EXECUTIVE SUMMARY

Subject Property: Vacant Lot

Location: 715 Monnett Ave Norman, OK 73069

Investigation Date: 11/9/15

Inspector: Mark R. Cox, Ph.D.

This report presents results from the Environmental report performed in accordance with the American Society for Testing Materials (ASTM) E 1527-13 Standard Practice for Environmental Site Assessment Process and the requirement to conduct, “All appropriate inquiry into the previous ownership and uses of the Property consistent with good commercial or customary practice in an effort to minimize liability” (42USC Sec. 9601(35)(b)). The consultant meets the ASTM definition of an environmental professional and has over 25 years of experience doingenvironmental studies. There are no significant data gaps in this study..

The Subject Property is a 1.13 acre tract of land occupied by a 21,070 sq. ft. two story apartment building. The building consists of sixteen three bedroom apartments mostly occupied by University of Oklahoma students. Access to apartments is through a central hall way and the complex is gated for extra security. The building uses structural insulated panels (SIPS) and has brick veener with concrete board siding. The building has a sloped composition shingle roof. The complex is located in an area of mixed residential housing types with construction on new multifamily in progress with in a block of the apartments. Prior to construction single family homes were located on this land. No industrial or commercial uses are in the chain of title. An environmental database search was conducted by EDR on October 29, 2015. The Subject Property was not listed in any of the databases searched. Within the appropriate search radii, the database search found evidence of:

1. The Subject Property is multifamily residential complex just north of the Universityof Oklahoma’s main campus with no history of industrial use. Prior to theconstruction of the apartments the land was used for single family residents and nosoil or groundwater contamination is expected from this use. The apartments wereconstructed in 2012 and meet or exceed all building codes.

2. No hazardous waste was on site and no indication the site has ever been used forstorage of waste materials. All leaking underground storage tanks in the radiussearch have been properly remediated.

3. No major topographic obstacles exist. The railroad tract is located at Duffy andJones Ave and acts as physical barrier during train crossings. It also increases theambient noise levels for short periods of time.

4. Surface runoff enters a detention area on the north side of the apartments and thenflows into the Bishop Creek Drainage basin which flows to the South CanadianRiver.

5. The Property is not in a flood plain as designated by FEMA. There are nojurisdictional wetlands present.

6. The Property was constructed after lead-based paint and asbestos were used. Nohazardous building materials were noted during the site visit.

The site has no recognized environmental conditions and is well suited for multifamily land use.

1.0 INTRODUCTION

1.1 Purpose:

The purpose of this report is to identify recognized environmental conditions associated with the Subject Property.

1.2 Limitations and Exceptions of Assessment:

x This practice is site-specific in that it relates to the assessment of environmental conditions on a specific parcel of land. This practice does not address any additional issues raised in transactions such as purchases of business entities, or interests therein, or of their assets, that may well involve environmental liabilities pertaining to properties previously owned or operated or other off-site environmental liabilities.

x This standard does not purport to address all of the safety problems, if any associated with its use. It is the responsibility of the user to establish appropriate safety and health practices and determine the applicability of regulatory limitations prior to use unless otherwise contracted for between the user and the environmental professional.

x No environmental site assessment can wholly eliminate uncertainty regarding the potential for recognized environmental conditions concerning a Property. Performance of this site assessment is intended to reduce, but not eliminate, uncertainty regarding the potential for recognized environmental conditions concerning a Property, and this practice recognizes reasonable limits of time and cost.

x Appropriate inquiry does not mean an exhaustive assessment of a clean Property. There is a point at which the cost of information obtained or the time required to gather it outweighs the usefulness of the information. One of the purposes of this practice is to identify a balance between the competing goals of limiting the costs and time demands inherent in performing an environmental site assessment and the reduction of uncertainty about unknown conditions resulting from additional information.

x Not every Property will warrant the same level of assessment. Consistent with good commercial or customary practice, the appropriate level of environmental site assessment will be guided by the type of Property Subject to assessment, the expertise and risk tolerance of the user, and the information developed in the course of the inquiry.

x It should not be concluded or assumed that an inquiry was not an appropriate inquiry merely because the inquiry did not identify recognized environmental conditions in connection with a Property.

x An environmental site assessment meeting or exceeding this practice and completed less than 180 days previously is presumed to be valid. An environmental site assessment completed more than 180 days previously may be used to the extent allowed by prior assessment usage

1.3 Limiting Conditions and Methodology Used:

The methods used to obtain information for the Site Description are listed below (These methods are intended to be used in concert with each other).

