    a. Establish, implement, maintain and improve a port safety, health and environmental managementsystem;

    1.1. Objective

    7KH RYHUDOO REMHFWLYH RI WKH 36+(0 &RGH LV WR GHQH FOHDU DQG XQDPELJXRXand provisions in order to facilitate the development, implementation, monitoring, evaluation andUHQHPHQW RI D 36+(06 E\ D SRUW DXWKRULW\ RSHUDWRU WR HQVXUH VDIHW\ LQ Whuman injury or loss of life, and the avoidance of damage to the environment, to property, and to

    cargo.

    7HUPV DQG 'HQLWLRQV

    Continual Improvement

    A recurring process of enhancing the management system in order to achieve improvements inRYHUDOO VDIHW\ KHDOWK DQG HQYLURQPHQWDO SHUIRUPDQFH FRQVLVWHQW ZLWK

    health and environmental policy . Note that the process need not take place in all areas of the portsimultaneously.

    This Code is based on the methodology of Plan-Do-Check-Act (PDCA), which entails continuallyimproving the performance of the PSHEMS (see Figure 1 3'&$ FDQ EH EULH\ GHVFULfollows:

    Plan: Establish the objectives and processes necessary to deliver results in accordance withWKH RUJDQL]DWLRQV VDIHW\ KHDOWK DQG HQYLURQPHQWDO SROLF\

    Do: Implement the process;

    Check: Monitor and measure processes against safety, health and environmental policy,objectives, targets, legal and other requirements, and report the results;

    Act: Take actions to continually improve performance of the port safety, health andenvironmental management system.

    Documented system

    $ IRUPDO PDQDJHPHQW V\VWHP WKDW LV HVWDEOLVKHG DQG ZULWWHQ WR GHQH WKH RUJDobjectives, the processes and procedures; to ensure that processes are under control to achievethe desired result and meet agreed requirements. An undocumented system is a managementsystem that exists by word of mouth and depends largely on supervision to ensure that practices areperformed consistently.

    Environment

    6XUURXQGLQJV LQ ZKLFK DQ RUJDQL]DWLRQ RSHUDWHV LQFOXGLQJ DLU ZDWHU ODQG QDWfauna and humans, and their interrelations.

    Hazard

    A source or situation with a potential for harm in terms of human injury or ill health, damage toproperty, damage to the workplace, and/or damage to the environment.

    Health and safety

    Conditions and factors that affect the well-being of employees, temporary workers, contractorspersonnel, visitors and any other person in the workplace.

    Industrial hygiene

    Organization

    The port authority or any company operating in a port, whose operation may have an effect on the

    health and safety of people, the environment, port installations and cargoes, and which has agreedto implement the duties and responsibilities stipulated in the Code.

    Process Approach

    Port Area

    The port area established by national legislation under the responsibility of a Port Authority.

    3. Governance

    3.1 Port Authority Commitment

    The Port Authority shall establish, document, implement and maintain a PSHEMS and continuallyimprove its effectiveness in accordance with the requirements of the PSHEM Code.

    The Port Authority shall:

    g. Determine the criteria and methods to ensure that the implementation and control of the processesare effective;

    h. Ensure availability of resources and information necessary to support the implementation andmonitoring of the processes;

    processes.k. Communicate to the members of the PSHEMS, including government and nongovernment

    stakeholders, the importance of achieving the policy, legislation and regulations, strategies,objectives and action plans for the PSHEMS.

    3.1.1 SHE Governance Policy

    The Port Authority shall establish and adopt a governance policy that includes its overall intentionsand directions with regard to SHE management within the port area.

    The Port Authority shall ensure that the SHE governance policy:

    a. Includes a commitment to comply with applicable national statutory and regulatory requirements,as well as with other relevant policies of national and local governments, and applicableinternational conventions, codes, guidelines, recommendations and standards of internationalJRYHUQPHQWDO RUJDQL]DWLRQV DQG QRQJRYHUQPHQWDO SRUW LQGXVWU\ DVVRFLDWLRQV DDV VXEVFULEHG WR E\ WKH RUJDQL]DWLRQ DQG

    b. Serves as a framework to develop, implement and update the SHE management objectives of the port.

