Proposal: The purpose of Bylaw No. 686, Zoning Amendment Bylaw (600-47) is to rezone 2150 Melrick Place from “Large Lot Residential (R1)” to “Small Lot Residential (R3)” with the intent of subdividing the property to create up to 10 single family lots. The R3 zone permits a minimum lot size of 350 square meters for subdivision. Secondary suites are a permitted use in the R3 zone.

BYLAW NO. 686

A bylaw to amend Bylaw No. 600, Sooke Zoning Bylaw, 2013 for the purpose of amending the zoning on the property located at 2150 Melrick Place from Large Lot

Residential (R1) to Small Lot Residential (R3). The Council of the District of Sooke, in open meeting assembled, enacts as follows: 1. This Bylaw is cited as Zoning Amendment Bylaw No. 686 (600-47), 2017. 2. The parcel of land legally described as Lot 1, Section 21, Sooke District,

Plan VIP74599 shown boldly outlined and hatched on Schedule A, which is affixed to and forms part of this Bylaw, is hereby rezoned from Large Lot Residential (R1) to Small Lot Residential (R3).

2150 Melrick Place - Rezoning Application RECOMMENDATION: THAT COUNCIL give First and Second reading to Zoning Amendment Bylaw No. 686 (600-47) to rezone 2150 Melrick Place from Large Lot Residential (R1) to Small Lot Residential (R3); AND THAT COUNCIL require a section 219 covenant to be registered prior to adoption of Zoning Amendment Bylaw No. 686 (600-47) to ensure that at time of subdivision, the owner constructs a minimum of one (1) off-street visitor parking space for every two (2) residential lots created in addition to providing the number of parking spaces required on each residential lot for a single family dwelling and a secondary suite as per the Zoning Bylaw; AND THAT a Public Hearing be scheduled for Zoning Amendment Bylaw No. 686 (600-47), in accordance with Section 466 of the Local Government Act. Report Summary: The applicant has initiated a rezoning application on 2150 Melrick Place. The property is currently zoned Large Lot Residential (R1) and the applicant has requested the property to be rezoned to Small Lot Residential (R3) with the intent of subdividing the property to create single family residential lots. The subject property is located within the Sewer Specified Area. Report: The subject property is approximately 0.88 acres (3561 m2) and is located in a predominately single family residential area. There is an existing single family dwelling located on the property that the owners wish to keep. The applicants intention is to subdivide the property into small single family lots. The R3 zone (attached) permits a minimum lot size of 350 m2. When the lot size of the subject property (3561 m2) is divided by the minimum lot size in the R3 zone (350 m2), the subject property could potentially have a maximum density of up to 10 lots. However, after provision of visitor parking stalls, accommodation of the existing single family dwelling, further engineering review of the site in regards to stormwater and geotechnical, and a road layout that is acceptable by the Approving Officer, it is reasonable to determine that a density of 7 or 8 lots is more feasible. Accommodating the existing single family dwelling for example, may require a lot size of at least 800 m2. The subdivision layout will be determined at the time of subdivision when the applicant works towards satisfying the requirements of Subdivision and Development Standards

Bylaw No. 404. It is at time of rezoning when staff would like to ensure that sufficient parking will be available for the proposed development and has recommended there be one (1) off-street visitor parking space for every two (2) residential lots created. The visitor parking stalls would be in addition to the number of parking spaces required on each residential lot as per the Zoning Bylaw, which is two (2) parking spaces for a single family dwelling and one (1) additional parking space for a secondary suite. If a future owner decides to build a suite, it is recommended that the covenant ensure that the parking space to service the secondary suite is constructed in a location on the residential lot where it does not impede or cannot be impeded by another parking space. This has been agreed to by the applicant. Referrals Referrals were sent to internal and applicable external agencies for review and comment. No major issues were identified. At time of subdivision, there will be consideration given to the internal road design and visitor parking layout to ensure that there is adequate space for emergency vehicle access. A. OFFICIAL COMMUNITY PLAN 2010 (OCP) The Official Community Plan, 2010 (OCP) provides the policy context for evaluating rezoning applications. This application falls within the 'Community Residential' (CR) designation on the OCP Land Use Map. The goals of the CR designation are to ensure sustainable single family and multi-family construction, reduction of sprawl, and provision of municipal services in an efficient manner. The objectives of the CR designation include encouraging a variety of housing types and providing affordable and attainable housing opportunities to meet the needs of various age groups, family types, lifestyles and income groups. A policy context is attached as it relates to this rezoning for the proposed use of the property for small lot single family residential. The proposed rezoning is providing infill and creating contiguous development to an area that is densifying. To the west is the Spiritwood Estates Zone and the owners of that property recently created 23 new single family lots known as "View Pointe Estates". Stone Ridge Estates is to the north east. There are existing single family lots to the east and south, as well as a recent rezoning to R3 on 7004 Melrick Place. Although the affordable housing component of the development proposal could be stronger, the OCP supports the proposed rezoning proposal. Affordable Housing The OCP requires a minimum of 10% of the total of any proposed bare land or strata single family residential subdivision to be affordable housing lots. Affordable housing lots are typically sold at an affordable rate through tools such as covenants and housing agreements. OCP section 4.7.3(g) gives consideration to allowing developers the flexibility to provide their required affordable housing in different forms thus creating an 'affordable housing mix' in new developments, e.g. secondary suites, condominium rental units, cash, or land in lieu to the District of Sooke towards on/off-site affordable housing.

