3. After regulation 17A of the principal regulations the followingregulationsareinserted-

Bananaplants - Musaspp Bananaweevil borer

1713. 1 Unless contrary intention appearsin this regulationandin Schedule6 -

"quarantine area" means the area boundedby IvanhoeRoad, River Farm Road, King Location 599 boundaryand the Ord River Irrigation Project boundary toIvanhoe Crossing in the River Farm Road Districtdelineatedin black in the map set out in Schedule6.

2 A personshall not remove-

a bananaplants, leaf stem,planting material and soil;and

b machinery or farm equipmentunless the machineryor farm equipmentis free from soil and bananaplantmaterial,

from within the quarantinearea.

3 For the purposesof regulation16 1 -

a the quarantineareais a specifiedportion of the State;and

b bananaweevil borer is aspecifieddisease.

17C. 1 Where a grower detectschrysanthemumwhite ruston his property the grower shall, as soonas practicable-

2 A groweror a personwho distributes,transportsor sellschrysanthemumplants shall ensurethat any plants,cuttings andcut flowers which are visually infected with chrysanthemumwhite rust -

a are not distributed;and

b are destroyedin an approvedmanner.

3 A person who distributes chrysanthemumpropagatingmaterial including cuttings and rooted cuttings, shall beapprovedandshallensurethat-

a chrysanthemumplants on the source property arevisually free from chrysanthemumwhite rust;

b staff and equipment are available to carry out aspraying programme and treat the diseasein theapprovedmanner;and

c relevant staff are trained to recognizechrysanthemumwhite rust.

4 Eachconsignmentof propagatingmaterial referredto inregulation 3 shall be accompaniedby a declaration from thegrower that -

a an approvedspraying programmehas been carriedout; and

b the consignmenthas been inspected by a trainedmember of staff and is visually free fromchrysanthemumwhite rust.

5 For the purposesof regulation 16 1 chrysanthemumwhite rustis aspecifieddisease.

6 A person who fails to comply with this regulationcommitsan offence. ".

3. Part 4 Division 2 of the principal regulationsis amendedby insertingafter Subdivision3 the following subdivision-

"

Subdivision4- Control of Codling Moth

Codling moth

19E. 1 In this subdivision and Schedule 4C unless thecontraryintention appears-

"fruit" meansanyfruit that mayhostcodling moth;

"orchard" means any land used for the growing orcultivating or handlingof fruit that may host codlingmoth;

"the disease"means the diseaseknown as codling mothCydia pomonella.

2 Section 11 of the Act applies to the disease.

3 The occupierof an orchardwhere the diseaseexists orappearsto exist shall take and adopt the steps and measuresspecified in Schedule 4C Part 1 or cause those steps andmeasuresto be takenandadopted.

4 An occupierreferred to in subregulation3 who fails tocomply with Schedule4C Part 1 commits an offence unless thenon-compliance is authorized by an exemption undersubregulation8.

Penalty: $5 000.

5 Where the diseaseis the subjectof a notice undersection12 and an orchardis in anareadefinedin the noticethe owneroroccupier of the orchard shall take and adopt the steps andmeasuresspecified in Schedule4C Part 2 or causethose stepsandmeasuresto be taken andadopted.

6 Subregulation5 has effect whether or not the diseaseexists or appearsto exist in the orchard.

2. Under the supervision and direction of an inspector theoccupiershall -

a removeall infected and potentially infected materialincluding fruit, fallen fruit and trees wherenecessary;

b dispose of the infected and potentially infectedmaterialby deepburial or burning; and

c removeany tree material,infected or otherwise,soasto ensure full penetration of spray to the point ofrunoff andto allow inspection of any remainingfruitand dispose of that material by deep burial orburning.

8. In this Part and in Part 3 unless the contrary intentionappears-

"infested area" means the area defined in the noticereferredto in regulation19E 5.