    3.1.2 Vision and Mission

    The Port Authority shall develop, adopt and promulgate strategic vision and missionstatements.

    The mission statement shall include commitments to protect the people working for, or onbehalf of the Port, the community and the environment.

    3.1.3 Objectives and Targets

    The Port Authority shall establish, implement and maintain documented SHE managementobjectives and targets that are consistent with the strategic vision and mission.

    7KH REMHFWLYHV VKDOO GHQH WKH GHVLUHG LPSURYHPHQWV RXWFRPHV DSHE management in the port.

    Targets which are time-bound and measurable as a consequence of the implementation of the PSHEMS shall be developed for each objective, where practicable.

    When establishing and reviewing the objectives and targets, the Port Authority shall consider the relevant legal and other requirements to which the port subscribes.

    3.2 Safety, Health and Environmental Management Regulations

    The Port Authority shall establish, implement and maintain a procedure(s) to identify andhave access to legal and other requirements that are applicable to the port activities andSURFHVVHV VDIHW\ KHDOWK DQG HQYLURQPHQWDO DVSHFWV DQG KD]DUperiodicallyevaluating compliance.

    The Port Authority shall ensure that applicable legal requirements and other requirements,LQFOXGLQJ UHTXLUHPHQWV VSHFLHG E\ VWDNHKROGHUV DUH FRQVLGHUHG

    Authoritys policy, vision, mission, objectives and targets.

    3.3 Management Arrangements

    3.3.1 PSHEMS Control

    3.3.3 Review and Improvement

    The Port Authority shall establish, implement and maintain a review process to determine theeffectiveness of the Safety, Health and Environmental Management governance of the ports under its control.

    The outputs of governance reviews shall include decisions and actions related to possible changesto governance policy, regulations, objectives, targets and other elements of the PSHEM, consistentwith the commitment to continual improvement.

    3.4 Awareness and Communication

    The Port Authority shall ensure the availability of resources essential to govern, establish, implement,maintain and improve the PSHEMS in the ports under its jurisdiction.     4. Port Operation, Safety, Health and EnvironmentalManagement System Requirements

    4.1 General Requirements

    The Port Operator shall establish, document, implement, maintain and continually improve a portsafety, health and environmental management system in accordance with the requirements of this&RGH DQG GHWHUPLQH KRZ LW ZLOO IXOO WKHVH UHTXLUHPHQWV

    In developing the PSHEMS, the Port Operator shall:

    D 'HQH WKH VFRSH RI LWV 36+(06E 'HQH WKH SURFHVVHV LQYROYHG LQ WKH RSHUDWLRQ V FRYHUHG E\ WKH VFRc. Determine the sequence of the processes, and their interactions;d. Determine criteria and methods needed to ensure that both the operation and control of these

    processes are effective; ande. Manage the processes in accordance with the requirements of this Code.

    4.2. Port Operation, Safety, Health and Environmental ManagementSystem Policy Statement

    The Port Operator shall establish and implement a port safety, health and environmental managementV\VWHP SROLF\ VWDWHPHQW ZLWKLQ WKH GHQHG VFRSH RI LWV 36+(06 ZKLFK LQFO

    pollution prevention, compliance with applicable legal requirements, prevention of accidents andcontinual improvement.

    The Port Operator shall ensure that its policy is documented, communicated and understood withinWKH RUJDQL]DWLRQ DQG LV LPSOHPHQWHG DQG PDLQWDLQHG DW DOO OHYHOV RI W

    Where an overall port policy is in place, the Port Operators port safety, health and environmentalpolicy shall be in line with the overall port SHE policy.

    The Port Operator shall review its port safety, health and environmental policy periodically to ensure

    that it remains relevant and appropriate.

    4.3. Planning

    The Port Operator shall ensure that the planning of the PSHEMS is carried out to meet theUHTXLUHPHQWV VSHFLHG LQ &ODXVH

    The Port Operator shall establish, implement and maintain a procedure for identifying and accessingthe legal and other requirements that are applicable to its PSHEMS.

    The Port Operator shall ensure that applicable legal requirements and other requirements to which

    4.3.3 PSHEMS Objectives and Targets

    The objectives and targets shall be measurable, where feasible, and consistent with the safety,health and environmental policy.

