1 POSITION PAPER OF THE GPH PEACE PANEL Submitted to the Senate Committee on Local Government 18 May 2015 Preliminary The Government Peace Negotiating Panel (GPH Peace Panel) for talks with the Moro Islamic Liberation Front (MILF) respectfully submits the following position paper to the Senate Committee on Local Government headed by the Honorable Senator Ferdinand R. Marcos, Jr. containing some clarifications on important issues that have been raised during the last two public hearings on Senate Bill no. 2408 or the draft Bangsamoro Basic Law (BBL), especially as they relate with the subject of today's hearing with the representatives and supporters of the Moro National Liberation Front (MNLF), as well as for the coming hearing with the Sultanates, the Indigenous Peoples (IPs), and the local government executives. At the outset, we wish to affirm and reiterate our unwavering commitment in supporting the legislative process for the enactment of the BBL. We are one with our honorable Senators in advocating for the passage of a Basic Law for the Bangsamoro that is just, comprehensive and truly responsive to the needs of the peace and development in Muslim Mindanao. Thus, we laud and sincerely appreciate the vigorous and dynamic efforts of the Senate in holding public hearings and consultations with the various stakeholders. On the Matter of Public Consultations Like the Senate, we in the GPH Panel also believe that wide-based and meaningful consultations with various stakeholders constitute a significant foundation to sound public policy. It is, as it has always been our practice, consistent with the memorandum of instructions to us of His Excellency President Benigno Simeon Aquino III, to listen to and take heed from the widest possible constituency of concerned groups and individuals when it comes to the Bangsamoro proposal, in particular, and the larger peace process, in general. As far back as the early stages of the peace negotiations with the MILF under the present administration up until the signing of the last document that culminated in the forging of the Comprehensive Agreement on the Bangsamoro (CAB), and later, during the drafting of the BBL, the GPH Panel has consistently conducted and/or participated in extensive consultation activities with various individuals and groups from both within and without the prospective Bangsamoro territory. The records, which we are providing the honorable Senate Committee thru this position paper, will bear this fact out. While it is truly unfortunate that some groups and individuals feel that they have not been consulted, we would like to submit to the Honorable Senate Committee the fact that, from 2010 until 17 May 2015, the GPH Peace Panel has conducted and participated in a total of five hundred fifty three (553) consultation activities (e.g. meetings, workshops, fora, and briefings) in order to shed light on the developments in the peace process with the MILF as well as to share and gather information, positions, and insights from the various stakeholders. Significantly, out of these 553 consultation activities, the GPH Panel has met ten (10) times on different occasions with representatives and supporters of the Moro National Liberation Front (MNLF) (see Table I), six (6) times with the Sultanates in Mindanao (see Table II), thirty two (32)

POSITION PAPER OF THE GPH PEACE PANEL Submitted to the Senate Committee on Local Government

Preliminary The Government Peace Negotiating Panel (GPH Peace Panel) for talks with the Moro Islamic Liberation Front (MILF) respectfully submits the following position paper to the Senate Committee on Local Government headed by the Honorable Senator Ferdinand R. times with the IPs (see Table III), and one hundred (100) times with leaders and officials of local government units (LGUs) (see Table IV). In all of these engagements and interactions with the different affected stakeholders, the GPH Peace Panel has taken into consideration their positions, insights and suggestions relative to our peace efforts with the MILF. Convergence of MNLF and MILF Peace Process With respect to the concerns of the MNLF, in particular, the above data on our consultation efforts with them also illustrates how, under the Aquino administration, it has been our policy to exert all possible efforts to ensure that the substance of the negotiations with the MILF is in harmony and convergence with the full implementation of the 1996 Final Peace Agreement with the MNLF. In view of this policy, several meetings and “convergence workshops” were held with MNLF cadres in 2011. These workshops aimed to inform representatives from the MNLF about substantial developments in the talks with the MILF and to solicit their inputs thereto as well. This convergence is also in line with the Organisation of Islamic Cooperation’s (OIC) efforts to unite the ranks of the MNLF and the MILF in their search for a political settlement with the Philippine Government. It will be recalled that during the 37th Session of the OIC Council of Foreign Ministers (CFM) in December 2010, the OIC adopted a resolution on Muslim Communities and Minorities in Non-OIC Member States urging the MNLF and MILF to unite their efforts for peace and development in the Bangsamoro. The Office of the Presidential Adviser on the Peace Process (OPAPP) is in full support of this call. Parenthetically, the inclusion of the OIC in the MILF peace process by way of being formally invited as observers in the GPH-MILF peace negotiations in March 2012 is in no small part due to their role in the MNLF peace process and in keeping with the desire for convergence between the two peace tracks. The OIC has since been consistently invited by the Malaysian Facilitator to attend the GPH-MILF talks in Kuala Lumpur. The OIC first attended the negotiations during the 28th GPH-MILF Formal Exploratory Talks in May 2012, where OIC–PSCP representative Ali Demirci, political officer of the office of OIC Sec. Gen. İhsanoğlu sat as observer. In the 39th and 40th Sessions of the OIC CFM, held in November 2012 and December 2013, respectively, the peace efforts between the GPH and the MILF were welcomed, expressing the hope that the Agreement between the two parties would be in line with the 1976 Tripoli Agreement. Unfortunately, the efforts towards convergence of the MNLF and MILF peace tracks has been admittedly strained by the Sabah standoff of February 2013 and the Zamboanga City crisis of September 2013. Be that as it may, the OPAPP has remained in close cooperation with the OIC, the MNLF and the MILF in furtherance of the desire for convergence. The same remains true up to the present. On 15 October 2014, the Bangsamoro Coordination Forum (BCF) was activated, as agreed upon during the meeting of the chairpersons of the MNLF and MILF and the OIC Secretary General. The BCF, as stated in its meeting report, shall serve as the mechanism for the MNLF and the MILF to “coordinate their movements toward achieving the aspiration of the Bangsamoro people towards just and lasting peace, and peaceful resolution of their problems.” In April 2015, OIC Secretary General Iyad Ameen Madani visited the Philippines and met leaders of the MNLF and the MILF to jointly discuss through the BCF on how to best move forward in harmonizing the Mindanao Peace Processes and the agreements they signed separately with the GPH.

