CommunicationHome movers identifi ed communication as a key attribute of a highly rated legal adviser.

8 out of 10 home movers are looking for their adviser to be a good communicator. It is important that home movers are able build a rapport with their adviser who can provide them with the advice and information they need to navigate their way through the process of buying and selling property.

It is perhaps not surprising that nowadays the majority of home movers like to be updated by e-mail. That said, 4/10 respondents said that they still preferred telephone conversations as e-mails can lack a personal touch. Whichever the case, the survey revealed that a highly rated adviser will establish their client’s preferred methods of communication at the beginning of the transaction.

Proactive vs ReactiveProactivity is another vital skill with 67% of respondents wanting their adviser to carry out tasks without having to be chased and also to positively deal with their requirements and potential di� culties before they arise.

UpdatesEveryone is di� erent and so it is by building a good rapport with your legal adviser that he or she will be able to identify your individual needs such as how often you wish to be kept updated.

The results of the survey show that 70% of home movers wanted to be kept updated at least once a week even if there is nothing to report. In contrast to this, just over

21% of respondents only wanted to be updated with information or developments that they need to know. Again, it was the advisers who established their client’s need at the beginning of the transaction which rated highly.

RecommendationsIt may not be possible for home movers to tell in the fi rst instance whether or not a legal adviser has the key attributes they are looking for. Home movers, therefore, tend to use recommendations as a means to locate and choose their advisers.

The survey revealed that 51% of respondents chose the legal adviser recommended by their estate agent. It is often the case that an estate agent is one of the fi rst points of contact established during the process of buying and selling property. An experienced agent will have established connections with a range of legal advisers and have worked with them on previous transactions. As such your agent should be well placed to recommend a legal adviser and perhaps even arrange an introduction.

It is also the case that 6 out of 10 respondents chose their legal adviser based on a third party recommendation. The results show that home movers who have built up a good relationship with their adviser and received a highly rated service previously will recommend that adviser to others, such as friends and family.

The Price FactorFor the past few years the results of the surveys have showed that home movers seldom choose the cheapest. In 2015 just 1 in

10 respondents chose the adviser who quoted the cheapest fee with 77% saying that price is ‘not very’ or ‘not really’ important.

It is clear from this and the results mentioned above that home movers want to see more from their adviser than just low prices. The survey indicates that advisers who cut their prices have to increase the volume of their workload which in turn produces lower rating in respect of the key attributes.

ConclusionThe survey reveals that home movers are looking for a legal adviser who is approachable, professional, contactable and proactive and that they are likely to locate such an adviser through recommendations from their agent and/or friends and family.

Is there life on Mars? There will be if Space entrepreneur Elon Musk has anything to say about it. The SpaceX founder has the ambitious plan to establish a human colony on Mars in the next 20 years. One of the big ideas to support human life in this hostile environment is to grow food in purpose built ‘biodomes’ on the surface.

Matt Damon in ‘The Martian’ is testament to this, growing rows of new potatoes with his own brand of improvised fertiliser (!).

Closer to home, we can borrow some of the tools and technology that make life in space possible. It’s just one small step to self su� ciency with a ‘biodome’ in your backyard. The biodome is essentially a space-age greenhouse built in a geodesic shape to make it super strong and energy e� cient. With solar mass, decent insulation and a small heater you can truly create your own microclimate.

They are perfect for growing your own organic veggies with excellent light penetration from the dome-like design and enough open space to have stacks of planters. It’s a great shout for the environment too, as your food only has to travel from garden to fork. All of the cancer-busting greens won’t protect you from radiation in space, but they’re certain to remind you of home!

The geodesic structure is designed to survive the harshest of environments, from gale force winds to small earthquakes, to meteor showers and marauding aliens (OK so we made up the last two, but it is robust!). And you don’t have to have NASA’s budget, you can build your biodome on a budget with creativity and some basic materials.  

Your fi rst step should be to consult an architect to help develop a 3D model of your dome using design software. This will help you scope out the size, specifi cations and the amount of raw materials required for the build. You can even stress test the struts at di� erent pressures. To create your struts you can order in scrap boards at pulp prices, you’ll need to ask a carpenter to help build your wooden frame. Cover with PVC plastic to create your canopy.

