PLAN OF MANAGEMENT 12 CHARLES PLACE, JANNALI 5 th January, 2021 – Revision 5 1. Introduction This Plan of Management (PoM) has been prepared to outline operational management controls which will apply to the boarding house on No. 12 Charles Place, Jannali. 1. Introduction

This Plan of Management (PoM) has been prepared to outline operational management controls which will apply to the boarding house on No. 12 Charles Place, Jannali.

The purpose of the Plan is:

• to ensure compliance with the Boarding Houses Act 2012 • to ensure sustainable affordable housing is provided (ie rent should not be above

30% of the median income for the Sydney statistical area) • to ensure an acceptable level of resident amenity, safety and privacy to meet the

needs of residents; • to minimise adverse impacts and ensure the operation of the boarding house does

not have any discernible effect on the amenity of adjoining or nearby properties; • to maintain the internal and external appearance of the premises; • to identify a procedure for reporting, processing and resolving complaints; and • to make provision for the PoM to be amended, as necessary over time, with the

approval of Council, in order to facilitate timely and responsive operational changes to improve and maintain residential amenity both within and external to the site.

2. Registration of Boarding House

The Boarding House is to be registered with the relevant State government authority such as the Department of Fair Trading and Sutherland Shire Council.

An example of a tenancy application and lease agreement that the boarding house residents will enter into has been attached in the appendices of this PoM and is consistent with the Occupancy Principles outlined on the Department of Fair Trading’s website.

3. Interpretation

For the purpose of this PoM, the following terms are used:-

Resident refers to any boarding room tenant or lodger.

On-Site Manager: Refers to a resident who has been appointed and trained to be responsible for enforcing House Rules and other responsibilities outlined in the PoM. The On-Site Manager will hold a minimum 12 month lease.

Site Manager: Refers to a suitably qualified and trained Managing Agent from the local Sutherland Shire Area, who is to be engaged to manage the day day-to-day operation, administration, cleanliness and fire safety of the premises, including the ongoing compliance with the terms and conditions of this PoM and the relevant conditions of the Development Consent applying to the boarding house.

4. Sustainable Affordable Housing

Under clause 6 of the State Environmental Planning Policy (SEPP) – Affordable Rental Housing (2009), affordable housing is defined as follows:

“affordable housing means housing for very low income households, low income households or moderate income households, being such households as are prescribed by the regulations or as are provided for in an environmental planning instrument.

In order for the boarding house to qualify as affordable housing under the SEPP, weekly rent must not be more than 30% of the median household weekly income for the Sydney statistical area.

According to the most recent census data from the Australian Bureau of Statistics from 2011, the median weekly income for the Greater Sydney area is $1,447. As outlined in the table below.

Therefore 30% of this median weekly income equates to no more than $431.10 per week. The owners have advised that that the proposed weekly rent for the proposed boarding rooms will be less than $431.10.

5. Access to Plan of Management

A copy of the PoM is to be provided to each boarding house resident and will be made available to all persons involved in the operation and management of the boarding house.

The PoM is to be available for viewing within the common room and boarding rooms and will be made available on request to the Site Manager.

6. Management & Supervision

The boarding house is to be managed by a Site Manager and On-Site Manager (as defined above). The On-Site Manager will reside at the property and be contactable 24 hours a day, 7 days a week.

The On-Site Manager will be offered a 12 month lease option only and will be required to hold a First Aid Certificate, Child Protection Clearance (WWCC) and must pass a Police Background Check. This person will receive training in conflict resolution in order to deal with any issues that may arise at the boarding house, providing inductions to new residents, and carrying out regular checks on the property. They will be required to have a thorough understanding of the house rules and be trained in methods of implementing them.

The position of On-Site Manager will be advertised in conjunction with the boarding room vacancy and the resident will be compensated by a small salary or rental assistance for providing this service.

In the event that the On-Site Manager is unable to be contacted (e.g. emergency, unwell, etc), a separate arrangement with a local Site Manager from Property Management Company, that is to be a recognised property management firm operating as a business with relevant ABN and authorities for property management and is licensed under the Property Stock and Business Agents Act and associated regulations, will be made the point of contact.

