Section 1 – Summary

1.1 An Environmental Site Assessment (ESA) in accordance with ASTM E 1527-13 was performed on the Clements site property located at F Rd., Cedar Point, Chase County, Kansas. 1.2 An on-site visual inspection was performed, interviews conducted, and public records searches and inquiries were made to determine the current environmental condition of the property. 1.3 Based on this Environmental Site Assessment, the Clements proposed tower site has been found to be in excellent environmental condition. 1.4 In accordance with ASTM E 1527-13, all appropriate inquiry has been made into this subject property, thus allowing the landowner to qualify for the innocent landowner defense and landowner liability protections under CERCLA. 1.4.1 All appropriate inquiry, as stated in paragraph 4.5.2 of E 1527-13, is not exhaustive. The level of inquiry required to make the determinations and recommendations in this report satisfies the all appropriate inquiry requirements as stated in this paragraph. 1.5 Please read this report for further details.

Section 2 – Introduction

2.1 Purpose 2.1.1 This environmental site assessment was performed to establish the current environmental condition, for the property in question at the request of Nex-Tech Wireless, lessee, for the purpose of developing a wireless communication tower with associated equipment. As a requirement thereof, the ASTM E 1527-13 ESA standard was used for investigation and reporting of findings. 2.2 Scope-of-Services 2.2.1 Scope of services includes those required under the ASTM E 1527-13 Standard Practice for Environmental Site Assessments in order for the user of this report to qualify for the landowner liability protections to CERCLA, and include: 2.2.1.1 Site reconnaissance of the subject property. 2.2.1.2 Interview(s) with owner or owner’s representative(s) and others knowledgeable about the subject property as may be required. 2.2.1.3 Interview(s) with local government officials and/or other government officials who may possess pertinent knowledge of the subject property as may be required. 2.2.1.4 Search of government environmental records. 2.2.1.5 Phase I ESA final report; one electronic copy in Adobe PDF format and one hard copy delivered to the user upon request. 2.3 Significant Assumptions 2.3.1 It is assumed that the subject property has been undeveloped land. 2.3.2 It is assumed, based on information provided to the inspector that the subject property has not been used in anyway for industrial purposes or in anyway related thereto. 2.4 Limitations and Exceptions 2.4.1 This environmental site assessment has been performed to meet ASTM standards in accordance with publication E 1527-13: Phase I Environmental Site Assessments. 2.4.2 Please see “Certification and Statement of Limiting Conditions” in Appendix I. 2.5 Special Terms and Conditions

2.5.1 There are no special terms and/or conditions in regard to this Phase I ESA. 2.6 User Reliance 2.6.1 The user shall have reliance that this ESA and report have been performed in accordance with ASTM E 1527-13 standards and that the information and finding in this report are true and correct to the best knowledge and experience of the environmental professional performing this assessment.

Section 3 – Site Description

3.1 Location and Legal Description. 3.1.1 Location. The Clements site is located at F Rd., Cedar Point, Chase County, Kansas. 3.1.2 Legal Description. A tract of land located in a portion of Section 15, Township 20 South, Range 6 East, Chase County, Kansas. Please see topographical map in Appendix II and site survey in Appendix III for site location portrayal. 3.2 General Site Setting 3.2 Site and General Vicinity Characteristics. Generally, this property is located on the northwest side of the small town of Clements, Chase County, in east Kansas. The site is located on undeveloped land. Please see street maps in Appendix IV for site location portrayal. 3.3 Current Use of the Property. 3.3.1 The property is currently raw undeveloped land. 3.3.2 Descriptions of Structures, Roads, Other Improvements on the Site. 3.3.2.1 Structures 3.3.2.1.1 None. 3.3.2.2 Roads. 3.3.2.2.1 The property is bounded by F Rd, to the North and West. 3.3.2.2.2 No non-outlet roads were noted with signs of possible use for the transport, treatment, storage, disposal or generation of hazardous substances or petroleum products. 3.4 Past Use(s) of the Property 3.4.1 Previous uses listed. Historical records, to include owner interviews and historical aerial photographs (Appendix V), indicate that the target property had been used as undeveloped raw land. 3.5 Current Use of Adjoining Properties. 3.5.1 This site is adjoined immediately on all sides by undeveloped raw land for agriculture. To the distant north is a single family farm home. No concerns noted.

