Citation

1. This notice may be cited as the Tobacco Control Exemption NoticeNo. 5 1993.

Exemption

2. Subject to the conditions set out in clause 3, competitors,and personsofficially supporting or directly assistingcompetitors, in the ocean racingevent known as the Whitbread Round The World Race "the Race" areexemptedfrom the operationof sections5 and 8 of the TobaccoControl Act1990, while participatingin the Race, from 10 December1993 to 9 January1994 inclusive.

Conditions

3. The conditionssubject to which the exemptionreferred to in clause2 isgrantedarethat -

a any trademark or brand name of a tobacco product shall bedisplayedonly -

i on the hull of yachtsthat areparticipatingin the Race;

ii on the sails of yachts when they are under way andparticipatingin the Race;

iii on the clothing of the competitorsandthe personsofficiallysupportingor directly assistingthe competitorsin the Race,if the trademark or brand name is accompaniedby thehealthwarning-

I "SMOKING CAUSESLUNG CANCER"; or

II "SMOKING CAUSESHEART DISEASE",

togetherwith the statement"HealthAuthority Warning"; or

iv when incidentally or accidentallypresentin photographsusedto publicize the Race;

b the area exclusively devotedto the display of the healthwarningreferredto in paragrapha and the statement"Health AuthorityWarning" shall be not less than 25% of the area devotedto thedisplay of the trademark or brand name referred to in thatparagraph;

1. RURAL LANDi Constructfirebreaksof not lessthan 2.5 metresin width aroundthe boundaryof all

standingcrops and that the maximumarea of standingcrop to 200 hectaresandaroundthe externalboundaryof each property, such breakto be not more than 20metresinside the boundaryfence.

ii Clear and maintain firebreaks at least 2.5 metreswide within 20 metres of theperimeterof any building or group of buildings or hay stacks,in such a manneras tocompletelyencircle the building or hay stack.

2. TOWNSITEAll townsite lots within the Shire of Tammin are requiredto be clearedandmaintainedfree of all inflammablematerial.For the purposeof this seasoninflammablematerialmeansdeadgrassandtimber,boxes,cartons,paperand any combustiblematerialor rubbishbut does not include living trees,bushes,shrubsand plants in gardens.

3. FUEL DUMPS AND/OR DEPOTSAll grassor inflammablematerialsto beclearedfrom areaswheredrum rampsare locatedandwheredrums,full or emptyarestoredandsuchareasare to be maintainedfree of grassandsimilar inflammablematerial until 1 March 1994.For the purposeof this sectioninflammablematerialmeansdeadgrassandtimber,boxes,cartons,paperand any combustiblematerial or rubbish but does not include living treesandbushes.

Prohibitedburning,period from 29 October 1993 to 6 February1994.Restrictedburning from 15 October1993 to 28 October1993 and7 February1994 to 18 March 1994.

GENERAL PROVISIONSIf it is consideredto be impractical for any reasonto provide fire breaksin the position or adhereto the provisionsrequiredby this notice, the approvalof the Council mustbe obtainedto preparesuchfirebreaksin analternativeposition.Approval to anysuchvariationwill only begrantedwherethe BushFire Control Officer for the areahas first signified approvalfor the variation. Exampleof reasonsto relocatefirebrealcsincludewhere thereare natural firebreaksor areasliable to soilerosion.The penalty to failing to comply with this notice is a fine of not more than $1 000 and a personin default is alsoliable, whetherprosecutedor not, to pay the cost of performingthe work directedin this notice if it is not carriedoutby the owneror occupierandby thedaterequiredby this notice.
