PROCEDURE FOR SELECTION AND ADMISSION TO POST-GRADUATE DEGREE COURSE IN DENTISTRY

MASTER OF DENTAL SURGERY (MDS)

1. INTRODUCTION: The Director, Medical Education & Research, Mumbai has been declared as the Competent Authority by Govt. of Maharashtra vide Government Resolution No. MED1013/CR-413/13/Edu-2, dated 13th November 2013 for conducting PGD-CET 2014 and selection of candidates for admission to various dental postgraduate courses (MDS) for the year 2014-2015. 1.1 CLARIFICATION : The Hon’ble Supreme Court (Bench of Hon. 7 judges) has

delivered a judgment on 12/8/2005 in Civil Appeal No.5041/2005 in SLP (C) No.9932/2004 in respect of ‘rights and entitlement’ of Government as against Private Professional Educational Institutions (including Private Medical/Dental Colleges conducting graduate and postgraduate Medical and Dental courses). This judgment expects enactment of legislation by Central Government and in its absence, by State Government in this regard. This process has been initiated. However it is not certain, as of this date, as to when such legislation will come into force, as also its provisions.

In the meanwhile, in terms of the observations of the Hon’ble Supreme Court from the aforesaid judgment, at least at this stage, it appears that State Government cannot claim any quota/seats in these colleges/institutions and consequently cannot effect admissions in these Private Medical/Dental Colleges/institutions, except to the extent agreed to with certain institutions. It is therefore made clear that on the aforesaid interpretation and advice given to the State Government, this Brochure will not apply to the admissions to be effected in the academic year 2014-2015 at the Private Medical/Dental Colleges/Institutions, in so far as postgraduate courses are concerned, with the above exception.

However, it is made expressly clear that if, after issuance of this Brochure, either on account of any legislation or on account of any different interpretation/opinion/advice or due to any judgment/order passed by any court of law or even otherwise, the State Government is found entitled to any seat(s) in the Private Medical/Dental Colleges/Institutions and consequently entitled to effect the admission(s) to such seat(s), the rules and regulations set out in this Brochure will be made applicable to such seat(s) and admission(s). In such event, a separate intimation will be issued with appropriate details.

It is also made hereby clear in no uncertain terms that the same ‘Common Entrance Test’ (CET) that is proposed to be conducted in terms of this Brochure will govern such admission(s), if any.

1.2This procedure will be called as “Procedure for selection and admission to Dental postgraduate courses at the State Government Dental Colleges, Brihanmumbai Municipal Corporation Dental College and all other Private Dental Colleges/Institutions who opt for admission to MDS courses through PGD-CET 2014.

1.3 Definitions: a) “Appropriate Authority” means the Government of Maharashtra. b) “Approved Institution” means the hospital, affiliated college recognised by

the DCI and Maharashtra University of Health Science, Nashik (MUHS) as an institution in which postgraduate Degree courses in dentistry are available.

c) “Central Government” means the Government of India.

d) “Competent Authority” means the authority appointed by the Government for the purpose of conduct of common entrance test for selection and admission to postgraduate degree courses in Dentistry.

e) “Course” means 3 years degree course leading to MDS degree in various subjects.

f) ‘Designated Authority’ means authority responsible to carry out the instructions given by the Competent Authority in respect of selection and admission process for postgraduate medical courses.

g) “Dental Council of India (DCI)” means the Dental Council of India established under Dentist Act, 1948.

h) Examination Centre: The city/town where the examination is conducted. i) Examination Sub-centre: The individual Institute where the examination is

conducted. j) “Internship” means the compulsory rotating internship to be completed as

per rules of Dental Council of India (DCI) and Maharashtra State Dental Council (MSDC) and concerned University.

k) “Postgraduate Teacher” means the postgraduate teacher who is recognised as a teacher under the regulation of the Dental Council of India (DCI), by Maharashtra University of Health Sciences, Nashik.

l) “PGD-CET Cell” means postgraduate dental common entrance test cell constituted for the purpose of conduct of PGD-CET and selection process for postgraduate course in dentistry.

m) “Recognised Qualification” means the qualification recognised by the Dental Council of India (DCI) and the Universities in the State of Maharashtra.

n) “Registration” means the registration of the qualification either with the Dental Council of India (DCI) or Maharashtra State Dental Council (MSDC) after completing 1 year compulsory rotating internship.

o) “Reservation” means the reservation prescribed by the Government for admission to postgraduate courses in dentistry for constitutional reservation for the Backward Classes and Physically Handicapped (PH) candidates.

p) “University” means the non-agricultural University constituted under the Maharashtra University Act, 1994 or by MUHS act 1998.

q) Terms which are used in these rules but not defined above are in consonance with the definition given in Maharashtra University Act, 1994.

2. COMPETENT AUTHORITY: The Competent Authority will supervise and control the selection process by implementing these procedures through the PGD-CET Cell/Designated Authorities. The Competent Authority will issue necessary executive instructions for implementation of these procedures and provide relevant information to be published or communicated. The Competent Authority will declare time-table, details of the dates of various processes relating to selection procedure. e.g. sale/ receipt of forms, date of Common Entrance Test, date of counselling for preference form filling etc.

3. DESIGNATED AUTHORITY: For the purpose of implementation of these procedure following authorities will act as designated authorities for the regions and the districts indicated against the names:

The Designated Authority will be responsible to carry out the instructions given by the Competent Authority in respect of Selection and admission process for postgraduate dental courses. Designated Authority may associate other officials to assist them in the selection and admission process.

4. APPELLATE COMMITTEE: Appellate Committee will consist of the following members:

(i) Competent Authority & DMER, Mumbai- Chairman. (ii) Jt. Director (Dental), MER, Mumbai.

(iii) Dean, Govt. Dental College & Hospital, Aurangabad The appeal in ordinary course shall lie against allegedly, arbitrary decision or

violation of prescribed procedure by PGD-CET cell, Designated Authority or their representatives.

