34542 ENVIRONMENTAL PROTECTION AGENCY [40 CFR Part 419] PETROLEUM REFINING POINT SOURCE CATEGORY Proposed Effluent Limitation Guidelines and New Source Standards Notice is hereby given that effluent limitations guidelines for existing sources and standards of performance and pre- treatment standards for new sources set forth in tentative form below are pro- posed by the Environmental Protection Agency (EPA) for the topping subcate- gory (Subpart A), low cracking subcate- gory (Subpart B), high cracking sub- category (Subpart C), petrochemical sub- category (Subpart D), lube subcategory (Subpart E), and integrated subcategory (Subpart F) of the petroleum. refining category of point sources pursuant to sections 301, 304(b) and (c), 306(b) and 307(c) of the Federal Water Pollution Control Act, as amended (33 U.S.C.'1251, 1311, 1314(b) and (c), 1316(b) and 1317 (c); 86 Stat. 816 et seq.; Pub. L. 92-500) (the Act). (a) Legal authority.-C1) Existing point sources. Section 301(b) of the Act requires the achievement by not later than JUly 1, 1977, of effluent limitations for point sources, other than publicly owned treatment works, which require the application of the best practicable control technology -currently available as defined by the Administrator pursuant to section 304(b) of the Act. Section 301(b) also requires the achievement by not later than July 1, 1983, of effluent limitations for point sources, other than publicly owned treat- ment works, which require the applica- tion of best available technology eco- nonlically achievable which will result in reasonable further progress toward the national goal of eliminating the dis- charge of all pollutants, as determined in accordance with regulations issued by the Administrator pursuant to section 304(b) to the Act. Section 304(b) of the Act requires the Administrator to publish, within one year of enactment of the Act, regulations pro- viding quidellnes for effluent limitations setting forth the degree of effluent reduc- tion attainable through the application of the best practicable control technology currently available and the degree of effluent reduction attainable through the application of the best control measures and practices achievable including treat- ment techniques, process and procedure innovations, operating methods and other alternatives. The regulations proposed herein set forth effluent limitations guide- lines, pursuant to section 304(b) of the Act, for the petroleum refining source category. (2) New sources. Section 306 of the Act requires* the achievement by new sources of a Federal standard of performance providing for the control of the discharge of pollutants which reflects the greatest degree of effluent reduction which the Administrator determines to be achiev- able through application of the, best available demonstrated control tech-. PROPOSED RULES nology, processes, operating methods, or other alternatives, Including, where prac- ticable, a standard permitting no dis- charge of pollutants. Section 306(b) (1) (B) of the Act re- quires the Administrator to propose reg- ulations establishing Federal standards of performance for categories of new sources included in a list published pur- suant to section 306(b)(1)(A) of the Act. The Administrator published in the FEDERAL REGISTER of January 16, 1973, (38 FR 1624) a list of 27 source catego- ries, including the petroleum refining category. -The regulations proposed herein set forth the standards of per- formance applicable to new sources for the petroleum refining category. Section 307(c) of the Act requires the Administrator to promulgate pretreat- ment standards for new sources at the same time that standards of perform- ance for new sources are promulgated pursuant to section 306. Sections 419.15, 419.25, 419.35, 419.45, 419.55 and'419.65 proposed below provide pretreatment standards for new sources within the petroleum refining category. Section 304(c) of the Act requires the Administrator to issue to the States and appropriate water pollution control agencies information on the processes, procedures or operating methods which result in the elimination or reduction of the discharge of pollutants to Implement standards of performance under section 306 of the Act. The development docu- ment referred to below provides, pur- suant to section 304(c) of the Act, infor- mation on such processes, procedures or operating methods. (b) Summary and basis of proposed effluent limitations guidelines for exist- ing sources and standards of perform- ance and pretreatment standards for new sources. (1) General methodology. The effluent limitations, guidelines and standards of performance proposed here- in were developed in the following man- ner. The point source category was first studied for the purpose of determining whether separate limitations and stand- ards are appropriate for .different seg- ments within the category. This analysis included a determination of whether dif- ferences in raw material used, product produced, manufacturing process em- ployed, age, size, waste water constit- uents and other factors require develop- ment of separate limitations and stand- ards for different segments of the point source category. The raw waste charac- teristics for each such segment were then identified. This included an analysis of (1) the source, floand volume of water used in the process employed and the sources of waste and waste waters in the operation; and (2) the constituents of all waste water. The constituents of the waste waters which should be sub- ject to effluent limitations guidelines and standards of performance were iden- tified. The control and treatment tgchnolo- gies existing within each segment were identified. This included an Identification of each distinct control and treatment technology, including both in-plant and end-of-process technologies, which are existent or capable of being designed for each segment. It also Included an Identi- fication of, in terms of the amount of constituents and the chemical, physical, and biological characteristics of pollu- tants, the effluent level resulting from the application of each of the technologies, The problems, limitations and reliability of each treatment and control tech- nology were also Identified. In addition, the non-water quality environmental impact, such as the effects of the appli- cation of such technologies upon other pollution problems, Including air, solid waste, noise and radiation, was Identi- fied. The energy requirements of each control and treatment technology were determined as well as the cost of the ap- plication of such technologies. The Information, as outlined above, was then evaluated In order to determine what levels of technology constitute the best practicable control technology cur- rently available, best available technol- ogy economically achievable and the beAt available demonstrated control technol- ogy, processes, operating methods,. or other alternatives. In identifying such technologies, various factors were con- sidered. These Included the total cost of application of technology in relation to the effluent reduction benefits to be achieved from such application, the ago of equipment and facilities involved, the process employed, the engineering as- pects of the application of various types of control techniques, process changes, non-water quality environmental Impact (including energy requirements) and other factors. The data upon which the above analy- sis was performed ncluded EPA permit applications, EPA sampling and inspec- tions, consultant reports, and industry submissions. The pretreatment standards proposed herein are intended to be complementary to the pretreatment standards proposed for existing sources under Part 128 of this title. The bases for such standards are set forth In the FEDERAL REGISTER Of July 19, 1973, 38 FR 19236, The provisions of Part 128 are equally applicable to sources which would constitute "now sources," under section 306 It they were to discharge pollutants directly to navi- gable waters, except for § 128.133. That section provides a pretreatment standard for "incompatible pollutants" which re- quires application of the "best practica- ble control technology currently avail- able," subject to an adjustment for amounts of pollutants removed by the publicly owned treatment works, Since the pretreatment standards proposed herein apply- to new sources, §§ 410.16, 419.25, 419.35, 419.45, 419.55 and 419.05 below amend § 128.233 to require appli- cation of the standard of performance for new sources rather than the "best practicable" standard applicable to exist- ing sources under sections 301 and 304(b) of the Act. (2) Summary of conclusions wth re- spect to the petroleum refining category of point sources.-(i) Categorization. Proposed Effluent Limitation Guidelinesand New Source Standards

