Definitions1(1) The following definitions apply in this Act.

"business contact information" means anindividual's name, position name or title, businesstelephone number, business address, businesse-mail, business fax number and other similarbus ine s s in fo rma t ion . (« coo rdonnée sprofessionnelles »)

"domestic" means related to home or family.(« domestique »)

"employee" means an individual employed by anorganization and includes an individual whoperforms a service for or in relation to or inconnection with an organization

(a) as an apprentice, volunteer, participant orstudent; or

(b) under a contract or an agency relationshipwith the organization. (« employé »)

"investigation" means an investigation related to

(a) a breach of an agreement;

(b) a contravention of an enactment of Manitobaor Canada or of another province of Canada; or

(c) circumstances or conduct that may result ina remedy or relief being available at law;

if the breach, contravention, circumstances orconduct in question has or may have occurred or islikely to occur and it is reasonable to conduct aninvestigation. (« enquête »)

"legal proceeding" means a civil, criminal oradministrative proceeding that is related to

(a) a breach of an agreement;

(b) a contravention of an enactment of Manitobaor Canada or of another province of Canada; or

(c) a remedy available at law. (« instance »)

"minister" means the minister appointed by theLieutenant Governor in Council to administer thisAct. (« ministre »)

"Ombudsman" means the Ombudsman appointedunder The Ombudsman Act. (« ombudsman »)

"organization" includes

(a) a corporation;

(b) an unincorporated association;

« document » Document qui reproduit desrenseignements sous une forme ou un supportquelconque, manuscrit, imprimé, photographique,électronique ou autre. La présente définition exclutles logiciels électroniques et les mécanismes quiproduisent des documents. ("record")

(c) a union as defined in The Labour RelationsAct;

(d) a partnership as defined in The PartnershipAct; and

(e) an individual acting in a commercialcapacity;

but does not include an individual acting in apersonal or domestic capacity. (« organisation »)

"personal employee information" means, inrespect of an individual who is an employee or apotential employee, personal information reasonablyrequired by an organization that is collected, used ordisclosed solely for the purposes of establishing,managing or terminating

(a) an employment relationship; or

(b) a volunteer work relationship;

between the organization and the individual, butdoes not include personal information about theindividual that is unrelated to that relationship.(« renseignements personnels liés à l'emploi »)

"personal information" means information aboutan identifiable individual. (« renseignementspersonnels »)

"personal reporting agency" means a personalreporting agency as defined in The PersonalInvestigations Act. (« bureau d'enquête privé »)

"public body" means a public body as defined inThe Freedom of Information and Protection ofPrivacy Act. (« organisme public »)

"record" means a record of information in any formor in any medium, whether in written, printed,photographic, electronic or any other form, but doesnot include a computer program or other mechanismthat can produce a record. (« document »)

« ombudsman » La personne nommée à ce titre enapplication de la Loi sur l'ombudsman.("Ombudsman")

« organisation » S'entend notamment :

a) des corporations;

b) des associations non constituées encorporation;

c) des syndicats au sens de la Loi sur lesrelations de travail;

d) des sociétés en nom collectif au sens de laLoi sur les sociétés en nom collectif;

e) des particuliers agissant dans le cadre defonctions commerciales.

Ne sont pas visés par la présente définition lesparticuliers agissant à titre personnel ou dans lecadre de fonctions domestiques. ("organization")

« organisme public » S'entend au sens de la Loi surl'accès à l'information et la protection de la vieprivée. ("public body")

« rapports mandant-bénévole » Rapports entreune organisation et un particulier dans le cadredesquels des services sont fournis à une organisationou relativement à celle-ci par un particulier qui agiten tant que bénévole ou à quelque autre titre sansrémunération à l'égard de ces services. Sontégalement visés tous rapports analogues entre uneorganisation et un particulier dans le cadre desquelscelui-ci est, à l'égard de ces rapports, un participantou un étudiant. ("volunteer work relationship")

« renseignements personnels » Renseignementsconcernant un particulier identifiable. ("personalinformation")

"volunteer work relationship" means arelationship between an organization and anindividual under which a service is provided for orin relation to or is undertaken in connection with theorganization by an individual who is acting as avolunteer or is otherwise unpaid with respect to thatservice and includes any similar relationshipinvolving an organization and an individual where,in respect of that relationship, the individual is apar t ic ipan t or a s tudent . (« rappor tsmandant-bénévole »)