Treatments

9. The owner or occupierof an orchard in the infestedarea inwhich codling moth does not exist or does not appear to existshall-

a underthe supervisionanddirection of an inspector

i remove all infected and potentially infectedmaterial including fruit, fallen fruit andtreeswherenecessary;

ii disposeof the infected and potentially infectedmaterialby deepburial or burning; and

iii removeanytree material,infectedor otherwise,so as to ensurefull penetrationof sprayto thepoint of runoff and to allow inspection of anyremainingfruit anddisposeof that material bydeepburial or burning;

b until harvest, apply an approved insecticide sprayprogrammeto all pome fruit treesbearing fruit, orstrip all fruit from unsprayedpome fruit trees inNovemberand destroy that fruit by burning or deepburial;

c where directed and to the satisfaction of aninspector-

12. Packersandprocessorsshall ensurethat -

a trucks, containers or any other form ofconveyancein which fruit from an orchardreferred to in regulation 19E is transportedto packingor processingestablishments;and

b any other potential carrier which has been incontactwith the fruit,

shall be cleanedof all fruit, plant material, larvae and pupaebeforeleavingthe premises.

Equipment to be cleaned

13. Packers and processorsshall ensurethat all packing andprocessingequipment which has been in contact with fruit duringprocessingor packing, shall be cleaned of all fruit, plant material,larvae and pupae.

Disposal of potentially infected material

14. ?ackers and processorsshall ensure that all fruit, plantmaterial, larvae and pupae removed in accordance with clauses12 and 13 shall be -

a deepburied; or

b burnt.

Distribution

15. A person who distributes fruit or potential carriers from anorchard referred to in regulation 19E shall only distribute fruit orpotential carriers to areas nominated by an inspector.

METHODS OF MEASUREMENT

1. Cobbler are measuredin a direct line from the base of theanterior edge of the caudodorsalfin to the tip of the tail.

2. Crabsare measuredfrom tip to tip of the posteriorcarapacespikes.

3. Garfish are measuredfrom the tip of the upperjaw to theend of the upperhalf of the tail.

4. Marron are measuredfrom the tip of the rostrum to theposteriormargin of the carapacealong the mid-dorsal line.

5. Prawnsare measuredalong the body from the eye to the tipof the tail.

6. Southern Rock Lobster are measured from the anteriorsurfaceof the median suture of the frontal tubercle to themid point of the posterior edge of the dorsal region of thecarapace.

7. Western and Northern Rock Lobster are measuredalongthe mid-dorsal line from the anterior edge of thepronouncedridge which joins the front edgesof the rostral

- horns- immediately posterior to the eyestalks, to theposteriormargin of the carapace.

PART 11-RESERVES2.1 SchemeReserves:The land shown as SchemeReserveson the SchemeMap, hereinafter called"Reserves" are lands reserved under the Schemefor the purposes shown on the SchemeMap andare listed hereunder-

2.2 Matters to be Considered by Council2.2.1 Except as otherwiseprovided in the Parta person shallnot carry out anydevelopmenton landreservedunder this Scheme,other than the erection of a boundary fence,without first applying forand obtaininga PlanningApproval from the Council.2.2.2 Wherean applicationfor planningconsentis madewith respectto land within a reserve, theCouncil shall haveregardto the ultimate purposeintendedfor the reserveand the Council shall,in the caseof land reservedfor the purposes of a public authority, confer with that authority beforegrantingits consent.2.3 Continued Use of Land: No provision of this part shall preventthe continueduse of the landfor the use of which it wasbeing lawfully used immediately prior to the Schemehaving the forceof the law, or the repairandmaintenance,for which theprior consentin writing of theCouncil hasbeenobtained,of buildings or works lawfully existingon theland, in accordancewith theprovisionsof Part III of the Scheme.2.4 Compensation:2.4.1 Wherethe Council refusesplanning consent for the development of a reserve on the groundthat the land is reservedfor LocalAuthority purposesor for the purposesshownon the schememap,or grantsconsentsubjectto conditionsthat are unacceptableto the applicant the owner of the landmay, if the land is injuriously affected thereby, claim compensationfor such irjurious affection.2.4.2 Claims for such compensationshall be lodged at the office of the Council no later than sixmonthsafter the date of the decisionof the Council refusing planningconsentor grantingit subjectto conditionsthat are unacceptableto the applicant.2.4.3 In lieu of paying compensationthe Council may purchasethe land affectedby such decisionof the Council at a price representing the unaffected value of the land at the time of refusal ofplanning consentor of the grant of consentsubject to conditionsthat are unacceptableto theapplicant.2.5Objectives: The objectives for the Local Reservesin this schemeareto setasideandsecurelandsfor the various public purposes.Onceachievedthe land shall be usedand developedin accordancewith the designatedland use.