Notice is hereby given that effluentlimitations guidelines for existing sourcesand standards of performance and pre-treatment standards for new sources setforth in tentative form below are pro-posed by the Environmental ProtectionAgency (EPA) for the topping subcate-gory (Subpart A), low cracking subcate-gory (Subpart B), high cracking sub-category (Subpart C), petrochemical sub-category (Subpart D), lube subcategory(Subpart E), and integrated subcategory(Subpart F) of the petroleum. refiningcategory of point sources pursuant tosections 301, 304(b) and (c), 306(b) and307(c) of the Federal Water PollutionControl Act, as amended (33 U.S.C.'1251,1311, 1314(b) and (c), 1316(b) and 1317(c); 86 Stat. 816 et seq.; Pub. L. 92-500)(the Act).

(a) Legal authority.-C1) Existingpoint sources. Section 301(b) of the Actrequires the achievement by not laterthan JUly 1, 1977, of effluent limitationsfor point sources, other than publiclyowned treatment works, which requirethe application of the best practicablecontrol technology -currently available asdefined by the Administrator pursuant tosection 304(b) of the Act.

Section 301(b) also requires theachievement by not later than July 1,1983, of effluent limitations for pointsources, other than publicly owned treat-ment works, which require the applica-tion of best available technology eco-nonlically achievable which will result inreasonable further progress toward thenational goal of eliminating the dis-charge of all pollutants, as determinedin accordance with regulations issued bythe Administrator pursuant to section304(b) to the Act.

Section 304(b) of the Act requires theAdministrator to publish, within one yearof enactment of the Act, regulations pro-viding quidellnes for effluent limitationssetting forth the degree of effluent reduc-tion attainable through the applicationof the best practicable control technologycurrently available and the degree ofeffluent reduction attainable through theapplication of the best control measuresand practices achievable including treat-ment techniques, process and procedureinnovations, operating methods and otheralternatives. The regulations proposedherein set forth effluent limitations guide-lines, pursuant to section 304(b) of theAct, for the petroleum refining sourcecategory.

