Women should talk to their healthcare provider about their individual screening schedule.

In recognition of the important lifesaving early detection practices available for breast cancer, I, David W. McCauley,

the Mayor of City of Buckhannon, do hereby proclaim October 2, 2017, as West Virginia Breast Cancer Awareness Day and

October 2017 as Breast Cancer Awareness Month. I urge all Upshur County women to become aware that they are at risk for

developing breast cancer and to discuss screening with their health care providers.

• Delegate Bill Hamilton – Road Bond Amendment Election - Delegate Hamilton shared information about the WV Road Bond Amendment. Resolution 2017-12 “Roads to Prosperity” supporting WV Road Bond Amendment of

2017 -

Motion Albaugh/Skinner to support Resolution 2017-12, read by Mayor McCauley.

Discussion: Council member CJ Rylands asked if these funds could be leveraged for

additional Federal funds; Delegate Hamilton responded that this was possible, and would be

used to continue work on Corridor H and other projects. Roll call vote: Cuppari – yes;

Skinner – yes; Rylands – yes; Albaugh – yes; Aloi – yes; McCauley – yes; Thomas –

absent. Motion passed unanimously among those present.

RESOLUTION 2017-12

WHEREAS, the City of Buckhannon, supports “Roads to Prosperity” road bond amendment on October

7, 2017, and;

WHEREAS, there are several important dates to remember which tie into this very important election:

September 18, 2017 – Voter Registration Deadline to register to vote or update your information for the

Special Election. Register to vote/ Update Information. September 22 – October 4, 2017 – Early Voting

is open during regular business hours at each county courthouse or courthouse annex. Early Voting is

also available each Saturday from 9:00am to 5:00pm. Contact your County Clerk to confirm Early

Voting hours and locations. September 30 – Noon, October 7, 2017 – Emergency Absentee Voting

Eligible citizens may request an emergency absentee ballot until noon Election Day. Learn more about

emergency absentee voting. Saturday, October 7, 2017 – Elections Day Polls open 6:30am through

7:30pm. Find your polling place, and;

WHEREAS, our West Virginia roads need fixing, and supporting the roads bonds will allow us to repair

existing roadway – from the secondary roads to expressways, small bridges, and larger bridges to newly-

planned projects – across the state, and;

WHEREAS, development of roads and road projects means jobs and economic development, as well as,

improving the safety of our citizens and interstate travelers in our State and;

WHEREAS, this past session, our legislature passed five key pieces of legislature proposed by Governor

Justice that put this funding mechanism in place in advance of the coming special election, and;

WHEREAS, these bills do many things: extend private-public partnerships in highway funding, increase

the amount of monies for both annual design-build construction projects, and the state’s bonding authority

of federal funds – that will raise as much as $1.6 BILLION. But all of this funding cannot happen unless

the people also vote FOR the amendment on October 7.

NOW, THEREFORE BE IT RESOLVED, that the City of Buckhannon, is in support of the “Roads to

Prosperity” initiative and urges all citizens to vote for this important amendment on October 7, 2017.

• Rhett Dusenbury, representing Congressman Alex Mooney, from Elkins; introduction to

Council. Also endorsed Road Bond issue. Mayor McCauley mentioned President Trump’s

recent announcement that funds would become available to municipalities to help with

substance abuse recovery. He asked if Congressman Mooney is going to advocate for

funding to come to West Virginia, Buckhannon in particular, to assist with local efforts. Mr.

Dusenbury believes this is possible, as Congressman Mooney and others are focused on

solutions. Mayor McCauley asked Mr. Dusenbury to encourage Congressman Mooney to

advocate for funds to help with Buckhannon’s efforts to deal with substance abuse.

Department and Board Reports ● Public Works Director – Jerry Arnold –

Buckhannon City Council Public Works Director Report September 21, 2017

Director:

• We opened bids today for our 2017 paving projects. We will give notice to proceed to the lowest bidder pending review of the specifications.

• The theatre floor demolition is about 90% complete. • I will be responding to a letter from Mr. Jason Hill to council about a damaged light pole on Main Street. • We will be installing fall décor on Monday.

Supervisors:

• Nothing new to report. Water Department:

• Continues to work on residential meter replacement.

• Installed a fire service tap for CJ Rylands on Main St.

