Bhe officers renderedinvalua le assistance in conducting the 5n uiry and ma!ing all the arrangements of our toursto the eight affected districts.

    Bhe Committee9 during its tours9 visited the scenes of ma-or incidents9 tal!ed to theaggrieved 0ersons9 gave 0atient hearing to all those )ho )anted to thro) light on theunfortunate incidents9 and also interacted )ith the officers. 5t turned out to e a 0ainsta!inge ercise in the course of )hich the Committee heard 2921 0ersons dra)n from different)al!s of life. " out 4++ of them gave )ritten statements also. Bhe Committee alsointeracted )ith a out 2++ officers of the affected districts. More than 1++ video films of shotsta!en during the agitation )ere received y the Committee. "ll this evidence )as carefullyevaluated.

    Bhe Committee )as given very limited time. 5t com0leted the e ercise in a out +days. " sincere effort )as made to identify officers )hose acts of omission and commissioncontri uted to the 0ro lem getting e acer ated. Bheir names have een mentioned in thedistrict')ise cha0ters. Bhe Committee has also made some recommendations to im0rove

    2.1 Bhe mem ers of the Committee9 after mutual consultations9 ado0ted a methodology)hich9 they felt9 )ould give them a clear understanding of the role of administrative and0olice officers during the agitation over reservations9 thro)ing light on their acts of omissionand commission A omission of acts and res0onsi ilities )hich they should have 0erformedand discharged9 and commission of acts )hich )ere not e 0ected of them as res0onsi leofficers.

    2.2 Bhe methodology involved visiting the districts affected9 )here the follo)ingse uence )as o served8

    i) &isit the scenes o' incidents A Bhe districts affected had different !inds of incidents. Bhere )ere incidents of looting and urning of sho0s andesta lishments9 houses and schools9 factories and malls9 etc. 5n fact9 any !indof unit elonging to a different grou0 considered inimical )as targeted. @herethe num er of incidents )as large9 the Committee visited the scenes of themore im0ortant incidents only. @hile visiting9 the Committee gave a 0atienthearing to the victims and s0ecially in uired a out the res0onse of the localadministration to their distress calls. "ll the scenes of incidents )erevideogra0hed.

    ii) $eeting cross(sections o' )eo)le ' Bhe visit )as follo)ed y meetingmem ers of the 0u lic. 5t is necessary clarify here that the 0rogramme of visitto a district )as al)ays 0u lished in the ne)s0a0ers9 oth 7nglish and Hindi.

    Care )as ta!en that it )as 0u lished in the local ne)s0a0ers also9 if any. "ssuch9 )herever the Committee )ent9 there )ere large num ers of 0eo0le)anting to have an audience )ith the Committee. Bhe total num er variedfrom district to district. 5t ranged from 2%+ to 4++. /eating arrangement )asmade for these mem ers and9 de0ending on their time of arrival9 everyindividual grou0 )as given a s0ecific serial num er and the individual grou0)as called in that order. Bhe Committee made it a 0oint to give a 0atienthearing to all those )ho had turned u0 even though it meant overshooting thetime schedule. esides9 the Committee also invitedres0onse information vie)s from mem ers of the 0u lic on any issues relevantto the conduct andr 0erformance of officers.

    iii) Recording statements A Bhe mem ers of the 0u lic )ere allo)ed a )iderange of discretion to convey their version. Bhey had the o0tion of orallys0ea!ing to the Committee. Bhey could also give )rittenre0resentation affidavit to the Committee. 5f they had not rought any )rittenstatement or affidavit9 they )ere given the facility of getting their statementsrecorded on the s0ot. $our ins0ectors )ere availa le at the venue to recordthe statements of )itnesses.

    iv) Interaction *ith O''icers in the istricts A Bhe Committee interacted )ithofficers in )hose -urisdiction incidents had ha00ened. Bhis interaction )as athree'tier e ercise. 5f there )ere s0ecific allegations against a 0articular officer9 he )as as!ed to give his version of the incident and thro) light on hisrole. Bhen9 there )as grou0 discussion )ith officers of the Magistracy and thePolice of the area )here unfortunate incidents sho)ing 0rima facie negligenceor cul0a ility of officers had ha00ened. Officers )ere as!ed to e 0lain their

"nd9 finally9 the Committee had an e clusive session )ith the *e0utyCommissioner and the /u0erintendent of Police. /e0arate sessions )ere alsoheld )ith senior officers of the ran! of *5G 5G )herever they )ere 0osted.Bhe Commissioners )ere coo0ted in these interactions )ith the senior officers.