PART Ill-ZONES3.1 Zones3.1.1 There are herebycreatedthe severalzonesset out hereunder-

3.1.2 The zones are delineated and coloured on the SchemeMap according to the legendthereon.3.2 Zoning Table3.2.1 The Zoning Table indicates,subject to the provisionsof the Scheme,the severalusespermittedin the Schemein the various zones.Suchusesbeing determinedby cross referencebetweenthe listof "use classes"on the left hand side of the Zoning Table and the list of "zones" at the top of theZoning Table.

3.2.2 The symbols used in the cross referencein the Zoning Table havethe following meanings-"P"means that the use is permittedprovided it complies with the relevant standardsandrequirementslaid down in the Schemeand all conditionsif any imposed by the Council ingrantingplanning consent-

meansthat the Council may, at its discretion, permit the use;"SA" meansthat the Council may, at its discretion, permit the use after notice of Applicationhasbeengiven in accordancewith Clause6.2.

meansthat use is not permittedin that zone.3.2.3 Wherein the Zoning tablea particular useis mentionedit is deemedto be excluded from anyuse class which by its more generalterms might otherwiseinclude such particularuse.3.2.4 Incidental Use or Activity: Notwithstanding that a particular use class is prohibited withina particular zone,a use or activity coming within the scopeof such a class may be approved by theCouncil where it is necessaryto or incidential to the main use of the land or premises.3.2.5 If the useof theland for a particularpurposeis notspecifically mentionedin theZoning Tableand cannotreasonablybe determinedasfalling within theinterpretationofoneof theusecategoriesthe Council may-

PART W-NON-CONFORMINGUSES4.1 Non-conformingUse Rights: No provisionof the Schemeshall prevent-

a the continueduse of any land or building for the purposefor which it wasbeing lawfullyusedat the time of coming into force of the Scheme;or

b The carryingout of any developmentthereonfor which, immediatelyprior to that time, aPermit or Permits,lawfully requiredto authorisethe developmentto be carried out, wereduly obtainedandare current.

4.2 Extensionof Non-conformingUse: A personshall not alter or extenda Non-conformingUse orerect,alteror extenda building usedin conjunctionwith a Non-conformingUsewithout first havingapplied for and obtained the planning consentof the Council under the Schemeand unless inconformitywith any other provisionsandrequirementscontainedin the Scheme.

4.3 Changeof Non-conformingUse: Notwithstandinganything containedin the Zoning Table theCouncil may grant its planning consent to the changeof use of any land from one non-conforminguse to another non-conforminguse if the proposed use is, in the opinion of the Council, lessdetrimentalto the amentityof thelocality than the existinguseand is, in the opinion ofthe Council,closerto the intendedusesof the zone.4.4 Discontinuanceof Non-conformingUse:4.4.1 Exceptwherea changeof non-conformingusehasbeenpermittedby the CouncilunderClause4.3when a non-conforming useof any land or building has been discontinuedfor a periodexceedingsix monthssuch land or building shall not thereafter be used other than in conformity with theprovisionsof the Scheme.4.4.2 The Council may effect the discontinuance of a non-conforming use by the purchase of theaffected property,or by the paymentof compensationto the owneror the occupieror to both theownerandthe occupierof that property, and may enter into an agreementwith the owner for thatpurpose.