Your sci-fi hothouse will be sure to raise some eyebrows, but you’ll have the last laugh as neighbours queue up for fresh organic produce grown from your biodome.  

And, if not a giant leap for mankind, it’s certainly a big step for your garden.

The law relating to residential tenancies has changed. Tenants are now more protected than they were previously. Landlords on the other hand have new obligations that they need to comply with, but may still not be aware of. Unwitting landlords beware; you could face penalties! The two major changes are the new tenant deposit scheme and the requirement for landlords to prepare condition reports.

Brief backgroundThe Residential Tenancy Law (Jersey) 2011 has been in force since 1st May 2013. It contains protections for the tenant but is also helpful to the landlord, in that it provides guidance on what should be in the lease, which will hopefully reduce disputes further down the line.

The law applies to all agreements for exclusive occupancy (i.e. not shared with landlord), for a value (i.e. rent), which are less than 9 years in length, or; ongoing for an indeterminate period, for a property which is deemed to be residential. For a property to be deemed residential by law, it must contain the following amenities as a bare minimum:

1. A shower or bath or other similar facility which is as (if not more) convenient, e.g. a wet room;2. A washbasin;3. A kitchen;4. A sleeping space; and5. A lavatory.

The law does not apply to licensees, boarders and lodgers, or to holiday lets of less than 3 months. If you are not sure if it applies to your agreement, take advice!

New obligations for landlordsCondition report – compulsory for every new tenancy agreement as of 31st October 2015. The penalty for not completing one is a fi ne of up to £2000. This must:

1. List all the fi xed parts of a property and its condition.2. List the condition of walls, ceilings and fl oors in each room.3. List the condition of items which are in the inventory of contents belonging to the landlord.4. Must be completed within 7 days of the tenancy agreement.

Further details and a draft condition report can be found on the States’ website.

Deposit scheme – compulsory for all new residential tenancies from 2nd November 2015. Failure to comply can result in a fi ne of up to £2000.

The Residential Tenancy Law states that tenants’ deposits must be held by a scheme approved for that specifi c purpose. Landlords must now put deposits into a scheme within 30 working days of taking it from the tenant.The states approved scheme for holding deposits is mydeposits Jersey. They charge a fee which is currently £20 (+£1 GST). This is paid out of the tenant’s deposit. Further details of the scheme can be found at: www.mydepositsjersey.je

When the tenant moves out, so long as there are no disputes, the landlord can authorise mydeposits Jersey to release the amount (minus the fee) back to the departing tenant.

If there is a dispute with regards to deductions from the deposit which cannot be agreed between the tenant and landlord, the scheme provides an Alternative Dispute Resolution Service (ADR) to help come to an agreement or compromise.

One of the most important factors to consider when selling a property is whether or not the purchaser is a cash buyer. If this issue is not clearly identifi ed at the outset, a sale can take longer than expected or may even be lost!This is generally due to miscommunication or a misunderstanding and can be easily resolved by gaining the correct information from the start.

To clarify, a buyer is only a cash buyer in the true sense if he / she has real cash assets (funds) available at the time of completion. This would include a buyer who has secured an “in principal” notifi cation from a mortgage lender that funds will be made available.

A buyer re-mortgaging a property to purchase another property - would only become a cash buyer once the transaction had been completed and equity released;

A buyer awaiting a divorce settlement - would only become a cash buyer once the divorce had been completed and funds released;

A buyer with a property to sell and a potential purchaser in place – would only

become a cash buyer once the property had been sold and funds released.

Sadly it can be the case that a purchaser pulls out at the last minute (as we experience from time to time) due to these discrepancies.

It is therefore vital that all parties concerned are fully aware of all the facts from the outset, such as what the fi nancial position of the potential purchaser is and the subsequent timescale for achieving cash buyer status.

Armed with all this information the property transaction can proceed through the necessary channels and result in success for all concerned.