3.6 Past Use(s) of Adjoining Properties. 3.6.1 Previous uses listed. 3.6.1.1 All prior uses of the facility would be that of raw undeveloped land. No concerns noted. 3.6.1.2 It if commonly known the surrounding property has always been raw undeveloped land. 3.7 Current or Past Use(s) in the Surrounding Area. 3.7.1 As noted in the site visit or through records review, the surrounding area current or past uses(s) does not indicate a likely recognizable environmental condition in connection with the property.

Section 4 – User Provided Information

4.1 Title Records. 4.1.1 Title records were not provided by the user. Public records indicate this property is owned by the Jeff Harshman.  4.2 Environmental Liens or Activity and Use Limitations. No records were found indicating any environmental liens or activity and use limitations. 4.2.1 There are no known environmental liens or activity and use limitations on the property as related to this project. 4.3 Specialized Knowledge. 4.3.1 There is no specialized knowledge concerning the subject property other than the historical use knowledge by the current owner. 4.4 Commonly Known or Reasonably Ascertainable Information. 4.4.1 It is commonly known that this property has been utilized as the existing communications facility for the past approximate forty-five years, with prior use as agricultural. 4.4.2 User Questionnaire. ASTM User Questionnaire (Appendix VI), was completed by the environmental professional on behalf of the user, Nex-Tech Wireless, based on information provided to the environmental professional and on known corporate practices. There were no concerns identified in the User Questionnaire. 4.5 Valuation Reduction for Environmental Issues. 4.5.1 There are no known valuation reductions for the property for environmental issues. 4.6 Owner, Property Manager, and Occupant Information. 4.6.1 This property is owned by Jeff Harshman. The site is not currently occupied.  4.6.1.1 Jeff Harshman, Owners, unavailable to provide the owner information in this report, to include but not limited to the Transaction Screen Questionnaire(s) (Appendix VII), owner interview information, and other pertinent information.   4.6.1.2 Jeff Harshman contact number is 620-343-0627.  4.7 Reason for Performing Phase I.

4.7.1 The stated reason for performing this Phase I ESA is to determine the environmental condition of the property prior to enacting any lease or purchase transaction, prior to commencement of any construction, and to qualify for CERCLA LLP.

Section 5 – Records Review

5.1 Standard Environmental Record Sources. 5.1.1 An environmental records report was ordered and obtained from Environmental Data Resources (EDR). This report service provider used the ASTM 1527-13 standard requirements for compiling and inclusion in their reports. 5.1.2 EDR Radius Map with GeoCheck Report attached as Appendix VIII. 5.2 Physical Setting Sources. 5.2.1 The EDR report includes physical setting information, to include the following: 5.2.1.1 Geographic Coordinates: Approximately N 38° 18’ 46.65”, W 96° 45’ 8.4’’. 5.2.1.2 USGS Topographical Map Map ID: Cedar Point, Kansas. Quadrangle, 7.5 Minute Series, USGS 5.2.1.2.1 The topographical map was reviewed for possible indications of recognizable environmental conditions that may affect the property, and noted in the report as applicable. 5.3.1.3 Geologic Age Identification Geologic Code: M1 Era: Paleozoic System: Mississippian Series: Osagean Kinderhookian Series 5.3.1.4 Rock Stratigraphic Unit Category: Stratified Sequence 5.3.1.5 Groundwater Flow Information Not Reported. Generally to the east southeast from the site location, based on topographic gradient interpretation and site visit. 5.3.1.6 Dominant Soil Composition The dominant soil composition in the general area of this site is of the Armstrong component. The surface texture is loam, and the soil is of a Class C hydrologic group, with slow infiltration rates and is moderately well drained. 5.6 Sewage system 5.6.1 This site property has no sewage system. 5.7 Water system

