TERMS AND CONDITIONS

Please read this page carefully. It provides you important information about Mentor Sacco ltd. Accounts and the terms of the use of your account and any other services connected to your account.

The information on this page (and any further instructions and conditions that may be prescribed by Mentor Sacco from time to time) are the agreement between you and Mentor Sacco. When you sign the account application form you accept these terms as binding on you

All deposits into Mentor Sacco must be made through the authorized collection channels. Mentor Saccowill not be liable for funds handed over to any

members of its staff or appointed agents outside the approved collection channels. Mentor Sacco may exercise its general lien or any similar right it is entitled to by law or consolidate all or any of your accounts against any liabilities to

mentor and set off or transfer any sum standing to the credit of any one or more of such accounts or any other credit against any indebtedness you may have with us.

While we will try and operate your account accurately, mistakes may occur. If you are aware that an amount has been incorrectly credited or debited to your account you should notify us immediately. If you use funds with the knowledge that they were incorrectly transferred into your account, we may take steps to recover the money from you or your account and take such proceedings or actions as may be appropriate. Any anomaly in the entries on your account statements must be brought to the attention of Mentor Sacco within 21 days of the date thereof and you agree that failure to give such notice absolves Mentor Sacco from all liabilities arising there from.

Your account may be debited for such service charge as may be set by Mentor Saccofrom time to time. Mentor Sacco will not be liable for any loss or damage to funds deposited with Mentor Sacco due any future Government order, law, levy, tax embargo,

moratorium, exchange restriction or any other causes beyond our control. All notices or letters will be sent to the address supplied by you and will be considered duly delivered and received at the time it is delivered or seven

days after posting using the postal address last provided to us. Mentor Saccowill levy charges on the account from time to time. Mentor Sacco may in its sole discretion revise these charges and fees with or without

any noti ication. MentorSacco may upon your request issue you with an ATM card to enable you access your account. If your Mentor Sacco Link ATM card gets lost,

stolen or is missing you must notify us within 24 hours where practical or immediately thereafter with su icient reason for any delay. Mentor shall not be held liable for any unauthorized use of ATM card where the loss or otherwise of the same has not been noti ied with the stipulated time.

You have given Mentor Sacco in an acceptable form the specimen signature of every person authorized to operate your account. Unless otherwise agreed all signatories are entitled to operate the account with full rights as yourself.

In addition to the foregoing, in the case of joint accounts, the following shall apply if one of the account holders dies: Any money for the time being standing to the credit of your joint account(s) shall be held to the order of the survivor (subject to the applicable

legislation). Any liability incurred by joint account holders to Mentor Sacco (whether inform of borrowing or otherwise) shall be joint and several.

Mentor Sacco Limited may, at its discretion, from time change the features of any alerts/ facility. The customer will be solely responsible for keeping himself updated of the available alerts, which shall, on best-effort basis, be noti ied by Mentor Sacco Limited through their website or through any other legally recognized medium of communication.

Mentor Sacco Limited is not bound to acknowledge the receipt of any query instructions nor shall Mentor Sacco Limited be held responsible to verify any instructions. Mentor Sacco shall endeavor to provide instructions on a best effort basis and wherever operationally possible for the Sacco.

The customer acknowledges that the Spot Cash facility is dependent on the telecommunications infrastructure, connectivity and services within Kenya. The customer accepts that timelessness of alerts sent by Mentor Sacco Limited will depend on factors affecting the telecommunication industry, neither Mentor Sacconor its service providers shall be liable for non-delivery or delayed delivery of alerts, errors, loss, and distortion in transmission of and wrongful transmission of alerts to the customer.

Mentor Sacco Limited shall endeavor to provide the facility on a best effort basis and the customer shall not hold Mentor Sacco or its partner(s) responsible / liable for non-availability of the facility or any loss or damage caused to the customer as a result of use of facility (including relying on the alerts for the customer’s investment or business purposes). Mentor Sacco Limited or its service providers shall not be held liable in any manner to the customer in connection with the use of facility.

The customer accepts that each alert may contain certain account(s) information relating to the customer. The customer authorizes Mentor Sacco to send account related information, though not speci ically requested, if Mentor Sacco deems that the same is relevant.

The customer must keep their Spot Cash personal identi ication Number (PIN) secret at all times. Failure to adhere to the above and/or in case of any unauthorized use of his/her Spot Cash PIN.

You shall keep Mentor Sacco indemni ied on a full and unquali ied indemnity basis against all and any costs, claims, actions, damage or losses suffered or incurred by Mentor Sacco in connection with any breach by you of any term and condition hereof where the particular circumstance is within your control

The action, claim or loss is brought against Mentor Sacco on Mentor Sacco’s reliance on any incorrect, illegible, incomplete or inaccurate information received by you.

Mentor Sacco will not be responsible nor liable for any loss suffered by you should it be unable to offer its services to you by reason of any circumstance whatsoever not reasonably within Mentor Sacco’s control.

These terms and conditions are subject to change. The change may consist of the addition of a new term or the alteration or deletion of an existing term. Mentor Sacco reserves the right to change these terms and conditions without reference to you.

Mentor Sacco is not responsible for the authenticity or validity of documents provided Mentor Sacco Limited or its employee/contractual staff will not be liable for:

Any unauthorized use of the customers’ PIN or

Mobile phone number/instrument or unauthorized access to e-mails received at his noti ied e-mail address for any fraudulent, duplicate or erroneous instructions given by use of the same;

Acting in good faith on any instructions received by Mentor Sacco to act on all or any of the instructions; Loss of any information/instructions/alerts in transmission; Unauthorized access by any other person to any information/instructions given by the customer or breach of con identiality. All responsibility of use of facility by secondary cardholder/joint account holder shall be binding on all joint account holders.

I/We have read and understood the terms and conditions set out above governing the use of your account and the services to be provided together with your account offered by Mentor Sacco and I/we hereby accept them and will abide by them.