Sewer Department: • Clarifier project is expected to be completed around the first week of October.

• Installing a storm water drop near bocce ball court at Jawbone.

Waste Department:

• Nothing new to report.

Street Department: • Began work on the Ameriprise lot project. • Excavated the ADA parking spaces at NBP and will be placing pervious concrete to meet FEMA

regulations.

Engineering: • Nothing new to report.

• Finance Director - Amberle Jenkins – -General Fund/Coal Tax Balance Sheet June 30, 2017

• City Attorney - Tom O’Neill – Working with Jerry Arnold to finalize the uniform contract template. Working on waiver for City of Lewisburg to participate in vehicle sub-lessor program with City of Buckhannon. Mayor McCauley will share the vehicle lease program at the October Municipal League meeting; perhaps the Municipal League would consider managing a state-wide lease program which would reduce the price for all.

• Buckhannon Police Department– Doug Loudin-

Mr. Loudin first read a message from Buckhannon Fire Chief, Jim Townsend, regarding regulations on outdoor burning and urging extra caution due to recent dry weather conditions. Moved up from Strategic Issues: Discussion and possible action of equipping all municipal first responders with Narcan – Motion Cuppari/Albaugh to approve Narcan for all first-responders, including Police and Fire Dept officers. Discussion: Doug Loudin explained that the Health Department will provide the Narcan and provide training. Mayor McCauley asked about the Police officers’ views about this. Mr. Loudin explained that all officers are trained on CPR, first aid and self-treatment. He believes this is just one more area in which police should be trained. The mayor referred Council members to information about Narcan provided by Matt Kerner, Executive Director of Opportunity House. Call for question: Motion passed unanimously. Doug Loudin mentioned that Matt Gregory is already working on policies and procedures related to Narcan administration to be included in Police manual.

WHEREAS, the unprovoked attacks of Sept. 11, 2001, upon America by foreign terrorists have thrust the United States, and other countries, into a war it never envisioned, militarily or diplomatically; and

WHEREAS, the challenges facing all the civilized people of the world as they relate to the war on terrorism will not end until those fanatics responsible are eliminated or brought to justice; and WHEREAS, America is fully committed to ensuring our freedoms remain unfettered and sovereign for all generations, now and forever; and WHEREAS, world opinion needs to remain focused upon the eradication of these inhuman acts perpetrated around the globe; and WHEREAS, one way to accomplish this is to NEVER FORGET that those innocent victims did not die in vain; and WHEREAS, America can fight back by reminding the world that the deaths of these people will always be remembered and that they will be forever loved; and

WHEREAS, a noble and appropriate way to accomplish this is through the annual celebration of their living; and

WHEREAS, this commemoration should be conducted each Sept. 11 throughout the land to include: • The promotion of global peace and goodwill; • The demonstration of America’s resolve and perseverance to win the war on terrorism; • The advancement of responsible citizenship; • The encouragement of patriotism and love of country; and • The poignant remembrance of those innocent victims who died Sept. 11, as heroes, one and all; Now therefore be it RESOLVED, as the Mayor of the City of Buckhannon, WV, I am issuing this proclamation to memorialize those men, women, and children who lost their lives; and be it further RESOLVED, that this proclamation be publicized for all to see and know that the citizens of Buckhannon remember with eternal respect those whose lives were suddenly, without cause and pointlessly taken from them on Sept. 11, 2001. 3. Proclamation – National POW/MIA Recognition Day

National POW/MIA Recognition Day

For years, The American Legion supported a National POW/MIA Recognition Day, which is now recognized

annually on the third Friday of September. This commemoration is set aside to honor the commitment and sacrifices

made by this nation's prisoners of war and those who are still missing in action, as well as their families.

Until July 18, 1979, no commemoration was held to honor POW/MIAs. In the first year, Congress passed

resolutions and the national ceremony was held at the National Cathedral in Washington. The 1st Tactical Squadron

from Langley Air Force Base in Virginia flew the Missing Man formation. A poster was published by VA which

contained only the letters POW/MIA. That continued until 1982, when a black and white drawing of a POW in captivity

was used to show urgency of the situation.

Every year, National POW/MIA Recognition Day legislation was introduced until 1985, when Congress

determined that commemorative days would no longer be considered. The president now signs a proclamation each

year.