The contact details for both the Site Manager and On-Site Manager will be placed on each of the community notice board required to be installed. Their details will also be provided to Sutherland Shire Council and the local Police Force. Any changes will be notified to Council and the Police immediately.

A clearly visible sign with the name and telephone number of the Site Manager will be displayed externally at the front entrance of the boarding house and internally on notice boards in the common areas. These details will be made available to all residents and the public.

The Site Manager will be responsible for the operation, administration, cleanliness and fire safety of the premises, including compliance with the conditions of both the PoM and the Development Consent for the boarding house.

7. Site Manager’s Responsibilities

The Site Manager is to monitor, supervise and be responsible for the following aspects of the boarding house.

House Rules The House Rules are contained in Attachment 1.

The House Rules are to be prominently displayed in the entry foyer, common room and boarding rooms.

The House Rules are to be attached to the Lease Agreement of each resident and will require mandatory compliance.

The Site Manager is to ensure that residents comply with the House Rules. If the House Rules are broken, the Site Manager is to deal with the non-compliance within 24 hours and issue a notice in writing of the breach of the rules with a requirement that the breach ceases immediately.

The resident may request a meeting with the Site Manager to discuss the issue.

The Site Manager is to keep a Register containing details of any breach of the House Rules and the measures employed to remedy that breach.

The Site Manager is to keep minutes of meetings and attach these minutes to the Register.

Occupancy Rate The maximum number people permitted to occupy each boarding room is to be 1 person.

This is to be documented in the Lease Agreement between the owner and the resident.

There is to be a monthly inspection of each room to ensure compliance with the Lease Agreement and Huse Rules.

Impact on Adjoining Premises

The impact of the boarding house on adjoining premises is to be managed through the House Rules as well as any complaints received from neighbouring residents.

A 24 hour contact number will be displayed on the outside of the building to ensure any complaints are promptly addressed.

The Site Manager is to ensure that noise from the boarding house does not unreasonably impact surrounding residents and neighbours.

This includes ensuring residents adhere to the House Rules in relation to noise emanating from the boarding house (including common indoor and outdoor areas).

Complaint Register A complaint register is to be maintained by the Site Manager. All complaints logged are to be recorded in the register and be available for Council inspection. Section 18 outlines the process the Site Manager is required to follow should a complaint be received. .

Waste Minimisation & Recycling

The Site Manager is to ensure that a cleaner attends the boarding house weekly to ensure that the common areas, private open space, car parking and general outside areas of the boarding house are kept clean, tidy and disinfected to a professional standard. Each room will be provided with a waste disposal container. The Site Manager is to ensure that residents place all non-recyclable waste in the garbage bins and that all recyclable waste is placed in the recycling bins provided.

Safety & Access Internal signage is to be prominently displayed to provide the Site Manager's contact details, as well as emergency contact numbers for essential services, such as fire, ambulance, police, and utilities such as gas, electricity, plumbing, locksmith, security and cleaning services. The Site Manager is to provide residents with swipe card access to their room and the common areas once they have entered into a Lease Agreement. The Site Manager is to check equipment, fittings and furnishings and maintain them in safe working order. The On-Site Manager is to report to the Site Manager any equipment that is broken or needs repairs between inspections. If equipment is identified as unusable, these items are to be tagged appropriately and a replacement or repair organised within a reasonable period. The Site Manager is to ensure facilities are maintained in safe working order within each room and common areas.

Resident Selection The Site Manager is to ensure that all residents submit a tenancy application, together with appropriate identification and verification checks prior to entering into a Lease Agreement. Examples of the tenancy application and ID check list have been attached in the appendices.

Resident selection will involve:

• applying a 120 point ID check and cross check of all prospective residents against Trading Reference Australia, a national tenancy database;

• confirming details with employers and previous real estate agencies used by residents; and

• carrying out reference checks.