The appeal/representation should be submitted through Designated Authority with one advance copy to Competent Authority, within 48 hours of cause of action, by aggrieved party.

5. LIST OF POSTGRADUATE DENTAL DEGREE COURSES: 5.1 List of postgraduate degree courses are given in Annexure “A”. 5.2 The seats available for admission to postgraduate dental courses through

PGD-CET will be from all State Government and Brihanmumbai Municipal Corporation Dental colleges and All other Privat Dental Colleges / Institution who opt for admission to MDS Course through PGD CET 2014 (Annexure “B”).

6. PG SEAT DISTRIBUTION:

6.1 The Seat available for admission to Dental Postgraduate Courses will be distribute as 50% to all India Quota and remaining 50% the State Quota. From the State Quota 15% Seats from Government Dental Colleges will be distributed to the dental In-Service Candidates of Government Dental College & Hospital and Government Medical College & Hospital as per Government Resolution ihth,e&1012$iz-d1$12$f'k{k.k&2] fnukad30 tkusokjh2012 o ledzekdhr 'kklu fu.kZ; fnaukd 2 ekpZ 2012-

6.2 The institute wise availability of the seats will be as per Postgraduate Regulation of Dental Council of India (DCI) and MUHS, Nashik.

6.3 The seat position will be given in the preference form filling information brochure and will be displayed on the website of DMER (www.dmer.org).

6.4 The seats available will be filled in on the basis of State Merit List in PGD-CET. There will be no Regional reservation. However there will be reservation in these seats as per State Government orders issued from time to time (Annexure “C & D”).

6.5 Any seats remaining vacant from all India Post Graduate quota will be reverted back to State quota, after these seats are surrendered by the Concerned Authorities. Seats surrendered from All India Quota will retain there original Category character. All India Quota surrendered Seats having OBC character will be allotted to PGD CET candidates, of VJ, NT1, NT2, NT3, OBC & SBC Category candidate (group together) as per inter-se merit. All India surrendered quota will be allotted to state quota and there will not be in-service reservation in this surrendered quota.

6.6 Vacancies arising due to any reason in postgraduate courses in Academic Year, shall neither be filled nor be carried forward to the next or subsequent academic years after the last date of joining for post graduate

courses i.e 31st may 2014 as per DCI Guidelines. The academic year will be start from 2nd May, 2014 as per DCI Guidelines.

7. ELIGIBILITY CRITERIA FOR PGD-CET 2014 FOR DENTAL POST GRADUATE COURSES:

7.1 Candidate must be an Indian National. Nationality Certificate issued by District Magistrate or Additional District Magistrate or Chief Metropolitan Magistrate / valid passport or School Leaving (SSC)/Jr. College Leaving Certificate of HSC/12th Std. indicating the nationality of the candidate as “Indian” shall constitute the proof of nationality. [Persons of Indian Origin (PIO) / Non Resident Indians (NRI) / Overseas Citizen of India (OCI) are not eligible].

7.2 All candidates, who have passed final B.D.S. Examination and

Completed / Completing One year internship training by 31st March, 2014 from a recognised dental college (Annexure-E) included in the schedule of the Dental Council of India and situated in Maharashtra, affiliated to the Non-agricultural University established under Maharashtra Universities Act, 1994 or the Maharashtra University of Health Sciences Act 1998 or Dental Colleges affiliated to Deemed University as per University Grant Commission Act 1956 under section 13/A, situated in Maharashtra, and who have obtained registration either from the Dental Council of India or Maharashtra State Dental Council (MSDC) after completing one year compulsory rotating internship will be eligible to appear for PGD-CET. Candidate obtained BDS Degree before introduction of one year compulsory rotating internship training, i.e. on or before 1989 will also be eligible to appear for PGD-CET 2014.

7.3 IN-SERVICE CANDIDATES 7.3.1 Eligibility for In Service Candidates will be as per provisions

7.3.2 To be eligible for in-service seats candidates should have passed BDS examination in maximum three attempts from DCI recognized Dental College, Situated in Maharashtra State.

7.3.3 Candidates working on the post of Dental Surgeon for Minimum 3 years in Government Dental College & Hospital or Government Medical College & Hospital are eligible for In-Service Reservation. Candidates working on temporary Dental Surgeon Post are not eligible for In-Service reservation.

7.3.4 Age of the candidates should not be more than 45 years at the time of submission of application for PGD CET.

7.3.5 Candidates must appear the PGD CET Examination and should qualify the examination as mentioned in rule no 11.3.

7.3.6 Separate Merit list will be prepared for in-service Candidates. For every one year service as dental surgeon 10% of obtained marks up to maximum 30% marks shall be added in the PGD CET obtained marks. Candidate qualifying PGD CET are only eligible for this additional weightage mark.

7.3.7 There will be constitutional reservation in in-service quota. Roster for 5 years for this reservation will be maintained.

7.3.8 The In-Service reservation will be 15% of the seats available with Competent Authority excluding all India Quota. There will be no reservation in the all India Quota Seats Surrendered to the State.

7.3.9 In-Service candidates after obtaining MDS qualification must serve The Government for 10 years otherwise he/she has to pay Rs 50,00,000/- (Fifty Lakhs Only) as a penalty.

7.4 A candidate should have obtained MSDC/DCI registration by the date of document verification process. (Except for a candidate who will be completing Internship by 31/03/2014, such a candidate must submit the aforesaid certificate by the beginning of academic term (i.e. second May 2014) to the college authority)

7.5 A candidate who has completed one year compulsory rotating internship or is likely to complete the same on or before 31st March 2014 can appear for PGD-CET.

7.6 The candidates who were admitted to the colleges/institutions which are now affiliated to the Maharashtra University of Health Sciences (MUHS) will be eligible till such time as they are awarded the degrees by the University established under Maharashtra Universities Act, 1994.

