State President Report Terry Longberry September 2020
Dear Brothers,
I have neglected to congratulate, in this newsletter, Grand Auxiliary Vice-President Elaine Regi (Carlisle
1299) on her ascension to that office. We will be celebrating with you in 2022 in Columbus, Ohio. Another
piece of housekeeping to correct is last month in naming those pictured with me at my Home Aerie,
Wattsburg 4516, were Past Trustee Eric Coulter and his wife, Past Secretary Heather Coulter.
The Ladies Auxiliary Fall Membership Conference was held at the Quality Inn Hotel in New Kensington. I
was happy to be invited for the banquet along with my Membership Chairmen, PSP Larry Mendenhall
(Littlestown 2226) who is also our Eastern Regional President; and Gary Baker (Shenango 285). The
mistress of ceremonies was PMSP Deb Bailey (Freedom 1429). Deb did an excellent job. Her black outfit
was covered in fluorescent paper bananas. Historically, the State Worthy President is forced to wear some
costume that reflects the SMP’s theme. I was spared this year. I was gifted by SMP Pat Rodriguez and
State Auxiliary Membership Chairman Valerie, a monkey t-shirt and a sock-monkey with a stethoscope. I
was not made to dress as a monkey with a stethoscope! Much appreciated. The meal was very good and
a precursor for our joint testimonial dinner which will be held there next April. State Brothers at the
Banquet were: PSP Dwaine Shupe State Secretary (Blairsville 1488), Mike Deleo State Trustee first year
(Falls Creek 965), Patrick Laughman State Chaplain (Hanover 1406), PSP Jack Shirey Clarion 3807, and State
Webmaster Mike Eppley (Gettysburg 1562).
After the function, Gary and I along with Past Zone Captain Linda Boice and her Boyfriend Rick, went to the
Aerie Home for refreshments and a D.J. He played music that we enjoyed and at a volume at which you
could still visit with each other. While there, New Kensington Aerie 533, presented a check for my State
Charity. Thank You Brothers.

During the 2020 Annual Meetings in Reno, Nevada, the following law changes related to membership were passed on the floor by a vote of the Aerie delegates:
1. The $10 re-enrollment fee will be waived until December 31, 2020, for members who
were dropped this year from the rolls. This rule is effective Wednesday, July 22, 2020. Any
members who were charged a re-enrollment fee prior to July 22 will not be entitled to a
refund.
2. Any member who was dropped this year who re-enrolls before the end of the current
fraternal year (May 31, 2021) will be allowed to keep their years of membership. These
members will still be considered “re-enrolled” and will be subject to a vote of the
membership but will retain their original initiation date. This includes benefit
membership status, so long as they pay the proper dues amount associated with benefit
membership. Any member dropped in a previous year who re-enrolls will NOT be
entitled to having their years of membership reinstated.

This guide will assist you when applying for Grants and ensure a smooth process.
Resume letter writing guide for FOE Charity Foundation grant recipients
The FOE Charity Foundation aims to distribute funds where needed as efficiently as possible. The guidelines for
the required resume letter are minimal compared to similar charities that awards grants.
1) Resume letter should be 1-2 pages in length.
2) Resume letter must be on the organization’s letterhead.
3) Resume letter should include a short explanation of the organization’s activities in relation to the grant
request.
4) Resume letter doesn’t require a detailed explanation of purchases or itemized costs.
5) The intent statement (see below) must explain how the funds will be used in correspondence with the
FOE Charity Foundation fund. For example, if the grant has been earmarked for the Cancer fund, the
statement must explain how the organization will use the grant fund for cancer purposes – ie: Cancer
Research.
6) Resume letter must include a statement saying none of the grant funds will be used for administrative
expenses. The FOE Charity Foundation is not permitted to grant funds for costs such as payroll, tuition,
overhead costs, training, continuing education, counseling, payments to speakers, per diems or financial
assistance, including gift cards and vouchers.
7) Letters may be mailed, emailed or faxed.
Intent statement - Explains how the funds will be used, within the grant guidelines. Please be concise and to the
point with this statement. Avoid broad-meaning words and phrases such as “plan to purchase”, “hope to
purchase” and “etc”. Auditors want to see a definitive use of the funds. Funds may not be used to pay for
previous purchases or put into a general fund for future use.
For example:
Grant funds will be used to purchase equipment and supplies for our children’s backpack
program.
Grant funds will be used exclusively for cancer research.
Grant funds may be used in one or more of the following areas:
Research: Must be performed by the organization’s research facility.
Educational Materials: These are non-marketing materials that are distributed
to the public, free of charge. For example: pamphlets on eating with diabetes,
living with Alzheimer’s.
Equipment/Supplies: These are physical/tangible items that are used within the
organization to assist recipients. For example: food for a food program or
puzzles for a game room.
**The FOE Charity Foundation does not accept resume letters that are old/outdated, handwritten, have
handwritten changes or letters where “white out” has been used.