    Bhe officers )ere also re uested to give their )ritten statements and sendthose to the Committee at its Chandigarh address. " 0roforma )as furnishedto the officers and they )ere told to ensure that all the 0oints mentioned in it)ere ade uately covered in their res0onse. Bhey could give their vie)s comments on any other 0oint also.

    v) $edia A Mem ers of the media )ere al)ays chasing the Committee. Bhey)ere clearly told that the Committee could not share even its tentative findings)ith them. Bhey )ere given only factual details a out our visits to the districts.5n fact9 they )ere as!ed to furnish any material thro)ing light on the conduct of officers. Bhe material could e in the form of re0orting or 0hotogra0hs or videocoverage. esides the Committee9 on its o)n9 scrutinised the media re0orts onagitation for )hatever they )ere )orth.

    vi) Interaction *ith Senior O''icers A Bhe Government had9 as the situation)orsened9 de0uted senior officers of the 5"/ and 5P/ to several districts toadvise and assist the local administration. Bhese officers )ere also called y

    vii) Intraction *ith Senior O''icers at +ead,uarters A Bhe Committee alsointeracted )ith senior officers at the head uarters. Bhese included Chief /ecretary9 "dditional Chief /ecretary >Home?9 *irector General of Police andthe "dditional *irector Genral of Police > a) and Order? to elicit information9thro)ing light on res0onse from the highest levels in the government and onthe role of administrative and 0olice officers in the field.

    2.3 Bhe mem ers of the Committee held intensive mutual consultations after visits to thevarious districts and interactions )ith different grou0s of 0eo0le and officers. Bhese )ererecorded and the o servations and findings )ere seen y all the mem ers. 5f there )as anysuggestion for amendment or modification9 the same )as acce0ted re-ected after detaileddiscussions.

    +istorical #ac-ground o' the Agitation

    3.1 Bhe land area of Haryana has een the cradle of 5ndian civili ation. 5t )as here that

    the (edic civili ation lossomed. "rchaeological findings of Guy 7. Pilgrim sho) that 1%million years ago9 the early man lived in the /hivali!s. 5t )as here that the e0ic attle of Maha harata )as fought9 in )hich 0rincess and their armies from 0ractically all over thecountry came to fight. 5t )as here in uru!shetra that ord rishna gave the teachingscontained in hag)ad Gita to "r-una9 the great Pandava )arrior. 5n later times9 decisiveattles )hich changed the course of history )ere fought in Pani0at. /uccessive )aves of invaders9 )ho coveted the )ealth of 5ndia or )anted to esta lish their rule over *elhi9 had to0ass through the area 0resently !no)n as Haryana. Bhey had to fight isolated attles )iththe martial races inha iting the region.

    3.2 5t )as here that the armies clashed. 5t )as here that the fate of 5ndia )as decided inhistoric attles. 5t )as here that the cavalries gallo0ed through. 5t )as here that the invadershad to face9 for the first time9 formations of ele0hants )hich uite often u0set their calculations.

    3.3 Bhe state of Haryana )as carved out on 1 ;ovem er9 1 %6. 5t has since made0henomenal 0rogress. Haryana has the second highest 0er ca0ita income in 5ndia >after Goa?.

