The incident occurred in a vacant shack which has been the bone of contention for residents. They claim to have made numer- ous requests to the City of Cape Town to have the shack demolished. It was eventually broken down on Sunday 22 September, a few hours after the incident had occurred. Community worker Aysha Davids says a number of requests were made to have the shack demolished, but the community re- ceived no responses from the City. “People are really angry in this communi- ty, as we complained about this shack but nobody listened,” she says. “Now a (woman) has been raped, her life destroyed and only now does the City come forward and do what they were supposed to have done months ago.” Davids says Village Heights has a large number of shacks from which illegal she- beens, drug dens and prostitution rings op- erate. This, Davids says, has been communicat- ed to the City. “Why must something ugly first happen before anybody listens to our people? If the City just did their job properly, they could have avoided this rape,” she says. But Mayoral Committee member for Hu- man Settlements Tandeka Gqada explains the City would require a court order to de- molish a structure, even if criminal activity is taking place. “If officials find a vacant structure, they will investigate to establish if there is an oc- cupant who is perhaps on holiday, (in) hospi- tal (or) out of town. Officials will then demol- ish the structure only if we have proof that it is vacant,” she says. Gqada claims the City’s Anti-Land Inva- sion Unit (ALIU) had only received a request to remove the structure on Sunday 22 Sep- tember. However, the unit was not responsible for demolishing the structure. If a vacant structure is found, the Informal Settlement Management (ISM) will alert the ALIU, which, in turn, will conduct an inves- tigation. She says a community leader alerted the ISM staff that the structure’s occupant was in the process of moving out the previous day (Saturday 21 September). Some furniture was still in the structure. “On Monday 23 September, an ALIU team was despatched to investigate,” Gqada says. “They subsequently found that the occu- pant had demolished the structure herself, earlier that morning.” Steenberg police spokesperson Constable Zodwa Kedama says the rape victim was on her way to a shop when one of the suspects grabbed her. She then was dragged into the vacant shack. “There were two other suspects inside the shack and they apparently threatened her, telling her they are all gangsters and would kill her if she resisted,” Kedama says. Driving schools need to be regulated inSouth Africa, says Nazeem Kisten, act-ing general secretary of the South Afri-

can Driving School Operators Association(Sadsoa).

This comes after the association, whichhas been in operation for five years, foundthat very few measures are in place to en-sure that driving instructors deliver ade-quate service to learner drivers.

“Driving instructors only need to pass theinstructors’ test before they can teach some-one how to drive,” says Kisten.

“This is not enough, because many in-structors learn through trial and error,don’t undergo advanced driving courses,and testing centres are often corrupt andaward certificates to people who have failedthe test.”

Sadsoa sent a draft bill of possible regula-tory clauses, which they believe should as-sist in governing the industry, to the nation-al transport department.

Kisten says the bill states that instructorsneed five years’ driving experience; (and)two years’ work experience as an instructorwith an accredited driving school.

He adds instructors also need to be “ap-proved by the provincial transport minister;and should also attend a college which offersa rigorous driving school programme”.

The bill also looks at ways and means toregulate and accredit the driving school in-dustry. All driving schools in South Africaare unregulated as there’s no regulatorybody. More than 95% have not been accredit-ed by the Transport Education Training Au-thority (Teta).

This accreditation allows for drivingschools to apply for government and busi-ness tenders where they’ll be able to teachlearner drivers.

Kisten says tough economic times are of-ten the cause for people becomingdriving in-structors – they may have lost their jobs andhave a car and some patience to teach learn-er drivers. “But pop-up driving schools,which are often called pirates, also need tobe accredited by Teta. Accreditation usuallycosts between R25 000 and R30 000, which on-ly the large, more established drivingschools can afford,” he says.

“The only way more driving schools willbe accredited is if government reduces thelarge costs attached to accreditation andTeta approval. Large driving schools haveno issues with accrediting their businesses,because they have means to do so.”

Kisten says acquiring a driver’s licensewill become more difficult over time due tothe computerised learner’s test implement-ed at some testing centres.

This new testing means will require learn-er’s license candidates to sit in a simulatorto test their possible driving skills, as wellas 16 hours of preparation.

He hopes to see testing yards regulated toensure they meet the standards set by thebill.