(2) New sources. Section 306 of the Actrequires* the achievement by new sourcesof a Federal standard of performanceproviding for the control of the dischargeof pollutants which reflects the greatestdegree of effluent reduction which theAdministrator determines to be achiev-able through application of the, bestavailable demonstrated control tech-.

Section 306(b) (1) (B) of the Act re-quires the Administrator to propose reg-ulations establishing Federal standardsof performance for categories of newsources included in a list published pur-suant to section 306(b)(1)(A) of theAct. (b) Summary and basis of proposedeffluent limitations guidelines for exist-ing sources and standards of perform-ance and pretreatment standards fornew sources. (1) General methodology.The effluent limitations, guidelines andstandards of performance proposed here-in were developed in the following man-ner. The point source category was firststudied for the purpose of determiningwhether separate limitations and stand-ards are appropriate for .different seg-ments within the category. This analysisincluded a determination of whether dif-ferences in raw material used, productproduced, manufacturing process em-ployed, age, size, waste water constit-uents and other factors require develop-ment of separate limitations and stand-ards for different segments of the pointsource category. The raw waste charac-teristics for each such segment were thenidentified. This included an analysis of(1) the source, floand volume of waterused in the process employed and thesources of waste and waste waters inthe operation; and (2) the constituentsof all waste water. The constituents ofthe waste waters which should be sub-ject to effluent limitations guidelinesand standards of performance were iden-tified.

The control and treatment tgchnolo-gies existing within each segment wereidentified. This included an Identificationof each distinct control and treatmenttechnology, including both in-plant andend-of-process technologies, which are

crete subcategories which coincide witha breakdown of the category accordingto the flow of materials as outlined in theDevelopment Document for the petro-leum refining category.

The six subcategories for the petrole-um refining industry are based on theraw waste load with respect to the typeof refinery, process technology employed,and the waste severity from the opera-tions. Other factors which were con-sidered but did not affect the categoriza-tion include: age of refinery, size of re-finery, treatability, of waste waters andlocation. A description of the subcate-gories follows:

(A) Subpart A-Topping Subcategory.This subpart is applicable to the dis-charges of process waste water pollutantsand other waste water pollutants fromany facility which produces petroleumproducts by the use of topping and cats-lytic reforming, whether or not the fa-cility includes any processes other thantopping and catalytic reforming. Thissubpart shall not be applicable to fa-cilities which include processes specifiedin subparts B, C, D, E, and F. This sub-part is also applicable to the waste waterpollutants resulting from contaminatedstorm water runoff and from ballastwater.

(B) Subpart B-Low Cracking Sub-category. This subpart is applicable tothe discharges of process waste waterpollutants and other waste water pol-lutants from any facility which producespetroleum products by the use of topping,catalytic reforming and cracking, whenthe non-recycle feedstock to the crackingand hydroprocessing processes is lessthan 50 percent of the total feedstock tothe refinery, whether or not the facilityincludes any processes other than top-ping, catalytic reforming and cracking.This subpart shall not be applicable tofacilities which include processes speci-fied in subparts C, D, E, and F. This sub-part is also applicable to the waste waterpollutants resulting from contaminatedstorm water runoff and from ballastwater. -

(C) Subpart C-High Cracking Sub-category. This subpart is applicable tothe discharges process waste water pol-lutants and other waste water pollutantsfrom any facility which producespetroleum products by the use topping,catalytic reforming and cracking, whenthe non-recycle feedstock to the crack-ing and hydroprocessing processes isgreater than 50 percent of the total feed-stock-to the refinery, whether or not thefacility includes any processes othei thantopping catalytic reforming and crack-ing. This subpart shall not be applicableto facilities which include processesspecified In subpart D, E and F. Thissubpart is also applicable to the wastewater pollutants resulting from con-taminated storm water runoff and fromballast water.

(D) Subpart D-Petrochemical Sub-category. -This subpart is applicable tuthe discharges of process waste" waterpollutants and other waste Water pol-lutants from' any facility which pro-duces petroleum products by the use of

topping, catalytic reforming, crackingand petrochemical operations, with pro-duction of greater than 15 percent of thefeedstock throughput in first generationpetrochemicals and isomerization prod-ucts (benzene, toluene, xylene, olefins,cyclohexane, etc.) or production of sec-ond generation petrochemicals, (alcohols,ketones, cumene, etc.), whether or notthe facility includes any processes otherthan topping, catalytic reforming andcracking and petrochemical operations.This subpart shall not be applicable tofacilities which Include processes speci-fled in subparts E and F. This subpart Isalso applicable to the waste water pol-lutants resulting from contaminatedstorm water runoff and from ballastwater.