Priority for the accessible room will be given to those in need of accessible facilities.

If all rooms are occupied when a lodger needing accessible facilities seeks accommodation, they will be placed at the top of a waiting list.

If a person not in need of accessible facilities occupies an accessible room and another non-accessible room becomes available, they will be asked to move to allow those on a waiting list who are in need of accessible facilities to be allocated the accessible room.

Car Parking On-site car parks are to be allocated by the Site Manager.

Car parking operation instructions are to be installed near the key operation push button switch. Tenants who have been allocated parking must be inducted into the safe operation of the car parking stacker system by the Site Manager. Car Stacker details have been attached in the Appendices of this PoM.

8. On-Site Manager’s Responsibilities

The On-Site Manager is to monitor, supervise and be responsible for the following aspects of the boarding house.

House Rules To ensure the House Rules are prominently displayed in the

entry foyer and common room.

To ensure that the residents comply with the House Rules and if the House Rules are broken, to inform the Site Manager immediately.

Occupancy Rate To ensure that the maximum number people occupying each room is 1 person.

To ensure that the 24 hour contact number of the Site Manager is displayed on the outside of the building.

Waste Management To ensure that residents place all non-recyclable waste in the garbage bins and that all recyclable waste is placed in the recycling bins provided.

Safety & Security To ensure internal signage is prominently displayed to provide the Site Manager's contact details, as well as emergency contact numbers for essential services, such as fire, ambulance, police, and utilities such as gas, electricity, plumbing, locksmith, security and cleaning services.

To report any equipment, fittings and furnishings that is not in safe working order to the Site Manager.

Car Parking To ensure that on-site car parks are used as allocated by the Site Manager.

9. House Rules

The House Rules to be observed by all residents and visitors to the premises are contained in Attachment 1 of the Appendices,

10. Access to Boarding House

The boarding house is to be accessible 24 hours a day, 7 days a week. Access may be provided by appointment with the Site Manager. The opening hours of the common areas shall be as follows, unless separately agreed with the Site Manager.

Outdoor common areas The outdoor common areas are to be available for use of t h e residents, at all times, between 7:00am and 9:00pm, 7 days a week.

Indoor common areas The indoor common areas are to be available for use of

residents at all times between 6:00am and 10:00pm, 7 days a week.

11. Accommodation

The boarding house contains 8 x single lodger boarding rooms and is to accommodate a maximum of 8 residents.

Rooms are to be leased for a minimum period of 6 months with 12 month leases also being offered. The On-Site manager is to have a minimum 12 month lease option only.

All rooms are self-contained and include a bed, kitchenette and bathrooms with selected rooms also containing a washing machine/dryer. Remaining rooms have the option of including a washer & dryer if deemed necessary.

The only shared facilities in the boarding house will be the common room and common open space area. The common room will include washer/dryer facilities for the rooms that do not include them.

Access and facilities designed for use by people with a disability are to be maintained in a satisfactory and useable condition.

Residents will be provided with the following:

• A copy of this PoM

• A copy of their Lease Agreement. • One (1) swipe access key per resident to access their bedroom and common areas. • Working door locks to individual rooms. • Adequate furniture in each room, including:

o a bed o a lockable cupboard o a mirror o a desk, chair and lamp o a waste and recycling container o blinds or curtains on each window for privacy o a telephone line and telephone o a television outlet o a washing machine/dryer o a sink with running hot and cold water o a microwave o a refrigerator o overhead cupboards, below bench cupboards and bench top space

• Bathrooms in each room will include: o a shower with running hot and cold running water o a towel rail and toilet paper dispenser o a washbasin with hot and cold running water o a mirror o a toilet

• Common room facilities will include: o a couch and coffee table o a kitchenette facility with hot plate, refrigerator, microwave, washing

machine, cooking implements such as pots and pans o a vacuum cleaner, floor mop and cleaning supplies in a communal cupboard

• A copy of the Fire Safety Plan. • First Aid Kit

12. Parking

Parking is to be provided for:

• 4 car spaces (including a disabled parking space) • 2 motorbike spaces • 2 bicycle racks

The on-site car and motorcycle parking spaces are to be allocated by the Site Manager and cannot be used without the Manager’s authorisation.

