1.0 INTRODUCTION

1.1 OVERVIEW

This document, combined with the Draft Environmental Impact Report (DEIR), constitutes

the Final EIR for the Pomona Hyatt Place Hotel Project (Project). The DEIR describes

existing environmental conditions relevant to the proposal, evaluates the Project’s potential

environmental effects, and identifies mitigation measures to reduce or avoid the potentially

significant impacts. The DEIR was circulated for public review and comment from May 27

through July 12, 2016.

1.2 CONTENT AND FORMAT

Subsequent to this introductory Section 1.0, Section 2.0 of this Final EIR presents revisions

and errata corrections to the DEIR text. Responses to comments received on the DEIR are

presented at Final EIR Section 3.0. The EIR Mitigation Monitoring Program is presented at

Final EIR Section 4.0.

1.3 DRAFT EIR COMMENTORS

1.3.1 Overview

1.5 PROJECT SUMMARY The following information is summarized from the Project Description in the Draft EIR. For additional detail in regard to Project characteristics and Project-related improvements, along with analyses of the Project’s potential environmental impacts, please refer to Draft EIR Sections 3.0 and 4.0, respectively. 1.5.1 Project Location The Project is located within the Pomona Ranch Plaza (Plaza) in the City of Pomona. The Plaza comprises approximately 71 acres formed by the intersection of State Route 60 (SR-60), State Route 71 (SR-71), and Rio Rancho Road. Uses proposed by the Project would be constructed on approximately 14.88 acres located at the southerly limits of the Plaza site. With the exception of the Project site, the remainder of the Plaza is substantively developed with commercial/retail and office uses and associated parking fields. 1.5.2 Project Overview The proposed Pomona Hyatt Place Hotel Project (the Project), including all facilities proposed within the Project site, on- and off-site supporting improvements, and associated discretionary actions comprise the Project considered in this Environmental Impact Report (EIR). Primary uses proposed by the Project include:

• A 6-story, 200-room Hyatt Place/Hyatt House Hotel with conference facilities and supporting amenities totaling approximately 159,000 square feet; and

• A free-standing, 3-story office building totaling approximately 75,000 square feet.

1.5.3 Project Objectives The primary goal of the Project is the development of the subject site with a productive mix of hotel and office uses. Complementary objectives of the Project include the following:

• Implement land uses that are consistent with the City of Pomona General Plan land use and development density vision for the subject site;

• Support mobility goals and objectives by taking advantage of regional access

provided by adjacent SR-71 freeway and local access provided by Rio Rancho Road;

• Take advantage of the site’s visibility from adjacent SR-60 and SR-71 freeways;

• Develop the subject site with high-quality hotel uses offering a unique guest experience;

• Establish hotel and office uses that are compatible with, and complement, existing

uses within the Pomona Ranch Plaza;

• Attract and accommodate new and additional hotel and office development serving local and regional markets;

• Attract visitors, business travelers, meeting/convention activities, and office tenants

to the City of Pomona;

• Transition the Project site from its current unimproved/vacant state to a commercial development, with resulting new fiscal benefits to the City of Pomona. Benefits would include new sales/room tax revenues and increased property tax revenues.

• Implement employment-generating land uses that would create new jobs available to City residents.

1.5.4 Discretionary Actions

1.5.4.1 Lead Agency Discretionary Actions and Permits Requested decisions, or discretionary actions, necessary to realize the Project include, but may not be limited to the following:

• CEQA Compliance/EIR Certification. The City must certify the EIR prior to, or

concurrent with, any approval of the Project.

• Approval of a Tentative Parcel Map. The Project proposes a commercial parcel map that would create and/or reconfigure lots for development of the Project facilities. At the direction of the City, the Tentative Parcel Map may also dedicate necessary public rights-of-ways and establish easements.