“Driving schools should join the associa-tion so they can be prepared for the possibleregulations, because by the time the govern-ment passes the legislation no one will beable to have an unaccredited driving

school,” Kisten says.“Cars used for teaching will need to be a

certain type, with an operating number andall driving schools will need to be registeredcompanies with an office and a landline.”

He further adds the regulatory body hopesto apply these stringent rules, because ofpast caseswhere learners paid for lessonsupfront and fraudulent instructors, who oper-ated from cars and with a cellphone, disap-peared with their money.

A learner driver, who spoke on conditionof anonymity, says he had been requested topay in advance for lessons at Aubrey’s Driv-ing Academy, which had come highly rec-ommended. “The instructor asked for themoney up front. I did not feel comfortablehanding over more than R1 000 to someoneI did not know, and instead switched to aschool where I (was required to) pay per les-son,” he says.

Academy owner Aubrey Richter has beena driving instructor for 15 years. He, too,wants to see the industry regulated.

“An ombudsman is needed for drivingschools where people can lodge complaintsabout schools, because the industry lacks ac-countability,” he says.

He says his business asks for payment pri-or to lessons as people who pay per lessonare very inconsistent and lack commitment.

“It’s difficult to satisfy clients all the time.If people don’t like what they see, theyshould go to another established drivingschool and avoid the fly-by-night ones,” hesays.

Provincial department of transportspokespersonAl-AmeenKafaar says there isno legislation to regulate driving schools.

Village Heights ‘rape’ shack destroyedTAURIQ HASSEN

On Monday 23 September two suspects werearrested in Village Heights and appeared inthe Wynberg Magistrate’s Court on chargesof rape.

Village Heights resident Willimiena Ar-dendorf says she is overcome with sadnessafter hearing of the rape.

She says the community already fears fortheir lives, with the ongoing gang activityplaguing the area. “It can all just end now,but it seems like it is getting worse by theday,” the mother of three says.

“I would probably die if that was my daugh-

ter, because (the woman) is now scarred forlife.”

Ardendorf confirms that a number of resi-dents had complained about shacks beingused for illegal activities.

She is also aware of the shack in questionand is angry that “nothing ever happened”about the initial complaints. “It really istough for our people, because you have to liveamong the deaths, rapes, robberies, gang-sters and drug dealing,” Ardendorf says.V Report vacant shacks to the City’s Anti­Land InvasionUnit on 080 022 5669 or the City’s ISM, which will alertthe ALIU to vacant structures. The ALIU also does spo­radic patrols.

More than 20 homeless after blazeA fire destroyed the homes of 26 MilitaryHeights residents at the weekend.

The blaze, which was ignited by an elec-trical short circuit in the early hours ofSaturday morning, has left these informalsettlement residents homeless.

The City of Cape Town’s Fire and Res-cue Services spokesperson Sharon Boschsays the fire was extinguished just before05:00, destroying six wooden and ironstructures.

“One adult man sustained burn woundsto his hand and was taken to hospital fortreatment,” she says.

Earlier this month a fire left another 25people displaced at the nearby VillageHeights informal settlement.

One man sustained burn wounds andwas treated at the Victoria Hospital.

Follow these safety tips to avoid the ig-niting of infernos:

. Keep a close eye on paraffin stoves.

Don’t cook near a window with a curtain.. Make sure the stove does not fall over,

which may burn children or cause a fire.. Make sure candles are secure and

can’t fall over. . Don’t go to sleep withcandles still burning.

. Teach children about the dangers offire.

. Watch out for discarded cigarettebutts.

. Be aware of the dangers of illegal andfaulty electricity connections, which alsocause fires.

. Keep a bucket handy to fill with waterso that you can extinguish flames easily.

. Keep a bucket of sand to put out paraf-fin fires.

Build dwellings a good distance apart toprevent fires from spreading. Make surethis space is kept open.

. Keep roads and access to dwellingsclear at all times.

Retreat locals living in Concert Boule-vard claim their cries for an upgradeof their blocks of flats are falling on

deaf ears.The Sterling, Horsely, Ayre, Albertus

and Lesar (SHAAL) courts are believed tobe in an appalling state with leakages,cracked walls, broken windows and rottenceilings topping the list of concerns.