The Site Manager is to instruct and familiarise residents with the operations of the car stacker, in accordance with the details contained in Attachment 3.

13. Visitors

Any visitors are to be accompanied at all times by a resident of the boarding house.

Visitors are only permitted on-site between 7:00am and 10:00pm, 7 days a week.

Visitors will be required conduct themselves in a responsible and courteous manner while on the premises so as not to negatively impact the amenity of other residents and surrounding residents.

Visitors are required to comply with the House Rules (Attachment 1).

Residents are to take full responsibility for the behaviour of their visitors and ensure that they comply with the House Rules. Failure to do so may result in visitors, and in certain cases the residents, being evicted from the boarding house.

The On-Site Manager is to keep a record of residents and their visitors who breach the rules.

14. Fire Safety

The boarding house is to comply with essential fire safety measures outlined in the Environmental Planning and Assessment Regulation 2000, including but not limited to the following:

• A copy of the annual fire safety statement and current fire safety schedule for the boarding house is to be prominently displayed in the boarding house entry area.

• A floor plan is to be permanently fixed to the inside of the door of each room to indicate the available emergency egress routes.

• The Site Manager and On-Site Manager are to be trained in relation to the operation of the approved Emergency Management and Evacuation Plan.

• The boarding house is to obtain annual certification for the essential fire safety measures to comply with the Environmental Planning and Assessment Regulation 2000.

A fire evacuation plan is to be clearly displayed in each boarding room, common room and entry foyer to the building. The evacuation plan will indicate the available emergency egress routes from the respective boarding room/common room to each fire exit. Emergency contact details (police, fire ambulance) are to also be clearly visible in each boarding room and common room.

Curtains and furniture will be of materials that resist the spread of fire and limit the generation of smoke and heat. Smoke alarms will be fitted in each boarding room and within the common areas. Emergency exit lighting will be provided in each common hallway, common room and exit locations.

The premises will be checked regularly to ensure that essential fire safety measures in the building are maintained and that all required exits and egress paths are clear and free of obstructions.

Annual certification of Fire Safety Equipment and preparation of the Form 15a will be carried out by a fire safety consultant. Annual certification required of any of the equipment is to be overseen by the Site Manager. A copy of the annual fire safety compliance statement shall be displayed in a prominent location.

15. Security

Doors leading to and from the premises are to be kept closed and locked at all times.

Access to the property will be via security key access (swipe key system) by the residents and for visitors there will be an intercom linked back to the room of each resident to allow access within the premises.

One set of swipe keys will be issued to each resident. Any loss of keys will incur a fee to replace the keys. Keys to the premises are not to be given or lent to non-residents.

The entry locations, car park and ground floor common areas of the premises will be monitored at all times by CCTV surveillance cameras.

Perimeter lighting and motion sensor lighting will be provided to ensure that there are no areas of concealment when entering or leaving the property.

No cash will be stored on site, with all rental payments being made electronically to the Site Manager (and their associated agency).

16. Notice Boards

Notice boards are to be placed within the entrance foyer and common room.

17. Neighbourhood Liaison

A neighbourhood meeting is to be arranged on a half yearly basis by the owner and Site Manager.

The purpose of these meetings is to provide for a proactive line of communication to resolve operational issues that may be directly linked to the operation of the boarding house.

Meetings are to be held in the common room of the boarding house at 6.30pm on the first Wednesday in June and December.

These meeting times may be altered if it is agreed to by earlier neighbourhood meetings.

People invited to attend the meeting will include residents/landowners in the immediate area, the Police and representatives of Council.

18. Complaint Register

The Site Manager is to maintain a complaint register of both public (external) and resident (internal) complaints.

The register is to contain forms to be completed by the Site Manager, residents and/or complainants. A copy of the complaint form is contained in Attachment 2.