(E) Subpart E-Lubc Subcategory.This subpart is applicable to the dls-charges of process waste water pollutantsand other waste water pollutants fromany facility which produces petroleumproducts by the use of topping, catalyticreforming, cracking and lubes, with theproduction of less than 12 percent of thefeedstock throughput as lubes, whetheror not the facility Includes any processesother than topping, catalytic reforming,cracking and lubes. This subpart shallnot be applicable to facilities which in-cludes processes specified In subparts Dand F. Refineries with greater than 12percent lubes are being considered asspecialty refineries and limits for themwill be set at a later date. This subpart isalso applicable to the waste water pol-lutants resulting from contaminatedstorm water runoff and from ballastwater.

(F) Subpart F-InteograteL Sub-category. This subpart Is applicable tothe discharges of process waste waterpollutants and other waste water pol-lutants from any facility which produdespetroleum products by the use of topping,catalytic reforming, cracking, petro-chemical operations (as defined in sub-part D) or lubes, whether or not thefacility includes any processes other thantopping, catalytic reforming, cracking,petrochemical operations and lubes. Thissubpart is also applicable to the Watewater pollutants resulting from con-taminated storm water runoff and fromballast water.

(ii) Waste characteristics and sources.The pollutants contained in raw wastewaters resulting from the petroleum re-fining category include BOD5, COD, or-ganic carbon, suspended and dissolvedsolids, oil and grease, phenolic com-pounds, nitrogen compounds, sulfides,sulfites, chlorides, fluorides, chromium,zinc, lead, cyanides, acidity, alkalinityand other metallic ions. Large volumes ofcooling water are required by the In-dustry and heat is a potential problem.Eight pgllutants are usually found %n thepetroleum refining industry in objection-able amounts In the raw waste. These oreBOD5, COD, TOO, suspended solids, oiland grease, phenolic compounds, am-monia and sulfides. In addition, objec-tionable amounts of chromfum andzinc are often found in cooling towerblowdown, when thege materials are used

as corrosion inhibitors. A qualitativesummary of the process sources for theabove parameters is outlined in thedevelopment document.

(Ill) Treatment and control tech-nology. In plant procedures to controlpollution include: good housekeeping.control of spills and leaks, reduction andcontrol of start-up nd shut-down opera-tions, reuse of waste water from oneprocess in another, cooling towers, sourwater strippers, phenol extraction ortreatment, sewer segregation, and processchanges.

End-of-pipe waste water treatmentprocesses include: equalization, gravityseparation, additional'oll and soldsre-moval (AP, filters, etc.), biologicaltreatment (oxidation ponds, aerated la-goons, activated sludge, tricking filters,etc.), polishing (filters, ponds), physical-chemical treatment (activated carbon,etc.).

(lv) Definition of technology basis forBPCTCA, BATEA, and BADT. Wastewater treatment and control technologieshave been studied for each subcategoryof the Industry to determine what is thebest practicable control technology cur-rently available, the best available tech-nology economically achievable, and thebest available demonstrated technology,processes, operating methods or otheralternatives.

It was determined that each level oftechnology should be Identical within theIndustry (all subcategories).

(A) Best prdctlcable control tech-nology currently available (BPCTCA).(1) Process and influent changes. Thefollowing are practiced extensivelythroughout the industry and are con-sldered as BPCTCA: Installation of sourwater strippers to reduce the sulfide andammonia concentrations entering thetreatment plant, elimination of once-through barometric condenser water byusing surface condensers or recycle sys-tems with oily water cooling towers, se-regation of seweri, so that uncontami-nated storm runoff and uncontaminatedonce through cooling waters are nottreated normally with the process andother contaminated waters, and elimina-tion of contaminated once-throughcooling water, by monitoring and repairof surface condensers or by use of wetor dry recycle systems.

(2) Waste water flow considerations.In a petroleum refinery the waste watertreatment plant should be used to treatonly contaminated waters. All once-through cooling water or storm runoffwhich Is uncontaminated should be sep-arated, as It dilutes the contaminatedwaters and requires treatment of agreater flow. Flows for BPCTCA werebased on the 50 percent probability of oc-currence flows for plants practicing re-cycle or air cooling with less than 3 per-cent hnt removal by once-through cool-ing water (on a dry weather basis). Rec-ognizing the additional flows and wasteloads associated with rain runoff and bal-last waters, allocation for these addedflows may be given based on strictly seg-regated runoff and ballast water.

