3 BACKGROUND

TheMAG,whichisAnnexIIoftheBilateralAgreement(BA)thatisestablishedbetweentheUnitedStatesandtheEuropeanCommunity,hadbeenrevisedfromchange5dated09/09/2015tochange6dated06/01/2016.Ithasbeennotedthat,someofsectionsfromSectionB,AppendixI,paragraph10,contradictswithrelevantexistingFAAorders,advisorycirculars(ACs)andregulations.ThiscontradictionbetweenFAAandMAGhasbeencreatingconfusionandambiguityamongEASA-approvedU.S.-based14CFRpart145repairstationsandFAAPMAPAHfacilities.TheserepairstationshavecontactedMr.DominickDaCosta(FAADER-T,DAR-F)PresidentofDERSGroupSvcLLC(hereinafter‘DERSGroup’)seekingexpertiseguidance.Mr.DominickDaCostahasover30yearsofaerospacemanufacturingand20yearsofEngine/APUmaintenanceandrepairexperience.Mr.DaCostaisaFAADER-TwithdelegationsinEngines,Powerplant,MechanicalSystems,StructureswithRS-DERauthorityandaDAR-FalsoforClassI,IIandIIIparts.AndDERSGroupisaconsortiumofconsultantFAAdesignees(DER,RS-DER,DAR)locatedat2901E.OhioBlvd,Suite140A,TerreHaute,IN47803.ThisPositionPaperdescribes,(1)MAGchange6revisionmainlypertainingtoSectionB,AppendixI,paragraph10,(2)it’scontradictionwithexistingFAAOrders,ACsandregulationsand,(3)ambiguity,problemsthathavearisesfortheRepairStationsorotherequivalentorganizationslocatedinUSA.Paperalso(4)proposesanalternatemeans/procedureofcompliancetocomplywiththeintentandspiritoftheMAGchange6,stilladheringtoexistingorders,AC’sandregulations.FAAandEASAwillberecipientofthepositionpaperfortheirreview,commentsandresponse.UponFAAandEASAacknowledgementand/oragreementoftheproposedprocedure,DERSGroupwillrecommendtheincorporationofitsproposedproceduretoformpartoftheFAA14CFRpart145RepairStationManual/QualityControlManual(s)(RSM/QCM).Thoughthispapermainlyaddressesrepairstation’s(consideringthegreatestpopulation)regulatoryconfusionisalsoimpactingFAAPAHfacilitiesandproposesaprocedure,ofsimilarresolutionthatcanbeapplicabletoothereligibleorganizationssuchasU.S.aircarriercertificateoperatingunderPart121orPart135andPAHfacilitiesunderpart21.

ii) For new components released by an EU-PAH, release must be documented on an EASA Form 1, as a new part. iii) For new components released by a Canadian-PAH, release must be on the Transport Canada Civil Aviation (TCCA) Canadian Form One as a new part.

iv) Fabricated parts, produced by an appropriately rated repair station with a quality system, for consumption into a repair or alteration of a product or article in accordance with 14 CFR part 21, section 21.9(a)(6), and part 43, are not subject to the foregoing provision. v) Standard parts are not subject to the forgoing provisions, provided such parts are traceable to the manufacturer, accompanied by a conformity statement, and are in a satisfactory condition for installation.