PART V-DEVELOPMENT REQUIREMENTS5.1 Developmentof Land.

5.1.1 Subject to Clause5.1.2 a personshall not commenceor carry out developmentof any landzoned or reservedunder the Schemewithout first having applied for and obtainedthe planningconsentof the Council under the Scheme.

5.1.2 The Planningconsentof the Council is not requiredfor the following developmentof land-

a The use of the landin a Reserve,wheresuchland is heldby the Council or vestedin publicAuthority-i for the purposefor which the land is reservedunderthe Scheme;or

ii in the caseof land vestedin a Public Authority for any purposefor which said landmay be lawfully usedby that Authority.

b the erectionof a boundaryfenceexcept as otherwiserequiredby the Scheme;

c The erection on a lot of a singlehouse,including ancillary outbuildings, in a zone wherethe proposeduse is designatedwith the symbol "P"in the cross-referenceto that zoneinthe Zoning Table;

d The carryingout of any work on, in, over or undera streetor roadby a public Authorityacting pursuantto the provisionsof any Act.

e The carrying out of works for the maintenance,improvementor other alterationof anybuilding, being works which affect only the interior of the building or which do notmaterially affect the externalappearanceof the building;

f The carrying out of works urgently necessaryin the public safety or for the safety orsecurity of plant or equipmentor for the maintenanceof essentialservices.

5.2 Discretion to Modify DevelopmentStandards: If a development,other than a residentialdevelopment,the subjectof an applicationfor planning consent,doesnot comply with a standardor requirement prescribed by the Schemewith respect to that developmentthe Council may,notwithstandingthat non-compliance,approvethe applicationunconditionallyor subject to suchconditionsas the Council thinks fit. The power conferredby this clausemay only be exercisedifthe Council is satisfiedthat-

a Approval of the proposeddevelopmentwould be consistentwith the orderlyand properplanningof the locality andthe preservationof the amenity of the locality;

b the non-compliancewill not have any adverseeffect upon the occupiersor usersof thedevelopmentor the inhabitantsof the locality or upon thelikely future developmentof thelocality; and

c the spirit and purposeof the requirement or standard will not be unreasonably departedfrom thereby.

5.3 ResidentialDevelopment:ResidentialPlanningCodes.

5.3.1 Forthe purposeof this Scheme"ResidentialPlanningCodes"meansthe ResidentialPlanningCodes set out in appendix 2 to the Statementof Planning Policy No. 1, togetherwith anyamendmentsthereto.

5.3.2 A copy of the ResidentialPlanningCodes,as amended,shall be keptandmadeavailable forpublic inspectionat the offices of the Council.

5.3.3 Unlessotherwiseprovidedfor in theSchemethe developmentof landfor any of theresidentialpurposesdealt with by the Residential PlanningCodes shall conform to the provisionsof thosecodes.5.4 DevelopmentOther Than Residential Development:All developmentother than residentialdevelopment,shall comply with the provision set out in the zonedevelopmenttable at ScheduleNo. 2.5.5 Appearanceof buildings: A personshall not without the approvalof the Council erect orcommenceto erect a building which by virtue of colour or type of materials,architecturalstyle,height,bulk, or ornamentalor general appearancehas in the opinion of the Council an exteriordesignwhich is out of harmonywith the exterior designsof existingbuildings or is likely to injurethe amenity of the locality.5.6 Control of Advertisements:5.6.1 Power to Control Advertisements-

a For the purposeof this Scheme,the erection,placementanddisplayof advertisementsandthe use of land or buildings for that purposeis developmentwithin the definition of theAct requiring, except as otherwiseprovided, the prior approval of the Council. Suchplanning consentis required in addition to any licencepursuantto Council’s Signs andHoardingandBill PostingBy-laws.

b Applications for Council’s consentpursuantto this Part shall be submittedin accordancewith the provisions of Part VI of the Schemeand shall be accompaniedby a completedAdditional Information Sheet in the form set out in Schedule 6 giving details of theadvertisementsto be erected,placedor displayedon the land.