• Approval of a Conditional Use Permit for the proposed hotel use, to include allowance for on-sale of alcohol ancillary to hotel bar/lounge/banquet activities. Please refer also to Municipal Code Section .580, Conditional Use Permits.

• Various City of Pomona construction, grading, and encroachment permits are required to allow implementation of the Project facilities.

1.5.4.2 Responsible and Trustee Agency Discretionary Actions, Permits, and Consultation

CEQA Guidelines Section 15124 also provides that requirements or potential requirements for “Other Permits and Approvals” should, to the extent known, be identified. Based on the current Project design concept, other permits necessary to realize the proposal will likely include, but are not limited to, the following:

• Tribal Resources consultation with requesting Tribes as provided for under AB 52, Gatto. Native Americans: California Environmental Quality Act;

• Permitting may be required by/through the Regional Water Quality Control Board (RWQCB) pursuant to requirements of the City’s National Pollutant Discharge Elimination System (NPDES) Permit;

• Permitting may be required by/through the South Coast Air Quality Management District (SCAQMD) for certain equipment or land uses that may be implemented within the Project area; and

• Various construction, grading, and encroachment permits allowing implementation

of the Project facilities.

2.0 REVISIONS AND ERRATA CORRECTIONS

2.1 INTRODUCTION

Based on the comments received on the Draft EIR (which are provided in full in Section

3.0 of this Final EIR), this Section presents revisions to the text of the Draft EIR. For text

corrections, additional text is identified by underlined text, while deletions are

indicated by strikeout font. All text revisions affecting mitigation measures have been

incorporated into the Mitigation Monitoring Program presented in Section 4.0 of this

Final EIR. Text changes are presented under the chapter or topical section of the Draft

EIR where they are located. The revisions and corrections provided here expand and

clarify analyses previously provided, and do not constitute substantive new

information. Conclusions of the Draft EIR are not affected by these revisions.

2.2 REVISIONS

2.2.1 Text Revisions to Draft EIR Section 4.7, Public Services

Consistent with comments provided by the Los Angeles County Fire Department, the

text at DEIR Section 4.7.2.1, Page 4.7-2 (excerpt following) is amended to reflect the

provided updated station information:

The LACoFD answered almost 360,000 over 380,000 emergency calls in

2014 2015, providing fire protection and emergency response services

within its approximately 2,300-square-mile service area.

There are 19 fire stations among the cities in Division VIII, 8 of which are located in Pomona; however, one of those stations, Fire Station 181, is an

administrative site with no responding resources.

located approximately 1.5 miles northeasterly of the Project site at 925 East

Lexington Avenue; and Station 181 at 590 South Park Avenue, adjacent to the Civic Center 184 located at 1980 West Orange Grove Avenue,

approximately 1.7 3.1 miles northwesterly of the Project site.

The text at DEIR Section 4.7.4.2, Page 4.7-7 (excerpt following) is also amended to reflect

the updated information.

The City of Pomona is served primarily by Battalion 15, which includes

seven six active fire stations; however, personnel and equipment from

stations within other nearby batallions could also be dispatched to

respond, if needed.

Two additional stations are located near the Project site: Station No. 185,

located approximately 1.5 miles northeasterly of the Project site at 925 East

Lexington Avenue; and Station 181 at 590 South Park Avenue, adjacent to

the Civic Center 184 located at 1980 West Orange Grove Avenue,

3.0 COMMENTS AND RESPONSES

3.1 INTRODUCTION

The following Section presents written comments received pursuant to public review of the

DEIR, and provides responses to those comments as required by California Code of

Regulations, title 14 (hereinafter, “State CEQA Guidelines”) Sections 15089, 15132, and 15088.

Specifically, CEQA Guidelines Section 15088, subd. (a) requires that: “[t]he lead agency . . .

evaluate comments on environmental issues received from persons who reviewed the draft

EIR and . . . prepare a written response. The lead agency shall respond to comments

received during the noticed comment period and any extensions and may respond to late

comments.” The 45-day comment period on the Draft EIR commenced on May 27, 2016

and concluded July 12, 2016.