Problems had previously been listed andsent to the City of Cape Town for action, res-idents say, but nothing has been done.

Hermanus Williams, the newly-electedchairperson for SHAAL, says the City hasnot done anything to assist the people whoare forced to accept the “poor living condi-tions”.

“People are worried in this community,because nothing happens when complaintsare forwarded to the council,” he says.

Williams says residents are regularly re-porting various problems with their flats,which he finds “unacceptable and inexcus-able”.

“They do not deserve to live like this, be-cause these are their homes and theyshould be treated with respect,” he says.

Mellicent Adams has been living at theflats for nearly 20 years and was forced tofork out thousands of rands to fix her home.

“It is not my responsibility, but some peo-ple are so sick of waiting for the council todo something,” she says.

“We cannot wait until (the City) decidesto do something to our flats, because weneed to feel comfortable in our livingspace.”

Adams experienced moulding problemson ceilings and a wall, due to faulty gutter-ing installed by the City. She was also una-ble to open her bedroom windows, as it wasrusted and old.

Another Ayre Court resident, who spoke

on condition of anonymity, has given uphope on the council. “People living heremust look after themselves; it looks like theCouncil has forgotten about us,” she says.

She adds the blocks could do with a coatof paint.

Ward councillor Jan Burger waved awayclaims that the flats were being ignored bythe City, says “maintenance work has beencarried out”.

This includes the installation of new win-dows and guttering.

He says vandalism and poor communica-tion are key components to the problem.

South African Reserve Bank wants toreach 11 million South Africans andmake them aware of illegal pyramid orPonzi schemes.At a news conference last week Hlen-

gani Mathebula, head of group strategyand communications at the ReserveBank, said thousands of South Africansfall victim to illegal schemes that taketheir money and promise quick riches.People should be very careful and do

their homework properly before invest-ing their money in any scheme, he said.“Any promises or assumptions of exces-sive returns on your money should beviewed with suspicion.”Mathebula said people are often driv-

en by greed to makemoremoney, whichleads to them being exploited and even-tually losing everything.“Get advice from accredited and regis-

tered financial services before you in-vest any money. Accredited financialservices are regulated by the ReserveBank, the Financial Services Board andthe National Credit Regulator,” Mathe-bula said.“Take to heart the hackneyed expres-

sion: if it sounds too good to be true, itprobably is.”Mathebula said people do not only lose

retirement and pension money throughillegal schemes. “There are even thosewho borrow anything from R20 000 to amillion rand from banks to invest,” hesaid.“This has serious social and economic

implications. If you lose yourmoney, thebanks still want back what you bor-rowed from them. It causes people to bein trouble, can’t afford essentials or arenot able to pay children’s school fees.”He said the sum of money people in-

vest in the schemes range from thou-sands to several millions, and the size ofschemes are from 20 to 1000 people.As for the appearance of schemes, the

Reserve Bank received many com-plaints last year. It also reviewed and in-vestigated schemes started in January2008 to the end of last year.During this time temporary inspec-

tors investigated 75 cases.A total of 145 surveys were carried

over from previous years and 89 werecompleted over a five-year period.In 2012 11 new investigations were

launched and 27 were carried over fromprevious years.To the query why some investigations

Small-scale fishing communities canlook forward to a larger “basket” ofspecies when they apply for fishing

rights.DesmondStevens, actingdeputydirector-general of theDepartment of Fisheries, saidrights would be issued for more than onespecies in future, and not only for a particu-lar species, such as West Coast Rock Lob-ster.Scientific data will determine which spe-cies will be included.The aim is to utilise resources in a sus-tainable manner and to give it a chance torecover.Some species are also only available dur-ing a certain time of year,whichmeans thatfishermen only get an income then.Amendments to the Marine Living Re-sources Act (MLRA), which aims to includethe awarding of long-term fishing rights tosmall-scale fishers, was recently tabled inparliament.MPs will start considering it this week.At amedia briefing Stevens said the proc-ess, which expires in December, to allocatefor permits in eight fishing sectors is ontrack.On the small-scale fishing front, the de-partment plans toworkwith the Universityof the Western Cape to verify the fisher-