The National League of Families proposed the third Friday of September as a commemoration date. Most of

the National POW/MIA Recognition Day ceremonies have taken place at the Pentagon. Now, they're held throughout

the nation and around the world on military installations, ships, schools, churches, etc. The focus is to ensure that

America remembers its responsibility to stand behind those who serve it and to make sure that we do all that is

possible to account for those who have not returned.

Whereas, September 17, 2017 marks the two hundred and thirtieth anniversary of the drafting of the Constitution of the United States of America by the Constitutional Convention; and Whereas, it is fitting and proper to officially recognize that magnificent document and the anniversary of its creation; and Whereas, Public Law 915 guarantees the issuing of a proclamation each year by the President of the United States of America designating September 17th-23rd as Constitution Week; NOW, THEREFORE, I, David W. McCauley, Mayor of the City of Buckhannon, West Virginia, do hereby proclaim September 17th -23rd , 2017 to be

CONSTITUTION WEEK in Buckhannon and ask our citizens to reaffirm the ideals that the Framers of the Constitution had in 1787.

5. Press Release – Groundbreaking on new City water tank project – Victoria Hill WST

Press Release Regarding Groundbreaking on new City Water Tank Project September 12, 2017 Buckhannon City Hall (304) 472-1651

This Thursday, September 14, 2017, the City of Buckhannon’s Water Board will break ground on a new 1.2

million gallon water tank located at the top of Victoria Street Hill, immediately adjacent to an existing 1.0 million

gallon tank that will continue to serve the community. The Water Board will gather at the site at 4:00 p.m. for a

brief ceremony, & then members will return to City Hall about 4:30 to conduct their regular monthly meeting.

“This project marks a very significant moment in Buckhannon’s history as we establish our most

substantial quantity of water storage reserve. This helps prepare Buckhannon for future development &

particularly the completion of Corridor H & the inevitable growth that will be realized in our area upon that

highway’s completion” said Mayor David McCauley.

This is but the most recent of several upgrades to Buckhannon’s Harley A. Brown Memorial water plant

and distribution system, and during the past two years, more than three million dollars worth of improvements

have been undertaken. Buckhannon acquired its municipal waterworks system in 1963 from Mountain State

Water. The tank should be completed by about December 1. Jerry Arnold is the City’s Public Works Director, &

Kelly Arnold is the Water Department superintendent. Chapman Technical Group is the consulting engineering

firm that designed the project & will oversee its completion. The five-member Water Board includes Mayor

McCauley, Council members J. David Thomas & Robbie Skinner, & citizen members Don Nestor & Eric Waggoner.

Notice of Position of Information Coordinator & Grants Researcher/Writer

The City of Buckhannon will receive letters of interest and curriculum vitae from interested applicants to provide

services as a full-time, paid employee of the City who shall serve as the information coordinator & grant

researcher/writer for all City operations including the City’s four Utility Boards.

Information to be provided shall include: (1) letter of interest highlighting education, experience, & professional

qualifications & accomplishments; (2) professional resume; & (3) list of professional references.

Duties & Responsibilities of this position include but are not limited to the following:

(1) Trained, formally educated, & experienced in both oral & written communications, the Information

Coordinator & Grants Researcher/Writer (hereinafter “Coordinator”) will serve as a City point of contact with the

external community & press, all as overseen & authorized by the Mayor & Director of Finance & Administration.

The Coordinator will proactively engage local residents & press, to share information via press releases, newsletters,

& announcements of all matters involving the City. This includes general promotion as well as notification of City

activities & events via all appropriate mediums, i.e., traditional, City website, social media platforms, hard copy

documents, etc. The Coordinator will be a “sharer” of information to & from the City in all forms.

(2) The Coordinator will work closely with the Mayor, City Council, Directors of Finance &

Administration & public works, supervisors of Utility Boards, police & fire chiefs, Stockert Youth Center Director,

& Gibson Memorial Library supervisors. The Coordinator will receive, process, & redistribute appropriate

information to the general public & press. The Coordinator will be responsible for drafting well-written

announcements, notices, & press releases on behalf of City officials & the City of Buckhannon in general.

