    May it please your honours:

    This complaint petition is being filed on behalf Indu Rani, W/O Srikant Singh, Devi Sthan,

    Dhangawan, Jehanabad, Bihar (804408) referred hereafter as Complainant, and is as follows:

    1. That this complaint Petition is being filed under Sec. 2 (1)(b)(i) and Section -11 of theConsumer Protection Act.

    2. That the opposite party is a manager of branch of Punjab National Bank in Jehanabad.3. That the complainants are regular consumers of the Punjab National Bank and have a

    joint saving account (Account No- 0228000100219986). The Complainant No-2 also has

    a pension account in the said branch (Account No- 0228000300225963).

    4. That on dated 26/12/2012, when the Complainant No-2 came to Punjab National Bank,Jehanabad to withdraw money through cheque from his account(0228000100219986)

    then it was told that his account has been seized by the Branch Manager of the Bank i.e.

    Opposite Party. It was advised to the Complainant No-2 to meet Opposite Party but

    opposite party was absent on that day. It was also informed that a loan of about Rs. 5000

    (Loan P.C.- 14602) issued in year 2001, is due to Complainant No-1.

    5. That on next day i.e. 29 December 2012 (Saturday), the Complainant No-1 with his soncame to meet Opposite Party but he told the Complainant No-1 to wait till his return. The

    Complainant No-1 and his son waited in the bank for till 3 pm then return back.

    6. That on dated 31 December 2012 i.e. Monday, again Complainant No-2 came to meet theopposite party. Then, opposite party forcefully transacted Rs. 19700 from Complainants

    account (Account No- 0228000100219986) to Loan P.C- 14602.

    7. That on same day, Complainant No 2 came with his son to discuss the problem. Whenthey demand the details of loan, opposite party refused to show any detail or did not

    provide any details of loan. Then opposite party discover imaginary nexus with a Fixed

    Deposit of Complainant No-1 and told it as a loan security. Although, the Bank computer

    does not provide any such nexus with the loan and the said fixed deposit.

    8. Then the complainant no-2 and his son demanded the written account book of said fixeddeposit. The document clearly show that a lien has been created on the fixed deposit in

    year 2001 and successfully cleared in year 2002 and the said fixed deposit has been

    renewed in 2002.

    9. That even after this, the opposite party refuse offset the loan claim. He called thecomplainant no 2 again tomorrow and said that he will call the employee who had made

    the fixed deposit entry in written account book.

    10.That on next day dated 1/01/2013, as per the meeting scheduled the complainant no 2 andhis son come to opposite party. The opposite party neither call the employee nor offset the

    claim. He said that you have taken the loan and you have to pay it. When the complainant

    no 2 and his insist. The opposite party start shouting and question the complainant and his

    son identity and character. When the complainant and his son objected then he called

    other employees and bank guard of bank and assaulted, insulted and forcedly throws out

    of the Punjab National Bank, Jehanabad.

    11.That in support of the above averments and claims, following documents has beenenclosed along with the complaint-

    1. A photo copy of Joint Saving Account Fund Pass Book as Annexure No- 12. A photo copy of Pension Account Fund Pass Book as Annexure No- 23. A photo copy of cheque dated 26/12/2012 as Annexure No- 3

    12.That in support of rest of the averments and claims, the documents is in possession ofopposite party.

    PRAYER

    In view of the submissions contained in the preceding paragraphs, the complainant most

    respectfully prays to the Hon'ble Forum to direct the Opposite Parties to:

    Refund the money i.e. Rs. 19700 transact from the account( Account No-0228000100219986) of complainants along with 18 % interest ;

    pay a sum of Rs. 500,000/- towards the physical strain and mental agony suffered bythe complainant and his family members (compensation) ; and

    pay a sum of Rs. 10,000/- towards cost of this petition (Cost) ;For which act of kindness, the complainant shall, as is duty bound, ever pray.
