This Special Provision incorporates the Army Corps of Engineers (USACE) Section 404 Permit and the Sovereign Lands Permit obtained by Hettinger County for the structure replacement on 60th St SW in Hettinger County. The project as proposed includes aggregate surface course, grading, structure removal, two span bridge installation and incidentals.

The Contractor shall be responsible for complying with all the terms and conditions as contained in the permits attached hereto. Bidders shall become familiar with all standard conditions and special conditions of the permits and submit their bid for the construction of this project based on the following:

• USACE Section 404 Permit USACE Permit NWO-2017-00272-BIS authorizes replacement of the existing structure with a two span bridge. The 404 Permit is attached.

• Sovereign Lands Permit The North Dakota Office of the State Engineer authorizes replacement of the existing structure with a two span bridge. The Sovereign Lands Permit is attached.

The contractor shall be responsible for obtaining permits for impacts not authorized by the attached USACE 404 Permit and Sovereign Lands Permit obtained by Hettinger County.

Anapproximate 3O-foot-wide, 13O-foot-long section of river bed and banks under the bridge will be stabilizedafter excavation with approximately 484 square yards of geosynthetic material under 484 cubic yards ofgrade II riprap.

Project Description:

The Permittee is hereby authorized to remove and replace the existing bridge (Project) overthe Cannonball River on 60th Street SW in Hettinger Counfy.

The Project will involve the removal of an existing 3-span bridge and the installation of a129-foot concrete 2-span bridge using a temporary sheet pile cofferdam for pier construction.Temporary erosion control floatation silt curtains will be installed downstream of theconstruction area. Removal of the existing bridge will involve sectional removal from theroadbed within the existing right-of-way. Earthwork will include approximately L68 cubicyards of excavation from the river bed and banks to achieve a 2zl bank slope. Anapproximate 30-foot-wideo L30-foot-long section of river bed and banks under the bridge willne stafinzed after excavation with approximately 484 square yards of geosynthetic materialunder 484 cubic yards of grade II riprap.

Any other use of sovereign land is prohibited. Any proposed additional use must.comply with the

application and permitting process and all other requirements of state law.

General Conditions

1. Authorization of this undertaking is a privileged use of a public resource and does notconstitute a property right. The public use and enjoyment of the Cannonball River is of highpriority.

2. All construction, maintenance, and reclamation activities shall be carried out in a mannerreasonably designed to prevent degradation of the Cannonball River.

3. The Permittee must comply with all state regulations with regard to the prevention ofintroduction of Aquatic Nuisance Species (ANS) into the state's waters. The Permittee mustcontact the North Dakota Game and Fish Department at (701) 328-6300 to schedule an

inspection of all vehicles and equipment a minimum of 72 hours prior to those items beinglaunched or placed in the Cannonball River.

4. The Permittee must implement measures to minimize the opportunity for sediment to enter the

Cannonball River during construction.

5. The Permittee must obtain a Construction General Permit (CGP) from the North DakotaDepartment of Health.

6. No work is to be conducted within the Cannonball River from April 15 to June 1 to protectfisheries resources.

7. The Permittee must comply with the North Dakota Department of Health's Construction andEnv ir onme nt al D i s tur b anc e Re quir e m e nt s (copy attached).

8. Prior to or during construction, if items of substantial archeological value are discovered or adeposit of such items is disturbed, the Permittee must cease construction activities in the area

so-affected. The State Engineer and the State Historical Preservation Office must be promptlynotified of the discovery, and construction will not resume until both offices give writtenpermission.

g. This Autho rizationis site specific for the project as proposed and outlined in the applicationand supporting documents. Any changes or deviation from the site or design will need

authorization from the State Engineer.

10. At the discretion of the State Engineer, in accordance with the exercise of any of the State

Engineer's duties, the project is subject to modification or removal at the expense of thePermittee.

11. The State Engineer or the State Engineer's representative must have access to inspect theauthorized project during construction and associated activities and for the life of the projectto ensure that it is being or has been accomplished and maintained in accordance with the termsand conditions of this Authorization.

12. The Permittee must obtain any other local, state, or federal permits or approvals that may be

necessary prior to construction.