5.7.1 This site property has no water system. 5.7.2 No water wells were noted for this property. 5.8 EDR Report Findings 5.8.1 In accordance with ASTM standards, various governmental records and databases are searched concerning the specific site or location in question, as well as for other sites located within specific ASTM standard search distances from the target location. The electronic database search results provided by EDR located in this section. Below is a list of significant finds, where applicable, developed from the records search, and whose definitions can be found in the glossary: 5.8.1.1 Finds: 5.8.1.1.1 Target Property: The target property was not listed as a Find. 5.8.1.1.2 Findings of significance for area sites. 5.8.1.1.2.1 None. 5.8.2 Orphan Sites. These are sites for which there is poor or inadequate address information to map the sites. 5.8.2.1 Numerous orphan sites were listed in this record search. These sites were reviewed, and were determined to not have an impact on this site due to geographical distance and topographical analysis of the finds. 5.8.3 Sanborn Map Findings: 5.8.3.1 This is an unmapped area. 5.9 Data gaps. No data gaps were noted.

Section 6 – Site Reconnaissance

6.1 Methodology and Limiting Conditions. 6.1.1 A systematic visual inspection of the property was conducted by walking the property and encompassing the entire project area. The property was accessed to the site to be west of F Rd, via a short access of utility easement. The property was traversed in various locations to determine if any items of concern could be ascertained. 6.1.2 There were no limiting conditions during the site reconnaissance.

6.1.3 Finding noted below may include those from the visual site inspection, either visually and/or physically observed, or identified from interviews or records review. 6.1.4 The target property was visually inspected on April 27, 2016, by Stephen B. McFarlin or deputy representative. 6.2 Exterior Observations. 6.2.1 General: The exterior of the property is comprised of undeveloped raw land. 6.2.1 Practice Scope items: 6.2.2.1 Hazardous Substances and Petroleum Products:

6.2.2.1.1 No hazardous substances were noted.

6.2.2.1.2 No petroleum products were noted, with the exception of the propane tank. 6.2.2.2 Storage Tanks: No AST’s or UST’s were noted on the property, and no signs of vent pipes, fill pipe or access ways were noted. 6.2.2.3 Stains and odors: No stains or strong, pungent or noxious odors noted on the property.

6.2.2.4 Pools of liquid: No surface water; or sumps with associated liquids.

6.2.2.5 Drums: No drums of 55 gal, or containers of 5 gal or more. 6.2.2.6 Hazardous Substances and Petroleum Products Containers (Not Necessarily in Connection with Identified Uses): None noted.

6.2.2.7 Unidentified Substance Containers: None noted.

6.2.2.8 PCBs: No electrical or hydraulic equipment known or likely to contain PCB’s present on the property location.

6.2.2.9 Pits, Ponds or Lagoons: None noted.

6.2.2.10 Stained Soil or Pavement: None noted.

6.2.2. 11 Stressed Vegetation: None noted.

6.2.2.12 Solid Waste:

6.2.2.12.1 No signs of solid waste dumping or buried materials were noted.

6.2.2.13 Wastewater:

6.2.2.13.1 Storm water runoff areas, including any drains, ditches or underground injection systems as may be applicable, were noted and found to not have stains for signs of hazardous discharge.

6.2.2.14 Wells: No well, such as dry wells, irrigation, injection or other, present on site location. No concerns noted.

6.2.2.15 Septic Systems: No on-site septic system or cesspool present. 6.2.3 In general, there were no concerns noted from exterior visual inspection. 6.3 Interior Observations. Interior observation made with intent to identify releases or material threat of future releases of hazardous substances or petroleum products to the environment. 6.3.1 General: There are no structures on the property, hence no interior inspection was made:

6.3.2 Practice Scope Items:

6.3.2.3 Floors: N/A

Section 7 – Interviews

7.1 Jeff Harshman, Owners, was unavailable for interview.   7.1.1 Due to the nature of the property and all record previous uses of the land, it is determined that contact with the owners, Jeff Harshman, was unnecessary. There are no UST’s or buried materials on this site, and there have been no spills or contamination per the EDR records search. It is commonly known that the site property has always been undeveloped raw commercial land. In general, there were no concerns noted.  7.2 No concerns were noted from the interview or questionnaire. 7.3 This is a rural site with only a volunteer fire department available to comment on the property in regard to hazardous materials calls. Due to a lack of records, the volunteer fire department was unable to comment.

