"Pepsi Wepsi Break" The Theme “How Good Are in Your Gardening? “ talks about the Non- compete restrictive covenant. The article “Pepsi Wepsi Break” is about the hyper-competition between the two beverage companies- Pepsi and Coca Cola in India. Pepsi had entered India in 1988, had a joint venture with two Indian companies. People started associating Pepsi with Cola. So this linguistic advantage helped Pepsi to increase its sales. Coke had a presence in India earlier but it pulled out in 1977 after the new govt regulations forced it to partner with an Indian Company and share its drink’s secret formula which was a trade secret for them, a privilege communication. Coke re-entered in the 1993 after the Indian Regulations were changed. Coke followed the approach of a diversified portfolio of drinks to have an edge. The Hyper Competition between the two companies could also be seen from the story “EVP through Blank Cheque” where Coke tried to acquire the entire sales team of Pepsi in Kanpur by offering increased salaries. Three employees violated their Non-compete agreement and joined Coke. Pepsi filed for tortious interference against coke but the court rejected it by stating that employee mobility cannot be restricted by court injunction. The Non-Compete agreement in India is non-constitutional which we can see through the story of “Quit Infy, Can’t join rival for 6 months”, the employees were asked to sign a non-compete agreement for a period of 6 months after annual hike was declared. If I were to do this activity once again I would focus more on the hyper competition between the two companies and how the Non-Compete agreement is handled in different parts of the world.