13. By granting this Authorization no liability for damages of any kind, including those caused byimpioper c-onstruction, operation and maintenance, design or failure in design, materials, orworkmanship, is assumed by or transferred to the State of North Dakota, the State Engineer,the State Water Commission or any of their respective employees, agents, or assigns. ThePermittee will indemniff and hold harmless the State ofNorth Dakota, its officials, employees'agents, boards, commiisions, and assigns for any and all liability for work performed and

action taken under this Authorization.

Soils

prevent the erosion of exposed soil surfaces and trapping sediments being transported.Examples include, but are not restricted to, sediment dams or berms, diversion dikes,hay bales as erosion checks, riprap, mesh or burlap blankets to hold soil duringconstruction, and immediately establishing vegetative cover on disturbed areas afterconstruction is completed. Fragile and sensitive areas such as wetlands, riparianzones, delicate flora, or land reiources will be protected against compaction, vegetationloss, and unnecessary damage.

Surface Waters

All construction which directly or indirectly impacts aquatic systems will be managed tominimize impacts. All attempts will be made to prevent the contamination of water atconstruction sites from fuel spillage, lubricants, and chemicals, by following safe storageand handling procedures. Stream bank and stream bed disturbances will be controlledto minimize and/or prevent silt movement, nutrient upsurges, plant dislocation, and anyphysical, chemical, or biological disruption. The use of pesticides or herbicides in orneir these systems is forbidden without approval from this Department.

Fill Material

Any fill material placed below the high water mark must be free of top soils,deiomposable materials, and persistent synthetic organic compounds (in toxicconcentrations). This includes, but is not limited to, asphalt, tires, treated lumber, and

construction debris. The Department may require testing of fill materials. All temporaryfills must be removed. Debris and solid wastes will be removed from the site and theimpacted areas restored as nearly as possible to the original condition.

Dear Ms. Persinger:

Thank you for the opportunity to review the above referenced application for compliance with theStandards of Quality for Waters of the State (standards). The North Dakota Department of Health(department) has reviewed the proposal to replace the 60th Street Bridge over the Cannonball River inHettinger County, North Dakota. Based on our review, the department has the followingrecommendations:

l) The contractor obtains a Construction General Permit from the department and follows allrequirements.

2) If during construction channel bed or river bed material is excavated or dredged it should theaccomplished in a manner that prevents runoff of water or sediments back into the river.Additionally, material from the streambed below the ordinary high-water mark should not beplaced back into the river. [t can however be used for fill in areas without potential to drain backinto the river or drain.

3) If a spill of fuels, lubricants, antifreeze, hydraulic fluids, peffoleum products, and hazardousand/or potentially hazardous materials occurs during construction submit an environmentalincident report at http : //www. ndhealth. gov/ehs/eir /Eirform. htm.

4) When working in the Cannonball River or an area likely to drain into the river, develop a secureupland staging area or areas for the storage of equipment, fuel, petroleum products, andhazardous materials when not in use. The staging area(s) are to be located at or constructed insuch a way that a spill will not enter the river.

5) When working in the river or its bank have sufficient containment materials on site to addresslikely spills.

6) Prior to allowing any equipment to work in the river or the river bank inspect it for oil, gas,diesel, antifreeze, hydraulic fluid, and other petroleum leaks. Properly repair all such leaks, andclean equipment prior to allowing it on the site.

7) Clean and inspect all equipment, temporary bridge materials, watercraft, barges, and tools beforeand after use for Aquatic Nuisance Species (ANS).

8) Remove and dispose of, or store at an upland site any vegetation, debris, or other organic riverbank material removed during construction of the diversion structure, such that it cannot reenterthe river during high water or precipitation eyents. Wetland and river bank soils from above theordinary high-water mark may be reused.

9) All exposed riparian areas should be revegetated with native species immediately followingcompletion of work.

10) Protect upland, riparian, and adjacent vegetation, except where it is being removed.

The department reserves the right to review and amend this opinion if it becomes apparent that theconditions no longer provide reasonable assurances of standards compliance, or alternatives are proposedthat meet the goal of the standards.
