PHO Narrative

Arizona Housing, Inc., a 501c3 non-profit organization, (AHI) is requesting PHO hearing to remove the stipulation imposed during the rezoning of the property in 1978.

STIPULATION

• …subject to the stipulation that a maximum of 80 units be constructed

Rationale: The removal of this stipulation will allow the addition of 36 affordable studio apartments to the existing 80-unit complex which already operates as a permanent affordable supportive housing facility under the oversight of the City of Phoenix Housing Department. The supportive services currently on the property has the capacity to serve additional residents.

The project has been through the pre-application process, been under design and extensive efforts have been made to procure funding for over 2 years. Not until a zoning confirmation letter for the ADOH Funding Application was submitted to the city did it become revealed that a 1978 stipulation existed limiting the number of units on the site to 80. The project at that time was an extended stay motel, and the hypothesis is that the stipulation was crafted for that specific project. The use as well as the profound community benefit has evolved 42 years later, and thus the applicant kindly requests the stipulation to be removed for this fact alone. Collins Court has never had any neighborhood concern regarding the current operations or future plans.

Arizona Housing, Inc. also notes that the City of Phoenix Housing Department is in favor of the proposed expansion.

Background on AHI

In late 2010, the City of Phoenix Housing Department provided funding to AHI to purchase a blighted foreclosed extended stay motel at 10421 North 33rd Avenue with federal funds to create 80 units of permanent affordable supportive housing in a long-term partnership with Arizona Housing, Inc., a non-profit organization. To AHI’s knowledge there was no disclosure of the 1978 stipulation provided during this transaction nor during subsequent work on the project.

In late 2012, after extensive renovations, the property was re-opened as Collins Court Apartments and has provided formerly homeless and/or disadvantaged individuals with a clean, safe and affordable place to call home. The tenants at Collins Court Apartments are unique in that their income must be at or below 50% of the Area Median Income as defined by HUD and the City of Phoenix Housing Department.

Arizona Housing, Inc., a 501c3 non-profit organization, has been in operation twenty-four hours a day, 365 days a year, since 1995 and currently owns and operates 533 permanent affordable supportive housing apartments in Phoenix, AZ.

Application No.: 116-78 Applicant: C. Michael Pierce (Owner: Josam Investment Company) Subject: To rezone the northeast side of 33rd Avenue and Cochise

(approximately 2.45 acres) from R-4 to R-4A. The granting of this application will increase the number of dwelling units allowed on this parcel from 71 to 107, approximately.

Mr. Atonna read the staff r.ecommendation which was for approval wi'th stipu-' ·lations. There are no right of way needs for this property. A letter had. been received from the Deer Valley Planning Committee recommending denial of this application.

Mr. Michael Pierce spoke representing the owner of the property. He ex­plained the City Council had recommended approval of R-4 zoning for a motel on this property in October of 197~. The staff report at that time showed 90 units being allowable; the application and site plan depicted 80 units; the project engineer computed 90 allowable units. When the applicant filed for building permits, it was discovered the site actually only permitted 71 units. This would result in a 13% deferentiation in the financial outlay to build the motel which had the same overhead costs. This application would correct an error made at that original hearing. The plan being presented was the same one presented on the first application; nothing had changed.

Mr. Pierce thought that unless the Commission did not remember would not make. an extensive presentation since it would be the before, and which was approved by both Commission and Council. in agreement with staff's suggested stipulation.

There was no one present to speak in favor of this application. Mr. Charles Michaels, Chairman of the Deer Valley Planning Comm1ttee, spoke in opposition. He stated this application had been considered at their meeting of June 1, 1978 and unanimously recommended denial. The committee had opposed this application as originally filed 'and continued in that opposition.

I Mr. Kennelly refreshed everyone's memory regarding this application. It had originally been denied by the Commission, but approved by Council for 80 units. The request now was to grant the additional units needed to make that amount. He asked Mr. Michaels if this situation altered the committee's feelings. Mr. Michaels stated that the additional units did not make them favor the change.

Mr. Bendalin asked if this should be treated as a new application or did the fact that the applicant already had a zone and wished to increase the number by 9 make it different. Mr. Atonna stated this was a totally new zone, tec.h­nically. Staff had originally opposed this application, however, now that the policy had been set by Council, they felt 9 units should not be quibbled over.

Mr. Pierce stated there was a petition available from the owners surrounding

Mrs. Roberts made a MOTION to forward application 116-78 to the City Council with a recommendation for approval subject to the stipulation suggested by staff.

Mr. Jackson SECONDED the motion.

There was no discussion of the motion. Mr. Kennelly called for a vote and the MOTION PASSED unanimously.