In summary, the City’s written responses describe the disposition of significant

environmental issues raised and any revisions to the Draft EIR made as a result of the

comments. Additionally, the City’s written responses provide a good faith, reasoned

analysis of all environmental issues raised and cite to specific factual and legal support for

the Draft EIR’s conclusions.

3.1.1 Comments Received

The following Section presents a list of the comment letters received during the Draft EIR

public review period. Comment letters have been generally organized by state agencies;

county, city, and local agencies; utilities; and local organizations and individuals. Each

letter has been assigned an identifying designation (generally an acronym or name

abbreviation), and topical items within each letter have been numbered. Table 3-1 lists all

Comment LAFD-1 The Notice of Availability of a Draft Environmental Impact Report has been reviewed by the Planning Division, Land Development Unit, Forestry Division, and Health Hazardous Materials Division of the County of Los Angeles Fire Department. The following are their comments: Response LAFD-1 The Lead Agency appreciates the Los Angeles County Fire Department comment and input on the Draft EIR. Comment LAFD-2 PLANNING DIVISION: 1. Under PUBLIC SERVICES, Fire Protection Services, we have the following corrections/updates:

Paragraph 1, the second sentence should be updated to state that LACoFD answered over 380,000 emergency calls in 2015.

Paragraph 2, the second sentence should be corrected to state that while there are 19 fire stations in Division VIII, eight of which are located in Pomona, one of those stations, Fire Station 181, is an administrative site with no responding resources. Sentence six should be corrected to state that Fire Station 184 located at 1980 West Orange Grove, approximately 3.1 miles north of the project site, is the second of the two closest responding stations, not Station 181.

Impact Analysis: Paragraph 1, sentence four should be corrected to state that Battalion 15 has six active fire stations.

The commentor provides current station information and corrects information presented in the DEIR. Current station information is noted and DEIR Section 4.7.2.1, Page 4.7-2 (excerpt following) is amended accordingly.

Comment LAFD-3 LAND DEVELOPMENT UNIT: The Land Development Unit is reviewing the proposed “Pomona Hyatt Place Hotel Project” for access and water system requirements. The Land Development Unit comments are only general requirements. Specific fire and life safety requirements will be addressed during the review for building and fire plan check phases. There may be additional requirements during this time. The development of this project must comply with all applicable code and ordinance requirements for construction, access, water mains, fire flows, and fire hydrants. Access Requirements 1. The proposed development will require multiple ingress/egress access for the circulation of traffic

and emergency response issues. 2. All on-site Fire Department’s vehicular access roads shall be labeled as “Private Driveway and

Fire Lane” on the site plan along with the widths clearly depicted on the plan. Labeling is necessary to assure the access availability for Fire Department use. The designation allows for appropriate signage prohibiting parking.

a. The Fire Apparatus Access Road shall be cross-hatch on the site plan with the width clearly noted on the plan. 3. Every building constructed shall be accessible to Fire Department apparatus by way of access

roadways with an all-weather surface of not less than the prescribed width. The roadway shall be extended to within 150 feet of all portions of the exterior walls when measured by an unobstructed route around the exterior of the building.

4. Fire Apparatus Access Roads must be installed and maintained in a serviceable manner prior to and during the time of construction.

5. The edge of the Fire Apparatus Access Road shall be located a minimum of 5 feet from the building or any projections there from.

6. The Fire Apparatus Access Roads and designated fire lanes shall be measured from flow line to flow line.

7. The dimensions of the approved Fire Apparatus Access Roads shall be maintained as originally approved by the fire code official.