    3.4 Bhe follo)ing descri0tion of the 0eo0le of Haryana9 ta!en from the &e0ort of ;ationalCommission for ac!)ard Classes9 is illuminating8

    As per the literature of “People of India”, the JATS have been playing a significant role in the cultural, political, economic and ethnic arenas and that they are most ancient people. Their titles are haudhary, Pradhan, Tha!ur, "ali!, #au$dar and Sardar %Si!h JATS&. There are many synonyms in their names. In 'aryana they are!no(n only as JAT or JATT, or J)TT. Their tradition connects then (ith Jata, (ho issaid to be one of the sons of *ord +rahma. It is also said that they are descendantsof mperor -ayathi. o( they have three ma$or sections vi/., 'indu, "uslim and Si!h comprising more than 0111 gotras. They are predominantly agriculturists par e2cellence. Since the time of A!bar they have been !no(n as 3amindars. JAT contributed for the surplus food grains. +esides entering into all !ind of services,they have also ta!en to trade and transport bric!4!iln laying and builders, industriesand coloni/ers in the country and abroad. They are not bonded labour among theJATS. The history of the JAT regiment is the history of the Indian Army and thehistory of the JATS is the history of India. 'aryana soldiers have been decorated (ith the highest gallantry a(ards posthumously as (ell as surviving in the recent (ars against Pa!istan in defence of their motherland. They sacrificed themselves todefend the country. They are brave people. They normally spea! and communicateamong themselves and (ith others in their local dialects, vi/, Jatu, +angru, +ri$ and +agri, Pun$abi in case of Si!h Jats5 'indi, )rdu, ”'industani” and even nglish incase of educated ones. The scripts used by them are 6evnagri, Arabic or Persian,7urmu!hi and nglish apart from their o(n language Jat!i .

    The normal dress of male consisted of turban, !urta or !ami$, dhoti and $uti or patan%of leather&. The 'indu Jats (ear their turban (ith a slant either on right side or onleft and the Si!h Jats do the Patiala style. The JATs children and (omen are (ell dressed. Previously men al(ays preferred (hite clothes and (omen colorful, but no( their children are (earing all types of fashionable clothes. Peacoc! is their totem and emblem represented in the form of a (eather coc! on top of their havelis. The JATSare normally vegetarian. They are fond of hu88a smo!ing. +idi and cigarettes alsofind a favour (ith them.

    3.% Bragically9 today )e are )itnessing clashes et)een different communities over reservations. Bhe state )ent through a horrific 0hase of violence during the month of $e ruary in 2+169 )hen sections of 0eo0le )ent on ram0age9 destroying 0u lic and 0rivate0ro0erty9 disru0ting the lines of communication9 attac!ing 0eo0le they had develo0edadversarial relations )ith9 resulting in loss of 0recious lives.

    3.6 Bhe events )hich convulsed the state )ere the culmination of a series of acts of omission and commission on the 0art of 0eo0le9 the 0oliticians and the successivegovernments. Community leaders inflamed 0assions. Politicians of different hues had their o)n a es to grind . "dministration9 oth civil and 0olice9 )as caught na00ing and9 faced )itha formida le challenge on the la) and order front9 cut a very sorry figure. efore going intothe details of the acts of omission and commission of the administrative and 0olice officers9)hich is the mandate of the Committee9 it is necessary to go into the ac!ground of theagitation over reservations.

    Constitutional Provisions

    3. "rticle 1% of the Constitution 0rohi its discrimination on grounds of religion9 race9caste9 se 9 0lace of irth or any of them. Clause >4? of the "rticle goes on to say that nothingin this "rticle9 Dshall 0revent the /tate from ma!ing any s0ecial 0rovision for the

    advancement of any socially and educationally ac!)ard classes of citi ens or for thescheduled caste and scheduled tri es.E

    3.# "rticle 16 of the Constitution guarantees e uality of o00ortunity in matters of 0u licem0loyment. Clause >4? of the "rticle states that9 Dnothing in this "rticle shall 0revent the/tate from ma!ing any 0rovision for the reservation of a00ointments or 0osts in favor of anyac!)ard class of citi ens )hich9 in the o0inion of the /tate is not ade uately re0resented inthe services under the /tate.E

    3. "rticle 3# and "rticle 46 under the *irective Princi0les of /tate Policy are alsorelevant. "rticle 3# says that9 Dthe /tate shall strive to 0romote the )elfare of the 0eo0le y

    securing and 0rotecting as effectively as it may a social order in )hich -ustice9 socialeconomic and 0olitical9 shall inform all the institutions of the national lifeE and that it9 Dshall9 in0articular strive to minimi e the ine ualities in income9 and endeavor to eliminateine ualities in status9 facilities and o00ortunities9 not only amongst individuals ut alsoamong grou0s of 0eo0le residing in different areas or engaged in different vocationsE.