« renseignements personnels liés à l'emploi »S'entend, relativement à un particulier qui est unemployé ou un employé potentiel, desrenseignements personnels qui sont raisonnablementrequis par une organisation et qui sont recueillis,utilisés ou communiqués pour créer, entrel'organisation et le particulier, soit des rapportsemployeur-employé, so i t des rapportsmandant-bénévole, pour gérer de tels rapports oupour y mettre fin. Ne sont pas visés par la présentedéfinition les renseignements personnels sans lienavec ces rapports. ("personal employeeinformation")

Interpretation: destruction of records1(2) In this Act, a record is destroyed when it isphysically obliterated in a manner that

(a) renders it

(i) illegible, in the case of a written record,

(ii) unrecognizable, in the case of a photograph,or

(iii) useless or ineffective, in the case of arecord that is recorded or stored in anothermanner; and

(b) makes it impractical to reconstruct the record orany part of it.

b) que sa reconstitution totale ou partielle estpratiquement impossible.

Standard as to what is reasonable2 Where in this Act anything or any matter

(a) is described, characterized or referred to asreasonable or unreasonable; or

(b) is required or directed to be carried out orotherwise dealt with reasonably or in a reasonablemanner;

the standard to be applied under this Act in determiningwhether the thing or matter is reasonable orunreasonable, or has been carried out or otherwise dealtwith reasonably or in a reasonable manner, is what areasonable person would consider appropriate in thecircumstances.

PURPOSE AND APPLICATION OBJET ET CHAMP D'APPLICATION

Purpose3 The purpose of this Act is to govern thecollection, use and disclosure of personal informationby organizations in a manner that recognizes both theright of an individual to have his or her personalinformation protected and the need of organizations tocollect, use or disclose personal information forpurposes that are reasonable.

Objet3 La présente loi a pour objet de régir lacollecte, l'utilisation et la communication derenseignements personnels par les organisations d'unemanière qui tienne compte à la fois du droit desparticuliers à la protection de leurs renseignementspersonnels et du besoin des organisations de recueillir,d'utiliser et de communiquer de tels renseignements àdes fins raisonnables.

Application4(1) Except as provided in this Act and subject tothe regulations, this Act applies to every organizationand in respect of all personal information.

Champ d'application4(1) Sauf disposition contraire de la présente loiet sous réserve de ses règlements d'application, laprésente loi s'applique à toute organisation et à toutrenseignement personnel.

Exemption re public body 4(2) Subject to the regulations, this Act does notapply to a public body or any personal information thatis in the custody of or under the control of a publicbody.

Exemption applicable aux organismes publics4(2) Sous réserve de ses règlementsd'application, la présente loi ne s'applique pas auxorganismes publics ou aux renseignements personnelsqui relèvent d'un tel organisme.

Other exemptions4(3) This Act does not apply to the following:

(a) the collection, use or disclosure of personalinformation if the collection, use or disclosure, asthe case may be, is for personal or domesticpurposes and for no other purpose;

(b) the collection, use or disclosure of personalinformation if the collection, use or disclosure, asthe case may be, is for artistic or literary purposesand for no other purpose;

(c) the collection, use or disclosure of personalinformation, other than personal employeeinformation, that is collected, used or disclosedpursuant to sections 15, 17 or 21, if the collection,use or disclosure, as the case may be, is forjournalistic purposes and for no other purpose;

(d) the collection, use or disclosure of businesscontact information if the collection, use ordisclosure, as the case may be, is for the purposes ofcontacting an individual in that individual's capacityas an employee or an official of an organization andfor no other purpose;

b) la collecte, l'utilisation ou la communication derenseignements personnels qui est accomplieuniquement à des fins artistiques ou littéraires;

c) la collecte, l'utilisation ou la communication derenseignements personnels — autres que desrenseignements personnels liés à l'emploi recueillis,utilisés ou communiqués conformément àl'article 15, 17 ou 21 — qui est accomplieuniquement à des fins journalistiques;

d) la collecte, l'utilisation ou la communication decoordonnées professionnelles qui est accomplieuniquement dans le but de communiquer avec unparticulier en sa qualité d'employé ou de dirigeantd'une organisation;

(e) personal information that is in the custody of anorganization if The Freedom of Information andProtection of Privacy Act applies to thatinformation;