men’s status and register them. Small-scalefishers are people who make a living fish-ing, traditionally live close to fishing areas,use equipment of low technology and selland process their own products.“Currently we have 8 000 small-scale fish-ermenwho receive individual permits. Theidea is to eventually establish 143 fishingcommunities to whom community fishingquotas will be allocated,” Stevens said.He said although the fishing quota cakewill not to be increased, the departmentwants to ensure that small-scale fishers re-ceive value for their products.“The fishermen currently have no bar-gaining power. Middlemen, who give fish-ermen advances on the strength of fishingquotas, are crippling them,” Stevens said“Sometimes the small-scale fishermensell their products to middlemen as soon asit comes out of the sea. For example, if themiddleman offers R15 per unit, you do nothave a choice but to accept it. There are noset prices because the industry is not regu-lated.”Stevens said the idea is to set minimumprices.“We want companies to get involved andbuy fish from small-scale fishermen at ahigher price. We do not want to determinethe market, but regulate it so that small-scale fishers getmore for their products andexpand their market access.”

LAVENDER HILL: SUPPORT PLAN FOR SCHOOL DROPOUTS

Helping hand for childrenTAURIQ HASSEN

A local organisation has vowed to getschool dropouts in Lavender Hill backbehind a school desk.

When the gang violence spiralled out ofcontrol in the community,many school chil-dren feared for their lives and were forcedto stay out of school.The number of pupils dropping out of

school became a major concern, leading tothe establishment of the Local Network ofCare (LNC).Project coordinator Aysha Davids says

the LNCwas formed asmany feared the pos-sibility of children choosing the life of gang-sterism and crime.“We know that many of the children were

affected by the gang violence in the commu-nity and the LNC just wanted to give chil-dren another option, rather than succumb-ing to the violence in our community,” shesays.The LNC is made up of 10 local organisa-

tions operating in Lavender Hill. They carefor children by providing life skills training,investigating their living conditions, familycounselling and anger management classes.“We want our children to see that there is

help out there for them and they don’t haveto feel as if they are living in the dark,” Dav-ids says.The LNC proudly confirms that around 25

children have already gone through the pro-gramme and returned to school on Tuesday.Lavender Hill resident Anthea Sampson

has two children who decided to stay athome, as they feared for their safety on thestreets.She was delighted to hear that an initia-

tive is up and running in the community to

assist with the number of learners droppingout of school.“The people in this community feels like

nobody outside the area really cares aboutthem and everybody is afraid of doing some-thing in this community,” Sampson says.In a very sad tone, Sampson says her eld-

est daughter (19) died in the crossfire aboutsix years ago. He daughter’s death escalatedher fears of losing her two remaining chil-dren.She would happily allow the LNC to offer

her advice on how to get her children backin school safely.

“They missed out on most of their school-ing last year, because of all the shooting go-ing on. I just did not want to send them toschool and see them returning in a bodybag,” Sampson says.“The shooting here in lavender Hill gave

me sleepless nights.”

Apair of high tunnels forPhumlani Village will bethe start of a new era fora community drowningin poverty.The high tunnels – a

dome-like greenhouse–will be used to grow pro-duce all year round andwill meet a number ofneeds for both the com-munity and the NewChapter Foundation(NCF), the local organi-sation driving theproject.NCF director Malcolm

Josephs says fundrais-ing has already beenwrapped up, with the or-ganisation securing R120 000.The project will start off with two high

tunnels, which will cost R58 000 each.“We are currently in negotiationwith the

City of Cape Town for available land; thatis the challenge right now – finding openland,” he says.Josephs says NCF have their eyes set on

a vacant patch of land in Schaapkraal, buttalks are still underway.The organisation was founded in March