    When establishing and reviewing the objectives and targets, the Port Operator shall consider allVLJQLFDQW ULVNV DQG WKHLU LPSDFW WR SRUW VDIHW\ KHDOWK DQG WKH HQYLURQPHQWOHJDO DQG RWKHU UHTXLUHPHQWV WR ZKLFK WKH RUJDQL]DWLRQ VXEVFULEHV

    4.3.4 PSHEMS Programs

    The Port Operator shall establish, implement and maintain (a) program(s) for achieving its objectivesand targets. The program(s) shall include designation of responsibility for achieving objectives and

    a. Marine/Vessel Services;b. Terminal Operations;c. Storage, Handling and Transport of Cargoes/Dangerous Cargoes;d. Engineering and Maintenance of Infrastructure/Equipments; ande. Warehousing Services.

    4.3.4.2 Health Programs

    )RU SURWHFWLRQ RI HPSOR\HHV IURP KHDOWK KD]DUGV WKDW PD\ DULVH IURP WKH Gor the work environment, the Port Operator shall establish and implement a health program thatincludes:

    LGHQWLHG KHDOWK KD]DUGVc. Ensuring that adequate facilities are provided and available at all times to address risks associated

    with industrial hygiene.

    4.3.4.3 Environmental Programs

    )RU SURWHFWLRQ RI WKH HQYLURQPHQW DQG QDWXUDO UHVRXUFHV ZLWKLQ WKH ERXthe Port Operator shall establish and implement an environmental management program that coversKD]DUGV DVVRFLDWHG ZLWK DFWLYLWLHV DQG RSHUDWLRQV WKDW KDYH D SRWHQW

    a. Ambient air quality;b. Surface water and groundwater quality;c. Land use and soil quality;

    d. Health and functionality of natural resource systems; ande. Livelihood and food security of the surrounding community.

    4.4 Implementation and Operational Control

    4.4.1 Responsibility and Authority

    regularly to top management for review.

    4.4.3 Resource Management, Training and Awareness

    The Port Operator shall ensure the availability and adequacy of resources necessary to establish,implement, maintain and improve the PSHEMS. Resources include human resources, infrastructure,

    The Port Operator shall establish, implement and maintain procedures:

    a. To ensure that new personnel and personnel transferred to new assignments related to safety,KHDOWK DQG SURWHFWLRQ RI WKH HQYLURQPHQW DUH JLYHQ DV DSSURSULDWH SURSHUtraining related to their duties;

    b. To ascertain that all personnel involved in the PSHEMS are aware of the importance of conformitywith the environmental policy and procedures and with the requirements of the PSHEMS;

    c. To identify training that may be required in support of the PSHEMS and ensure that such trainingis provided for all concerned personnel, taking into account different levels of responsibility andability; and

    d. To communicate relevant information on the PSHEMS to personnel and stakeholders, and to

    receive feedback/participation of personnel and stakeholders in PSHEMS implementation andcontinual improvement.

    4.4.4 PSHEMS Documentation

    The PSHEMS documentation shall be referred to as the Port Safety, Health and EnvironmentalManagement System (PSHEMS) Manual.

    4.4.6 Operational Control

    The Port Operator shall identify, plan and implement its processes consistent with its port safety,health and environmental policy. The Port operator shall ensure that these processes are controlledand managed, by:

    a. Establishing, implementing and maintaining a documented procedure(s) to control situations

    where their absence could lead to deviation from the port safety, health and environmentalpolicy;

    b. Stipulating the operating criteria and procedure(s); andF (VWDEOLVKLQJ LPSOHPHQWLQJ DQG PDLQWDLQLQJ D SURFHGXUH V UHODWHG

    The PSHEMS shall provide for measures ensuring that the Port Operator can respond at any time toKD]DUGV DFFLGHQWV DQG HPHUJHQF\ VLWXDWLRQV ZLWKLQ WKH SRUW RU LQVWDOODWLRQ Wassociated safety, health and environmental impacts.

    The Port Operator shall establish and implement programs for drills and exercises to prepare for emergency response actions.

    The Port Operator shall periodically review and where necessary revise the emergency preparednessand response procedures, in particular after the occurrence of an accident or emergency situation.

