3 BACKGROUND
TheMAG,whichisAnnexIIoftheBilateralAgreement(BA)thatisestablishedbetweentheUnitedStatesandtheEuropeanCommunity,hadbeenrevisedfromchange5dated09/09/2015tochange6dated06/01/2016.Ithasbeennotedthat,someofsectionsfromSectionB,AppendixI,paragraph10,contradictswithrelevantexistingFAAorders,advisorycirculars(ACs)andregulations.ThiscontradictionbetweenFAAandMAGhasbeencreatingconfusionandambiguityamongEASA-approvedU.S.-based14CFRpart145repairstationsandFAAPMAPAHfacilities.TheserepairstationshavecontactedMr.DominickDaCosta(FAADER-T,DAR-F)PresidentofDERSGroupSvcLLC(hereinafter‘DERSGroup’)seekingexpertiseguidance.Mr.DominickDaCostahasover30yearsofaerospacemanufacturingand20yearsofEngine/APUmaintenanceandrepairexperience.Mr.DaCostaisaFAADER-TwithdelegationsinEngines,Powerplant,MechanicalSystems,StructureswithRS-DERauthorityandaDAR-FalsoforClassI,IIandIIIparts.AndDERSGroupisaconsortiumofconsultantFAAdesignees(DER,RS-DER,DAR)locatedat2901E.OhioBlvd,Suite140A,TerreHaute,IN47803.ThisPositionPaperdescribes,(1)MAGchange6revisionmainlypertainingtoSectionB,AppendixI,paragraph10,(2)it’scontradictionwithexistingFAAOrders,ACsandregulationsand,(3)ambiguity,problemsthathavearisesfortheRepairStationsorotherequivalentorganizationslocatedinUSA.Paperalso(4)proposesanalternatemeans/procedureofcompliancetocomplywiththeintentandspiritoftheMAGchange6,stilladheringtoexistingorders,AC’sandregulations.FAAandEASAwillberecipientofthepositionpaperfortheirreview,commentsandresponse.UponFAAandEASAacknowledgementand/oragreementoftheproposedprocedure,DERSGroupwillrecommendtheincorporationofitsproposedproceduretoformpartoftheFAA14CFRpart145RepairStationManual/QualityControlManual(s)(RSM/QCM).Thoughthispapermainlyaddressesrepairstation’s(consideringthegreatestpopulation)regulatoryconfusionisalsoimpactingFAAPAHfacilitiesandproposesaprocedure,ofsimilarresolutionthatcanbeapplicabletoothereligibleorganizationssuchasU.S.aircarriercertificateoperatingunderPart121orPart135andPAHfacilitiesunderpart21.

Thesection4.2.1establishesthatPAH,PAHsuppliers/associatedfacilitiesidentifiedinPAH’sapprovedproceduresandPAH’ssupplierswithDirectShipmentAuthorization(DAS)onlycanissueForm8130-3fornewproductsorarticles.FAAOrder8130.21HChapter4,Paragraph4-1(j)statesthat,“AnFAAForm8130-3issuedsubsequenttotheoriginalfindingofairworthinessisconsideredarecurrentairworthinessapproval,forexample,aPMAorTSOauthorizationarticlethatleftthePAH’squality/inspectionsystemandisbeingpresentedforexport.”Soiftherecurrentairworthinessstatusofsuchcomponentneedstore-identifyasnewthencomponentmustbepresentedbacktoPAHfortheirevaluationtodetermineairworthinessstatusasnew.Thismeansthatinsuchcases,ifanycomponentthatdoesnothaveFAAForm8130-3asnew,thentherepairstationcansendthecomponentsbacktothePAHwiththecertification(affiliation)andsubstantiationthatcomponenthasbeenneverusedandwasproperlystoredperthePAHinstructionsensuringnochangeinanycharacteristicsofthecomponent.AndtheRepairStationcanrequestthePAHfortheissuanceoftheFAAForm8130-3asnew.Itisobliviousthat,oncethePAHreceivessuchcomponentwithsuchrequestfromrepairstation,PAHmusthavetovalidatethecomponentforanyuse,damageorchangeincharacteristicsduetostorageorpossiblein-servicehistory.Hence,PAHmayhavetodisassemble,inspect,testthecomponentanduponsatisfactoryresults,mayissueaForm8130-3asnewforsamecomponent.RepairStationmayalsocontractaFAADARforthispurpose,butFAADARmayalsohavetodoallofthenecessarystepsthatPAHwillperformrequiredforthoroughvalidationofairworthinessstatusofthecomponent.Feasibility:ConsideringwholeprocessofsendingbackthecomponentwithaffiliationandsubstantiatetothePAH,andPAHtakingallnecessarystepsrequiredthoroughvalidationofairworthinessstatusofthecomponent,needstremendouseffortsandinvestmentintermsoftimeandcostandadditionalresources.AssumingthatallofsuchcomponentsthatrepairstationhavetosendbacktoPAH,areneverusedandstillinasitisoriginalairworthinesscondition,theadditionaleffortsdonotcontributemateriallytothepreviouslyestablishedlevelofsafety.TheFAAAC21.101-1Adated09/03/2010outlinesvariousstepstodeterminetheimpracticabilityofapplyingarequirementataparticularamendmentlevel,inChapter3,Paragraph10andAppendixB.Samerationalcanbeappliedinthissituationthatknowingthefactthatrepairstationstockedcomponentsareneverusedandareinsameairworthinessstatus,sendingthembacktoPAHforvalidatingandissuanceofForm8130-3asnew,willnotbeeconomicallyviable.HencethisAMOCwillnotbeproposedfortheFAA,EASAacceptanceand/orapproval,butpresentedheretodemonstratethelatitudeofthethinkingandresearchthathasputtogether.