(f) personal health information as defined in ThePersonal Health Information Act where thatinformation is collected, used or disclosed by anorganization for health care purposes, includinghealth research and management of the health caresystem, but for the purposes of this clause healthinformation does not include personal employeeinformation;

(g) the collection, use or disclosure of personalinformation by an officer of the Legislature, if thecollection, use or disclosure, as the case may be,relates to the exercise of that officer's functionsunder an enactment;

(h) personal information about an individual if theindividual has been dead for at least 20 years;

(i) personal information about an individual that iscontained in a record that has been in existence forat least 100 years;

(j) personal information contained in any recordtransferred to an archival institution where access tothe record was unrestricted or governed by anagreement between the archival institution and thedonor of the record before the coming into force ofthis Act;

(k) personal information contained in a court file, arecord of a judge of The Court of Appeal, the Courtof Queen's Bench or The Provincial Court, a recordof a master of the Court of Queen's Bench, a recordof a sitting justice of the peace or a presiding justiceof the peace under The Provincial Court Act, ajudicial administration record or a record relating tosupport services provided to the judges of any of thecourts referred to in this clause;

(l) personal information contained in a record of anytype that has been created by or for

(i) a member of the Legislative Assembly, or

(ii) an elected or appointed member of a publicbody;

e) les renseignements personnels qui relèvent d'uneorganisation et auxquels s'applique la Loi sur l'accèsà l'information et la protection de la vie privée;

f) les renseignements médicaux personnels au sensde la Loi sur les renseignements médicauxpersonnels recueillis, utilisés ou communiqués parune organisation à des fins médicales, y compris larecherche médicale et la gestion du système de soinsde santé, mais, pour l'application du présent alinéa,l'expression « renseignements médicaux » ne visepas les renseignements personnels liés à l'emploi;

g) la collecte, l'utilisation ou la communication derenseignements personnels qui est accomplie par unfonctionnaire de l'Assemblée législative dansl'exercice des fonctions qui lui incombent en vertud'un texte;

h) les renseignements personnels concernant unparticulier décédé depuis au moins 20 ans;

i) les renseignements personnels concernant unparticulier qui figurent dans un document existantdepuis au moins 100 ans;

j) les renseignements personnels figurant dans undocument transmis à un établissement d'archivage etdont l'accès n'était assujetti à aucune restriction ouétait régi par un accord entre cet établissement et ledonateur du document avant l'entrée en vigueur de laprésente loi;

k) les renseignements figurant dans les documentsjudiciaires, les documents d'un juge de la Courd'appel, de la Cour du Banc de la Reine ou de laCour provinciale, des conseillers-maîtres de la Courdu Banc de la Reine, des magistrats ou des juges depaix siégeant ou présidant en vertu de la Loi sur laCour provinciale, les documents concernantl'administration judiciaire et les documents ayanttrait aux services de soutien fournis aux juges destribunaux mentionnés dans le présent alinéa;

l) les renseignements personnels figurant dans touttype de document créé par ou pour, selon le cas :

(i) un député de l'Assemblée législative,

(ii) un membre — élu ou nommé — d'unorganisme public;

(m) the collection, use or disclosure of personalinformation by a constituency association or aregistered political party as defined in The ElectionsFinances Act;

(n) the collection, use or disclosure of personalinformation by an individual who is a candidate forpublic office where the information is beingcollected, used or disclosed, as the case may be, forthe purposes of campaigning for that office and forno other purpose;

(o) personal information contained in a personalnote, communication or draft decision created by orfor a person who is acting in a judicial,quasi-judicial or adjudicative capacity.

Previously acquired information4(4) If an organization has under its controlpersonal information about an individual that wasacquired prior to the date upon which this Act comesinto force, that information, for the purposes of this Act,

(a) is deemed to have been collected pursuant toconsent given by that individual;

(b) may be used and disclosed by the organizationfor the identified purposes for which the informationwas initially collected; and

(c) after the coming into force of this Act, is to betreated in the same manner as information collectedunder this Act.

Conflict4(6) If a provision of this Act is inconsistent orin conflict with a provision of another enactment, theprovision of this Act prevails unless

(a) the other enactment is The Freedom ofInformation and Protection of Privacy Act or ThePersonal Health Information Act; or

(b) another Act or a regulation under this Actexpressly provides that the other Act or a regulation,or a provision of it, prevails notwithstanding thisAct.