x Research the history of the site including current and prior owners, land use, and environmental incidents. Visit the site and document the present surface conditions and physical characteristics such as buildings, drains, tanks, oil and gas wells, and the general appearance of the Property.

x Review the Environmental Protection Agency’s Comprehensive Environmental Response Compensation and Liability Information System (CERCLIS) listing, and the Resource Conservation and Recovery Act (RCRA) listing for information regarding generation, storage, treatment, and disposal of hazardous waste on or adjacent to the Subject Property. Contact other local, state, and federal regulatory agencies (if warranted) regarding environmental concerns identified on the Subject Property.

x If warranted by the background investigation, interview the previous owners/operators (if available) to determine present/past operational practices that may have contributed to the present environmental condition of the site.

x Review historic aerial photographs to determine land use patterns, structures, existence of ponds, excavations, and areas of potentially stressed vegetation.

x Review available oil and gas well drilling and plugging records for activity on the Subject Property. Where practicable, document locations of abandoned oil and gas wells.

x Review information regarding the geology and hydrogeology of the site. Investigate the potential for the presence of radon in the soils.

x Review state records regarding permitted landfills and waste disposal facilities on or in the vicinity of the Subject Property.

x Contact the local Fire Marshall’s Office regarding hazardous material incidents, which may have occurred at the site.

x Provide a summary report documenting these tasks. Present conclusions regarding potential liability associated with existing environmental conditions, offer recommendations for future actions (if necessary), and estimate costs involved.

x This practice does not include any testing or sampling of materials (e.g., soil, water, air, building materials).

x The interview and site reconnaissance, as well as review and interpretation of information upon which the report is based and overseeing the writing of the report, are all portions of a site assessment that shall be performed by an environmental professional

2.0 SITE DESCRIPTION

2.1 Location and Legal Description

The Subject Property is located on the northeast corner of the intersection of Monnett Avenue and Eddington Street. The address of record is 715 Monnett Avenue in Norman, OK. The legal description is STATE UNIVERSITY LTS 1-11 BLK 1 & N10` VACATED ALLEY ADJCT S LINE LT 5 & S10` VACATED ALLEY ADJCT N LINE LOTS 6-11 BLK 1 AKA BEG NE/C LT 1 BLK 1 S 27D E211.20` W30.45` S150.10` W149.94` N293.40` N 62D E92.66` POB AKA LT 1A. 2.2 Site and Vicinity Characteristics

2.2.1 Surface Hydrology - Information provided by the Oklahoma Climatological Survey was reviewed. Cleveland County is located in an area of Oklahoma receiving approximately 37.29 inches of rain per year on average. More information can be found in Exhibit 2. Surface runoff from the Subject Property runs into storm drains which eventually lead to the South Canadian River.

2.2.2 Geology - Geological information was provided by the by Environmental Data Resources in a report dated October 29, 2015.

Era: Paleozoic Category: Stratified Sequence System: Permian Series: Upper part of the Leonardian Series Code: P2b (decoded above as Era, System & Series)

2.2.3 Topography - A USGS topographical map was reviewed for additional information about the surrounding land. The Norman Quadrangle covers this site and historical maps are included. These maps are in Exhibit 2. The elevation is approximately 1,160 feet above sea level and the general topography gradient is to the east-southeast.

2.2.4 Soils - This site has sandy and sandy loam soils, which are underlain by sandstone. According to the Oklahoma Geological Survey, the subsurface geology of the area is made up of terrace deposits. These are lenticular beds of sand, silt, clay, and gravel. Thickness ranges from a few feet to about 100 feet and probably averages about 50 feet along major streams. Radon levels of soils in this area of Oklahoma are below the level of concern. Below is a partial list of the site soils:

North The nearest road to the north is Duffy St. Duffy is a two lane local road serving mostly residential purposes in the area.

EastThe railway forms the eastern boundary of the Property. The nearest road after the railway is Ferrill St., a two lane local road serving residential purposes.

South The Property is bounded on the south by Eddington Street, a two lane local road serving residential purposes.

West The Property is bounded on the west by Monnett Ave., a two lane local road serving local purposes.

Structure Description(s) of major structures from county assessor records The Subject Property is improved with a single two-story apartment building. The building is 21,070 sq. ft. in size and was constructed in 2012. It is of brick construction with wood siding. It has a composition shingle roof. The complex is total electric.The gated parking lot is located on the east side of the complex adjoining a residential area and the railroad tracts.