(3) The Coordinator will work closely with other governmental entities & community organizations for the

purposes of information gathering & sharing. These organizations include State government & other local

government, Upshur County Commission, Board of Education, Region VII Planning & Development Council,

Chamber of Commerce, Buckhannon-Upshur Convention & Visitors Bureau, Upshur County Development

Authority, WV Strawberry Festival, Create Buckhannon, & all other community arts, recreational, educational, &

sports focused organizations.

(4) The Coordinator will become adept with the City’s internet website & develop a working use of the

website so that appropriate information may be provided regularly & promptly to the public.

(5) The Coordinator will collaborate to draft, proof, & edit all fliers, pamphlets, brochures, & other

documents intended for distribution by the City to enable consistent & professionally prepared information for the

public’s use.

(6) The Coordinator will oversee, research, write, or collaborate in writing & editing all municipal grant

applications for all City departments & supervisors.

(7) The Coordinator regularly will prepare newsletters to City employees to inform them of City activities

as well as matters related to employee benefits & other items concerning employees.

The Information Coordinator & Grant Researcher/Writer will be appointed by the Mayor & City Council & will

serve at the will and pleasure of the City Council. This position is an at-will one with benefits. The annual starting

salary for this position is expected to range from $30,000-$35,000 depending upon experience. All interested

Strategic Issues for Discussion and/or Vote

1. Ordinance 419 Sewer Rate Increase – 1st Reading. City Attorney, Tom O’Neil read the

ordinance, by caption. Mayor McCauley pointed out that the City has been out of

compliance with the legislatively-mandated requirement of utility companies to maintain a

working capital fund equal to one-eighth of the operating revenues. The mayor also

explained that funds that come into the Sanitary Sewer Board are restricted in use to the

sanitary operations and strictly regulated by the Public Service Commission. Buckhannon

is currently at the bottom 30th percentile in sewer rates across the state; with the two-tiered

increase, Buckhannon will still be at about the mean (50th percentile). The mayor

encouraged citizens to ask questions at City Hall to get factual information about the

proposed sewer rate increase. Motion Albaugh/Rylands to approve Ordinance 419 on first reading; motion passed unanimously.

2. Recommendation from Façade Committee to approve grant expenditures for

Opportunity House, Inc. The Opportunity House is making improvements to the façade of

their house on East Main Street. The Façade Committee unanimously recommends a $2,500

grant. Motion Rylands/Cuppari to fund $2,500 grant to Opportunity House upon

completion of their façade project; Motion passed unanimously.

3. Discussion-Approval from all four Utility Boards to participate in supporting the new

Information & Grants Coordinator position. The mayor reported that all four Utility

Boards have approved their participation.

4. Authorization to sign Agreement with State of WV DOH-Gateway West Phase I

Engineering & Design Project (State Project U349-BUC/KH-14.00). Motion

Skinner/Cuppari to authorize the mayor to sign the agreement with State of WV for

the Gateway West Phase I Engineering & Design project.

Council Members’ Comments & Announcements:

• Mary Albaugh- Thanks to Tom O’Neill, Jerry Arnold, and Amby Jenkins for the research and drafting of the ordinance for the sewer rate increase. Held veterans appreciation event today that was well attended.

• Pam Cuppari – Thanked Jerry and his crew on their work on the second annual Truck Fest. Also thanked the Elks Club for participating in SYC’s Children’s Festival, donating to the event, and filling backpacks. Thrilled that City employees will be decorating downtown for Fall Fest. The new Christmas holiday banners have arrived. Holiday decorating committee will meet on September 25 at 5:30p.

• CJ Rylands – Police officer Mark Stewart was honored by Create Buckhannon for modeling good community policing behaviour. Mr. Rylands pointed out that recognizing positive behaviour among law enforcement officers will encourage more to endorse the community-policing philosophy.

• Robbie Skinner - Thanked Delegate Hamilton and former Senator Bob Ashley for sharing information about the road bond issue. Many organizations, including Upshur Chamber of Commerce, have endorsed this issue. Early voting begins Friday, September 22; he encourages voters to support the bond because our area will benefit. He also mentioned that we need to thank Rob Barbor and his staff for the beautiful landscaping; he has received many positive comments about the flower.

• Dave Thomas – Absent. • Susan Aloi – Speaking of Robbie Barbor, congratulations to him and Leah on their recent

marriage. Mayor’s Comments & Announcements:

• A lot of visitors here for HAHA remarked on the flowers and other special things in Buckhannon.