Consent required7(1) Except where this Act provides otherwise,an organization shall not, with respect to personalinformation about an individual,

(a) collect that information unless the individualconsents to the collection of that information;

(b) collect that information from a source other thanthe individual unless the individual consents to thecollection of that information from the other source;

(c) use that information unless the individualconsents to the use of that information; or

(d) disclose that information unless the individualconsents to the disclosure of that information.

Notice in place of consent8(3) Notwithstanding subsection 7(1), anorganization may collect, use or disclose personalinformation about an individual for particular purposesif

(a) the organization

(i) provides the individual with a notice, in aform that the individual can reasonably beexpected to understand, that the organizationintends to collect, use or disclose personalinformation about the individual for thosepurposes, and

(ii) with respect to that notice, gives theindividual a reasonable opportunity to decline orobject to having his or her personal informationcollected, used or disclosed for those purposes;

(b) the individual does not, within a reasonable time,give the organization a response to that noticedeclining or objecting to the proposed collection,use or disclosure; and

(c) having regard to the level of the sensitivity, ifany, of the information in the circumstances, it isreasonable to collect, use or disclose the informationas permitted under clauses (a) and (b).

Withdrawal or variation of consent9(1) Subject to subsection (5), on givingreasonable notice to an organization, an individual mayat any time withdraw or vary consent to the collection,use or disclosure by the organization of personalinformation about the individual.

(b) in the case of a variation of a consent, abide bythe consent as varied.

(b) using deceptive or misleading practices;

any consent provided or obtained under thosecircumstances is negated.

Collection without consent14 An organization may collect personalinformation about an individual without the consent ofthat individual only if one or more of the following areapplicable:

(a) a reasonable person would consider that thecollection of the information is clearly in theinterests of the individual, and consent of theindividual cannot be obtained in a timely way or theindividual would not reasonably be expected towithhold consent;

(b) the collection of the information is pursuant toan enactment of Manitoba or Canada that authorizesor requires the collection;

(c) the collection of the information is from a publicbody and that public body is authorized or requiredby an enactment of Manitoba or Canada to disclosethe information to the organization;

(d) the collection of the information is reasonablefor the purposes of an investigation or a legalproceeding;

(e) the information is publicly available and isspecified by the regulations;

(f) the collection of the information is necessary todetermine the individual's suitability to receive anhonour, award or similar recognition or benefit,including an honorary degree, scholarship orbursary;

(g) the information is collected by a personalreporting agency to create a personal report wherethe individual consented to the disclosure to thepersonal reporting agency by the organization thatoriginally collected the information;

(h) the information may be disclosed to theorganization without the consent of the individualunder section 20;

(i) the collection of the information is necessary inorder to collect a debt owed to the organization orfor the organization to repay to the individual moneyowed by the organization;

(j) the organization collecting the information is anarchival institution and the collection of theinformation is reasonable for archival purposes orresearch;

(d) the use of the information is reasonable for thepurposes of an investigation or a legal proceeding;

(e) the information is publicly available and isspecified by the regulations;

(f) the use of the information is necessary todetermine the individual's suitability to receive anhonour, award or similar recognition or benefit,including an honorary degree, scholarship orbursary;

(g) a personal reporting agency was permitted tocollect the information under clause 14(g) and theinformation is not used by the personal reportingagency for any purpose other than to create apersonal report;

(h) the information may be disclosed by anorganization without the consent of the individualunder section 20;

(i) the use of the information is necessary to respondto an emergency that threatens the life, health orsecurity of an individual or the public;

(j) the use of the information is necessary in order tocollect a debt owed to the organization or for theorganization to repay to the individual money owedby the organization;

(k) the organization using the information is anarchival institution and the use of the information isreasonable for archival purposes or research;

(l) the use of the information meets the requirementsrespecting archival purposes or research set out inthe regulations and it is not reasonable to obtain theconsent of the individual whom the information isabout.