    4.5 Measurement, Analysis and Inprovement

    4.5.1 Monitoring and Measurement

    The Port Operator shall establish, implement and maintain a procedure to monitor the keycharacteristics of the PSHEMS. The monitoring shall include PSHEMS performance, implementationof operational controls and conformity with objectives and targets.

    4.5.3 Control of Records

    The Port Operator shall establish and maintain records to demonstrate conformity to the requirementsof the PSHEMS and of this Code, and the results achieved.

    The Port Operator shall carry out internal safety, health and environment protection audits at plannedintervals to:

    a. Determine whether the implementation of the PSHEMS conforms to the planned procedures andthe requirements of this Code;

    b. Review the results of previous audits; andc. Provide information on the results of audits to top management.

    The audit programme(s) shall be planned, established, implemented and maintained by theRUJDQL]DWLRQ WDNLQJ LQWR FRQVLGHUDWLRQ WKH DVVHVVPHQW RI ULVN V DQG

    Audit procedure(s) shall be established, implemented and maintained, covering the scope, frequency

    and methodologies, as well as the responsibilities and requirements for conducting audits andreporting results.

    Process Approach in PSHEMS

    The Port Authority shall establish and adopt a governance policy that includes its overall intentionsand directions with regard to SHE management within the port area.

    The Port Authority shall ensure that the SHE governance policy:

Includes a commitment to comply with applicable national statutory and regulatoryrequirements, as well as with other relevant policies of national and local governments, andapplicable international conventions, codes, guidelines, recommendations and standards of LQWHUQDWLRQDO JRYHUQPHQWDO RUJDQL]DWLRQV DQG QRQJRYHUQPHQWDO SRUW LQGXDQG RUJDQL]DWLRQV DV VXEVFULEHG WR E\ WKH RUJDQL]DWLRQ DQG

    The SHE governance policy is the driver for implementing and improving a ports safety healthand environmental management system, so that it can implement and potentially improve itssustainable development performance.     The SHE governance policy is put into practice by the Port Authority through:

    a. Adoption by administrative and/or regulatory means;b. Implementation and regular review to ensure its continuing suitability; andc. Dissemination and communication to all stakeholders and interested parties.

    In establishing the SHE governance policy the Port Authority should consider that the policy:

    a. Adopts participatory and integrated approaches in the development and implementation of PSHEMS;

    b. Contains an assurance to comply with applicable statutory and regulatory requirements, aswell as with other relevant policies of local and national governments;

    c. Serves as a framework to develop, implement and update the objectives of the Port Authoritywith respect to managing the safety health and environmental management of the port;

    d. Provides a platform for coordination and cooperation among Port Authority, Operators andother stakeholders

    The vision should contain the long-term outcomes expected by the Port Authority and stakeholders,provides direction for setting up and implementing the PSHEMS, and serves as the basis for measuring progress toward desired changes.

    The mission statement contains the means by which the vision will be achieved, who will beinvolved, and their roles/responsibilities.

    3.1.3 Objectives and Targets

    The Port Authority shall establish, implement and maintain documented SHE managementobjectives and targets that are consistent with the strategic vision and mission.

    Objectives are goals for PSHEMS performance. An objective may be qualitative or quantitativein nature, and should be capable of being measured. Some examples of measureable objectivesinclude:

    a. To reduce lost time accidents (LTA);b. To improve compliance with legal requirements and discharge permit limits; andc. To improve the effectiveness of the inspection system.

    When establishing objectives, the Port Authority should consider:

    a. Current and future state of the port and its surrounding areas;b. Needs of employees and stakeholders;c. Statutory and regulatory requirements;d. Sustainable development aspects and risk assessment results;f. Resources needed to meet the objectives;g. Capacity to meet the objectives;h. Continual improvement of the performance of the PSHEMS; andi. Measurability and assessability.

    Targets are short-term and medium-term results, which are usually quantitative in nature, andcapable of being measured. Some examples of targets include:

    a. To achieve (LTA) of 2.5 within two years;b 100% compliance to discharge permit limit within one year; and

    c. 100% implementation of planned SHE inspection;

    3.2 Safety, Health and Environmental Management Regulations

    The Port Authority shall establish, implement and maintain a procedure(s) to identify andhave access to legal and other requirements that are applicable to the port activities andSURFHVVHV VDIHW\ KHDOWK DQG HQYLURQPHQWDO DVSHFWV DQG KD]DUGV DQG IRUcompliance.