    3.1+ "rticle 46 of the Constitution em0hasi es that9 Dthe /tate shall 0romote )ith s0ecialcare the educational and economic interests of the )ea!er sections of the 0eo0le9 and9 in0articular9 of the scheduled castes and the scheduled tri es9 and shall 0rotect them fromsocial in-ustice and all forms of e 0loitations.E

    3.11 "rticle 34+ of the Constitution states as follo)s9

    DBhe President may y order a00oint a Commission consisting of such0ersons as he thin!s fit to investigate the conditions of socially andeducationally ac!)ard classes )ithin the territory of 5ndia and the difficultiesunder )hich they la our and to ma!e recommendations as to the ste0s thatshould e ta!en y the :nion or any /tate to remove such difficulties and toim0rove their condition and as to the grants that should e made for the0ur0ose y the :nion or any /tate and the conditions su -ect to )hich suchgrants should e made9 and the order a00ointing such Commission shalldefine the 0rocedures to e follo)ed y the CommissionE.

    Central #ac-*ard Classes Commissions

    3.12 Bhe first ac!)ard Classes Commission )as constituted y the President on 2,anuary9 1 %3 under the Chairmanshi0 of a!a /ahi 9 alel!ar. 5t su mitted its re0ort on 3+March9 1 %%. Bhe Commission 0re0ared a list containing as many as 293 communities)hich )ere treated socially and educationally ac!)ard. Bhe re0ort disclosed aconsidera le divergence of o0inion among its mem ers and the Commission failed tos0ecify any easily discerna le o -ective tests to define I ac!)ardnessJ. 5t ultimately decidedto treat the status of Caste as an im0ortant factor. Bhe Central Government did not acce0tthe criteria. Bhe re0ort )as neither discussed in 0arliament nor acce0ted y the Governmentof 5ndia.

    Mandal Commission

    3.13 On 2+ *ecem er9 1 #9 the then Prime Minister9 Morar-i *esai announced theformation of a ne) Commission to 0ro e the condition of socially and educationallyac!)ard classes. 5t )as headed y .P.Mandal9 a Mem er of Parliament. Bhe Commission

    recommended reservation for scheduled castes and scheduled tri es in 0ro0ortion to their 0o0ulation9 i.e. 22.%K and reservation of 2 K for O Cs. Bhe reservation )as to a00ly to allgovernment services as )ell as technical and 0rofessional institutions9 oth in the Centreand the /tates. Bhe Mandal re0ort gathered dust for a out one decade.     It is in Indra Sawhney’s case that the terms “bac!(ard class” and “socially and educationally bac!(ard classes” are not e8uivalent and further that in Article =E%F&the bac!(ardness contemplated is mainly social. The above interpretation of bac!(ardness in Indra Sawhney (ould be binding on numerically smaller +enches.Ke may, therefore, understand a social class as an identifiable section of the society (hich may be internally homogeneous %based on caste or occupation& or heterogeneous %based on disability or gender e.g. transgender&. +ac!(ardness is amanifestation caused by the presence of several independent circumstances (hichmay be social, cultural, economic, educational or even political. :(ing to historical conditions, particularly in 'indu society, recognition of bac!(ardness has beenassociated (ith caste. Though caste may be a prominent and distinguishing factor for easy determination of bac!(ardness of a social group, this ourt has been routinely discouraging the identification of a group as bac!(ard solely on the basis of caste.

    Article =E%F& as also Article =B%F& lays the foundation for affirmative action by theState to reach out the most deserving. Social groups (ho (ould be most deserving must necessarily be a matter of continuous evolution. e( practices, methods and yardstic!s have to be continuously evolved moving a(ay from caste4centric definitionof bac!(ardness. This alone can enable recognition of ne(ly emerging groups in