Substantive Provisions of the BBL affecting the MNLF, the Sultanates and the IPs The desire to make the Bangsamoro proposal as inclusive as possible for the various affected

stakeholders extends beyond the process of consulting with them and soliciting their inputs.

The results of the many engagements and interactions with them have since found their way

into the substance of the proposed BBL.

Relative to the concern on the access to seats of political power in the prospective Bangsamoro

regional government, for instance, the proposal contained in the draft BBL in Article VII, Section

5 thereof on party seats in the Bangsamoro Parliament to be filled by proportional

representation as well as the system of reserved seats are deemed significant entry points for

the MNLF, the Sultanates and the IPs, among others, to directly participate in the governance

and administration of the autonomous region. These special stakeholder groups may organize

themselves into regional political parties and vie for seats as Members of Parliament in the

Bangsamoro. Parenthetically, the non-Moro IPs within the territory of the Bangsamoro can also

field candidates for the parliamentary seats reserved for them under the proposed law. All of

these special mechanisms for winning seats in the Bangsamoro Parliament shall be without

prejudice still to the special stakeholders participating in the district seats contest in the same

Bangsamoro Parliament. Clearly, the BBL offers a wide range of opportunities and openings for

the special stakeholder groups such as the MNLF, Sultanates and the IPs to have a real and

meaningful access to political power in the autonomous regional government.

Thru the Council of Leaders – a body that shall serve as the advisors of the Chief Minister on

matters of governance – there is yet another opening for these special stakeholder groups to be

involved in the governance of the autonomous region since the bill mandates, in Article VI,

Section 5 thereof, that representatives of “other sectors” must be included in its composition. To

be sure, the important sectors of the MNLF, the Sultanates and the IPs have to be considered in

the membership of the Council when the Bangsamoro Parliament enacts the relevant

implementing legislation for the operationalization of the Council of Leaders.

For the Sultanates, additionally, the draft BBL in Article IX, Section 19 provides for the

establishment of a Bangsamoro commission for the preservation of the history, culture, arts,

tradition and rich cultural heritage of the Sultanates. This is in full recognition of the vast role,

influence and contributions of the various Sultanates in the Bangsamoro. Significantly,

moreover, the BBL in Article X, Section 26 on the Bangsamoro Justice System also puts primacy

on the institutionalization of traditional systems of dispute resolution in connection with the

mandate therein for the Bangsamoro to evolve a system of Alternate Disposition Resolution

(ADR). The traditional roles of the Sultanates in dispute resolution by way of conciliation or

mediation would surely figure prominently in the ADR system that the Bangsamoro Parliament

shall enact.

Further to the policy of convergence with the MNLF, on the other hand, the provisions of the

draft BBL have also incorporated the so-called “42 Consensus Points” of the GPH-MNLF-OIC

Tripartite Implementation Review of the 1996 Final Peace Agreement. These consensus points

are spread along five (5) themes, namely: (1) on Shari'ah and Judiciary; (2) on Special Regional

Security Force and Unified Command in the Autonomous Region; (3) on Education; (4) on

Natural Resources and Economic Development; and (5) on Political System and Right of

Representation. All of these have been considered in the parallel subjects of the draft BBL,

particularly in Articles VI, VII, IX, X, XI, XII and XIII thereof. In this manner, it is hoped the

proposed BBL can become an effective vehicle for the convergence of the MNLF and MILF peace

tracks. We wish only to underscore that the impetus for the inclusion of the product of the GPH-

MNLF-OIC Tripartite Implementation Review in the draft BBL was a product of the

consultations with the MNLF representatives and members as well as of other stakeholders.