(3) Wastewater treatment (end ofpipe). BPCTCA is based on the existing

waste water treatment processes cur-rently used in the petroleum refining in-dustry. These consist of equalization andstorm diversion; initial oil and solids re-moval using API separators or baffleplate separators; further oil and solidsremoval using clarifiers, dissolved air"flotation, or filters; carbonaceous wasteremoval using activated sludge, aeratedlagoons, oxidation ponds, trickling filter,activated carbon, or combinations ofthese; and filters (sand, dual media; ormulti-media) following biological treat-ment methods.

(B) Best available technology econom-ically achievable (BATEA). (1) Processchanges. Water use can be reduced byextensive reuse and recycle. This is dem-onstrated by the fact that approxi-mately 10 percent of the refineries pres-ently have water flows which meet theBATEA waste water flows. Water conser-vation measures presently used Include:use of air cooling equipment; reuse ofsour water stripper bottors in crude de-salters; reuse of- once-through coolingwater as make-up to the water treatmentplant; using waste water treatment planteffluent as cooling water, scrubber water,and influent to the water treatmentplant; reuse of boiler condensate as boilerfeedwater; recycle of water from cokingoperations; recycle of waste acids fromalkylation units; recycle of overheadwater in water washes; reuse of overheadaccumulator water in desalters; use ofclosed compressor and pump coolingwater system; reuse of heated waterfrom the vacuum overhead"condensersto heat the crude; use of rain runoff ascooling tower make-up or water treat-ment plant feed and others.

(2) Waste water flow considerations.The waste water flow reductions requiredfor BATEA were determined by averag-ing, within each category, the flows fromthose refineries that currently have wastewater flows less than the BPCTCA levels.There are 3 to 5 refineries in each sub-category that have flows less than orequal to the BATEA levels specified.These refineries range.in size from 832-69,400 cu m/day (5,200-434,000 barrels/day); with cracking capacities rangingfrom 0 to 100 percent of crude capacity.Within this same group of refineries withlow-water usage, there are refineries lo-cated in both high rainfall and dry areas(Washington and New Mexico) and areasof extreme temperatures (New Mexicoand Texas to Alaska and Minnesota).

(3) Wastewater treatment technology.For BATEA the effluent from a BPCTCAlevel waste treatment plant is fed to anactivated carbon unit. The data usedwere determined from pilot plant studies.It is recognized that as additional, actualperformance data becomes available theBATEA treatabiity levels for activatedcarbon may be revised.

(C) Best available deinonstrated tech-nology (BADT). BADT is the basis forNew Source Performance Standards(NSPS).

No major change in process tech-nology is projected for new refineries.Therefore, the same waste water flow hasbeen used for evaluating BADT as ob-tained from the BATEA.

(1) Process changes to be as describedfor BATEA.

(2) Waste water flow to be as describedfor BATEA.

(3) Waste treatment technology to beas described for BPCTCA.

Activated carbon is not being con-sidered as BADT because It has not beensufficiently demonstrated within the in-dustry at this time.

(v) Variability. The effluent from aproperly 'designed and operated treat-ment plant changes continually due to(a) changes in product mix, productionrate and reaction chemistry, which in-fluence the composition of raw wasteload and therefore its treatability; and(b) changes in biological factors whichinfluence the efficiency of the treatmentprocess. A common indicator of thestrength of the discharge from a plant isthe long-term average of the effluentload. By the use of data which show thevariability in the effluent load, statisticalanalysis can be applied to compute short-term limits (monthly, or daily) whichshould not be exceeded provided that theplant is designed and run in the properway to achieve the desired long-termaverage load. The levels of technology forBPCTCA, BATEA and BADT take intoaccount this variability as determinedfrom properly designed and operatedtreatment plants.

(vi) Nonwater quality aspects. Thenonwater quality. aspects of treatmentand pollution control in this industryare basically related to solid waste andland utilization. The waste waters fromthe industry, and the treatment proc-esses used, develop a considerable volumeof solid wastes. Currently, the industryconcentrates these wastes and disposes

* of them by one of the following methods:landflling, landfarming, incinerationand barging.

In general, noise levels from typicalwaste water treatment plants are notexcessive. If incineration of waste sludgesis employed, there is a potential for airpollution, principally particulates andpossibly nitrogen oxides. There are noradioactive nuclides used within the in-dustry, other than in instrumentation,so that no radiation problems will beencountered. Odors from the waste watertreatment plants may cause occasionalproblems since waste waters are some-times such that heavy, stable foams oc-cur on aerated basins. But in general,odors are not expected to be a significantproblem, especially since technology isavailable to control or eliminate them.