The form is to record the name, address, phone number and date of any person making a complaint and the details of the complaint.

Only complaints where all the above information is given are to be recorded in the register.

The Site Manager is to respond to a complaint whether written or oral within 24 hours and provide the reference number of the complaint.

The Site Manager is to respond within 7 days to a complaint in writing.

Should more than 7 days be required to respond to the complaint, the Site Manager will advise the complainant of why additional time is required to address the issue and provide an approximate time frame to enable a response.

The complainant may request a meeting with the Site Manager to discuss the issue.

The Site Manager is to keep minutes of any such meeting and attach the minutes to the Complaint Register.

The Site Manager is to keep in contact with neighbours who are prepared to be contacted to ensure that if there have been any problems associated with the operation of the boarding house, that appropriate action has been taken and neighbours are to be provided the Manager’s 24 hour contact phone number,

19. Pets

No pets are to be allowed to be kept on the property at any time.

20. Maintenance & Cleaning

The common areas and common room are to be professionally cleaned by a contractor once per week (arranged by the Site Manager).

The Site Manager is to organise for a gardener to maintain the outdoor common areas and gardens and ensure that they are adequately watered and that the lawns are cut regularly.

The Site Manager will also be responsible for periodic inspections (at least once a month) of the property to ensure that the common areas and boarding rooms are all clean and maintained to a high standard.

Cleaning of the boarding rooms will be the sole responsibility of each resident.

Building maintenance and repairs are to occur when required. Light fittings, appliances and the like will be checked and replaced as required, by the On-site Manager.

Pest control by a professional contractor is to be carried out at least once a year to protect against vermin.

21. Noise

Recorded and/or amplified music is permissible indoors between 7:00am and 10:00pm, 7 days a week. Residents must not play loud after 10:00pm at night and before 7:00am in the morning.

Residents must respect the other resident’s peaceful enjoyment of the premises, including surrounding neighbours.

The tenancy agreement will be terminated if this clause is breached three (3) times.

22. Review of Plan of Management

The PoM (including House Rules) will be reviewed on an annual basis, with the review to be completed prior to the 30th June of each year.

The Site Manager is to be responsible for overseeing each annual review and amending the PoM, if necessary.

Modification to the PoM must be consistent with the conditions of the Development Consent and council guidelines.

Any modification that is not consistent with the original Development Consent, must be first approved by council through a Section 96 modification application.

Once modified (and approved by council if necessary), the Site Manager is to provide an updated copy of the PoM to all residents.

Attachment 1 House Rules

Resident and visitor behaviour

Residents and their visitors must not interfere with the reasonable peace, comfort and privacy of other residents and neighbouring properties.

Residents must not demonstrate any anti-social behaviour, such as slamming doors, using abusive language or the like.

If house rules are not followed, a formal warning will be provided. On receipt of two formal warnings, a resident will be provided with a formal notification to evict the property. However, if illegal behaviour is exhibited (use of drugs etc), a resident will be evited immediately.

No violent or threatening behaviour/actions towards other residents or neighbours will be tolerated.

Residents and/or their visitors will be asked to leave the premises immediately and the Police will be called if violent behaviour is exhibited.

All common areas and the car park will be kept under surveillance.

Smoking Smoking is not permitted within any internal areas of the boarding house, including boarding rooms and the internal common room. Smoking is only permitted in the designated outdoor common open space/communal area.

Signs will be provided to indicate where smoking is permitted and not permitted within areas of the boarding house.

Amplified and Live Music All residents are to ensure that music is to be of a volume which does not unreasonably impact on the amenity of other residents.

Recorded and/or amplified music is permissible indoors between 7:00am and 10:00pm, 7 days a week. Residents must not play loud after 10:00pm at night and before 7:00am in the morning.

Maintenance of rooms Residents must maintain their rooms: • in a clean and tidy manner • in a way which does not interfere with the reasonable

comfort of other residents • in a way which does not create a fire or health hazard.

Rooms will be inspected by the Site Manager every month. Rooms must be made available for inspection upon notice from the Site Manager.