    The Port Authority shall ensure that applicable legal requirements and other requirements,LQFOXGLQJ UHTXLUHPHQWV VSHFLHG E\ VWDNHKROGHUV DUH FRQVLGHUHG LQ

    Authoritys policy, vision, mission, objectives and targets.

    Guidance Notes

    Legal and/or regulatory arrangements are put in place to ensure that the Port Authority has thenecessary authority and responsibility to facilitate the implementation of the PSHEMS.

    The Port Authority and/or responsible agencies should establish regulations, ordinances and/or decisions to facilitate the implementation of the PSHEMS and related safety health andenvironmental programs.

    The Port Authority should also identify regulatory requirements applicable to the PSHEMS andensure compliance with such requirements. To keep track of legal requirements, the Port Authoritycan establish and maintain a list of laws and regulations pertaining to the implementation of activities, processes and programs of the PSHEMS (i.e., a legal register).

    To facilitate the preparation and maintenance of a legal register, the Port Authority should

    establish, implement and maintain a procedure(s) to identify and have access to legal and non-regulated requirements that are applicable to its activities, processes, environmental aspectsDQG KD]DUGV

    The Port Authority may also subscribe to voluntary requirements, other than legal requirements.These requirements may include: voluntary principles or codes of practice, internationalagreements, requirements of trade associations, agreements with community groups or QRQJRYHUQPHQWDO RUJDQL]DWLRQ DQG SXEOLF FRPPLWPHQWV 6RPH RI WKHVHagreements may apply to several issues of the PSHEMS, and the Port Authority should exertefforts to identify and address such requirements.

This can be accomplished by establishing relevant regulations inthe port and clear stipulations in the Port Operators operating contracts or operating permits,and by the provision of policy and technical guidance to the Port Operators.

    The Port Authority should also conduct regular inspection and compliance monitoring todetermine if the Port Operators have established and implemented the necessary controls within

    their processes.

    3.3.2 Monitoring and Measurement

    The Port Authority shall establish, implement and maintain monitoring, measurement, analysisand improvement processes needed to:

    a. Ensure the effectiveness of governance activities;b. Determine that objectives and targets are being achieved in line with the Port Authoritys

    Communication aids in the effective implementation of the PSHEMS and leads to improvedPSHEMS performance. Communication is a two-way mechanism for sharing information,experience, feedback and insights among the various stakeholders.

    The Port Authority should develop and implement a communication plan to raise awareness,motivate and help the Port Operators to maintain good safety, health and environmentalpractices.

    The Port Authority should encourage feedback and communication from stakeholders as a meansof involving them. The Port Authority should establish, implement and maintain procedures for

    receiving, documenting and responding to relevant communication from external parties.

    The participation of Port Operators and stakeholders is a key contribution to the successfulimplementation of the PSHEMS.

    The Port Authority should establish a process and mechanisms to improve:

    a. Port Operator and stakeholder commitments to safety, health and environment;b, Coordination and cooperation;c, Partnerships; and

    d. Port Operators and stakeholders ownership of established policies and programs.

    Advocacy and communication activities should also be implemented at various levels to gaincommitment, support and involvement of Port Operator and stakeholders.

    In order to determine the effectiveness of its Port Operator and stakeholder awareness andparticipation program, the Port Authority needs to identify the measurement requirements for assessing the perception and behavioral changes among stakeholders.

    The Port Authority shall ensure the availability of resources essential to govern, establish,implement, maintain and improve the PSHEMS in the ports under its jurisdiction. ResourcesLQFOXGH KXPDQ UHVRXUFHV ZLWK UHTXLUHG VNLOOV LQIUDVWUXFWXUH WHFKQROfor the achievement of the PSHEM policy, objectives and targets.