5.6.2 Existing Advertisements-Advertisementswhich-

i were lawfully erected,placedor displayedprior to the approvalof this Scheme,orii may be erected,placed or displayedpursuantto a licence or other approvalgranted

by the Council prior to approvalof this Scheme,hereinafterin this Part referred toas "existing advertisements",may except as otherwiseprovided, continue to bedisplayedor be erectedand displayedin accordancewith the licence or approval asappropriate.

5.6.3 Considerationof Applications: Without limiting the generalityof the matterswhich may betaken into account when making a decisionupon an application for approvalto erect, place ordisplayan advertisement,Council shall examineeachsuchapplicationin thelight of the objectivesof the Schemeandwith particularreferenceto the characterandamentity of the locality withinwhich it is to be displayedincludingits historic or landscapesignificanceandtraffic safetyandtheamenityof adjacentareaswhich may be affected.5.6.4 Exemptionsfrom the Requirementto ObtainApproval: Subjectto the provisionsof the MainRoadsControl of SignsRegulations1983 andnotwithstandingthe provisionsof Clause5.6.1,theCouncil’s prior approvalis notrequiredin respectof those advertismentslistedin Schedule7 whichfor the purposeof this Part are referred to as "exemptedadvertisements".The exemptionslisted in Schedule 7 do not apply to places, buildings, conservationareasorlandscapeprotectionzoneswhich are either-

i listed by the National Trust;ii listed on the registerof the National Estate;oriii includedin local authority town planning schemesbecauseof their heritageor landscape

value.

5.6.5 Discontinuance:Notwithstandingthe Schemeobjectivesand Sub-Clause5.6.4 where in theopinion of Council, an exemptedor existing advertisementso seriously conflictswith the objectivesof this Part, it may by notice in writing giving clear reasonsrequirethe advertiserto remove,relocate, adapt, or otherwisemodify the advertisementwithin a period of time specified in thenotice.

5.6.6 Derelict or Poorly MaintainedSigns: Where, in the opinion of the Council, an advertisementhasbeen permittedto deteriorateto a point where it conflicts with the objectivesof the Schemeor it ceasesto be effective for the purposefor which it was erectedor displayed,Council may bynotice in writing requirethe advertiserto-

i repair, repaintor otherwiserestorethe advertisementto a standardspecifiedby Councilin the notice,or

ii removethe advertisement.

5.6.7 Notices-a "The advertiser"shall be interpretedas any one or any group comprisedof the owner,

occupieror licensee.b Any notice servedpursuantto Clause5.6.5 and5.6.6 shall be servedupon the advertiser

and shall specify-i the advertisementsthe subjectof the notice,

c Any personupon whom a notice is servedpursuantto this Partmay within a periodof 60days from the date of the notice appealto the Hon. Minister for Planningor the TownPlanningAppealTribunal in accordancewith PartV of theAct, andwhereany suchappealis lodgedthe effect of the notice shall be suspendeduntil the decisionto uphold, quashorvary the notice is known and shall thereafterhaveeffect accordingto that decision.

5.6.8 Schemeto Prevail: Wherethe provisions of this Part are found to be at variancewith theprovisionsof the Council’s Signs,HoardingandBill PostingBy-laws, the provisionsof the Schemeshall prevail.5.6.9 Enforcementand Penalties:The offencesand penaltiesprovisionsspecifiedin Clause7.2 ofthe Schemeapply to the advertiserin this part.

5.7 Multiple Occupancy

Generallyonly one dwelling will be permittedon anyone lot within the Rural andRural ResidentialZones.Council may however,approve a secondhouseon one lot if-

i the areaof the lot is not less than4ha; and

ii bothdwellings will be erectedin a position that complieswith all otherprovisions of theScheme.

