Jagdishpur-Haldia-Bokaro-Dhamra NG PL (JHBDPL) Tariff

1. GAIL has submitted its Tariff Filing for the subject Natural Gas Pipeline System.

2. On 17.10.2018, PNGRB webhosted the Public Consultation Document (PCD) solicitingcomments from interested stakeholders.

3. By 02.11.2018, Five (05) entities i.e. M/s IOCL, H-Energy, GSPL, EWPL and ONGC havesubmitted their comments.

4. On 12.11.2018, GAIL submitted its response to PNGRB.

5. All the comments and the responses have been web-hosted by PNGRB.

6. Comments by stakeholders and GAIL’s replies for the same are presented point-wise fordiscussions during this Open-house meeting.

Unaccounted GasStakeholder Comments GAIL’s Response

IOCL

In current regulations, Unaccounted Gas (UAG) loss isnot considered for Tariff calculations. So GAIL’s claimmay be reviewed.

H-Energy

Tariff Regulations provide for consideration of onlySystem Use Gas (SUG). Hence, Unaccounted Gas loss tobe excluded.

EWPL

Considering nature of business, Unaccounted for Gas isa practical reality. Hence may be allowed with certainnormative cap.

• Due to inherent inaccuracies between custody meters atentry and exit points, some unaccounted- for-gas isinevitable.

• Practically, all gas pipeline entities in India have seen actualannual unaccounted gas loss gas in the past years, whichon an average range between 0.1% to 0.3%. Individualpipelines have even seen UGL of upto 0.93% (AGCL)

• Typically entry points are limited in number and they havebulk and steady flow rates. But exit points are numerous innumber and they have dynamic and fluctuating flow rates,particularly more so in the case of CGDs. Therefore, withmore and more CGDs getting added to the system, actualunaccounted gas may further go up in future.

• Therefore, GAIL has consistently submitted for a 0.3%normative unaccounted gas loss for all the gas pipelines inthe country.

Number of Working DaysStakeholder Comments GAIL’s Response

IOCL & H-Energy

Regulation 14(3) of Access Code Regulations providethat planned maintenance should not exceed 10 daysin a year.

Therefore, number of working days submitted by GAILmay be reviewed and considered in accordance withextant regulatory provisions.

• While Access Code Regulations specify a cap of 10 daysfor Pipeline’s planned maintenance, there is no regulatorycap for other connected (i.e. Source/Customer) facilities.

• In PNGRB Tariff Regulations, there is no specific regulationthat has prescribed the number of operating days of anatural gas pipeline as 355 for tariff calculation purpose.

• In this regard, GAIL has always been submitting that, it isreasonable to take into account maintenance works ofother upstream/downstream facilities connected to apipeline (LNG facilities, Fertilizer Plants, Power Plants, LPGPlants etc.), which may independently occur as per theirrespective maintenance schedules. In fact, variousdownstream customers connected to GAIL’s pipelineshave taken annual planned shutdowns ranging from10 days to even 55 days.

• In view of the same, and in line with past practices, areasonable total 20 days (10 days for pipeline and 10 daysfor all other connected facilities) has been considered byGAIL as totally allowable maintenance period in the tariffcalculations

H-Energy

WPI Inflation rate @ 4.12% for Q2 2018 - Q2 2019 asper the 54th round of Report of ProfessionalForecasters should be allowed for escalating futureCAPEX/OPEX.

IOCL

PNGRB has been following inflation @4.5 % forescalating Opex. The same may be taken here also.

• GAIL has considered inflation rate based on long termCAGR for WPI as published by GoI.

• RBI disclaimer on the Professional Forecasters reportstates that “The results presented here represent theviews of the respondent forecasters and in no wayreflect the views or forecasts of the Reserve Bank”.

Economic Life – Capex, Line Pack; Opex Stakeholder Comments GAIL’s Response

H-Energy

• In line with regulatory definition givenunder PNGRB Authorization Regulations,applicable Economic Life for JHBDPL to beconsidered from the date ofcommencement of physical activities.