Keeping In Compliance
Compliance is the key to maintaining a healthy Aerie and Auxiliary. To ensure you're in full compliance with the Grand Aerie,
make sure your Aerie/Auxiliary has submitted the items on this page to the Grand Aerie Compliance Department. Failing to
remain in compliance can result in one or more of the following consequences:
Inability to receive representation from the Grand Aerie for any upcoming meetings or events.
Loss of nonprofit tax status.
Suspended or revoked Aerie/Auxiliary Charter
1. General Liability Insurance
You must submit the entire General Liability Insurance policy for the Aerie and Auxiliary with the Grand Aerie Fraternal Order
of Eagles named as Additionally Insured. Auxiliary must either be a policy owner on the Aerie's policy or have their own
separate policy.
2. Bond or Employee Dishonesty Coverage
Your policy MUST include bond or employee dishonesty coverage in order to be considered in compliance with the Grand Aerie.
3. Liquor Liability Insurance
Obtaining Liquor Liability Coverage protects you in the event a patron causes property damage, physical damage to another
individual or causes harm via a motor vehicle after being served at your establishment. A select number of states do not have
dram shop laws, which means the establishment cannot be held responsible for the actions of an individual served there. In these
states (Delaware, Kansas, Louisiana, Maryland, Nebraska, Nevada, South Dakota and Virginia) it is not required for an Aerie to
obtain Liquor Liability Insurance.
4. Signed Affiliation Agreement
As some of you may know, the Grand Aerie and some local Aeries have been found liable in recent lawsuits, costing the
organization in dollars, valuable membership and leadership and adding additional stress and frustration which inhibits our ability
to grow. With these situations and the protection of our members in mind, our legal team drafted the Affiliation Agreement. The
Agreement provides protection to local members, officers, their buildings and property, as well as the Grand Aerie, and provides
us with a valuable resource to guide decision-making on all levels.
The Worthy President and Secretary of the Aerie are required to sign the Affiliation Agreement and send it back to the Grand
Aerie Office to the attention of the Compliance Administrator. Once received, a Grand Aerie official will also sign the agreement
and send a copy back to your Aerie for record keeping purposes. The Affiliation Agreement is located in the MMS Admin
section of the Member Management System (MMS) for your review and signature.
Further, the Affiliation Agreement requires each Aerie to enter into a similar agreement with each of its Auxiliaries, clubs within
a club (such as REAC, Eagle Riders, etc.), and any other subordinate groups. A sample agreement has also been placed in the
reports section of MMS for your reference. Please note the waiver on the first page of the agreement. Due to the variations in the
laws across the United States, we cannot give each Aerie a finalized form to use, but we wanted to at least give an example of
what the agreement between your Aerie and its associated groups could look like.

5. Auditors & Treasurers Reports
Each Aerie and Auxiliary is responsible for submitting annual copies of their Auditors and Treasurers Reports in order to remain
in compliance. These reports help gauge the financial viability of the Aerie/Auxiliary and if executed properly can help protect
you from potential risk. Aeries/Auxiliaries who submit full 990s or the 990 EZ do NOT have to send in their Auditors Report as
the 990 or 990 EZ will include the information requested on the Auditors Report. Aeries/Auxiliaries who submit a 990-N
postcard and all clubs in Canada MUST send in a separate Auditors Report. ALL are responsible for submitting a Treasurers
Report, regardless of the type of 990 filed.
6. 990 for Year Ending May 31
You must have a 990 filed for the most recent fraternal year ending May 31. If all extensions were filed, deadline is April 15. All
extensions must be submitted to the Grand Aerie Compliance Department.
The local Aerie and Auxiliary 990's are due October 15 with the IRS. The IRS does not have the Grand Aerie classification
updated at all of their tax return centers. The Grand Aerie classification was changed from a 501(c)10 to a 501(c)8 in 2007.
All 990 returns should include a copy of the April 5, 2007 IRS Determination Letter. This will avoid local returns being rejected.

7. No Money Owed To The Grand Aerie
All outstanding Per-Capita Tax, Membership Fees and Supplies Invoices must be paid in full to date to be considered in
compliance.
8. House Rules Approved By Grand Aerie
All Aeries & Auxiliaries, per Section 122.4 of the Grand Aerie Constitution & Statutes and Rules & Regulations, must have their
House Rules submitted to the Grand Secretary's Office for approval. Those who have yet to submit their House Rules or whose
House Rules have been rejected will be considered out of compliance until their House Rules are properly approved. Any House
Rules posted which have not been approved are NOT ENFORCEABLE.