Residents must not intentionally or recklessly damage or destroy any part of their rooms or a facility of the boarding house.

Damage to or breakdown of any facility, fixtures furniture or equipment must be reported to the On-Site Manager.

Visitors Residents must make sure their visitors are aware of, and follow, the House Rules and are responsible for the behaviour/actions of their visitors.

Visitors are not permitted in rooms of other residents.

No visitors are allowed into the boarding house before 7:00am and after 10:00pm.

Pets No pets are to be kept on the p[remises.

Garbage Garbage is to be enclosed in a plastic bag (tied at the top) and placed in the bins in the garbage area. No domestic rubbish, food scraps, food wrappers, goods or materials are to be left in the hallways, common areas or outside the boarding house.

Fire Safety Residents are to familiarise themselves with the fire safety and evacuation procedures located in the hallway and back of room doors, location of fire blankets and fire extinguishers.

Noise Noise is to be kept to a minimum at all times. Residents are to enter and leave the premises quietly.

Residents must not interfere with the peace and quiet of other residents and neighbours.

No loud noise is to occur after 10.00pm and not before 7.00am.

Noise and television volume must be kept to a reasonable volume. Other residents and neighbours must not be disturbed.

Parties are not permitted on these premises.

Security Outside doors of the premises is to be closed at all times.

Please do not let anyone in the premises who has no legitimate reason to be there.

Keys are not to be given or lent to non-residents.

Outdoor Common Areas The outdoor common areas will be available for use of the residents, at all times, between 7:00am and 9:00pm, 7 days a week.

Residents are to ensure the common areas are clean and tidy after use.

Indoor Common Areas The indoor communal areas will be available for use of residents at all times between 6:00am and 10:00pm, 7 days a week.

Alcohol/Drugs Alcohol and drugs are strictly prohibited from being consumed in the boarding house or in the public areas fronting the boarding house.

Illegal substances are not permitted on the premises. Any resident found to be supplying or in the possession of illegal substance will have their tenancy agreement immediately terminated.

Use of Rooms Rooms are to be used for residential purposes only.

Unauthorised occupants are not permitted to reside within the rooms.

No illegal activity of any kind may occur on the premises.

Attachment 3 Car Stacker Operation

Car Stacker

The car stacker is to be a WOHR Park Lift 461 system which is a stand-alone independent duplication platform. The system requires a pit that allows the removal of cars on the lower platform without moving the cars parked on the upper platform. The additional Capture Key safety feature means that the system will only operate with a person holding and turning key in position. The platform will also always ascend back into position without leaving cars in a parked overhead position.

The system has in-built safety features, such as additional electromagnetic sensors, level locking mechanical devices and audio warning system and push button board.

General Safety Regulations

A copy is to be kept next to the main control-push button control located on the back eastern wall of the garage.

A barrier is provided between the single car space and the stacker car space. An alarm system is activated when the dead man control button is pressed. Once a vehicle is driven into the garage the roller door will automatically close. An automatic safety barrier can be keyed into the Capture Key System and an infrared-red audio warning alarm system can detect any persons on or near the platform.

Operation Manual

A copy of the operating manual is to be available from the On-Site Manager.

Rules:

• Person must be over the age of 18 to operate. • It is forbidden to transport persons on the platform or in the vehicle

• Vehicle must be wholly on the platform profile • Do not leave the platform not aligned with the entry level.

Operating Instructions

Car Deposing (Parking) Person to drive onto the platform and park the vehicle wholly on the

platform Person to activate the hand break before disembarking the vehicle.

Person must disembark the vehicle. It is forbidden to transport people

Insert key activation. Person to press the operation push button which has a dead man control hold to

operate switch. Wait for floor projections to close and operation complete before exiting garage.

Car Pick-up

Insert key activation. Push the operation control

button. Wait till car arrives and system finishes

operation.

Pick up car from the platform.

Turn key activation to retrieve key .

Additional barrier systems can be installed to prevent persons walking onto the platform during operation.
