About PIPEDA
The Personal Information Protection and Electronic Documents Act is a Canadian law relating to
data privacy. It governs how private sector organizations collect, use and disclose personal
information in the course of commercial business.
Ten privacy principles of PIPEDA are:
1. Accountability2. Identifying Purposes3. Consent4. Limiting Collection5. Limiting Use, Disclosure and Retention6. Accuracy7. Safeguards8. Openness9. Individual Access10.Challenging Compliance
Explanation of 3 principles (consent, openness, accuracy) with example
1. PrincipleConsent
The knowledge and consent of the individual are required for the collection, use or disclosure of
personal information, except where inappropriate.
Under the Consent principle, organization must:
Inform the individual in a meaningful way of the purposes for the collection, use ordisclosure of personal data.
Obtain the individual's consent before or at the time of collection, as well as when a newuse is identified.
Communicate in a manner that is clear and can be reasonably understood. (AssociationXpertise Inc., 2014)
For example The Canadian Opera Company (the COC) and its agents take the issue ofprivacy seriously. The COC has developed the Policy on the Protection of Patron Information
(this Policy) to formalize procedures necessary to ensure the privacy of personal patroninformation (current and potential ticket buyers and donors), and to communicate that policy to
patrons, staff, appointed representatives and business associates. COC patron information isnever sold, but on occasion the COC exchanges names and addresses from its database with
other organizations that the COC believes would be of interest to its patrons (COC, 2014)

2.PrincipleOpenness
An organization shall make readily available to individuals specific information about its policies
and practices relating to the management of personal information.
Under the Openness principle, organization must:
Inform members, donors, customers, clients and employees that you have policies andpractices for the management of personal information.
Be open about its policies and practices relating to the management of personalinformation.
Make these policies and practices understandable and easily available. (AssociationXpertise Inc., 2014)
For example: Manulife Financial Develop literature to explain organizations personal
information management policies and practices to the public, in keeping with the
Accountability principle. Such materials may include policies, application forms,questionnaires, survey forms, pamphlets, brochures, Web site, etc. (Manulife )
3. PrincipleAccuracy
Personal information shall be as accurate, complete, and up-to-date as is necessary for the
purposes for which it is to be used..
Under the Accuracy principle organization must:
Minimize the possibility of using incorrect information when making adecision about the
individual or when disclosing information to third parties. (Association Xpertise Inc., 2014)
For example: FCT insurance Review why organization collects personal information, balancinghow the information will be used and the interests of the customer. Assess the importance of
accuracy, completeness, and currency in circumstances where information is used on an ongoing
basis or is routinely disclosed to third parties. (privacy, 2014)