2011 and serves communities across theCape Town region.NCF recently also started a nutrition cen-

tre which provides soup for the children onFridays, as well as to many who strugglewith malnutrition.The produce grown at the high tunnels

will be used to feed the nutrition centre toprovide low-cost, local, nutritious and or-ganic food to the Phumlani Village commu-nity.Employment opportunities will also be

created, will assist with educating the com-munity about nutrition and provide practi-cals to whoever needs help with startingtheir own gardens.The tunnels could also provide NCF with

some additional income through the sellingof some produce in local markets whichwill, in turn, go towards projects like thenutrition centre.“This is a fantastic opportunity for the

community to have something that will notonly benefit them now, but in the long run.This can be a really great project that couldleave a lasting legacy,” Josephs says.Project coordinator Ben Pfeffer says ex-

citing times lay ahead for the informal set-tlement, as the tunnels will be aimed at cre-ating some positivity within the communi-ty.“Projects like these are really important,

because this is a community where the un-employment rate is really high,” he says.“This is a good step towards poverty alle-

viation and we hope this will be the startof many more positive projects for the vil-lage.”Josephs also indicated that a local busi-

nessman has already agreed to sponsor athird tunnel, but discussions are still un-derway.Phumlani Village resident Solumsi

Mkhize is excited at the prospect of havinga project that will benefit the community.She is more wound up about employment

opportunities becoming available, as shehas two unemployed sons struggling to findwork. “Our area has very little working op-portunities and people in this communityare frustrated about that,” she says.“It reallywould help to have a project like

this in the area, because not only can peoplebeworking, but the things they areworkingon will be for the community.”

local musos started, a few years ago andboats stellar talent. With this Cape JazzSeries they are now releasing Volume 4,Musical Democracy.

Mountain Record’s Paddy Lee-Thorpehas been in the music industry in thispart of the world since the 1970s, havingproduced and managed acts such as Pacif-ic Express and Jonathan Butler, when hestarted getting into the jazzier side of mu-sic. “I’ve never lost my love for the musicfrom the Cape,” Lee-Thorpe confesses.

“Most of the time I am based in Germa-ny, but when I want to take a quick triphome, one of my CDs from here has meback in a flash.

“This project is very important to meand the musical heritage of music fromthe Cape, as there is still so much musicthat these living legends have to offer.More importantly, it is now also giving

the younger generation a chance to workwith these legends to inspire the genera-tions to come.”

Under the leadership of veteran stardrummer Jack Momple, compositions byErrol Dyers, Stephen Erasmus, SpencerMbadu and Ramon Alexander have beenrecorded.

It was also made to pay tribute to thememory of the Mountain Records record-ing artists such as Robbie Jansen andTony Schilder, who have passed on.

While Dyers, Erasmus, Mbadu andMomple are an integral part of the richlegacy of the music, they were also joinedby reknowned percussionist DizuPlaatjies and Tony Cedras, a multi-in-strumentalist from the Cape, who hasgone on to take to the world stages withthe best in the business.

Cedras was also part of Paul Simon’sband for many years.

If some schools were to literally throw their rule book atsomeone, they would seriously injure that person.Former Model C schools, private and even some govern-

ment schools have rule books which compete with a tele-phone directory. To underpin their seriousness towards dis-cipline – amuch-envied component at SouthAfrican schools– pupils are also required to sign these rule books as an indi-cation they’ve read it and agreed to the content.In brief, the signature means those pupils will abide by

the dense document of rules.While the intention is honourable, it may be rather hard

for the average school child to abide by these often rigid re-quirements. Some schools have full A5 pages stipulating re-quirements for hairstyles, length of hems and general be-haviour.It is good to have rules as children need structure and

boundaries. Many parents seek out schools valued for theirhigh regard for discipline.The question is: to what extent before it starts infringing

on their constitutional rights and children start acting out?Many schools, especially ones with a governing body, op-

erate on their self-determined set of rules. One has to ques-tion if these rules are meant to harness discipline amongthe school populace or if they are there to the exclusion ofpresumed wayward children.School violence has been highlighted lately. In a recent

incident, a Johannesburg primary school pupil allegedlypunched a teacher in the face for asking him to remove ajersey which was not part of the school uniform.Teachers often bear the brunt of children who cannot ver-

balise their frustrations. And children are far more au faitwith their rights. They know corporal punishment is out-lawed.Children will push the boundaries, but even with all this

knowledge they still remain children.Much like adults, sometimes children just want to be

heard. And then the rule bookmay be inadequate. Teachersare, after all, in loco parentis.

sity of Stellenbosch in 2009 to broadcastmat-ric lessons via satellite to 144 schools.The department now has many hours of

A glut of Western Province play-ers have been named in theSouth African Rugby Legends

Association Iqhawe Week All StarTeam.The All Star Team will not play

any matches but head of develop-ment for SA Rugby Legends, PieterMuller says the selection could raiseplayers’ profile and lead to them be-ing selected for elite squads at theirunions. “The All Star Team couldn’tbe a formalnational side, as all 16un-ions were not competing. But wewanted to give recognition to theplayers who played well at the tour-nament,” Muller says.“It’s important for unions to un-

derstand that they should be lookingat the players we picked for theirelite squad system, as these kids are15-years-old and are eligible for theGrant Khomo Week.“All we can do is contact the un-

ions to inform themof the selections.