7.7 However, the candidate who are domiciled in Maharashtra and who obtained admission under 15% quota from All India Entrance Examination (AIEE) for BDS course in a dental college/institution situated out-side Maharashtra State and who has obtained the degree from a University situated outside the State of Maharashtra will also be eligible for PGD-CET. Such candidate should submit: i) Certificate from the Dean of respective college stating that the

candidate was admitted under 15% AIEE quota for BDS course. ii) Certificate of domicile in State of Maharashtra by virtue of residence.

7.8 The candidate belonging to Backward Class must have claimed so in his Online/ Computerized Scanable application form, failing which such a claim will not be entertained subsequently. The candidate belonging to Backward Class Category should produce the Caste Certificate, Caste Validity Certificate and Non-Creamy Layer Certificate (wherever applicable) at the time of preference form filling process.

7.9 A Candidate belonging to ‘Creamy Layer’ amongst the categories (VJ) DT -A, (NT-1) NT-B, (NT-2) NT-C, (NT-3) NT-D, OBC and SBC must note that the provision of reservation is NOT applicable to him/her. A candidate claiming benefit of reservation under these categories will be required to produce Non-Creamy Layer Certificate as specified in the Govt. Resolution No.CBC-10/2008/CR-697 VJNT-1, dated 24th June, 2013. The certificate in prescribed Proforma stating that it is valid upto 31/3/2014, should be submitted at the time of Document Verification process.

7.10 Candidate will be eligible to appear for PGD-CET 2015, if he/she cancels his/her admission of PGD-CET 2014 before prescribed date.

7.11 Non-eligibility of Candidate The following candidates are not eligible for applying/appearing at PGD-

CET 2014 as the case may be: 7.11.1 Candidates who have passed Final BDS exam from institute located

outside Maharashtra, except candidates who are Domicile of Maharashtra and selected under 15% AIEE quota (Ref. Rule 7.7).

7.11.2 Candidates who have passed final BDS examination from foreign university are not eligible.

7.11.3 Candidates who are not completing internship on or before 31st March 2014.

7.11.4 Candidates who have not obtained MSDC/DCI registration. (refer rule 7.4)

7.11.5 Candidates who had been admitted to PG course through NEET MDS- 2013 and resigned/left/not joined which resulted in lapse of a seat.

7.11.6 Candidates who are previously registered and are pursuing/have completed the PG degree course or have obtained PG degree.

8. APPLICATION FORM AND FEES FOR EXAMINATION: 8.1 The Competent Authority shall issue Notification regarding online/

Computerized Scanable application form filling process. The information Brochure containing procedures for admission to postgraduate courses will be made available on website of DMER www.dmer.org. An applicant seeking admission to the PGD-CET-2014 will be required to submit single prescribed online application form (Excepts In-service Candidates) (ANNEXURE "H" Specimen Copy of online application form).

8.2 FOR IN-SERVICE CANDIDATES 8.2.1 The Information Brochure and Computerized Scanable Application

form will be available at Designated Authorities (Annexure F) i.e. all Government Dental Colleges and B.J Medical College, Pune from 28/11/2013 to 12/12/2013 excluding Sundays and State Government Holidays. The cost of the Information Brochure along with Computerized Scanable Application Form of PGD-CET 2014 and Examination Fee is Rs. 2500/- to be paid by Demand Draft/Pay Order drawn on any Nationalized/scheduled commercial Bank in favour of the Director, Medical Education and Research, Mumbai, payable at Mumbai. This amount is not refundable.

8.2.2 In-service candidates should submit in person Computerized Scanable Application form to the Designated Authority after obtaining eligibility remarks from the concerned Dean of his/ her Establishment within prescribed time schedule for submission of application form. The Dean of Concerned Establishment will be responsible for scrutiny and determining the eligibility of In-Service Candidates. (Annexure-“I” Specimen Copy of Computerize Scanable Application form).

8.2.3 Application forms of the candidates shall be received at Designated Authorities i.e. all the Government Dental Colleges and B.J Medical College, Pune. The applications will be scrutinized by them and shall be submitted to the Competent Authority. The Designated Authority will be responsible for sale, receipt of application form of In-Service Candidates.

8.3 Cost of online application form of PGD CET 2014 & examination fee is Rs. 2500/- + Rs. 60/- Bank Charges. This amount is not refundable. (for In-Service Candidates refer rule no 8.2.1)

8.4 PGD-CET-2014 will be conducted at Mumbai, Pune, Aurangabad and Nagpur centres. Candidate can choose the centre for examination as per his choice and indicate the same in online/ Scanable Application form for In-Service Candidates. Such choice once exercised will be final and binding.

8.5 The information Brochure and online application Form will be available from 28/11/2013 to 12/12/2013. Before filling Online Application form download information brochure of PGD CET 2014 and read the same carefully. The Applicants must possess the required criteria and education qualification as mentioned in the Information Brochure of PGD CET 2014

The details of online form submission process on DEMR website www.dmer.org are as mentioned below. (Not Applicable for In-Service Candidates) a) ‘Apply Online for PGD CET-2014’ Link will be available on DMER

website www.dmer.org. Click on the above Link. b) Application form link will be displayed. click on Application form link. c) Instructions page will be displayed. Carefully read the Instructions for

filling online form. After reading Instructions, applicant has to click NEXT button to go to actual Online Application form.(Annexure-G)

d) Candidate should fill all the entries in application form and upload his/ her Scanned photograph and signature.

e) System will validate required fields before allowing him/ her to submission.

f) During submission the application system will ask to Candidate for Password.

g) Eligible Candidate will be able to submit the form. There is provision to make changes in the Application Form before Click on Submit Button. Candidate should verify the Correctness of entries made in application form. There is no provision to make changes in the application form once Submit Button is clicked.

h) After submission of form Bank Challan will be displayed in two parts. i) Unique Application No. (Username) along with details of nonrefundable

required fee Rs. 2,500/-+ Rs. 60/- Bank charges will be available on challan and same details will be mailed to the Candidate on his given E-mail ID.

j) Candidate should take printout of Bank Challan. With this Challan pay the required fee in any Branch of State Bank of India on Second Working Day onwords, from the day of Printing Challan and obtain your copy of Challan indicating Journal ID/Transation ID.

k) ‘Log In’ Link will be available on DMER website www.dmer.org to verify the Application Form.

l) Candidate should login with Application No. (User Name) and his/her unique Password to download the printout of Application Form. Candidate has to preserve the downloaded printout of Application Form for subsequent use.

m) Applicants need not send copy of Application Form or any Document to this office.

n) Please note that if you commit any mistake in filling the online Application Form, it cannot be corrected by this office. The office will take no responsibility of any kind for such forms.