Section 8 – Non-Scope Considerations

8.1 The following is a list of non-scope considerations, which are beyond the scope of the ASTM E1527-13 practice (Section 14 of the Practice). Section 9 – Findings

9.1 Scope findings 9.1.2 Recognized Environmental Conditions (ASTM 1527-13, para 1.1.1) 9.1.2.1 Hazardous Substances. No signs of hazardous materials were noted on the target property, nor in the search area that pose an environmental threat to the property. All records Finds in the search area were reviewed with no finding that poses an environmental risk to the target property. 9.1.2.2 Petroleum Products. There was no petroleum products found on or near this property that pose a threat to human health or the environment. 9.1.3 CERCLA Requirements other than Appropriate Inquiry. 9.1.3.1 The report does not address whether requirements in addition to all appropriate inquiry have been met in order to qualify for Landowner Liability Protections. 9.2 Non-Scope findings 9.2.1 There were no non-scope findings.

Section 10 – Opinion

10.1 The approach taken during the site audit was based on initial information that the site is an existing wireless communications facility no known or suspected environmental conditions. The inspector then focused on discovery techniques, as guided by AAI and the ASTM E 1527-13 standard, to determine if there were any obvious or suspected recognizable environmental conditions which would be contrary to the assumed use and history of the property, in amounts or use that would pose an environmental concern for the property. 10.2 Based on the lack of discovery of substantial amounts of hazardous environmental conditions, the research and discovery portion of the site evaluation was terminated after thorough investigation. As stated in paragraph 4.5.2 of E 1527-13, all appropriate inquiry is not exhaustive. The level of inquiry required to make the determinations and recommendations in this report satisfies the all appropriate inquiry requirements as stated in standard.

Section 11 – Conclusions

11.1 We have performed a Phase I Environmental Site Assessment in conformance with the scope and limitations of ASTM Practice E 1527-13 for the Clements proposed wireless communication tower site located at F Rd., Cedar Point, Chase County, Kansas. Any exceptions to, or deletions from, this practice are described in Section 2 or 9 of this report. This assessment has revealed no evidence of recognized environmental conditions in connection with the property.

USER Questionnaire

In order to qualify for one of the Landowner Liability Protections (LLPs) offered by the Small Business Liability Relief and Brownfields Revitalization Act of 2001 (the “Brownfields Amendments”), the person commissioning the Phase I Environmental Site Assessment report must provide the following information (if available) to the environmental professional. Failure to provide this information could result in a determination that “all appropriate inquiry” is not complete.

1. Environmental cleanup liens that are filed or recorded against the site (40 CFR 312.25). Are you aware of any environmental cleanup liens against the subject property that are filed or recorded under federal, tribal, state or local law? No.

2. Activity and land use limitations that are in place on the site or have been filed or recorded in a

registry (40 CFR 312.26). Are you aware of any AULs, such as engineering controls, land use restrictions or institutional controls that are in place at the site and/or have been filed or recorded in a registry under federal, tribal, state or local law? No.

3. Specialized knowledge or experience of the person seeking to qualify for the LLP (40 CFR 312.28).

As the user of this ESA do you have any specialized knowledge or experience related to the subject property or nearby properties? For example, are you involved in the same line of business as the current or former occupants of the property or an adjoining property so that you would have specialized knowledge of the chemicals and processes used by this type of business? No.

4. Relationship of the purchase price to the fair market value of the property if it were not

contaminated (40 CFR 312.29). Does the purchase price being paid for this property reasonably reflect the fair market value of the property? If you conclude that there is a difference, have you considered whether the lower purchase price is because contamination is known or believed to be present at the property?