8. Provide a minimum unobstructed width of 28 feet exclusive of shoulders and an unobstructed vertical clearance “clear to sky” Fire Department’s vehicular access to within 150 feet of all portions of the exterior walls of the first story of the building as measured by an approved route around the exterior of the building when the height of the building above the lowest level of the Fire Department's vehicular access road is more than 30 feet high or the building is more than three stories. The access roadway shall be located a minimum of 15 feet and a maximum of 30 feet from the building and shall be positioned parallel to one entire side of the building. The side of the building on which the aerial fire apparatus access road is positioned shall be approved by the fire code official.

9. If the Fire Apparatus Access Road is separated by island, provide a minimum unobstructed width of 20 feet exclusive of shoulders and an unobstructed vertical clearance “clear to sky” Fire Department’s vehicular access to within 150 feet of all portions of the exterior walls of the first story of the building as measured by an approved route around the exterior of the building.

10. Dead-end Fire Apparatus Access Roads in excess of 150 feet in length shall be provided with an approved Fire Department turnaround. Include the dimensions of the turnaround with the orientation of the turnaround shall be properly placed in the direction of travel of the access roadway.

11. Fire Department Access Roads shall be provided with a 32 foot centerline turning radius. Indicate the centerline, inside, and outside turning radii for each change in direction on the site plan.

12. Fire Apparatus Access Roads shall be designed and maintained to support the imposed load of fire apparatus weighing 75,000 pounds and shall be surfaced so as to provide all-weather driving capabilities. Fire apparatus access roads having a grade of 10 percent or greater shall have a paved or concrete surface.

13. Provide approved signs or other approved notices or markings that include the words “NO PARKING- FIRE LANE”. Signs shall have a minimum dimension of 12 inches wide by 18 inches high and have red letters on a white reflective background. Signs shall be provided for fire apparatus access roads, to clearly indicate the entrance to such road or prohibit the obstruction thereof and at intervals as required by the Fire Inspector.

14. A minimum 5 foot wide approved firefighter access walkway leading from the Fire Department Access Road to all required openings in the building’s exterior walls shall be provided for firefighting and rescue purposes. Clearly identify firefighter walkway access routes on the site plan. Indicate the slope and walking surface material. Clearly show the required width on the site plan.

15. Fire Apparatus Access Roads shall not be obstructed in any manner including by the parking of vehicles or the use of traffic calming devices including but not limited to, speed bumps, or speed humps. The minimum widths and clearances established in Fire Code Section 503.2.1 shall be maintained at all times.

16. Traffic Calming Devices including but not limited to, speed bumps, and speed humps shall be prohibited unless approved by the fire code official.

17. Security barriers, visual screen barriers, or other obstructions shall not be installed on the roof of any building in such a manner as to obstruct firefighter access or egress in the event of fire or other emergency. Parapets shall not exceed 48 inches from the top of the parapet to the roof surface on more than two sides. Clearly indicate the height of all parapets in a section view.

18. Approved building address numbers, building numbers, or approved building identification shall be provided and maintained so as to be plainly visible and legible from the street fronting the property. The numbers shall contrast with their background, be Arabic numerals or alphabet letters, and be a minimum of 4 inches high with a minimum stroke width of 0.5 inch.

19. Commercial buildings having entrances to individual units not visible from the street or road shall have unit numbers displayed in groups for all units within each structure. Such numbers may be grouped on the wall of the structure or mounted on a post independent of the structure and shall be positioned to be plainly visible from the street or road as required by Fire Code 505.3 and in accordance with Fire Code 505.1.

Water System Requirements 1. All fire hydrants shall measure 6”x 4”x 2-1/2” brass or bronze, conforming to current AWWA

standard C503 or approved equal and shall be installed in accordance with the County of Los Angeles Fire Department Regulation 8.

2. The development may require fire flows up to 8,000 gallons per minute at 20 pounds per square inch residual pressure for up to a five-hour duration. Final fire flows will be based on the size of buildings, the installation of an automatic fire sprinkler system, and type(s) of construction used.