It’s up to the unions to (take it fur-ther); we will do what we can to getthe kids in.”The Iqhawe Week was hosted at

City Park in Athlone last week andeight coastal provinces competed inthe under-15 tournament. The teamswere WP, Boland, Griquas, KwaZu-lu-Natal, South Western Districts,Golden Lions, Border and EasternProvince. All players selected for theprovinces came from developingrugby schools; the vast majoritycame from schools which partici-pate in the Vuka League – anotherinitiative of SA Rugby Legends.Muller says the aim of the Vuka

League and the Iqhawe Week is tocreate a means to develop playersand offer them a “pathway” to theelite set-up at their unions.“Wewant to give these kids anoth-

er opportunity to be seen.We are notlooking at the top schools; we arelooking at the rural schools and thedormant schools. Nobody looks atthose schools. We want to give them

the opportunity,” he says.“Our Vuka programme in the

Western Cape has over 80 schools.That’s where the WP team was se-lected from– fromschools that neverplayed rugby; schools in Langa andAtlantis. That’s whatwewant to cre-ate all around the country.”Players in theWP team came from

16different schools across thePenin-sula, including Mountview High inHanover Park, Spine Road, Port-lands and Lentegeur high schools inMitchell’s Plain and Darul Islam inGreenhaven. The weight of expectation thatcomes with the “favourites” tagcan be crippling for a sports

team.Not so for Milano United.The Grassy Park side have started

the National First Division (NFD)season in fine form, winning four outof four matches and scoring ninegoals while conceding just three.This promising start, combined

with a surprising showing last sea-son – their first in the NFD – has seenMilano crowned early-season favour-ites.Head coach Theo Hempe says his

team doesn’t mind either way.“There are no clear favourites in

this league. The good start doesn’tmeananything;we still have to finishwell,” Hempe says.“We don’t mind being called fa-

vourites. There is mental toughnessin this team and we believe we aregood enough to win the league. Wedon’t care whether we are favouritesor not. We believe we can go all theway.”Milano started the seasonwitha 2-0

win against Jomo Cosmos (H), wenton to beat FC Cape Town 3-1 (A) andedged Roses United 1-0 (A).On Sunday Hempe’s charges re-

corded their most meaningful victo-ry thus far, beating AfricanWarriors3-2 (H) in a top-of-the-table clash. TheFree State team went into this matchplaced second on the table, trailingtheir opponents on goal difference.Warriors finished sixth last sea-

son, a place above Hempe’s side, andMilano are yet to play any team whofinished in the top five.Hempe rejected the idea that his

team’s position at the summit couldbe due to a easy start to the season.“No games are easy in this league.

It’s very difficult to win four in arow,” he says.“The players have matured and

learned since last season. We aregood enough to beat every team. Itdoesn’t matter who we play, everygame is difficult.”Milano are likely to maintain their

perfect record on Saturday whenthey face sixth-placed NFD debu-tantes Baroka FC.The Black and Yellow will be with-

out 2012/2013 top goal scorer LesvinStoffels for at least another twoweeks. But Hempe believes his sidewill manage to win without their hit-man.“We have all-round strength in our

team. All our players aren’t availa-ble, but we have depth in our squad,”he says.“There is (still) a lot of room for im-

provement. The more the team playstogether, the better theywill get. Andwith the players coming back frominjury and reaching full fitness, theteam will just get better.”Meanwhile, fifth-placed Santos

will hope to get their promotion cam-paign back on track when they hostBlackLeopards at Coetzenberg Stadi-um in Stellenbosch tomorrow (Fri-day) at 19:30.Leopards were relegated from the