(vii) Economic impact analysis. Theeconomic analysis has focused on bothinternal and external costs associatedwith the proposed levels of water pollu-tion abatement.

The total investment and annual costsrequired for all subcategories to achievethe 1977 effluent limitations are estimatedat $1 billion and $380 million, respec-tively.

The total cost of water pollution abate-ment has been related to the productselling price to determine the magnitudeof either price increases, If these costscan be passed on, or decreases in pre-tax

profitability. Price increases of 5-0 centsper barrel ' are expected, as a result ofpollution abatement, by 1917 and 9-10cents per barrel by 1983 (in the absenceof the Impact fee system)..

External cost deals basically with theassessment of economic impact of theinternal costs discussed above In termsof price Increases, production curtail-ments or plant closures, resultant em-ployment, community and regional Im-pacts, international trade, and futureindustry growth. It should be noted thata precise study of economic Impact Isdifficult due to numerous other economicforces at work within an Industry, andbecause of the great variability experi-enced from plant to plant In such factorsas pollution control costs, profitability,and return on Investment. In an eco.nomic study such as this, it Is not pos.sible to deal with these factors on an In-dividual plant basis,

It Is not expected that any significanteconomic impact would result from Im-posing the 1977 and 1983 effluent limita-tions (Best Practicable Control Technol-ogy and Best Available Treatment Eco-nomically Achievable), Because of thisconclusion, we Judge that the proposedguldelines for 1977, 1983 and new sourcesare economically achtbvable. No price In-creases due to water pollution controlare expected as a result of the change Inrefinery profitability which will be causedby implementation of the Import licensefee system. The economic viability of'from 2 to 11 refineries accounting for0.02 percent to 0,3 percent of current re-fining capacity will be threatened by theadded burden of water pollution controlcosts. Possible, resultant Job losses wouldbe a maximum of 500 out of 150,000 cur-rent refinery employees. Since these re-fineries are located in several geographi-cal areas, the community and regionalimpacts of even the highest estimate ofjob losses do not appear to be substan-tial. The domestic prices of crude endproducts, by mid-decade, will be deter-mined by the Impact license fee system;therefore, pollution control expenditureswill have no effect on the future balanceof payments for petroleum products.

The report entitled "Development Doc-ument for Proposed Effluent LimitationsGuidelines and New Source PerformanceStandards for the Petroleum RefiningPoint Source Category" details the pfial-ysis undertaken In support of the regu-lations being proposed herein and isavailable for inspection In the EPA In-formation Center, Room 227, WestTower, Waterside Mall, Washington,D.C., at all EPA regional offices, and atState water pollution control offices. The comments were highly variableranging from full approval to total re-jection. The primary issues raised in the'development of these proposed effluentlimitations guidelines and standards ofperformance and the treatment of theseisues are as follows:

(1) .There were several comments onthe subcategorization of the industryproposed in the draft report, whichrepresents a change from the traditionalAPI classification system. After an anal-ysis of available data, the API-D" and E

classifications which had been combinedin the draft report were separated. Inaddition the lube subcategory was dividedto show difference between the large re-finery manufacturing lube oils and thesmall "specialty" lube oil manufacturer.Limits for the lube subcategory (greaterthan 12 percent lubes) are not being setat this time since the 19 refineries in thisgroup are small specialty plants (com-prising 0.8 percent of the total industrythroughout). These refineries are, as agroup, a special case when looking at theindustry in terms of economics, landavailability, age, feedstocks, etc. Thelimits for these refineries will be set ata later date. The division of the API "B"category into low and high cracking sub-categories, based on percent cracking wasreevaluated and is considered Justifiable.

(2) Several commenters questioned thelack of additional allocation for ballastwaters and storm runoff (the flow datawas based on the API/EPA Refinery Sur-vey which reports dry weather flow). Al-locations are now included for both ofthese waste sources.

(3) Comments were received on the is-sue of the handling of "non-contact"once-through cooling water. Since totallyexcluding once-through cooling waterfrom consideration (as requested by sev-eral commenters) would allow heavy

contamination of these waters, it wasdecided to include them in the total al-location. Comments requesting the totalelimination of once-through coolingwaters were considered economicallyunjustifiable. Refineries with contami-nated once-through cooling water couldeither monitor and clean up this water byrepairing leaky heat exchangers or go torecycle cooling systems.

