Generally, firm-fixed-price contracts are used to acquire supplies and services. They may be priced— (1) On a lump-sum basis (when a lump sum is paid for the total work or defined parts of the work),

(2) On a unit-price basis (when a unit price is paid for a specified quantity of work units), or (3) Using a combination of the two methods.

The contractor shall submit, as part of the proposal, a schedule of proposed payments based on targeted deliverables in the scope of work. These targeted deliverables can be negotiated during the bidding process and will be based on the agreed upon time frame of the entire project. D. Minimum Criteria: A quotation will not be considered further if it does not meet the following minimum criteria:

• Completed pricing on BOQ • Proposed work schedule (timeline) • Proposed payment schedule • List 3 references for work completed in last 24 months

E. Evaluation Factors: Quotations that meet the minimum criteria listed above may be further evaluated based on the following factors:

• Total price of project • Delivery timeframe (and availability of supplies) • Past experience with USG facilities • Staffing capacity for this project • Warranties offered on supplies and completed work

Award may be made with or without negotiations between the Peace Corps and the selected vendor. Award may be made to a vendor that provided the lowest priced technically acceptable quotation, or to a vendor other than the one that provided the lowest priced quotation, should that vendor be determined to have provided the best value quotation to the Peace Corps taking technical and cost factors into account. All vendors that submit quotations in response to this RFQ will be notified of the results.

A. GENERAL NOTES

A1. SCOPE OF WORK

The scope of work shall be as provided in the Contract Drawings, Bills of Quantities, and as described in relevantspecifications.

A2. BILLS OF QUANTITIES

These Bills of Quantities have been prepared generally in accordance with the principles laid down in the Methodof Measurement of Building Works (First Revision) SLS 573:1999 (Issued by the Sri Lankan Standards Institution,17 Victoria Place Elvitigala Mawatha Colombo 08 Sri Lanka.) Where SLS 573 is not applicable Standard Methodof Measurement of Building Works Edition 7 issued in 1989 (SMM7) by the Royal Institution of CharteredSurveyors UK shall prevail.

Specially described or prescribed rules / instructions shall prevail over the general rules in Methods ofMeasurement stated above.

The Bills of Quantities shall be rated strictly according to the Specifications and Drawings. In the event ofdiscrepancies between Bills of Quantity and Drawings, the Drawings prevail. Between Drawings and Specification,the Specification shall prevail.

A3. UNITS

In these Bills of Quantities, the following abbreviations have been used.

A4. RATES

Rates for all items shall be inclusive of the following unless measured, itemised, or specified otherwise:

1. Providing samples, tests, specimens etc., for such items of work as required by the Engineer2. All handling, loading and unloading of materials, equipments, accessories and spares whether specifically mentioned or not in the respective items.3. All cost of mobilisation, demobilisation, and maintenance of plant and equipments.4. All necessary scaffolding unless otherwise measured separately.5. All temporary work as required.6. Providing bonds and guarantees 7. Removal of all temporary work8. Submission of programmes and bar charts9. Construction management10. Revenue stamps if required11. Providing all holes, chasings etc., as directed by the Engineer for all services, and making good the same as and when such installations are provided.12. All builders work in connection with Mechanical and Electrical Installations 13. Submission of shop drawings in triplicate.

A5. MATERIALS

All materials, equipments and accessories shall be the best of their kind and shall comply with the requirements ofthe relevant Standards, Specifications or equivalent where such exists. In all cases of permanent workspecifications, model nos., makes etc., and other technical data shall be approved by the Engineer before an order isplaced, and all materials, equipment, accessories and spares etc., supplied shall correspond in quality with theapproved samples. The Engineer will exercise the right to reject all such items not complying in quality with thestandard of the approved items and all costs incurred by this rejection shall be borne by the Contractor. All suchrejected items shall be removed from the site. The Contractor shall provide the necessary details to the Engineerregarding the dates and sources of obtaining such items.

The Contractor shall submit the following information on the Items/equipment quoted for together with theContract:

1. Make;2. Model Number;3. Technical data;4. Country of Manufacture;5. Delivery Period;

A6. INSPECTION OF SITE

Bidder are advised to visit the site to acquaint themselves with all existing conditions and the type of work to bedone under this Contract as no claims will be entertained on the plea of want of information due to neglect on theirpart in this regard.

The Bidder shall take into consideration the following in their pricing wherever it is applicable:

1. Extent and nature of the work to be done.2. Site conditions.3. Transport facilities and storage facilities inside and outside the site premises.4. Working conditions.5. Limitation of working time and Limitation of space available.6. Strength and stability of the adjoining structures.7. Access to the location.8. Ground water table and rock levels.9. Weather during the construction period and extra ordinary weather conditions.10. Removing/ relocating existing services.12. General security arrangements in the country and security at site.13. Traffic movement at the vicinity of the site.14. Special security measures to be provided for the approval of the authorities.

15. Erecting/Leasing of ware house for external storage to the approval of Board of Investment Sri Lanka.

16. Special arrangement for storage, transportation, handling and re-handling of materials, plants and equipment due to the security situation.

A7. PLANT AND EQUIPMENTS

Prior approval shall be obtained from the Engineer regarding the suitability, type and capacities of the plant andequipment to be used.