    4.0 Port Operation, Safety Health and EnvironmentalManagement System Requirements

    4.1 General Requirements

    The Port Operator shall establish, document, implement, maintain and continually improve a portsafety, health and environmental management system in accordance with the requirements of WKLV &RGH DQG GHWHUPLQH KRZ LW ZLOO IXOO WKHVH UHTXLUHPHQWV

    In developing the PSHEMS, the Port Operator shall:

    D 'HQH WKH VFRSH RI LWV 36+(06E 'HQH WKH SURFHVVHV LQYROYHG LQ WKH RSHUDWLRQ V FRYHUHG E\ WKH VFRc. Determine the sequence of the processes, and their interactions;d. Determine criteria and methods needed to ensure that both the operation and control of

    In developing the PHSEMS, the Port Operator should use the business process approach,meaning that the Port Operator should consider to integrate the PSHEMS within its existingmanagement system and not treat it as a separate system.

    4. 2 Port Operation, Safety, Health and Environmental Management SystemPolicy Statement

    The Port Operator shall establish and implement a port safety, health and environmentalPDQDJHPHQW V\VWHP SROLF\ VWDWHPHQW ZLWKLQ WKH GHQHG VFRSH RI LWV 36+(06 ZKLa commitment to pollution prevention, compliance with applicable legal requirements, preventionof accidents and continual improvement.

    The Port Operator shall ensure that its policy is documented, communicated and understoodZLWKLQ WKH RUJDQL]DWLRQ DQG LV LPSOHPHQWHG DQG PDLQWDLQHG DW DOO OHYHOV R

    Where an overall port policy is in place, the Port Operators port safety, health and environmentalpolicy shall be in line with the overall port SHE policy.

    The Port Operator shall review its port safety, health and environmental policy periodically toensure that it remains relevant and appropriate.

    be given to ensure awareness of all employees and interested parties.

    4.3.3 PSHEMS Objectives and Targets

    The objectives and targets shall be measurable, where feasible, and consistent with the safety,health and environmental policy.

    In setting objective and targets, the Port Operator can consider several inputs including:

    The Port Operator should also consider the implementation of health monitoring/surveillanceprograms that may include the following activities:

    a. Biological monitoring;b. Medical surveillance; andc. Symptoms injury, inspection and examination.

    The Port Operator should provide the necessary medical and dental services and facilities.The Port Operator should also maintain necessary additional emergency medical supplies andmedicines as recommended by its medical personnel. In the absence of a clinic or hospital

    near and/or in the proximity to the place of work, every employer should ensure that suitableWUDQVSRUW IDFLOLWLHV DUH UHDGLO\ DYDLODEOH DQG VXIFLHQW QXPEHU RI SHUVDQG UHDGLO\ DYDLODEOH WR UHQGHU UVW DLG 7KH HPSOR\HU VKRXOG DOVR SURYLand welfare facilities in the workplace.

    The Port Operator should establish programs for industrial hygiene. Industrial hygiene is theprocess devoted to the recognition, evaluation and control of environmental factors or stresses(i.e., chemical, physical, biological and ergonomic) that can cause sickness, impaired health or VLJQLFDQW GLVFRPIRUW WR HPSOR\HHV RU UHVLGHQWV RI WKH FRPPXQLW\

    Programs and facilities should be made available for jobs that require industrial hygiene

    control. The type extent of controls depends on the physical, chemical, and toxic properties of contaminants, evaluations made of the exposure, and the operation that disperses or removesthe contaminant. This may include good housekeeping measures, special monitoring devisesand safety/hygiene training and education to help ensure a safe, healthy workplace.

    4.3.4.3 Environmental Programs

    )RU SURWHFWLRQ RI WKH HQYLURQPHQW DQG QDWXUDO UHVRXUFHV ZLWKLvicinity of the port, the Port Operator shall establish and implement an environmental

    Environmental problems at the port can have a major impact not only on workers but also on thesurrounding areas and community. The port operator should take appropriate actions to protecttheir workers; and public health and welfare; and natural resources from a wide range of toxicmaterials and environmental threats.

    The Port operator should seek to prevent environmental pollution; address general andKD]DUGRXV ZDVWH SUREOHPV IDFLOLWDWH HIIHFWLYH XVH RI UHVRXUFHV DQG SUHYHQWdegradation.

    Examples of environmental programs are:

    a. Energy and resources conservation;E )DFLOLWLHV LPSURYHPHQW WR LPSURYH HIFLHQF\F :DVWH PLQLPL]DWLRQd. Recycling of materials;H 5HGXFLQJ WKH DPRXQW RI KD]DUGV ZDVWH SURGXFHGf. Eliminating the source of pollution and/or provision of additional controls;g. Natural resources habitat rehabilitation, protection and management;h. Establishing sound environmental strategies; andi. Active participation in an Integrated Coastal Management Program.