8.6 Candidate should preserve the (i) Bank Challan (ii) Copy of downloaded Online form (iii) downloaded copy of Information Brochure for subsequent use.

Admit Card: 8.7 The Admit Cards will be downloaded from www.dmer.org website after

login during 30/12/2013 to 04/01/2014. (Except In-service Candidates)

8.8 Candidate has to go to Centre with downloaded Admit Card and any Photo ID proof (Aadhar Card, Driving licence, PAN Card, Pass port).

8.9 Issue of Admit Card is merely an enabling document for appearing at the PGD-CET and does not imply that the candidate satisfies all the requirements of eligibility conditions of admission.

8.10 Admit Cards will be issued at the Designated Authority where the candidate has submitted his/her application form during 30/12/2013 to 04/01/2014.

9. CONDUCT OF PGD-CET-2014: 9.1 All the eligible candidates are required to appear the PGD-CET at their own

cost. 9.2 The PGD-CET will be conducted on Sunday 05Th January, 2014 at 10.00

a.m. No entry will be permitted to the candidate in the examination hall after 10.00 a.m. for any reasons whatsoever.

9.3 The PGD-CET will be conducted at Mumbai, Pune, Nagpur and Aurangabad.

9.4 There shall be one paper of 1½ hours duration containing 100 multiple choice questions (MCQs). Each question will be of single best response objective type, with four answer options. Each correct response shall be awarded one mark. There shall be no negative marking for wrong answers. Scratching, overwriting, tick mark and multiple answers will be considered as wrong answers and no marks will be awarded to them.

9.5 Candidate should completely darken one and the only one best response (oval).

Candidate should not use any other method for answering i.e. Scratching, overwriting, tick mark, and multiple answers will be considered as wrong answers and no marks will be awarded to them. Half circle, dot, tick mark, cross etc. This may not be read by the scanner. Answer sheet of each candidate will be evaluated by computerized scanning method only (Optical Mark Reader). There will not be any manual checking during evaluation and verification.

9.6 The Common Entrance Test shall be of the standard of BDS Examinations and shall cover all the subjects of BDS course. The tentative number of questions of each subject will be as given below:

9.8 Grievance Redressal Committee : A Grievance redressal Committee will be constituted at each sub centre comprising following members:

i) Sub-centre Incharge - Chairperson. ii] A Supervisor - Member Secretary iii] An Invigilator - Member

An invigilator and supervisor will be persons who are in the 10% additional staff. The committee will function from 8.00 am to the end of the examination on the day of examination. If there is any grievance during this period (regarding loss of time due to administrative error or any other examination related important matter), the candidate will report it to the invigilator of his/her examination block. It will be communicated to the sub centre incharge through supervisor. The committee will examine the Grievance on the spot (by consulting with center in-charge if necessary) and take necessary decision regarding the Grievance/s.

9.9 All the four versions of question paper booklets will be made available on www.dmer.org website on 7th January 2014 along with provisional key of each version. All the OMR Sheets of all candidates will be made available on www.dmer.org website on 8th January 2014

9.10 If any candidate has any objection against any question in the question paper & answer key of this examination, the same may be submitted by sending an email on [email protected] during 08/01/2014 to 11/01/2014. Representation received after this period shall not be considered.

10. DECLARATION OF PROVISIONAL RESULT/ MARKS 10.1 The Competent Authority shall declare the provisional result/marks

scored by candidates of PGD-CET on DMER website on 28/01/2014. The candidates should downloads the copy of marks by login at website www.dmer.org. The final state merit list will be generated after verification of marks and after document verification. (Except In-Service Candidates)

10.2 In case of any typographical error in result, regarding name, age, gender, category etc. it will be corrected at the time of document verification.

10.3 There will be no rechecking/ revaluation of answer sheets. However the candidate can apply for verification of marks to the Competent Authority by 31st January, 2014 in prescribed form (Annexure–O) along with fees of Rs.1000/- (Rupees One Thousand Only) to be paid by Demand Draft in favour of “Director of Medical Education and Research, Mumbai” payable at Mumbai and drawn on any nationalized/ scheduled commercial bank. The candidate will be given photocopy of the answer sheet and model answer key after verification by Speed post. The Final state merit list will be generated after completing verification of marks and after document verification. (For In-Service Candidates refer Rule No.12.2)

11. PROCESS OF DOCUMENT VERIFICATION 11.1 The competent Authority will declare schedule regarding process of

document verification during 2nd week of March, 2014 by way of notification on DMER website www.dmer.org

11.3 The candidate should present personally to respective center for document verification process Proxy will not be permitted.

The Process of document verification will be carried out at four Center i.e. Grant Government Medical College, Mumbai, B.J. Government Medical College Pune, Govt. Medical College, Nagpur & Govt. Medical College, Aurangabad.

11.4 At the time of document Verification the candidate should bring all original documents and a set of attested copies of the same in support of claim made in application form i.e. Caste Certificate, Caste Validity Certificate, and non-creamy layer certificate. If the matter is still pending with Hon'ble Court, candidate should submit a fresh Court order for PGD-CET 2014, failing which claim will not be granted and the candidate will be considered as General Category candidate.

