Standard Minimum Service on Public Worksand Space Layout

Early 2014, inFebruary, theRegulation of theMinister of PublicWorks Number01/PRT/M/2014 onStandard MinimumService on Public Works and Space Layout (SPM) waspromulgated. SPM means the terms on the type and qualityof basic services on public works and space layout

constituting obligatory affairs of the region that everyindividual has the right to obtain. This regulation revokesthe previous regulation of 2010.

Provincial region The provincial government shall provide 4 types of basicservice on public works and space layout. The basic serviceswill be implemented in phases with deadline ofaccomplishment up to 2019. The 4 types of basic serviceare, (i) water resources, supply of standard water for thepeople’s need, (ii) roads, provision of roads to serve thepeople’s need, (iii) construction service, development ofinformation system on construction service, (iv) spacelayout, information on space layout. The SPM will beimplemented in phases with deadline of accomplishment inthe year of 2019. The Governor is responsible to implementSPM in provincial region.

Indefinite Term Employment Agreement

Under Article 56 of Law Number 13 of 2003 onEmployment (“Law No.13/2003”), there are two types ofemployment agreements, namely the employment agreementfor definite term employment agreement and indefinite termemployment agreement (“PKWTT”).

Employment Relation

Article 51 of Law No.13/2003 regulates that employmentagreement can be made orally or in writing. If it is madeorally, the employer is obliged to issue a letter ofappointment for the worker. The mentioned letter ofappointment letter shall at least contain information on (i) thename and address of the worker, (ii) the date the workerstarts to work, (iii) the type of job that the worker issupposed to do and (iv) the amount of wages that theworker is entitled to.

Under Article 54 paragraph (1) of Law No.13/2003, awritten employment agreement shall at least contain:

Provisions on Mandatory Report onEmployment

Law Number 7 of1989 on MandatoryReport onEmployment in theCompany (“LawNo.7/1981”)requires anyentrepreneur ormanagement to report in writing any establishment,discontinuance, recommencement, assignment or dissolutionof the company to the minister or the competent authority.

Under Article 1 letter (b) of Law No.7/1981 entrepreneurmeans:

1. an individual, a partnership or a legal body that runsa self-owned business;

2. an individual, a partnership or a legal body thatindependently runs a business is not owned by them;

3. an individual, a partnership or a legal body that isdomiciled in Indonesia but represents a business as setout in number 1 and number 2 above.

The management is defined as the person who is appointedto lead a company.

Article 6 of Law No.7/1981 stipulates that entrepreneur orthe management shall report in writing to the appointedminister or competent authority at the latest 30 (thirty) daysafter establishment, recommencement or transfer of thecompany. Under Article 2 of Ministry of Employment andTransmigration Regulation Number PER.14/MEN/IV/2006on the Mechanism of Employment Report in the Company(“MOMT No.14/2006”), entrepreneur is required to preparean employment report in accordance with the actualcondition whether it is in the head office, branch office orthe independent part of the company.