Multiple occupancyof the land shall require specific zoning of the land andwill only be supportedif the proposalaccordswith State Planning CommissionPolicy.5.8Tree Preservation:In orderto conservethe rural environmentor featuresof naturalbeautynotreesshall be felled or removedexceptwhere -

i treesare dead,diseasedor dangerous;

ii the establishmentof a firebreak is requiredundera regulationor by-law;

iii accessto a building site is requiredand approved;

iv the site is an approvedbuilding site for a dwelling or out building;

The removalof treesfor any purposeother than the aboveexceptionsshall require the approvalof Council and as a condition of granting consent, Council may require the planting andmaintenancefor a period of at least3 years,of treesin locations approvedby Council.

PARTVI-PLANNING CONSENT

6.1 Application for Planning Consent.

6.1.1 Every Application for planning consentshall be madein the form prescribedin Schedule3to the Schemeandshall be accompaniedby suchplansandother information as is requiredby theScheme.6.1.2 UnlessCouncil waivesany particularrequirementevery applicationfor planningconsentshallbe accompaniedby-

a A Plan or plans to a scaleof not less that 1:500 showing-

i Streetnames,Lot numbers.North Point andthe dimensionsof the site.

ii The location andproposeduseof any existingbuildings to be retainedandthe locationand use of buildings proposedto be erectedon the site;

iii The existingand proposedmeansof accessfor pedestriansandvehiclesto andfromthe site;

iv The location, number,dimensionsandlayout of all car parkingspacesintendedto beprovided;

v The location anddimensionsof any areaproposedto be providedfor the loading andunloadingof vehiclescarryinggoodsor commoditiesto andfrom thesiteandthe meansof accessto and from those areas;

vi The location, dimensionsand designof any landscaped,open storageor tradedisplayareaandparticularsof the mannerin which it is proposedto developthe same;

b Plans,elevationsandsectionsof any building proposedto be erectedor alteredandof anybuilding it is intented to retain;

c Any other plan or information that the Council may reasonablyrequire to enabletheapplication to be determined.

6.2 Advertising of Applications:6.2.1 Where an application is madefor planningconsentto commenceor carry out developmentwhich involves an "SA" use the Council shall not grant consentto that application unlessnoticeof the applicationis first given in accordancewith the provisionsof this Clause.

6.2.2 Wherean application is madefor planning consentto commenceor carry out developmentwhich involves an "AA" use,or for any other developmentwhich requiredthe planning consentofthe Council, the Council may give noticeof the applicationin accordancewith theprovisionsof thisClause.

6.2.3 Wherethe Councilis requiredor decidesto give noticeof any applicationfor planningconsentthe Council shall causeone or more of the following to be carriedout-

a Notice of the proposeddevelopmentto beservedon theownersandoccupiersof landwithinan areadeterminedby the Council as likely to be affected by the granting of planningconsentstatingthat submissionsmay be madeto the Council within twenty-onedays ofthe service of such notice;

b Notice of the proposeddevelopmentto be publishedin a newspapercirculating in theSchemeArea statingthat submissionsmay bemadeto the Councilwithin twenty-onedaysfrom the publication thereof;

c A sign displayingnoticeof theproposeddevelopmentto beerectedin a conspicuouspositionon the land for a. period of twenty-one days from the date of publication of the noticereferredto in paragraphb of this Clause.

6.2.4 The notice referredto in Clause6.2.3 a andb shall be in the form containedin ScheduleNo. 4 with suchmodifications as circumstancesrequire.

6.2.5 After expiration of twenty-onedays from the serving of notice of the proposeddevelopment,the publicationof notice or the erectionof a sign or signs whicheveris thelater, the Council shallconsiderand determinethe application.6.3 Determinationof Application:6.3.1 In determining an application for planning consentthe Council may consult with anyauthority which, in the circumstances,it thinks appropriate.