12. STATE MERIT LIST: 12.1 The Competent Authority will prepare a Final State Merit List of eligible

candidates on the basis of the marks obtained by the candidate at the PGD-CET-2014 and as per the tie breaker criteria.

12.2 For In-Service Candidates, The Competent Authority will prepare a State Merit List separately indicating State Merit List number, name, marks scored, category, category merit number, of the candidate. The same will be made available on the Website of DMER “www.dmer.org” on 28/01/2014. The merit list of In-service candidates will be prepared as per the provision mentioned in G.R. ihth,e&1012$iz-d 1$12$f'k{k.k&2 fnukad30 tkusokjh2012 o ledzekfdr 'kklu fu.kZ; fnaukd 2 ekpZ 2012 and any G.R. issued in this regard from time to time.

12.3 To be eligible for selection to Dental Postgraduate courses a candidate belonging to General category must secure not less than 50% Marks and candidate belonging to Constitutional Reservation category & Constitutional Reservation category with physically handicapped claim candidate must secure not less than 40% Marks at PGD-CET-2014. Physically Handicapped category candidate in General category must secure not less than 45% Marks at PGD-CET-2014

12.4 TIE-BREAKER - Determination of the Inter-se-merit of candidates obtaining equal PGD-CET marks.

In case of two or more candidates obtaining equal marks in the PGD-CET, the inter-se-merit of such candidates will be determined in the order of preference as under:-

12.4.1 The candidate with higher aggregate marks (converted into percentage) at First, Second, Third and Final B.D.S. examination (Semester-I & II) taken together shall be preferred. If the tie still persists,

12.4.2 The candidate with higher aggregate marks (converted into percentage) at Final B.D.S. examination (Semester-I & II) will be preferred. If the tie still persists,

12.4.3 The candidate with higher aggregate marks (converted into percentage) at Third B.D.S. examination will be preferred. If the tie still persists,

12.4.4 The candidate with higher aggregate marks (converted into percentage) at Second B.D.S. examination will be preferred. If the tie still persists,

12.4.5 An older candidate will be preferred over a younger candidate. 12.4.6 While considering I, II, III and Final BDS marks and aggregate for

above purpose, grace and/or NSS marks will not be taken into account.

12.5.7 The Candidates will have to download statement of marksheet from the website of DMER. from 3rd week March, 2014 onward. Marksheet will indicate State Merit number, name, marks scored, category, category merit number, of the candidate.

12.5.8 Statement of marks for In-Service Candidates will made available from respective Designated Authorities where he/she has submitted application form.

13. PREFERENCE FORM SYSTEM:

13.1 The Competent Authority will declare the schedule of online preference form filling process by way of Notification on DMER website. The candidates will give their online preferences through this online process. The schedule, seat distribution and procedure regarding online preference form filling process and details of further admission process will be made available in the preference form brochure to the eligible candidates on the website. A candidate should fill in online preference form by login on DMER website. The selection to a course/college will be made considering his/her State Merit List Number and preferences given by the candidate. Seat allocation shall be made centrally at a later date on the basis of PGD-CET-2014 State Merit List (SML) and preferences exercised by the candidate. (Not applicable to In-Service Candidate). (for in-service candidates preference form filling process and sub-sequent selection process will be conducted separately on prescribed date which will be notified by competent authority).

13.2 For Constitutional reservation category candidates: Ear-Marking - Reserved category candidate entitled to admission on the basis of merit in an open category seat will have the option of taking admission either against his/her respective category seat or on an open `category seat. If he/she opts for the reserved category he/she will be deemed to have been admitted as an open category candidate and not as reserved category candidate. One seat in the college where he/she was eligible for admission against open seat shall be earmarked for a candidate belonging to the respective reserved category. Such earmarked seat will be made available immediately to the successive reserved category candidate from the same category merit.

13.3 Based on preferences given, the seats will be allotted on merit and the allotment will be displayed on website of DMER i.e. ‘www.dmer.org’. All the candidates to whom a seat has been allotted in the 1st round on the basis of Merit-cum-Preference will have to compulsorily join the college and course so allotted, with in prescribed period by completing the requisite formalities.

13.4 It is made clear that even if a candidate to whom a seat has been allotted in the 1st round wants a betterment of his/her choice, such a candidate must initially accept the allotment and join the college by completing the necessary formalities as set out by these Rules, failing which such a candidate will be thrown out of the entire admission process of the current academic year 2014-2015.

If any candidate to whom a seat has been allotted in the 1st round does not join the college and course seat so allotted, it will be presumed that such a candidate is not interested in the admission process and for all further round(s) of admission, such candidate shall not be considered for allotment of any seat whatsoever.

The seat so allotted to such a candidate who does not join, will be presumed to be a vacant seat as on and from the next date after the date set out as the last date for joining the college in terms of such allotment. Such a vacant seat will be allotted in the next round of admission process within prescribed period.

13.5 All the candidates who have filled the preference form and to whom a seat could not be allotted in the round will be held eligible for allotment of a seat in the subsequent Round(s).

13.6 After the first Preference Form round, Competent Authority may conduct subsequent preference round(s), based on the same preference form.

13.7 Cut-off date for the eligibility: The eligibility of the candidate shall be determined and/or decided for all purposes including for applicability of all these Rules and Regulations by considering the last date of document verification as the cut off date. It is made abundantly clear that if a candidate is found ineligible as on the last date of submission of preference form, in terms of these Rules and Regulation, and if such an ineligible candidate acquires the requisite eligibility after the aforesaid cut off date (i.e. the last date of document verification ), such subsequent acquisition of eligibility will not make an ineligible candidate eligible for any purpose whatsoever, much less for the purpose of admission.