According to historical maps and city directories, the Subject Property was previously occupied by single family residences prior to the current improvements being constructed. Chain of title search was not required to determine historical land use. Sanborn maps were available for this property and document land use from 1918. A copy of these maps is included in Exhibit 2 of this report. A City Directory was obtained and reviewed to check past land use. No past industrial uses of the Property took place. Part of this directory is in Exhibit 2 of this report.

There are no environmental liens held against the Property. Please note that the user is responsible for determination of any liens other than environmental liens held against the property. No land use restrictions due to environmental issues were found for this Property.

3.0 RECORDS REVIEW

3.1 State and Federal Regulatory Records Review

The purpose of the records review is to obtain and review records that will help identify recognized environmental conditions concerning the Subject Property. Some records to be reviewed pertain not just to the Property but also pertain to properties within an additional approximate minimum search distance in order to help assess the likelihood of problems from migrating hazardous substances or petroleum products. When the term approximate minimum search distance includes areas outside the Property, it shall be measured from the nearest Property boundary. The term approximate minimum search distance is used in lieu of radius in order to include irregularly shaped properties.

3.1.1 Standard Federal and State Record Sources - ERS provided a database report of both federal and state environmental records, using ASTM guidelines, dated October 29, 2015.

3.1.2 National Priorities List - The National Priorities List (NPL) is the EPA’s database of uncontrolled or abandoned hazardous waste sites identified for priority remedial actions under the Superfund Program. A site must meet or surpass a predetermined hazard ranking system score, be chosen as a state’s top priority site, or meet three specific criteria set jointly by the US Department of Health and Human Services and the US EPA in order to become an NPL site (approximate minimum search distance 1 mile).

The database search produced no evidence of NPL sites within a 1-mile radius of the Property.

3.1.3 State Equivalent Priority List -The State Equivalent Priority List is provided by the Oklahoma Department of Environmental Quality (approximate minimum search distance 1 mile).

The database search provided no evidence of SPL sites within a 1-mile radius of the Property.

3.1.4 CORRACTS-RCRA Corrective Actions with or without TSD - The EPA maintains this database of RCRA facilities, which are undergoing “corrective action”. These can be with or without waste treatment, storage, or disposal facilities (approximate minimum search distance 1 mile).

The database search produced no evidence of CORRACTS-RCRA actions within a 1-mile radius of the Property.

3.1.5 RCRA-TSD CORRACTS - The EPA’s RCRA program identifies and tracks hazardous waste from point of generation to point of disposal. The RCRA facilities database is a compilation by the EPA of facilities reporting generation, storage, transportation, treatment, or disposal of hazardous waste requiring corrective action (approximate minimum search distance 0.5 mile).

The database search produced no evidence of RCRA-TSD CORRACTS sites within 0.5 mile of the Property.

3.1.6 Comprehensive Environmental Response, Compensation and Liability Act - TheEPA Comprehensive Environmental Response, compensation and Liability Act (CERCLA) Information Service (CERCLIS) serves to track sites that have come to the EPA’s attention as having the potential for releasing hazardous substances into the environment. Appearance on the CERCLIS list does not necessarily indicate a release has occurred or a significant risk that a release will occur. NFRAP sites may be sites where, following an initial investigation, no contamination was found, was removed quickly, or was not serious enough to require Federal Superfund action (approximate minimum search distance 0.5 mile).

The objective of the site reconnaissance is to obtain information indicating the likelihood of identifying recognized environmental conditions in connection with the Property.

No unusual environmental issues were noted during the site visit.

4.2 Oil and Gas Records – Oil and gas records were obtained from the Oklahoma Geological Survey at the University of Oklahoma. There are no oil or gas wells drilled on the Subject Property.

4.3 Indications of Polychlorinated Biphenyls (PCBs) – OG&E provides electricity for this area and all of their transformers are PBC-free. There were no indications of any other sources of PCBs.

4.4 Solid Waste – Solid waste is collected by the City of Norman. There was no excess solid waste buildup noted during the site inspection.

4.5 Interviews of Individuals – The objective of interviews are to obtain information indicating recognized environmental conditions in connection with the Property. The Oklahoma Corporation Commission, Oklahoma Department of Environmental Quality, City of Norman and other agencies were contacted regarding information for the Property. A Phase I Environmental Site Assessment was conducted for the Monnett Place Apartments located at 715 Monnett Avenue in Norman, Oklahoma. A database search was conducted in conjunction with a site inspection and interviews with local residents.