(4) The consideration of feedstocks asa .sibcategorization factor received sev-eral comments. An unsuccessful attemptwas made to spilt the industry by feed-stock used (sweet or sour crudes, naturalgas liquids). As a result the effluent limi-tations set are based- on sour crudes asthe feedstock. This could be somewhatadvantageous to those refineries usingsweet crudes, but the effect will not besignificant since the long range forecastis for a continuing and rapid decline in.sweet crude availability.,

(5) The inclusion of a polishing stepsuch as filters or polishing ponds afterbiological treatment In BPCTCA wasquestioned by a few commenters. It isfelt that this additional treatment stepis justified in the petroleum industrysince several refineries already havepolishing ponds; one has mixed mediafilters and several more are currently un-der construction. The mixed media filtersare expected to result in a 50 percentreduction of TSS, 30-50 percent reduc-tion of oil and the associated BOD, CODand insoluble metals removals, over thoselevels attainable by biological treatimantalone. This additional treatment step Isexpected to raise the industries' costs for.treatment as follows: apital-S percent,operating cqsts-6 percent, and energycosts-7.5 percent.

(6) A point of some disagreement wasthe incluslofl of total organic carbon(TOC) as one of the pollutant parametersbeing limited. The points raised rangedfrom "TOC Is an untried and meaning-less parameter" to "TOO Is the only goodmeasure of a refinery waste stream.." TOOin fact has several advantages over BOD5and COD which, in general, are used asa measure of the same waste charac-teristics. It is a test which is fast, accu-rate and reproducible, but does require anInitial capital outlay for equipment ofEeveral thousand dollars. The meaning ofthe TOO value can be particularly im-portant for discharges to estuaries andlakes with extended flush times; theBODS value may not reasonably reflectthe oxygen demanding quality of thewaste in these areas, while TOC should.In addition, the TOC is the best and fast-est method of determining plant upsetconditions and treatment plant opera-tion.

Subpart A-Topping Subcategory

§ 419.10 Applicability; description ofthe topping subcategory.

The provisions of this subpart are ap-plicable to the discharges of processwaste water pollutants and other wastewater pollutants from any facility whichproduces petroleum products by the useof topping and catalytic reformingwhether or not the facility includes anyprocesses other than topping and cata-lytic reforming. This subjart shall not beapplicable to facilities which includeprocesses specified in subparts B, C, D, E,and F of this part. Allocations for thewaste water pollutant discharges result-ing from contaminated storm water run-off and ballast water are also applicableto this subpart.

§ 419.11 Specialized definitions.

For the purposes of this subpart:(a) The term "process waste water"

shall'mean any water which during themanufacturing process comes into directcontact with any raw material, inter-mediate product, by-product,. wasteproduct or finished product.

(b) The term "process" waste waterpollutants" shall mean pollutants con-tained in process waste waters.

(c) The term "other waste water pol-lutants" shall mean pollutants containedin cooling tower and utility blowdowns,once-through cooling water, runoff, bal-last, and from auxiliary facilities such aslaboratories and others.

(d) The term "runoff" shall mean theflow of storm water (daily average flow).

(e) The term "ballast" shall mean theflow of waters, from a ship, which is tobe treated at the refinery (daily averageflow).

(f) The term "feedstock" shall meanthe crude oil and natural gas liquidsfeed, to the topping units.

(g) The term "oil and grease" shallmean those components of a waste wateramenable to measurement by the methoddescribed In "Methods for ChemicalAnalysis of Water and Wastes," 1971,Environmental Protection Agency, Ann-lytical Quality Control Laboratory, page217;(h) The term "phenol(s)" shall mean

§ 419.15 Pretreatment standards fornew sources.

Subpart B--Low Cracking Subcategory§ 419.20 Applicability; description of

the low cracking subcategory.The provisions of this subpart are ap-

plicable to discharges of process wastewater pollutants and other waste waterpollutants from any facility which pro-duces petroleum products by the use oftopping, catalytic reforming and crack-ing, when the non-recycle feed to thecracking and the hydroprocessing proc-esses is less than 50 percent of the feed-stock throughput, whether or not thefacility includes any processes other thantopping, catalytic reforming and crack-Ing. This subpart shall not be applicableto facilities which include processes spec-ified in subparts C. D, E, and F of thispart. Subpart C-High Cracking Subcategory

§419.30 Applicability; description of.the high cracking subeategory.