6.3.2 The Council having regardto any matterwhich it is requiredby the Schemeto consider,tothe purposefor which the land is reserved,zonedor approvedfor use underthe Scheme,to thepurposefor which landin the locality is used,andto the orderlyandproperplanningof thelocalityand the preservationof the amenitiesof the locality, may refuseto approve any application forplanningconsentor may grant its approvalunconditionallyor subjectto suchconditionsas it thinksfit.6.3.3 The Council shall issue its decisionin respectof an applicationfor planning consentin theform prescribedin ScheduleNo. 5 to the Scheme.

6.3.4 Where the Council approves the application for planning consentunder this SchemetheCouncil may limit the time for which that consentremainsvalid.6.4 DeemedRefusal:

6.4.1 Wherethe Council hasnot within sixty daysof the receiptby it of an applicationfor planningconsenteitherconveyedits decisionto the applicantor given noticeof the applicationin accordancewith Clause6.2 the applicationmay be deemedto havebeenrefused.6.4.2 Where the Council hasgiven notice of an applicationfor planningconsentin accordancewithClause6.2 and where the Council has not within ninety days of receipt by it of the applicationconveyedits decision to the applicant, the applicationmay be deemedto havebeenrefused.

6.4.3 Notwithstandingthatan applicationfor planning consentmaybe deemedto havebeenrefusedunderClause6.4.1 or 6.4.2 the Council may issue a decision in respectof the applicationat anytime after the expiry of the sixty day or ninety day periodspecifiedin thoseclauses,as the casemay be.

PART WI-ADMINISTRATION7.1 Powersof the Council: The Council in implementingthe Schemehas,in addition to all otherpowersvested in it, the following powers-

a The Council may enterany agreement,with any owner, occupieror other personhavingan interest in land affected by the provisionsof the Schemein respectof any matterspertainingto the Scheme.

b The Council may acquire any land or buildings within the district pursuantto theprovisionsof the Schemeor theAct. The Councilmay dealwith or disposeof anyland whichit hasacquiredpursuantto the provisionsof theSchemeor theAct in accordancewith lawand for such purposemay makesuch agreementswith other ownersas it considersfit.

c An officer of the Council, authorisedby the Councilfor the purpose,may at all reasonabletimes enterany building or land for the purposeof ascertainingwhetherthe provisionsofthe Schemeare being observed.

7.2 Ofi’ences:7.2.1 A personshall not erect,alter or add to or commenceto erect,alteror addto a building oruse or changethe use of any land,building or part of a building for any purpose-

a Otherwise than in accordancewith the provisionsof the Scheme-b Unlessall approvalsand consentsrequiredby the Schemehavebeengrantedor issued;c Unlessall conditionsimposeduponthe grantor issueof any approvalandconsentrequired

by the Schemehavebeenand continueto be compiled with;

d Unless all standardslaid down and all requirements prescribed by the Scheme ordeterminedby the Council pursuantto the Schemewith respectto that building or thatuse of that land or building or that part havebeenandcontinueto be compiled with.

7.2.2 A personwho fails to complywith any of the provisionsof the Schemeis guilty of an offenceandwithout prejudiceto any otherremedygivenhereinis liable to the penaltiesprescribedby theAct.7.3 Notices:7.3.1 Twenty-eight28 dayswritten notice is herebyprescribedas the notice to be given pursuantto Section 10 of the Act.7.3.2 The Council may recoverexpensesunderSection 10 2 of the Act in a Court of competentjurisdiction.