• Representatives from the Municipal League visited this week to consider Buckhannon as a site for the Municipal League meeting in August 2018.

• Encouraged people to visit the dog park. • Timmy Tree Dedication – recognition of those who are struggling with addiction and

working to reduce the related stigma. • Mayor’s Statement on the inaugural Hope and Help Assembly held on September 9th

CITY OF BUCKHANNON – MAYOR’S STATEMENT ON INAUGURAL HOPE AND HELP ASSEMBLY – September 9, 2017

On June 18, 1971, President Richard Nixon commenced our society’s “War on Drugs.” That American battle has raged

on for more than 46 years now. Two years prior to this, in 1969- Nixon had formally declared our nation’s "war on drugs" that

would be directed toward eradication, interdiction, and incarceration. Today, the Drug Policy Alliance, which advocates for an

end to the “War on Drugs,” estimates that the United States spends $51 billion annually on these initiatives. Our nation has

spent approaching two trillion dollars on the “War on Drugs.” Nearly 2.3 million Americans are in jail right now, or one in every

110 of our citizens. Approximately five million Americans are on probation or parole right now, or about one in 50. Most of

these people are incarcerated due to some form of drug involvement.

The single biggest expenditure in our War on Drugs has been the building of new prisons & the cost of incarcerating

millions of our citizens. More Americans are in jails today than at any time in our nation’s history, & we are trending upward.

Beginning in 1980s, the number of people jailed for drug offenses increased by 126%. Since 2008, we have averaged 1.5 million

people arrested in the U.S. annually for drug offenses, a half million of which are incarcerated- each year. Mandatory minimum

sentencing requirements at the federal level have resulted in many citizens receiving stiff penalties of many years for nothing

more than possessing illegal drugs.

Imagine what our society would be like if a fraction of what we spend on locking people up was to be expended in

therapeutic programs- detox centers, residential placement facilities, counseling, & reintroduction to the work force initiatives.

We cannot continue to wait on our federal or state governments to address our drug crisis. We have to do this at the

local level. In February, the City of Buckhannon launched the HOPE Project -

“A holistic, community-supported approach to assisting addicts in their recovery & reintroducing them as contributing

members of our society by assuring that addicts’ health needs are met, that they sense there are bona fide opportunities at

turning their lives around, that they have a place to call home, & that there are employers willing to take a chance on

employing them. We will have meaningful dialogue and commitment from government & area employers to create genuine

hope for those recovering.

HEALTH – intervention, detox, recovery, & counseling for addicts & their families

OPPORTUNITY – a second chance, a fresh start, a clean slate, a non-judgmental support network during addicts’ lifetimes of

recovery

PLACE – residential options or services in the home, we all need “our place”

EMPLOYMENT – a consortium of employers willing to discreetly give recovering addicts a chance to return to gainful

employment, & hence a sense of value as sustaining, productive members of our community

I implore you all to join us, to end the failed, judgmental approach. The old notion that addicts simply need to pull

themselves up by their boot-straps is a myth that has been perpetuated for a half century. People need help- & our addict

population is part of “US” and “WE” need to provide help. “Help” is not achieved by locking more people up. And remember-

David, I just wanted to share with you our granddaughter, Kylar's, perspective on Buckhannon. Kylar absolutely LOVES this town. She constantly raved about Buckhannon being the best place in the whole world. She particularly named the following:

• The book kiosks were amazing to her. She exchanged books several times during the week they were here and was continually spying a new book kiosk and counting them several times.

• The Walking Trail as you saw was a hit. I hope it was okay that I permitted her feeding of the wildlife. Even if her brother tried to eat the corn it was a treat for them both. She was also pleased by the Dog Park aspect.

• Both children loved the City Park which we visited several times during the week. She named it the best City Park in the world.

So, thank you and the city for your dedication to our community and providing phenomenal facilities for Buckhannon citizens and for refugees from the Florida hurricane. Kylar says this is the best place ever. Shirley Ah Shirley, that is so thoughtful of you to send this message. I'm going to make it a part of the City Council packet for this Thursday's meeting, but more importantly- have it included in all of our employees' next paycheck envelope.