3. The fire hydrant spacing shall be every 300 feet for both the public and the onsite hydrants. The fire hydrants shall meet the following requirements:

a. No portion of lot frontage shall be more than 200 feet via vehicular access from a public fire hydrant.

b. No portion of a building shall exceed 400 feet via vehicular access from a properly spaced public fire hydrant.

c. Additional hydrants will be required if hydrant spacing exceeds specified distances. 4. All required PUBLIC fire hydrants shall be installed, tested, and accepted prior to beginning

construction. 5. All private on-site fire hydrants shall be installed, tested, and approved prior to building

occupancy. a. Plans showing underground piping for private on-site fire hydrants shall be submitted to the

Sprinkler Plan Check Unit for review and approval prior to installation. 6. An approved automatic fire sprinkler system is required for the proposed buildings within this

development. Submit design plans to the Fire Department Sprinkler Plan Check Unit for review and approval prior to installation.

4.0 MITIGATION MONITORING PROGRAM

4.1 INTRODUCTION

To ensure that the mitigation measures contained in this EIR are properly implemented,

a monitoring plan has been developed pursuant to State law. This Mitigation

Monitoring Program (MMP) identifies measures incorporated in the Project which

reduce its potential environmental effects; the entities responsible for implementation

and monitoring of mitigation measures; and the appropriate timing for implementation

of mitigation measures. As described at CEQA Guidelines §15097, this MMP employs

both reporting on, and monitoring of, Project mitigation measures.

The objectives of the MMP are to:

• Assign responsibility for, and ensure proper implementation of mitigation

measures;

• Assign responsibility for, and provide for monitoring and reporting of

compliance with mitigation measures;

• Provide the mechanism to identify areas of noncompliance and need for

enforcement action before irreversible environmental damage occurs.

Mitigation monitoring and reporting procedures incorporated in the Project are

presented in the following Section 4.2. Specific mitigation measures incorporated in the

Project, mitigation timing, and implementation and reporting/monitoring

responsibilities are presented within this Section at Table 4.2-1.

4.2 MITIGATION MONITORING AND REPORTING

Mitigation Monitoring and Responsibilities

As the Lead Agency, the City of Pomona is responsible for ensuring full compliance

with the mitigation measures adopted for the proposed Project. The City will monitor

and report on all mitigation activities. Mitigation measures will be implemented at

different stages of development throughout the Project area. In this regard, the

responsibilities for implementation have been assigned to the Applicant, Contractor, or

a combination thereof.

If during the course of Project implementation, any of the mitigation measures

identified herein cannot be successfully implemented, the City shall be immediately

informed, and the City will then inform any affected responsible agencies. The City, in

conjunction with any affected responsible agencies, will then determine if modification

to the Project is required and/or whether alternative mitigation is appropriate.

4.2.1 Prior to issuance of the first certificate of occupancy, the Project Applicant shall extend the westbound left turn pocket at Rancho Camino Drive at Rio Rancho Road to accommodate a minimum 260 feet of vehicle stacking. Signal timing at Rancho Camino Drive at Rio Rancho Road shall be modified accordingly as required by the City of Pomona.

Watering, with complete coverage of disturbed areas, shall occur at least three times a day, preferably in the mid-morning, afternoon, and after work is done for the day; and • The contractor shall ensure that traffic speeds on unpaved roads and Project site areas are limited to 15 miles per hour or less.

4.5.5 In order to meet the City of Pomona 45 dBA CNEL interior noise standards, and 2014 California Green Building Standards Code requirements, the final Project architectural designs should incorporate the following (or equivalent) noise attenuation features.

• Windows: All windows and sliding glass doors shall be well fitted, well weather-stripped assemblies and shall have a minimum sound transmission class (STC) rating of 40. • Doors: All exterior hinged and sliding glass doors to habitable rooms that are directly exposed to transportation noise and are facing the source of the noise shall be a door and edge seal assembly with a minimum STC rating of 27.