14. FINAL ROUND BY PERSONAL COUNSELING: 14.1 The Competent Authority will issue notification of final round by Personal

Counselling in the news papers and on DMER website indicating the schedule of selection process. There shall be a final round for allotment of seats remaining vacant after completion of the earlier rounds of allotment of seats by way of preference forms. This final round of allotment of seats shall be conducted by way of personal counseling instead of allotment on the basis of preference forms and there will be instant seat allocation.

On account of allotment of seats in this final round of admission, no fresh vacancies consequent upon allotments made in this round will be created. This is principally because this final round of allotment is meant to fill up (as far as possible all) available vacant seats without creating a new or fresh vacant seat on account of such allotment.

At this round, eligible candidates will appear personally (Proxy will not be permitted), seeking allotment of seats of their choice. The personal counseling for such allotment will be held strictly in the order of State Merit List (SML) number. Each candidate will be offered all seats that have remain vacant and are available for allotment as per merit and category, only at the time of his/her turn of counseling i.e. State Merit Position.

14.2 Before personal counselling round all available vacant seats (due to

non-allotment/non-joining/resigning etc.) will be notified on the website. All the Candidates should carefully go through the vacant seats as notified on website and decide as to whether retain the allotted seat to him/her or to go for Final Personal Counselling round. All the candidates who have joined in the previous round(s) and not filled status retention form earlier, will be given a stipulated period to fill status retention form. Status Retention: In case if a candidate to whom a seat has been allotted in the preference form round(s) and who has joined the college accordingly, is satisfied with the allotment, such a candidate must submit a Status-Retention Form (Annexure-J) in the given format on or before prescribed date with the Dean of the College where such a seat has been allotted to such a candidate. The Dean of every Dental College to which admissions are so made in terms of these rules, may appoint an appropriate Officer to receive such Status Retention Forms. Upon receipt of such Status Retention Forms, an acknowledgement in writing shall be issued immediately to the concerned candidates to acknowledge the receipt of such a Status Retention Form within the prescribed time. It is mandatory for every such candidate submitting a Status Retention Form to insist for issuance of acknowledgement thereof and to preserve such acknowledgement till the present admission process is finally concluded. In absence of such an acknowledgement, the claim of submission of Status Retention Form within the prescribed time shall not be entertained.

Candidate who has submitted status retention forms will not be eligible for personnel counseling round.

It is hereby made clear that the period provided for submission of Status Retention Form is crucial and vital. This period shall not be extended for any reason whatsoever. Submission of the Status Retention Form is an irrevocable and irreversible act for the candidate submitting such Status Retention Form. It is made clear that under no circumstances whatsoever, a candidate will be allowed to submit a Status Retention Form after the aforesaid last date. Under any circumstances whatsoever, a candidate who has submitted a Status Retention Form shall not be allowed to withdraw the same either before or any time after the aforesaid last date. All the candidates therefore, are hereby called upon to carefully consider their case before submission of such a Status Retention Form.

All such candidates to whom seat has been allotted in the earlier round and who have accordingly joined the college if do not submit the ‘status retention form’ as set out herein will loose the seat so allotted and joined by them. All such candidates will have to compulsorily appear at the ‘final personal counseling round’ and get an allotment made in their favour in accordance with their relative merit, choice and availability, failing which such candidates will not get any seat whatsoever.

14.3 All the candidates who have submitted the Status Retention Form as above within the prescribed time and the seats occupied by them will be removed out of consideration for the remaining admission process.

14.4 Eligibility for the personal counselling round will be as follows:

14.4.1 The following candidates are Eligible for Personal Counseling round (a) All PGD-CET-2014 candidates who have filled the preference form and

to whom a seat has not been allotted in the previous round(s) of admission.

(b) All such candidates to whom though a seat was allotted in the previous round(s) and though such candidates joined the college accordingly by completing necessary formalities under these Rules, did not submit the Status Retention Forms as mentioned hereinabove on or before the date/s prescribed by the Competent Authority.

(c) All such candidates to whom though a seat was allotted in the All India Postgraduate admission process in a College situated in Maharashtra, but voluntarily surrendered the seat by giving an application before the prescribed date and the said seat is added to the State quota.

(d) All such candidates to whom a seat is allotted through PGD CET 2014 in the previous round(s) and joined the college, but resigned the seat will be eligible for personal counselling round. It is made clear that no other candidate shall be held eligible for this round of admission.

14.4.2 Following candidates are Not Eligible for the personal counselling round. (a) All PGD-CET-2014 candidates who have not filled the Preference Form. (b) All PGD-CET-2014 candidates to whom a seat has been allotted in

previous round(s) but have not joined are not eligible for personal counselling round.

(c) All the candidates to whom a seat has been allotted in the previous round(s) and who have joined the college accordingly and have further submitted Status Retention Forms by the aforesaid prescribed date will be removed out of consideration for the remaining admission process.

(d) PGD-CET-2014 candidates who have been allotted a seat thorough All India Postgraduate quota in Dental Colleges in Maharashtra and joined the College and have not surrendered the seat to the State quota by giving an application before the prescribed date.

14.5 The aforesaid final rounds of admission shall be conducted by personal counselling. For the purpose of this round, following seats shall be considered as available for admission which will be displayed on the web site before the commencement of Personal Counselling round :- (a) All the seats that have remained vacant, if any, at the end of previous

admission round(s) on account of non-allotment (b) All the seats that were allotted in the previous round(s) but were rendered

vacant on account of the candidate to whom such seats were allotted either did not join or resigned or joined but did not fill in Status Retention Forms.

(c) All such seats that may revert back to the State Government quota from All India Quota for any reason whatsoever Rule 5.4 information brochure.

(d) All such seats that may become additionally available on any account whatsoever, including but not limited to seats if any additionally recognized by Dental Council of India/MUHS, Nashik or made additionally available on account of any Order that may be passed by the Courts etc.

14.6 In the aforesaid final round of admission by personal counselling, preference forms submitted by all the eligible candidates will not be considered and the same shall be treated to have been cancelled. In other words, this final personal counselling round shall not be conducted on the basis of choices given in preference forms submitted by the candidates.

