Subject to the conditions set out in clause 3, competitors,and personsofficially supporting or directly assistingcompetitors, in the ocean racingevent known as the Whitbread Round The World Race "the Race" areexemptedfrom the operationof sections5 and 8 of the TobaccoControl Act1990, while participatingin the Race, from 10 December1993 to 9 January1994 inclusive.

Conditions

3. The conditionssubject to which the exemptionreferred to in clause2 isgrantedarethat -

a any trademark or brand name of a tobacco product shall bedisplayedonly -

i on the hull of yachtsthat areparticipatingin the Race;

ii on the sails of yachts when they are under way andparticipatingin the Race;

iii on the clothing of the competitorsandthe personsofficiallysupportingor directly assistingthe competitorsin the Race,if the trademark or brand name is accompaniedby thehealthwarning-

I "SMOKING CAUSESLUNG CANCER"; or

II "SMOKING CAUSESHEART DISEASE",

togetherwith the statement"HealthAuthority Warning"; or

iv when incidentally or accidentallypresentin photographsusedto publicize the Race;

b the area exclusively devotedto the display of the healthwarningreferredto in paragrapha and the statement"Health AuthorityWarning" shall be not less than 25% of the area devotedto thedisplay of the trademark or brand name referred to in thatparagraph;

c the healthwarning referredto in paragrapha shall -

i appear directly beneath the trademark or brand namereferred to in that paragraphanddirectly adjacentto thestatement"HealthAuthority Warning";

ii occupy, together with the statement "Health AuthorityWarning" not less than 80% of the area devoted to thedisplayof’ that warningand that statement;

d the lettersin the statement"Health Authority Warning" shall notexceedhalf the height of the lettersusedfor the healthwarningreferredto in paragrapha; and