As for the IPs, finally, we find that the various sections of the draft BBL amply provides for

recognition, protection and promotion of IP rights and interests in the Bangsamoro. Drawing

from the existing corpus of IP rights that are articulated in domestic and international legal

sources such as Republic Act no. 8371 or the Indigenous Peoples Rights Act of 1997 (IPRA),

International Labor Organization (ILO) Convention 169, and the United Nations Declaration on

the Rights of Indigenous Peoples (UN-DRIP), the draft BBL provides for the base or minimum

substantive protections and guarantees of IP rights and interests from which the future

Bangsamoro Parliament, in crafting its own indigenous peoples rights law, cannot diminish or

subtract. Although the full application of the IPRA per se is not expressly provided in the draft

law, the “bundle of rights” that are set forth therein have since been disaggregated and

integrated into the proposed BBL as follows:

Right to Ancestral Domains and Ancestral Lands (e.g. Article V, Section 4 [d]; Article IX,

Section 5);

Right to Self-Governance and Empowerment (e.g. Article VII, Sections 5-6; Article IX,

Section 5; Article X, Sections 23-24; Article XII, Section 34; Article XIII, Section 12);

Right to Social Justice and Human Rights (e.g. Article IX, Sections 1, 2, 5, 6, & 8); and

Right to Cultural Integrity (e.g. Article IX, Sections 5 & 19-21), among others.

These provisions of the draft BBL illustrate the clear and manifest intent of the proposed law to

lean heavily in favor of recognizing, protecting and promoting the interests and rights of the IPs

in the prospective Bangsamoro territory. Importantly, there is nothing in the draft law that

professes to derogate from nor otherwise diminish the existing rights of the IPs. While a more

secure language in the text of the draft BBL could be introduced in order to carry this intent

through or to further enhance its import, it has never been the case that the proposed

Bangsamoro law endeavored to gloss over or weaken the existing rights of IPs, contrary to what

has been claimed by some during the public hearings.

Support to the BBL: SWS Survey Results Amidst claims that there is no support to the proposed Bangsamoro Basic Law (BBL) in the island provinces, the results of the Special Mindanao Survey conducted by the Social Weather

Stations (SWS) in February 20151 demonstrate that there is indeed significant support for the approval of the proposed bill. Based on the survey, more than half in Basilan (59%) and Tawi-Tawi (52%) are in favor of the passage of the BBL with only 12% in Basilan and 22% in Tawi-Tawi opposing it (see Figure I). In Sulu, 31% said that they approve the bill while only 14% claimed that they do not support it. In Isabela City, 38% said they support the bill versus 20% who said they oppose it.

FIGURE I. While there is a significant margin of undecided constituents, the results demonstrate that claims of widespread or homogenous disapproval of the BBL may have little empirical basis. What the survey results show is a significant number of Filipinos in the core areas both in mainland areas and the island provinces who consider the passage of the bill as a necessary measure to bring in peace and development to conflict-affected Muslim Mindanao. The results highlight that majority in Sulu (59%), Basilan (70%) and Tawi-Tawi (80%) agree with the proposed replacement of the ARMM with an expanded autonomous area called the Bangsamoro (see Figure II). In these areas, only 15% in Sulu, 10% in Basilan and 7% in Tawi-Tawi do not approve of the proposed dissolution of the ARMM. Meanwhile, mainland areas of the core territory consistently show high public support to the establishment of the Bangsamoro. Based in the survey results, 8 out of 10 in these areas in Central Mindanao agree with the replacement of the ARMM by the proposed Bangsamoro (see Figure III).

Although hope that the proposed Bangsamoro will bring peace and development ranges from slightly to extremely positive in the core territories – with areas in Central Mindanao as the most hopeful and Sulu fairly hopeful (see figure IV) – it can be noted that only a slim margin claim that they are not hopeful at all that the creation of the Bangsamoro will lead to peace and development in the area. It is significant to highlight that there is indeed no overwhelmingly negative perception towards the ability of the proposed Bangsamoro to be an avenue for lasting peace and development in Muslim Mindanao.

FIGURE IV. These figures further accentuate with how majority of the constituents in the core areas in Central Mindanao and BASULTA perceive that pursuing the peace talks between the Government and the MILF despite the Mamasapano incident is indeed beneficial. In Central Mindanao and BASULTA, generally 9 out 10 say that there is benefit from continuing the peace talks with the MILF (see Figure V). Among these areas, mainland areas are extremely positive that the peace talks with the MILF will benefit the Filipinos while BASULTA areas feel that it would only be moderately beneficial.

FIGURE V. Indeed, it cannot be denied that the Mamasapano incident has greatly affected the general perception on the peace process with the MILF, leaving only a fifth of Filipinos still supportive of the BBL as of February 2015. However, this sentiment as observed in the survey results is clearly not equally shared in core areas in Central Mindanao and BASULTA, where support to the BBL still remain net positive. Residents in the core territories also remain highly optimistic that Congress can pass the proposed bill despite the Mamasapano incident. The passage of the proposed BBL and the eventual establishment of the Bangsamoro should be subject to the consent of the governed. The BBL as a legislative measure is seen as part of the whole democratic process, the sentiments of the constituents in the core areas should be equally accorded attention as part and parcel of the democratically governed body politic. The BBL gives life to the spirit in which social justice and autonomy are provided for in the Constitution. Thus, we sincerely hope that a BBL that is just and truly responsive to the needs of the peace and development in Muslim Mindanao will be passed by the Senate.