14.7 On account of allotment of seats in this final round of admission, no fresh vacancies consequent upon allotments made in this round will be created. This is principally because this final round of allotment is meant to fill in (as far as possible all) available vacant seats without creating a new or fresh vacant seat on account of such allotment.

At this round, eligible candidates will appear personally, seeking allotment of seats of their choice. The personal counseling for such allotment will be held strictly in the order of State Merit List. Each candidate will be offered all seats that have remain vacant and are available for allotment only at the time of his/her turn of counseling i.e. State Merit List position.

In this round, allotment shall be made on the basis of choice made on the spot by the candidate at the time of personal appearance counseling.

All the candidates to whom the seats will be allotted in accordance with the choice and available seats at his/her merit position at the time of personal counseling, he/she will be required to join the concerned college and complete all necessary formalities (by submitting all original documents and paying prescribe fees) for taking admission accordingly within the prescribed time.

Allotment of seat once made in this personal counseling round, shall not be changed and/or cancelled at any count whatsoever. Therefore, while giving the choice on the spot at the time of this personal counseling round, the candidates must consider the available seats thoroughly and opt for a seat which they must join once allotted.

It is made hereby clear that in case such a candidate does not join the concerned College and/or fails to comply with the necessary formalities of the admission within the prescribed time, such a candidate shall not be eligible for appearing at next two succeeding PGD-CET conducted for grant of admissions to post-graduate courses in the State of Maharashtra i.e. PGD-CET 2013 & 2014 and will have to pay Rs. 10,00,000/- (Rupees Ten Lacs Only) as penalty for lapse of post graduation Dental seat.

15. THE CONDITIONS TO BE SATISFIED BY THE CANDIDATE AFTER SELECTION:

15.1 A candidate will have to pay the prescribed fees (i.e. tuition + deposit + others). In the form of separate Demand Drafts, (One for tution fees and another for other fees) In favour Dean/Principal of concerned institution. He/she must deposit all relevant original certificates/documents in the concerned institution.

15.2 All selected candidates will have to submit DD/Pay order of ` 650/- drawn on any Nationalized/Scheduled Commercial Bank in favour of “Competent Authority, MH-CET” payable at Mumbai for Amartya Shikshan Yojana as per GR.MED/100/880/CR-129/Edu-1, dated 13/10/2003.

16. CANCELLATION AND REFUND: 16.1 Candidate who has confirmed his/her admission may cancel it by

submitting an application to the concerned Dean/the head of the institution. (As per Annexure-K)

16.2 Candidate cancelling his/her admission on or before prescribed date, which will be notified in due course of time, will be eligible for subsequent PGD-CET examination.

16.3 Candidate cancelling his/her admission after Prescribed date will not be eligible for subsequent one year for PGD-CET.

16.4 Refund of fees by the college after change of college, course or cancellation of admission:

a) On or before prescribed date Rs 1500/- (Rs. One Thousand Five Hundred only) to be deducted and rest of the fees to be refunded.

b) After prescribed date - No refund. 16.5 If a candidate expires or becomes unfit to undergo PG course as per MCI Norms and decided by notified Medical Board within 3 months from the date of admission, full refund shall be made. 17. CONDUCT AND DISCIPLINE:

17.1 Failure of the candidate in making full and correct statements in the application form and/or suppression of any information would lead to disqualification of the candidate, even at later date. Such a candidate will be debarred from the entire selection process.

17.2 It is responsibility of every candidate to submit proper documents. Any attempt to submit documents which are not genuine will lead to cancellation of the admission of the candidate, forfeiture of the fees, deposits and expulsion of the candidate from the college by the Competent Authority or by his authorised official. The name of such candidate/s shall be deleted from the State Merit List and he/she will not be eligible for further rounds of the selection process and will be debarred from the selection process. All such action against the candidate if leads to lapse of seat then additional penalty of Rs 10,00,000/- (Rupees Ten Laks Only) will be recovered from the candidates. If deemed fit even criminal proceeding may be initiated by the Competent Authority against such candidates/ their parents.

17.3 If any candidate/Authorised representative or person accompanying is found obstructing the counseling and/or admission process, or trying to influence in unlawful manner/creating nuisance, the candidate shall be liable for disqualification from the process of selection and appropriate legal action will be taken. The decision taken by the Competent Authority in this respect shall be final and binding.

17.4 The registration once granted is valid only if the teacher and the Dean are satisfied about regularity, diligent pursuance of studies by the student as well as good conduct.

17.5 All candidates selected for admission shall be subject to the disciplinary rules of the Institution, MUHS, Nashik, and Government.

17.6 Maharashtra University of Health Sciences, Nashik shall take the decision regarding eligibility, enrolment and registration and granting of the term of selected candidates. The selection of a candidate by the Competent Authority at a later date does not place any onus to accord approval for grant of term.

17.7 Canvassing directly or indirectly for the allotment of seat would disqualify the candidate for admission. Influencing the staff by unfair means, will lead to cancellation of allotted seat and such candidate will also face disqualification for appearance in the subsequent PGD-CET examination.

17.8 A candidate selected for postgraduate course will not be allowed to change subject/college/institute on mutual basis as per the rules of Institution/ MUHS regulations.

17.9 In case of dispute in the matter of allotment of seat/course/institution or any other matter pertaining to the provisional selection or cancellation of admission, the decision of the Competent Authority shall be final and binding.

17.10 Legal Jurisdiction: All disputes pertaining to the conduct of examination and selection process shall fall within the jurisdiction of courts in Mumbai only.

18. PENALTY & BOND: 18.1a) Candidate who has joined Postgraduate Course should complete PG

studentship, failing which he/she will be required to pay Rs.10,00,000/- (Rupees Ten Lakhs Only) for the default (i.e. Non Completion of PG Studentship). However this is not applicable to the candidates of PGD-CET 2014 resigning the PG Registration before personal counselling round.