A8. ANALYSIS OF RATESBidder shall submit an analysis of rates for any item or items with all the documentary evidence for approval forany item or items if called upon to do so by the Engineer. The Engineer’s assessment shall be final.

A9. DIMENSIONS

All dimensions for the items stated in this Bills of Quantities, Drawings or Specifications should be checked at thesite by the Contractor prior to commencing all such work. In the event of any discrepancies, the Contractor isadvised to inform the Engineer for necessary instructions well in advance prior to, commencing, ordering, andfabrication of such items.

A10. ELECTRICITYIt shall be the responsibility of the Contractor to ensure continuous supply of electricity for the Works during thecourse of construction and obtaining the necessary connections to the Work and all expenses shall be included inthe rates, unless specified otherwise. In the case of a breakdown of power supply, the Contractor shall ensure thatelectricity is provided for the works through other means, and all expenses shall be included within the rates.

A11. WATER

It shall be the Contractors responsibility to ensure continuous supply of water for the Works during the course ofconstruction and for obtaining necessary connections, and all expenses shall be included in the rates, unlessspecified otherwise. In the case of a shortage of water for the Works, the Contractor shall ensure that adequatewater supply is maintained for the works through other means, and all expenses shall be included within the rates.

A12. DETAIL DRAWINGS

Any additional detail drawings issued to the Contractor to assist him in his work during the course of constructionshall not constitute a variation if it is given for purposes of clarity.

A13. KEEPING ADJACENT STREETS/AREAS CLEAN

During demolition, construction, and excavation, the Contractor shall be responsible for keeping adjacent area in aclean condition not endangering/hindering the traffic/public, by provision of necessary hoarding and protectivemeasures.

A14. LIAISONS WITH LOCAL AUTHORITIES

Prior to taking possession of the site the Contractor shall discuss and make arrangements with all RelevantAuthorities with regard to traffic of his transport fleet to the area, entry during periods of heavy traffic movements,location of concrete plant, if any, or discharge-location of pre-mixed concrete trucks, temporary connections forpower, water supply, waste water/soil water disposal, telephone connections etc.,

A15. TRADE NAMES

Where trade names, brands and/or catalogue numbers are referred to, sole preference to any material equipment andaccessories is not intended. Any other materials equipment and accessories or equivalent may be used providedthat the characteristics of type, quality, appearance, finish, method of Construction and/or performance is not lessthan specified and provided also that the approval is first obtained from the Engineer.

A16. SAMPLES

Rates of all items shall be inclusive of providing Specifications, model nos., maintenance manual, makes, technicalinformation, catalogue and literature, when requested by the Engineer for approval. No extra payments will beallowed for submission of the same.

A17. PRELIMINARIES

Lists of general preliminary items are given in this Bills of Quantities. The Bidders shall include their price for totalpreliminary work in their quote.

A18. VALUE ADDED TAX (VAT) and NBT

Tender sum shall not include Value Added Tax (V.A.T.) The tenderer shall provide his estimated V.A.Tcomponent separately together with the detail calculation at the tender summary as shown.

The contractor shall submit his invoice to the owner based on the payment certificates issued by the consultant withactual V.A.T component including all necessary documentary evidences for such payment.

If applicable, NBT payments to be included in the rates and No extra payment shall be made.

A19. DETAIL DRAWINGS

Any additional detail drawings issued to the Contractor to assist him in his work during the course of constructionshall not constitute a variation if it is given for purposes of clarity.

A20. PROVISIONAL SUMS

Payments for all provisional items shall be as per actual measurements of works done at site. The Contractor isadvised to keep proper records for such items with the approval of the Engineer. Provisional Sums have beenallowed in the Bills of Quantity, which shall be spent wholly or in part as requested by the Engineer.

J Whether stated or not, the Contractor shall prepare andsubmit Shop drawings and obtain Consultant's approvalbefore proceeding the fabrication and work.

(a) The Contractor shall check Site dimensions and makefabricated work corresponding to the "approved" ShopDrawings.

(b) Drawings shall show in detail, various portions of thework, kind of materials, size of members and thestructural stability of the fabricated units.

K The Contractor should arrange to display all theapproved samples and the construction working order inthe site office.

2.0 Plant, Material & Work Practices

L No work in any trade shall be carried out in such amanner as to cause any nuisance to adjacent owners orthe public or any damages to adjacent structures. TheContractor is advised to co-operate with the Client inmaintaining an environment free of unnecessary noiseand dust pollution as possible.

Note

M Mechanical plant and equipment which emits excessivenoise, water, smoke, fumes or obnoxious liquids, gases,etc. will not be allowed to be used on the site. If the useof such machinery becomes necessary the contractor isexpected to obtain prior approval from the Consultant.

N The Consultant has the discretion as to when he deems itnecessary for the Contractor to take precautions,maintain or repair any such plant and equipment or ordertheir removal from the site.

O The Contractor shall be responsible for protecting andsafeguarding the works, materials and plants againstdamage , trespass and carrying out tests etc.

3.0 Facilities for the Contractor

3.1As soon as the Contractor has been given instructions to proceed with the Works, he shall immediately present to the Engineer his location and layout plan of the office facilities for approval and arrange for completion within 1 week of the Engineer's approval.

4.3 Allow for providing Performance Bond as required bythe Contract. The bond shall be effective from the dateof commencement of Contract upto the end of defectsliability period and further 28 days thereafter.