    4. 4 Implementation and Operational Control

    4.4.1 Responsibility and Authority

    7KH 3RUW 2SHUDWRU VKDOO GHQH GRFXPHQW DQG FRPPXQLFDWH ZLWKLQ WKH RUresponsibilities and authorities of personnel who manage, perform and verify activities within thePSHEMS.

    The functions, responsibilities and authorities of the personnel involved in the PSHEMS shouldbe clearly described.

    Documentation of roles and responsibilities can be done in several ways, including, for example:

    The responsibility and authority of the management representative, irrespective of other duties,VKDOO EH GHQHG WR HQVXUH WKDW

    a. The PSHEMS is established, implemented, maintained and monitored;b. Adequate resources are applied, as required; andc. The performance of the PSHEMS, including recommendations for improvement, is reported

    regularly to top management for review.

    TThe Port Operator should designate a Management Representative for the PSHEMSimplementation. This Management Representative should be a member of the Port OperatorsWRS PDQDJHPHQW ZKR KDV VXIFLHQW DXWKRULW\ DQG LQGHSHQGHQFH WR HQVXUHand objectives are achieved.

    4.4.3 Resource Management, Training and Awareness

    The Port Operator shall ensure the availability and adequacy of resources necessary toestablish, implement, maintain and improve the PSHEMS. Resources include human resources,LQIUDVWUXFWXUH WHFKQRORJ\ DQG QDQFLDO UHVRXUFHV

    The Port Operator shall establish, implement and maintain procedures:

    a. To ensure that new personnel and personnel transferred to new assignments related to safety,KHDOWK DQG SURWHFWLRQ RI WKH HQYLURQPHQW DUH JLYHQ DV DSSURSULDWH SUwith or training related to their duties;

    b. To ascertain that all personnel involved in the PSHEMS are aware of the importance of conformity with the environmental policy and procedures and with the requirements of thePSHEMS;

    c. To identify training that may be required in support of the PSHEMS and ensure that suchtraining is provided for all concerned personnel, taking into account different levels of responsibility and ability;

    d. To communicate relevant information on the PSHEMS to personnel and stakeholders, andto receive feedback/participation of personnel and stakeholders in PSHEMS implementationand continual improvement.

    The Port Operator should develop and implement a capacity-development program for maintainingand improving the capacity of personnel who are performing work for the implementation of thePSHEMS.

    Strengthening the skills and competence of personnel implementing the PSHEMS can befacilitated through Port Operators actions and programs to:

    a. Determine training or other needs by comparing the job requirement with the currentcompetence levels of the personnel;

    E ,PSOHPHQW DZDUHQHVV SURJUDPV WR IDPLOLDUL]H SHUVRQQHO ZLWK WKH 36+(06 Sand targets, and the action programs to achieve them;

    F 2UJDQL]H WUDLQLQJ SURJUDPV RU RWKHU DFWLYLWLHV QHHGHG WR HQVXUH WKHpersonnel, such as on-the-job training, appropriate supervision and coaching until personnelbecome fully competent, or hiring of new personnel with the necessary competence;

    e. Review the training needs and determine further actions as necessary.

    The Port Operator should evaluate the effectiveness of the capacity-development program andmaintain appropriate records of the education, training, skills and experience of people involvedin the implementation of the PSHEMS.

    Some of the basic training requirements associated with PSHEMS development include:

    a. PSHEMS development and implementation;b. Policy, Objective, targets and program development;c. PSHEMS Awareness;d. PSHEM Code requirements;

    e. Legal and Regulatory requirements;

    The Port Operator should also establish an information and knowledge sharing mechanism bydeveloping means to disseminate information such as newsletters, websites and other means.

    A record refers to data or information that provides evidence of activities performed or resultsachieved. A record is a historical document that does not change over time (e.g., minutes of ameeting with an attendance list).

    a. A formal methodology for ensuring ease of directing PSHEMS;b. Consistency and uniformity of practice;c. A means of measuring the performance of each process in the PSHEMS, thereby making it
