This planning application relates only to land within the applicants ownership (Jenners Basin). I attach a copy of Jenners Basin and the River Bed Title Plan for your use. Norwich city council own the river bed but I couldn't see anything within the red line which would be owned by the council and therefore their objection is misguided. Arguably NCC as the owners of the river bed *could* accuse someone of trespass for mooring over their river bed but that is an incredibly dangerous precedent to pursue. In any event this wouldn't be a planning issue, it would be a civil issue and one for the council to pursue with the applicant/boat landowner should someone choose to moor boats alongside the river. If such a position was taken, this should be applied consistently as there is no evidence that such action is intended or has been taken against any other riverside site owner - which would include the houses and pubs at thorpe, and boatyards. Finally, I am advised that riparian rights are not something which the NCC would be able to grant to a landowner. Owners of riverside land have riparian rights and responsibilities as a matter of law, and one of these is an obligation to keep their riverbank in good repair. So one could argue that the applicant would be in breach of his riparian responsibilities if he allowed the quayheading to collapse into the river. I trust the above is sufficient and will allow the application to proceed without further delay.