(i) authorizes or requires its disclosure, and

(ii) is made under an enactment of Manitoba orCanada;

(e) the disclosure of the information is for thepurpose of complying with a subpoena, warrant ororder issued or made by a court, person or bodyhaving jurisdiction to compel the production ofinformation or with a rule of court that relates to theproduction of information;

(f) the disclosure of the information is to a publicbody or a law enforcement agency in Canada toassist in an investigation

(i) undertaken with a view to a law enforcementproceeding, or

(ii) from which a law enforcement proceeding islikely to result;

(g) the disclosure of the information is necessary torespond to an emergency that threatens the life,health or security of an individual or the public;

(h) the disclosure of the information is for thepurposes of contacting the next of kin or a friend ofan injured, ill or deceased individual;

(i) the disclosure of the information is necessary inorder to collect a debt owed to the organization orfor the organization to repay to the individual moneyowed by the organization;

(j) the information is publicly available and isspecified by the regulations;

(k) the disclosure of the information is to thesurviving spouse, common-law partner or to arelative of a deceased individual if, in the opinion ofthe organization, the disclosure is reasonable;

(o) the organization is a personal reporting agencyand is permitted to disclose the information underThe Personal Investigations Act;

(p) the organization disclosing the information is anarchival institution and the disclosure of theinformation is reasonable for archival purposes orresearch;

(q) the disclosure of the information meets therequirements respecting archival purposes orresearch set out in the regulations and it is notreasonable to obtain the consent of the individualwhom the information is about.

(a) during the period leading up to and including thecompletion, if any, of the business transaction,collect, use and disclose personal information aboutindividuals without the consent of the individuals if

(i) the parties have entered into a writtenagreement under which the collection, use anddisclosure of the information is restricted tothose purposes that relate to the businesstransaction, and

(ii) the information is necessary

(A) for the parties to determine whether toproceed with the business transaction, and

(B) if they proceed with the businesstransaction, for the parties to carry out andcomplete the business transaction; and

(b) where the business transaction is completed,collect, use and disclose personal information aboutindividuals without the consent of the individuals if

(i) the parties have entered into an agreementunder which the parties undertake to use anddisclose the information only for those purposesfor which the information was initially collectedfrom or in respect of the individuals, and

(ii) the information relates solely to the carryingon of the business or activity or the carrying outof the objects for which the business transactiontook place.

Definitions23 The following definitions apply in thisDivision.

(b) the purposes for which the personal informationreferred to in clause (a) has been and is being usedby the organization;

(c) the names of the persons to whom andcircumstances in which the personal informationreferred to in clause (a) has been and is beingdisclosed.

(a) the information is protected by any legalprivilege;

(d) the disclosure of the information might result inthat type of information no longer being provided tothe organization when it is reasonable that that typeof information would be provided;

(e) the information was collected by a mediator orarbitrator or was created in the course of a mediationor arbitration for which the mediator or arbitratorwas appointed to act

(i) under an agreement,

(ii) under an enactment, or

(iii) by a court; or

(f) the information relates to or may be used in theexercise of prosecutorial discretion.

Where access must be refused24(3) An organization shall not provide access topersonal information under subsection (1) if

(a) the disclosure of the information couldreasonably be expected to threaten the life orsecurity of another individual;

(b) the information would reveal personalinformation about another individual; or

(c) the information would reveal the identity of anindividual who has in confidence provided anopinion about another individual and the individualproviding the opinion does not consent to disclosureof his or her identity.

Inaccessible information to be severed 24(4) If, in respect of a record, an organization isreasonably able to sever the information referred to inclause (2)(b) or subsection (3) from a copy of the recordthat contains personal information about the individualwho requested it, the organization must provide theindividual with access to the record after theinformation referred to in clause (2)(b) or subsection (3)has been severed.

Right to request correction25(1) An individual may request that anorganization correct an error or omission in the personalinformation about the individual that is under thecontrol of the organization.

How to make a request26(1) For an individual to obtain access topersonal information about that individual or make arequest for a correction to personal information aboutthat individual, the individual must make a writtenrequest to the organization setting out sufficient detailto enable the organization, with a reasonable effort, toidentify the information in respect of which the writtenrequest is made.

Duty to assist27(1) An organization must

(a) make every reasonable effort

(i) to assist applicants, and

(b) at the request of an applicant provide, if it isreasonable to do so, an explanation of any term,code or abbreviation used or referred to in anyrecord provided to the applicant.

(a) the record can be created from a record that is inelectronic form and that is under the control of theorganization, using its normal computer hardwareand software and technical expertise; and

(b) creating the record would not unreasonablyinterfere with the operations of the organization.