18.1b) Any candidate responsible for lapse of post graduate medical seat will have to pay Additional penalty of Rs.10,00,000/- (Rupees Ten Lakhs Only) as stated in rule no 14.7 Any such candidate will not be eligible for appearing at succeeding two PGD-CET i. e PGD-CET 2015 & 2016

18.2 As per Government Resolution (G.R. No. MED 1010/CR-184/10/Ed-2 dated 28th May 2010 and any G.R issued in this regard from time to time), candidates joined against the seats of Government/Municipal Corporation colleges for admission to Post graduation Courses either through All India Post Graduate quota or through PGD CET 2014 will be required to sign a bond to serve the Government of Maharashtra or local self government or Defence services for a period of one year, failing which he/she will be required to pay Rs. 50,00,000/- (Rupees fifty Lakhs only) for the default.

19. Any issue not dealt here-in above will be dealt with, when arising, fully and finally by the Competent Authority. Any amendments made by Government of Maharashtra from time to time will be implemented.

Applicants belonging to Special Backward Class N.B.: Hon’ble High Court Mumbai had stayed admission to SBC category as a

separate quota and therefore, vide Government Circular from Social Welfare, Cultural Affairs and Sports Department No. CBC-1095/WS/264/BCD-5 dated 24th October 1995, the persons belonging to Special Backward Class (SBC) are to be considered as OBC candidates.

7) Inter-se amongst the reserved categories will be operated at the end of each admission process against the unfilled reserved category seats as per merit and choice of the reserved category candidates.

The seats remaining vacant from various categories will be filled in during inter-se admission process as follows:

a) From among the candidates of their respective group from the Inter-se State Merit List of that particular group where the vacancies exist.

The groups are as follows - GROUP - I

(i) Scheduled Castes and Schedule Caste converted to buddhism (S.C.) 13% (ii) Scheduled Tribes including those living out-side specified area (S.T.) 7%

(c) If the seats still remain vacant then the seats will be filled from among the candidates of the common merit list.

8) Ear-Marking: Reserved category candidate entitled to admission on the basis of merit in an open category seat will have the option of taking admission either against his/her respective category seat or on an open category seat. If he/she opts for the reserved category he/she will be deemed to have been admitted as an open category candidate and not as reserved category candidate. One seat in the college where he/she was eligible for admission against open seat shall be earmarked for a candidate belonging to the respective reserved category. Such earmarked seat will be made available immediately to the successive reserved category candidate from the same category merit.

Admission under constitutional reservation seat will be governed by the Maharashtra Schedule Castes, Scheduled Tribes, Denotified Tribes (Vimukta Jatis), Nomadic Tribes, Other Backward Classes and Special Backward Category (Regulation of Issuance and Verification of) Caste Certificate Act, 2000 (Mah. Act No. XXIII of 2001).

PERSONS WITH DISABILITY (PWD) RESERVATION 1) As per Postgraduate Medical Education Regulation 2000 and Amendment Notification No.

MCI.18(1)/2008-Med./ 54470 Dated 25th March 2009 following is the criteria for reservation under Physically Handicapped Category “1(a). 3% seats of the annual sanctioned intake capacity shall be filled up by candidates with locomotory disability of lower limbs between 50% to 70%. Provided that in case any seat in this 3% quota remains unfilled on account of unavailability of candidates with locomotory disability of lower limbs between 50% to 70% then any such unfilled seat in this 3% quota shall be filled up by persons with locomotory disability of lower limbs between 40% to 50% - before they are included in the annual sanctioned seats of State Quota. Provided further that this entire exercise shall be completed by each medical college/institution as per the statutory time schedule for admissions and in no case any admission will be made in the Postgraduate Medical course after 31st of May”

2) The Candidate with a disability more than 70% will not be eligible for admission to Health Sciences (Post Graduate) Courses. No other disability shall be allowed as per the MCI regulations. However, such a candidate will be required to undergo medical examination by a Special Medical Board constituted for this purpose by the Competent Authority. The Medical Board after ascertaining his/her disability must be satisfied that the candidate is physically fit to undergo the course despite his/her disability.

3) Candidate is required to submit the proof of his/her disability by way of a certificate (issued in year 2014) in prescribed proforma from Civil Surgeon of a District Hospital/Medical Board/Medical Superintendent of a Government Medical College/Hospital in Maharashtra; or from the Director of All India Institute of Physical Medicine and Rehabilitation, Haji Ali, Mumbai; (as per Prescribed Proforma) at the time of verification of disability. However, Verification of the disability will be carried out by Special Medical Board constituted for this purpose by Competent Authority. and decision of the Special Medical Board will be final. The date and place of Special Medical Board shall be communicated by the way of notification.

01. Candidate must preserve the Receipt-Cum-Identity Card and Admit Card safely and bring to the examination hall and produce the same on demand by invigilator / supervisor.

02. Candidate should occupy the seat in the examination hall at least 45 minutes before the commencement of the examination.

03. Details, such as seat number, question paper booklet number and version code number must be entered carefully on the answer sheet. The answer sheet No. & the seat No. must be entered carefully on the Question Booklet.

04 Under any circumstances, no candidate will be allowed to enter the examination hall after 10.00 a.m.

05. No candidate will be allowed to leave the examination hall till the end of examination.

06. In case of the loss of Admit Card, it shall be obligatory on the part of the candidate to procure duplicate Admit Card from the concerned sub-centre in charge not later than one hour before the commencement of examination, on payment of Rs.  500/- and on production of sufficient evidence to prove that he / she is the genuine / bonafide examinee

07. All entries on answer sheet must be made only with Black ballpoint Pen.

08. Photograph on application form and Receipt cum - Identity card should be taken from the same negative.

09. Please note that issue of admit card is just an enabling provision for appearing PGD – CET 2014 and does not imply that the candidate satisfies all the requirements of eligibility conditions of admission.