• Capex and Line Pack to be consideredaccordingly. Actual Capex from FY 2015-16 to FY 2017-18 doesn’t match with CACertificate.

• PNGRB may review Line Pack consideredby the entity and the price used for LinePack calculation.

• Percentage breakups for consideringOpex as 2.5% of CAPEX need to besupported by CA certified historical data.

IOCL

• Basis of line pack quantity not explained.

• In PNGRB Tariff Regulations, in the prescribed formats for thepurpose of calculation of tariffs, the Economic Life is specified for25 years after the 3-year construction period of pipeline.

• That is, as per Attachment 1(g), 1(h) & 1(i) of Schedule A ofPNGRB Tariff Determination Regulations, the Economic Life of apipeline is given as 25 years starting from the commissioning ofthe pipeline.

• Accordingly, PNGRB has also consistently taken thecommencement of Economic Life period from the commissioningdate only for all the pipelines for which tariffs are determinedand fixed under Tariff Regulations. The same is adopted by GAILin this tariff filing also from expected date of commissioning.

• Thus Capex and Line Pack are considered as per aforesaidEconomic Life only. Capex as per CA certificate is correct.

• Quantity is estimated based on the simulation in TG-NetSoftware used for Capacity Determination as per theRegulations. Gas price is based on gas tie-up made by GAIL

• The Opex figure considered are based on GAIL’s past experienceof operating various cross-country pipelines.

Volume Divisor (Increase in length without increase in capacity)

GSPL

• Capacity of originally planned JHPL in 2007 is16MMSCMD.

• Subsequently Bokaro to Dhamra and Barauni toGuwahati lines have been included. GSPLbelieves inclusion of these pipelines shall lead tocapacity expansion of JHPL.

• There is a non-determination / non-availability ofincrease in capacity due to addition of such trunkpipelines.

• So Capex/Opex of pipeline of approx. 2416 km isto be excluded for Tariff Determination of JHPL,in line with GSPL Tariff Order which has excludedCapex/Opex of its compressors.

• JHBDPL capacity of 16 MMSCMD is estimated based onCapacity Determination Regulations.

• Estimation of the capacity is based on sources atPhulpur, Dhamra and the anticipated consumer profile.

• Linking capacity with pipeline length is incorrect.

• Comparison with some other pipeline system may notbe proper.

Volume Divisor and Capacity DeterminationStakeholder Comments GAIL’s Response

IOCL

• Volume divisor not computed as per Regulations.

• Volume divisor should be calculated byconsidering authorized provisional capacity of 16MMSCMD.

• Capacity determination exercise may be taken upimmediately after project commissioning.

H-Energy

• PNGRB may determine and approve the finalcapacity for JHBDPL first before proceedingtowards tariff determination.

• Sl.9 of Attachment 1(j) of Schedule A of PNGRB Tariff Regulations states that “Implementation period of the Project in Phases to be provided”. Tariff Regulations identifies commissioning in phases.

• PNGRB’s letter no. INFRA/NGPL/124/GAIL/JHBDPL/01/18 dated 29.01.2018 acknowledges two phases for the pipeline.

• CAPEX and OPEX along with corresponding VolumeDivisor considered in Phases for submission.

• Capacity to be determined by PNGRB as per the extantRegulations.

• Connectivity of JHBDPL to ONGC’s CBM blocks tobe ensured.

• Proposed Capex of Barauni – Guwahati section is Rs2,900 Crores is without inflation. PCD figure ofRs.3277.27 Crores is including inflation @5.02%

• Pipeline system consists of pipeline and all otherassociated facilities viz. Metering, etc. Two pipeline evenof similar length would have different cost based on thevolume handled at terminal.

• It is based on estimated weighted average GCV of naturalgas which is likely to be transported.

• Would come under “Tie-in connectivity” . To be dealtwith under the applicable regulatory framework