qualitysystemandareacquiredbyanotherPAHmusthavesubsequentworkperformedinaccordancewiththepart21qualitysystem.”Thethree(3)optionsfornewproductsorarticlesareasfollows:(1)TheproductorarticlemaybereturnedtooriginalPAHandre-inspectedandre-released.(2)TheworkmaybeperformedbytheoriginalPAHpersonnelatthelocationofthereceivingnewPAH.(3)TheworkmaybeperformedbythereceivingPAH[Iftheypossesstheapproveddesigndata]HencetheSection8-1helpstodefinethestatusoftheproductsorarticleswhenitremainswithinPAH(includingPAH,approvedsupplier,oranotherPAH)asnew.TheSection8-2,definesthestatusoftheProductsorArticlesthatarenolongerwithinPart21i.e.lefttheU.S.PAHortheirapprovedsupplier'squalitysystemandarereceivedbyRepairStation,Airline,andDistributoras,“(1)Completedaircraftwithairworthinesscertificateor(2)Spare,replacement,ormodificationarticlesorproductsintendedforinstallationonahigher-levelproductorarticlethathasalreadymettheapplicabilityrequirementsofpart43.Therefore,thereceivingairline,repairstation,ordistributorisresponsibleforensuringthatanymaintenance,preventivemaintenance,rebuilding,altering,etc.,onsuchproductsorarticleswillbeperformedbypersonsauthorizedunderpart43.”[AsdefinedinMAG6“approvedsubcontractors”.]TheSection8-2helpstodefinethestatusoftheproductsorarticlesasspare,replacementormodificationarticles,whenitleftthePAHqualitysystem.Itjustifiesthatassoonasthenewproductorarticleleave’sPAHqualitysystem,thestatusoftheproductorarticlesdoesnotremainnew.Itisaspare,replacementormodificationarticlethatisneverputintoservicesandwithin-servicehoursonit.TheregulatoryanalysisandreferencesprovidedinthissectionemphasisondefiningthestatusoftheproductsorarticleswhenitswithinPAHqualitysystemorwhenitleftPAHqualitysystem,subsequentlyreceivedbyorganizationssuchasrepairstations.ItisdefinedthatiftheproductorarticleremainswithinaPAHqualitysystemthenthestatusremainsnew.ButifproductorarticleleftPAHqualitysystemitisnolongerconsidered“newproductorarticle”.Thissectionisconsideredtobeoneoftheimportantsectionsofthispositionpaperwhichestablishesbasisfortheproposedprocedure/solutionsthatarepresentedinfollowingsections.5.2 Procedure#1ThissectionproposesapossiblesolutionfortheIssue#1identifiedinprevioussection4.5,whereanEASA-approvedU.S.-based14CFRpart145repairstationintendtouse/consumeapreviouslyPAHsuppliedpartthatdoesnothaveaForm8130-3withit.Asidentifiedinsection4.4,MAGallowsuseofnewpartsthathasU.S.PAHissuedForm8130-3.

Thesection4.2.1establishesthatPAH,PAHsuppliers/associatedfacilitiesidentifiedinPAH’sapprovedproceduresandPAH’ssupplierswithDirectShipmentAuthorization(DAS)onlycanissueForm8130-3fornewproductsorarticles.FAAOrder8130.21HChapter4,Paragraph4-1(j)statesthat,“AnFAAForm8130-3issuedsubsequenttotheoriginalfindingofairworthinessisconsideredarecurrentairworthinessapproval,forexample,aPMAorTSOauthorizationarticlethatleftthePAH’squality/inspectionsystemandisbeingpresentedforexport.”Soiftherecurrentairworthinessstatusofsuchcomponentneedstore-identifyasnewthencomponentmustbepresentedbacktoPAHfortheirevaluationtodetermineairworthinessstatusasnew.Thismeansthatinsuchcases,ifanycomponentthatdoesnothaveFAAForm8130-3asnew,thentherepairstationcansendthecomponentsbacktothePAHwiththecertification(affiliation)andsubstantiationthatcomponenthasbeenneverusedandwasproperlystoredperthePAHinstructionsensuringnochangeinanycharacteristicsofthecomponent.AndtheRepairStationcanrequestthePAHfortheissuanceoftheFAAForm8130-3asnew.Itisobliviousthat,oncethePAHreceivessuchcomponentwithsuchrequestfromrepairstation,PAHmusthavetovalidatethecomponentforanyuse,damageorchangeincharacteristicsduetostorageorpossiblein-servicehistory.Hence,PAHmayhavetodisassemble,inspect,testthecomponentanduponsatisfactoryresults,mayissueaForm8130-3asnewforsamecomponent.RepairStationmayalsocontractaFAADARforthispurpose,butFAADARmayalsohavetodoallofthenecessarystepsthatPAHwillperformrequiredforthoroughvalidationofairworthinessstatusofthecomponent.Feasibility:ConsideringwholeprocessofsendingbackthecomponentwithaffiliationandsubstantiatetothePAH,andPAHtakingallnecessarystepsrequiredthoroughvalidationofairworthinessstatusofthecomponent,needstremendouseffortsandinvestmentintermsoftimeandcostandadditionalresources.AssumingthatallofsuchcomponentsthatrepairstationhavetosendbacktoPAH,areneverusedandstillinasitisoriginalairworthinesscondition,theadditionaleffortsdonotcontributemateriallytothepreviouslyestablishedlevelofsafety.TheFAAAC21.101-1Adated09/03/2010outlinesvariousstepstodeterminetheimpracticabilityofapplyingarequirementataparticularamendmentlevel,inChapter3,Paragraph10andAppendixB.Samerationalcanbeappliedinthissituationthatknowingthefactthatrepairstationstockedcomponentsareneverusedandareinsameairworthinessstatus,sendingthembacktoPAHforvalidatingandissuanceofForm8130-3asnew,willnotbeeconomicallyviable.HencethisAMOCwillnotbeproposedfortheFAA,EASAacceptanceand/orapproval,butpresentedheretodemonstratethelatitudeofthethinkingandresearchthathasputtogether.