The provisions of this subpart are ap-plicable to the discharges of process

waste water pollutants and other wastewater pollutants from any facility whichproduces petroleum products by the useof topping, catalytic reforming andcracking, when the non-recycle feed tothe cracking and hydroprocessing proc-esses is greater than 50 percent of thefeed throughput, whether or not the fa-cility includes any processes other thantopping, catalytic reforming and crack-ing. This subpart shall not be applicableto facilities which include processes spec-ified in subparts D, E, and F. Allocationsfor the waste water pollutant dischargesresulting from contaminated storm waterrunoff and ballast water are also applica-ble to this subpart..

§ 419.31 Specialized definitions.For the purposes of this subpart:(a) The term "process waste water"

shall mean any water which during themanufacturing process comes into directcontdct witl4 any raw material, inter-medlati product, by-product, waste prod?-uct or finished product.

(b) The term "process waste waterpollutants" shall mean pollutants con-tained in process waste waters.

(c) The term "other waste water pol-lutants" shall mean pollutants containedin cooling tower and utility blowdowns,once-through cooling water, runoff, bal-last, and from auxiliary facilities such aslaboratories and others.

(d) The term 'rmnoff" shall mean theflow of storm water (daily average flow).

(e) The term "ballast" shall mean theflow of waters, from a ship, which is tobe treated at the refinery (daily averageflow).

(f) The term "feed" shall mean thecrude oil and natural gas liquids feedto the topping units.

(g) The term "oil and grease" shallmean those components of a waste wateramenable to measurement by the methoddescribed in "Methods for ChemicalAnalysis of Water and Wastes," 1971, En-vironmental Protection Agency, Analyti-cal Quality Control Laboratory, page 217;

plicable to the discharges of processwaste water pollutants 'and other wastewater pollutants from any facility whichproduces petroleum products by the useof topping, atalytic reforming, crackingand. petrochemical operations, withproduction of greater than 15 percent ofthe feed throughput in first generationpetrochemicals and isomerization prod-ducts (BTX, olefins, cyclohexane, etc.)or production of second generation pe-trochemicals (alcohols, ketones, cumene,etc.), whether or not the. facility in-cludes any processes other than topping,catalytic reforming, cracking and petro-chemical operations. This subpart shallnot be applicable to facilities which in-elude processes specified in subparts Eand F of this part. Allocations for thewaste water pollutant discharges result-ing from contaminated storm water run-off and ballast water are also applicableto this subpart.§ 419.41 Specialized definitions.

§419.45 Prctreatmcnt standards fornew sources.'

The pretreatment standards 'undersection 307(c) of the Act, for a sourcewithin the petrochemical subcategory,which is an industrial user of a publiclyowned treatment works (and whichwould be a new source subject to section306 of the Act, if it were to dischargepollutants to navigable waters), shall bethe standard set forth in Part 128 ofthis title, except that for the purposes ofthis section, § 128.133 of this title shallbe amended to read as follows:

Subpart E-Lube Subcategory§ 419.50 Applicability; description of

the lube subeategory.

The provisions of this subpart are ap-plicable to the discharge of process wastewater pollutants and other waste waterpollutants from any facility which pro-duces petroleum products by the use oftopping, catalytic reforming, crackingand lubes, with the production of lessthan 12 percent of the feed throughputas lubes, whether or not the facility in-cludes any processes other than topping,catalytic reforming, cracking and lubes.This subpart shall not be applicable tofacilities which include processes speci-fled in subparts D and E of this part.Refineries with greater than 12 percentlubes are being considered specialty re-

fineries and are to be handled oi an indi-vidual basis. Allocations for the wastewater pollutant discharges resulting fromcontaminated storm water runoff andballast water are also applicable to thissubpart.§ 419.51 Specialized definitions.

For the purposes of this subpart:(a) The term "process waste water"

shall mean any water which during themanufacturing process comes into directcontact with any raw material, interme-diate product, by-product, waste productor finished product.

(b) The term "process waste waterpollutants" shall mean pollutants con-tained in process waste waters.

plicable to the discharges of proceewaste water pollutants and other wastewater pollutants from any facility whichproduces petroleum products by tho useof topping, catalytic reforming, cracking,petrochemical operations, with produc-tion of greater than 15 percent of thefeedstock throughout In first genratlollpetrochemicals and isomer'zatlon prod-ucts (BTX, olefins, cyclohexane, etc,) orproduction of second generation petro-chemicals (alcohols, ketches, cuene,etc.), and lubes, whether or not the fa-cility includes any processes other thantopping, catalytic reforming, cracking,and petrochemical operations. Alloca-tions for the waste water pollutant dis-charges from contaminated storm waterrunoff and ballast water are also appli-cable to this subpart.§ 419.61 Specialized definitions.