7.4 Claims for Compensationand Betterment:7.4.1 Exceptwhere otherwiseprovidedin the Scheme,the time limit for the making of claims forcompensationpursuantto Section11 1 of the Act is six 6 monthsafter the datewhen notice ofthe approvalof the Schemeis publishedin the GovernmentGazette.7.5 Appeals: An applicant aggrievedby a decisionof the Council in respectof the exerciseofdiscretionarypowerunder this Schememay appealin accordancewith Part V of the Act andtherules and regulationsmadepursuantto the Act.7.6 Power to Make Policies:7.6.1 In order to achievethe objectivesof the Scheme,Council may makeTown PlanningSchemePoliciesrelating to partsor all of the schemeareaandrelating to oneor more of the aspectsof thecontrol of development.7.6.2 A Town Planning SchemePolicy shall becomeoperativeonly after the following procedureshavebeencompleted-

a The Council havingpreparedandhaving resolvedto adopta draft Town PlanningSchemePolicy, shall advertisea summaryof thedraft policy oncea week for two consecutiveweeksin a newspapercirculating in the areagiving details of where the draft policy may beinspectedandwhere,in what form, andduring what periodbeing not less than 21 daysrepresentationsmay be madeto the Council.

b The Council shall review its draft Town Planning SchemePolicy in the light of anyrepresentationsmadeandshall thendecideto finally adoptthedraftpolicy with or withoutamendment,or not proceedwith the draft policy.

c Following final adoption of a Town Planning SchemePolicy, details thereof shall beadvertisedpublicly and a copy kept with the Schemedocumentsfor inspection duringnormal office hours.

7.6.3 A Town PlanningSchemePolicy may only be alteredor rescindedby-

a Preparationandfinal adoption of a new policy pursuantto this clause,specifically wordedto supersedean existing policy.

b Publicationof a formal noticeof recissionby the Council twice in a newspapercirculatingin the area.

7.6.4 A Town PlanningSchemePolicy shall not bind the Council in respectof any application forplanningconsentbut the Council shall takeinto accountthe provisionsof the policy andobjectiveswhich the policy was designedto achievebefore making its decision.

Car Park: meansa site or building usedprimarily for parkingprivate cars or taxiswhetheras apublic or private car park, but does not includeanypart of a public road used for parkingorfor a taxi rank, or any land or buildings on or in which cars are displayedfor sale.

Car SalesPremises:meansland andbuildings used for the displayand sale of cars,whethernewor secondhandbut does not include a workshop.

Civic Building: means a building designed, used or intended to be used by GovernmentDepartments,statutorybodiesrepresentingthe Crown, or Councilsas offices or for administrative or other like purpose.

of his professionby a legally qualified medical practitioner,dentist or chiropractor,or by aphysiotherapist,a masseuror a personordinarilyassociatedwith a medicalpractitionerin theinvestigationor treatmentof physicalor mental injuries or ailments.

Council: meansthe Council of the Shire of Cranbrook.Development:shall havethe samemeaninggiven to it in and for the purposesof the Act.District: meansthe district of the Council.Dry Cleaning Premises:meansland and buildings usedfor the cleaningof garmentsand other

fabricsby chemical processes.Eating House:meanspremisesin which mealsare servedto the public for gain or reward,but does

not include-a Premisesin respectof which a hotel licence,tavern licence,limited hotel licence or wine

of that meetingshall resign;and

ii the Life MembersandOrdinary Membersshall vote on the electionofeight Life Membersor Ordinary Membersto form the Committee asfrom the close of that SpecialGeneralMeeting,

and the provisionsof By-laws 19 to 26 shall apply to such election as if,where applicable, referencesto the "GeneralMeeting" were referencestothe "SpecialGeneralMeeting" mentionedin this By-law 29A, savethat thefollowing provisionsshall apply only to that SpecialGeneralMeeting:

i The four Life Members or Ordinary Members so elected to theCommitteeandreceivingthe greatestnumberof votesshall retire fromthe Committeeat the GeneralMeeting to be heldin 1995 but shall beeligible for re-electionpursuantto By-law 18; and

ii The remainingfour Life Membersor Ordinary Membersso electedtothe Committeeshall retire at the GeneralMeeting to be held in 1994but shall be eligible for re-electionpursuantto By-law 18.

b This By-law 29A shall ceaseto haveeffect upon the close of the GeneralMeeting to be held in 1995 ".