5.3 Procedure#2Thissectionproposesamorefeasiblesolutionbasedontherationalprovidedinsection5-1fordefiningthestatusofproductsorarticlesthathaveleftthePAHqualitysystem.Thissectiondefinessucharticlesasspare,replacement,ormodificationarticlesorproducts.Thesection5-1alsoclarifiesthatsuchproductsorarticlesalreadymetpart43requirementsandrepairstationisresponsibleisresponsibleforensuringthatanymaintenance,preventivemaintenance,rebuilding,altering,etc.,onsuchproductsorarticleswillbeperformedbypersonsauthorizedunderpart43.Hence,therepairstationcaninspectsuchpartsandcanissueadualreleaseFAAForm8130-3forthesecomponentsas‘Inspected’inBlock11oftheform.ThisformmayhavefollowingorsimilarnoteinBlock12that,“ThepartwaspurchasedfromtheFAA-approvedPAH/PAHsupplierwithDAS,againstPurchaseOrder(number&date).ThepartwasreceivedwithCertificateofConformancedated(number&date).”ThisprocedureisinlinewithFAArequirementsforrepairstationofperforminginspectiononreceiving(incoming)newarticles,toverifyforif,

- Componentreceivedisorderedon,hasanyshippingdamages,- Conformstothestandards,meetsintendeduse,properpaperworkinplace,general

conditionandworkmanship.Thiswillresolvetheissue#1identifiedinprevioussectionandwillensurethetraceabilityandairworthinessstatusofthepart.ThisprocedureensurescompliancewiththeParagraph10(k)(2)(i)(ii)ofMAGchange6,SectionB,Appendix1.ThecomponentsproducedbytherepairstationinaccordancewithFAAAC43-18underFQCS,arereplacementcomponentsthatarenotputintoservice.Hence,therepairstationinspectsuchfabricatedpartsandcanissueFAAForm8130-3forthesefabricatedcomponentsas‘Inspected’inBlock11oftheform.ThisformmayhavefollowingorsimilarnoteinBlock12that,“Locallyfabricatedpart,inaccordancewithFAAAC43-18Change2,underapprovedFabricationQualityControlSystem(FQCS).Thesepartscannotbesoldseparatelyandmustbeconsumedwithinrepairstationbyinstallingintothenexthigherassemblycomponentpart,orwithinaproduct,whileundergoingmaintenanceoranalteration”.Thiswillallowtheconsumptionofsuchfabricatedcomponentsbyinstallingintothenexthigherassemblycomponentpart,orwithinaproduct,whileundergoingmaintenanceoranalteration.BasedontheexhaustiveanalysisthatispresentedinthispaperalongwiththeabovefeasibleProcedure#2,abestlogicalpathispreparedandpresentedinAppendixA.Theproposedprocedure#2ensurescompliancewiththeintentandspiritoftheMAGchange5,stilladheringtoexistingOrders,ACsandregulations,withoutburdeningtherepairstations.TheAppendixAisbasedonProcedure#2andproposedtobeincorporatedintotherepairstationmanualsothatrepairstationcanfollowtheFAA/EASAaccepted/approvedguidancethatisprovidedinthispaper.TheAnnexalsocontainsexamplesofFAAForms8130-3whereverapplicable.Note:ThiswasincorporatedintoMAG6SectionB,andSectionCparagraphs[iv].

FAAhasdefinedin14CFR21.1(b)(3)and14CFR21.9(a)(4),introducescommercialpartsunderreplacementandmodificationarticles.AspartoftheTC,ATC,STC,ASTC,orPMAcertificationproject,theapplicantidentifieswhetherornottheyplantodevelopaCPLaspartoftheirICA.Section5(a)ofOrder8110.118states,“FAAdesignapprovalholders(DAH)havetheprivilegeofdesignatingqualifiedarticlesascommercialpartsbyincludingtheCPLaspartoftheirinstructionsforcontinuedairworthiness(ICA).ThemanufacturerofanarticleonaCPLisnotrequiredtogetanFAAproductionapprovalforthatarticle.”AC21-29CalsoreferstocommercialpartsasoneoftheapprovedpartunderFAAregulatory;referSection3(b)(12).ThispossibilityofmanufacturingarticleswithoutaproductionapprovalhasnotbeenconsideredintheMAGchange5.AndsincethemanufacturerofcommercialpartfromCPLisnotrequiredtohaveproductionapproval,theycannotissuea81130-3forsuchnewmanufacturedarticles,whichcontradictswithMAGChange6SectionB,Appendix1,Paragraph10(k)(1)(ii)requirement.[Note:ThesepartshavenowbeenaddressedinMAG6]