Time period for deciding extension not included 28(3) If an organization asks the Ombudsmanunder section 31 for authorization to extend the timelimit for responding, the 45-day period referred to insubsection (1) does not include the period from the startof the day in which the request is made under section 31to the end of the day in which a decision is made by theOmbudsman with respect to giving the authorization.

Contents of response29 In a response to a request made undersection 24, the organization must inform the applicant

(a) as to whether or not the applicant is entitled to orwill be given access to all or part of his or herpersonal information;

(b) if the applicant is entitled to or will be givenaccess, when and where access will be given; and

(c) if access to all or part of the applicant's personalinformation is refused,

(i) of the reasons for the refusal and theprovision of this Act on which the refusal isbased, and

(ii) of the name of the person who can answer,on behalf of the organization, questions aboutthe refusal.

(a) the applicant does not give enough detail toenable the organization to identify the personalinformation or the record relating to the information;

(b) a large amount of personal information isrequested or must be searched;

(c) meeting the time limit would unreasonablyinterfere with the operations of the organization; or

(d) more time is needed to consult with anotherorganization or with a public body before theorganization is able to determine whether or not togive the applicant access to the requested personalinformation or record relating to the information.

Exception re law enforcement agency investigation34(3) The requirement to notify an individualunder subsection (2) does not apply where

(a) the organization is instructed to refrain fromdoing so by a law enforcement agency that isinvestigating the theft, loss or unauthorizedaccessing of the personal information; or

(b) the organization is satisfied that it is notreasonably possible for the personal information tobe used unlawfully.

(a) protect personal information that is in its custodyor under its control; or

(b) provide an individual notice undersubsection (2), if it was not reasonable for theorganization to have been satisfied that the personalinformation that was stolen, lost or accessed in anunauthorized manner would not be used unlawfully.

Other rights not affected34(5) The right of action under this section is inaddition to any other right of action or remedy availableat law. But where the court deems it just, damagesawarded in an action under this section may be takeninto account in assessing damages in any otherproceeding arising out of the failure of the organizationto protect personal information in its custody or underits control.

Professional regulatory organizations36(1) The following definitions apply in thissection.

(ii) direct that, during the period that the code isin effect,

(A) the code, with respect to mattersprovided for under the code, is to operate inthe place of sections 1 to 35, or any one ormore of those provisions, insofar as thecode provides for those matters, and

(B) compliance by the professionalregulatory organization with the code, theterms or conditions, if any, imposed by theminister under subsection (3) is deemed tobe in compliance with sections 1 to 35, orany one or more of those provisions, insofaras the code operates in the place of thoseprovisions;

(d) governing the granting of, revoking of andvarying of any authorization or direction and anyterms or conditions provided for in clause (c);

(e) governing the coming into force of this Act orany provision of this Act with respect to aprofessional regulatory organization;

(f) providing that this Act or any provision of thisAct commences to apply to a professional regulatoryorganization at a date that is later than the date uponwhich this Act is proclaimed into force;

(g) providing for and governing any transitionalmatter relating to the application of this Act to aprofessional regulatory organization.

GENERAL PROVISIONS DISPOSITIONS GÉNÉRALES

Protection of organization from legal actions38 No action lies and no proceeding may bebrought against an organization, or any person acting onbehalf of or under the direction of an organization, fordamages resulting from

(a) the disclosure of or failure to disclose, in goodfaith, all or part of a record or personal informationunder this Act, or any consequences of thatdisclosure or failure to disclose; or

(b) the failure to give a notice required under thisAct, if reasonable care was taken to give therequired notice.

Protection of employee39 An organization shall not take any adverseemployment action against an employee of theorganization, or deny an employee a benefit, on accountof or for any reason arising out of the situation where

(a) the employee, acting in good faith and on thebasis of reasonable belief, has disclosed to theOmbudsman that the organization or any otherperson has contravened or is about to contravene thisAct;

(b) the employee, acting in good faith and on thebasis of reasonable belief, has done or stated anintention of doing anything that is required to bedone in order to avoid having any person contravenethis Act;

(c) the employee, acting in good faith and on thebasis of reasonable belief, has refused to do or statedan intention of refusing to do anything that is incontravention of this Act; or

(d) the organization believes that the employee willdo anything described in clause (a), (b) or (c).