The applicant has been made aware of the District of Sooke's Housing Reserve Fund, a fund where all money contributed is used to develop or assist in developing affordable housing in Sooke. Developers do have the option of considering a cash contribution to the Fund. The Sooke Affordable and Social Housing Policy does not provide direction on a recommended dollar amount per unit/per lot but depending on the development proposal, developers in the past have contributed between $500 - $15,000 per unit/per lot. The provision of rental suites and a cash contribution towards affordable housing would be an 'affordable housing mix'. The applicant has proposed to meet the affordable housing policy by providing secondary suites for the rental market and has confirmed in writing that they do not wish to make any further contributions. Suites are considered a form of affordable housing for the rental market and are used as a mortgage helper for a homeowner. In R3 zones, building a suite is not mandatory and the applicant has indicated that the construction of rental suites will be dictated by the market and by the needs of future lot owners. Budget/Financial Impacts: The developer is responsible for all costs associated with off site improvements in accordance with Subdivision and Development Standards BylawNo. 404. Strategic Relevance: This proposal meets the following strategic priorities in In Council’s 2016 Corporate Strategic Plan: COMMUNITY PLANNING – The District will work towards streamlining planning processes to encourage investment and job growth in the community. ENHANCING COMMUNITY LIVEABILITY- The District will work towards making Sooke a vibrant and accessible community. Conditions of Use:

POLICY CONTEXT – 2150 MELRICK PLACE OFFICIAL COMMUNITY PLAN, 2010 (BYLAW 400) 3.2.9 Preserving Sooke's Character (d) Encouraging view corridors to Sooke's natural features, including the harbor and waterfront areas; 4.2 SUSTAINABLE LAND USE POLICY 4.2.2 (c) Enhance existing neighbourhoods and promote pedestrian-oriented subdivisions; (g) Promote a variety of housing including townhouses, rowhouses, apartments, multiple family developments, co-operative housing, co-housing, co-strata structures, secondary and basement suites, small starter homes and duplexes; 4.3 Energy and Climate Change 4.3.3(f) Create contiguous development (avoiding gaps of undeveloped properties) 4.7 Housing 4.7.3(f) Require that a minimum of 10% of the total of any proposed bare land or strata single family residential subdivisions are affordable housing lots as defined by the District of Sooke. meet the diverse needs of, and attract, individuals and families of varying income levels and demographics;

(b) Provide affordable and attainable housing opportunities, to meet the needs of various age groups, family types, lifestyles and income groups; (c) Encourage a variety of housing types, including coach housing, row housing, live/work units and townhouses etc. that diversify the housing stock; (d) Provide the most efficient use of land and existing physical infrastructure in terms of infill/densification; (f) Primarily concentrate new residential development in existing areas or

TERMS OF INSTRUMENT – PART 2

SECTION 219 COVENANT

THIS AGREEMENT, dated for reference ____________, 201__ is made

BETWEEN:

Douglas Nachtigal Krista Janine Nachtigal 1995 Sooke Lake Road

Shawnigan Lake, BC V0R 2W3

(the “Owner”)

AND:

DISTRICT OF SOOKE, a municipality incorporated under the Local Government Act, R.S.B.C. 1996, c.323 and having its office at 2205 Otter Point Road, Sooke, BC V9Z 1J2

(the “Municipality”)

GIVEN THAT:

A. The Owner is the registered Owner in fee simple of the land in Sooke, British Columbia, legally described as:

Lot 1, Section 21, Sooke District, Plan VIP74599

(PID 025-563-629)

(the “Land”);

B. The Owner proposes to develop the Land for a residential use;

C. The Owner has requested the Municipality to adopt Bylaw No. 686, Zoning Amendment Bylaw (600-47) (the “Rezoning Bylaw”) rezoning the Land to permit the development proposed by the Owner, and

D. The Council of the Municipality has determined that the adoption of the Rezoning Bylaw would, but for the covenants contained in this Agreement, not be in the public interest; and the Owner therefore wishes to grant pursuant to s.219 of the Land Title Act, and the Municipality wishes to accept, the covenants over the Land that are set out in this Agreement;

THIS AGREEMENT is evidence that in consideration of payment of $1.00 by each of the Municipality to the Owner (the receipt of which is acknowledged by the Owner), the Owner grants to the Municipality in accordance with s.219 of the Land Title Act the following covenants:

1. The Owner covenants and agrees with the Municipality that:

(a) The Land must not be redeveloped beyond its current use;

(b) The Land must not be subdivided

(c) No building permit may be applied for, and the Municipality is not obliged to issue any building permit, in respect of the Land with exception of improvements to existing structures; and

(d) No occupancy permit may be applied for, and the Municipality is not obliged to issue any occupancy permit, in respect of the Land,

unless the use, subdivision, building or occupancy is in accordance with the Schedule of Restrictions attached as Schedule A.