Exercise of rights by other persons40(1) Any right or power conferred on anindividual by this Act may be exercised

(a) if the individual is 18 years of age or older, bythe individual;

(d) if the individual is deceased, by the individual'spersonal representative if the exercise of the right orpower relates to the administration of theindividual's estate;

(e) if a committee or substitute decision maker hasbeen appointed for the individual under The MentalHealth Act or The Vulnerable Persons Living with aMental Disability Act, by the committee or substitutedecision maker if the exercise of the right or powerrelates to the powers and duties of the committee orsubstitute decision maker;

(f) if a proxy has been designated under a healthcare directive under The Health Care Directives Act,by the proxy if the directive so authorizes;

(g) if a power of attorney has been granted by theindividual, by the attorney if the exercise of the rightor power relates to the powers and duties conferredby the power of attorney; or

(h) by any person with written authorization fromthe individual to act on the individual's behalf.

(c) disposes of or alters, falsifies, conceals ordestroys personal information or any record relatingto personal information, or directs another person todo so, with an intent to evade a request for access tothe information or the record.

(a) in the case of an individual, to a fine of not morethan $10,000.; and

(b) in the case of a person other than an individual,to a fine of not more than $100,000.

General regulations42(1) The Lieutenant Governor in Council maymake regulations

(a) defining, for the purposes of this Act, any termthat is used in this Act but is not defined in this Act;

(b) governing procedures to be followed in makingand responding to requests under this Act and forgaining and giving access to personal information orrecords;

(c) governing the giving of consent and any otherdirection under this Act;

(d) governing the application of this Act to personswho collect, use or disclose personal information inthe course of carrying out investigations or similarinquiries as part of their functions or duties pursuantto an authority given to those persons under anenactment or in the course of acting as peaceofficers;

(e) governing the collection, use and disclosure ofpersonal information for archival purposes orresearch and respecting requirements concerningarchival purposes or research;

(f) expressly providing that another enactment or aprovision of it prevails notwithstanding this Act;

(g) governing forms or notices to be used under thisAct and the manner in which notices are to be given;

(h) governing fees, including circumstances inwhich fees

(i) are or are not payable, or

(ii) must not be above a prescribed amount orpercentage;

(i) respecting the application of this Act to a publicbody;

(j) prescribing additional subject matter in respect ofwhich or circumstances under which personalinformation or a specific type of personalinformation may be collected, used or disclosedwithout the consent of the individual that are inaddition to the subject matter in respect of which orcircumstances under which personal informationmay be collected, used or disclosed without theconsent of the individual under section 14, 17 or 20;

(k) prescribing or otherwise determining whether ornot personal information or a specific type ofpersonal information does or does not come withint h e m e a n i n g o f a p r o v i s i o n o fsection 14, 15, 17, 18, 20, 21 or 22 under whichpersonal information may be collected, used ordisclosed without the consent of the individual;

(l) specifying information or classes of informationfor the purpose of clauses 14(e), 17(e) and 20(j);

(m) prescribing or otherwise determining whether ornot personal information or a specific type ofpersonal information does or does not come withinthe meaning of a provision of subsection 4(3);

(n) prescribing reasonable security arrangementsthat must be made by organizations which possess orcontrol personal information.

Application of regulation42(2) Where a regulation made

(a) under clause (1)(j) prescribes additional subjectmatter with respect to which or circumstances underwhich personal information may be collected, usedor disclosed without the consent of the individual,that information is to be treated in the same manneras if it had been collected, used or disclosed undersection 14, 17 or 20, as the case may be;

(b) under clause (1)(k) prescribes or otherwisedetermines that personal information

(i) comes within the meaning of a provision ofsection 14, 15, 17, 18, 20, 21 or 22, as the casemay be, that information is to be treated in thesame manner as any other personal informationthat is dealt with under that provision, or

(ii) does not come within the meaning of aprovision of section 14, 15, 17, 18, 20, 21 or 22,as the case may be, that information is to betreated in the same manner as any other personalinformation that does not come within themeaning of that provision; and

(c) under clause (1)(l) prescribes or otherwisedetermines that personal information

(i) comes within the meaning of a provision ofsubsection 4(3), that information is to be treatedin the same manner as any other personalinformation that comes within the meaning ofthat provision, or

(ii) does not come within the meaning of aprovision of subsection 4(3), that information isto be treated in the same manner as any otherpersonal information that does not come withinthe meaning of that provision.