2. Any opinion, decision, act or expression of satisfaction of the Municipality provided for in this Agreement is to be taken or made by the Municipality’s Municipal Engineer or his or her delegate authorized as such in writing, in each case acting reasonably.

3. The Owner may, after the Rezoning Bylaw is adopted, request a discharge of any particular covenant granted in this Agreement in respect of any parcel into which the Land may be subdivided, and the Municipality shall execute and deliver a discharge in respect of any such covenant that has been, in the Municipality’s opinion, fully satisfied by the Owner.

4. The Owner releases, and must indemnify and save harmless, the Municipality, its elected and appointed officials and employees, from and against all liability, actions, causes of action, claims, damages, expenses, costs, debts, demands or losses suffered or incurred by the Owner, or anyone else, arising from the granting or existence of this Agreement, from the performance by the Owner of this Agreement, or any default of the Owner under or in respect of this Agreement.

5. The parties agree that this Agreement creates only contractual obligations and obligations arising out of the nature of this document as a covenant under seal. The parties agree that no tort obligations or liabilities of any kind exist between the parties in connection with the performance of, or any default under or in respect of, this Agreement. The intent of this section is to exclude tort liability of any kind and to limit the parties to their rights and remedies under the law of contract and under the law pertaining to covenants under seal.

6. The rights given to the Municipality by this Agreement are permissive only and nothing in this Agreement imposes any legal duty of any kind on the Municipality to anyone, or obliges the Municipality to enforce this Agreement, to perform any act or to incur any expense in respect of this Agreement.

7. Where the Municipality is required or permitted by this Agreement to form an opinion, exercise a discretion, express satisfaction, make a determination or give its consent, the Owner agrees that the Municipality is under no public law duty of fairness or natural justice in that regard and agrees that the Municipality may do any of those things in the same manner as if it were a private party and not a public body.

8. This Agreement does not:

(a) affect or limit the discretion, rights or powers of the Municipality under any enactment (as defined in the Interpretation Act, on the reference date of this Agreement) or at common law, including in relation to the use of the Land,

(b) affect or limit any enactment related to the use of the Land, or

(c) relieve the Owner from complying with any enactment, including in relation to the use of the Land.

9. Every obligation and covenant of the Owner in this Agreement constitutes both a contractual obligation and a covenant granted under s.219 of the Land Title Act in respect of the Land and this Agreement burdens the Land and runs with it and binds the successors in title to the Land. This Agreement burdens and charges all of the Land and any parcel into which it is subdivided by any means and any parcel into which the Land is consolidated. The Owner is only liable for breaches of this Agreement that occur while the Owner is the registered Owner of the Land.

10. The Owner agrees to do everything reasonably necessary, at the Owner’s expense, to ensure that this Agreement is registered against title to the Land with priority over all financial charges, liens and encumbrances registered, or the registration of which is pending, at the time of application for registration of this Agreement.

11. An alleged waiver of any breach of this Agreement is effective only if it is an express waiver in writing of the breach in respect of which the waiver is asserted. A waiver of a breach of this Agreement does not operate as a waiver of any other breach of this Agreement.

12. If any part of this Agreement is held to be invalid, illegal or unenforceable by a court having the jurisdiction to do so, that part is to be considered to have been severed from the rest of this Agreement and the rest of this Agreement remains in force unaffected by that holding or by the severance of that part.

13. This Agreement is the entire agreement between the parties regarding its subject.

14. This Agreement binds the parties to it and their respective successors, heirs, executors and administrators.

15. The Owner must do everything reasonably necessary to give effect to the intent of this Agreement, including execution of further instrument.

16. By executing and delivering this Agreement each of the parties intends to create both a contract and a deed executed and delivered under seal.

As evidence of their agreement to be bound by the terms of this instrument, the parties hereto have executed the Land Title Office Form C that is attached hereto and forms part of this Agreement.

SCHEDULE “A”

SCHEDULE OF RESTRICTIONS

1. Prior to subdivision approval, the owner shall construct one (1) off-street Visitor Parking space for every two (2) residential lots created. These spaces will be in addition to the number of parking spaces required on each lot created for a single-family dwelling and a secondary suite as per the Sooke Zoning Bylaw.

2. Any lot on which a single-family dwelling with suite is to be constructed shall provide a minimum of two (2) parking spaces for the primary residence and one (1) additional parking space for the secondary suite. All three (3) parking spaces shall be located within the lot upon which the single-family dwelling and suite are to be located. The three (3) parking spaces shall be in addition to the Visitor Parking spaces to be constructed on the Common Property strata road or fee simple road. Additionally, the parking space to be constructed to service the secondary suite shall be designed so it is independently accessible and will not be blocked by another parking space. All proposed parking spaces must be shown on the building permit application site plan for approval by the Director of Development Services prior to building permit issuance. All parking spaces must be fully constructed and ready for use prior to an Occupancy Certificate being granted.
